    The fiction of ministerial accountability in the Kingdom of Poland (1815-1830). Consideration of the inefficacy of extra- judicial bodies in the field of criminal responsibility

    Il saggio è il tentativo di affrontare la questione della responsabilità ministeriale nel Regno di Polonia dal 1815 al 1830. Questo tema complicato chiede, in primo luogo, che la terminologia chiave utilizzata nell’articolo sia spiegata, considerando i contributi di autori polacchi e stranieri (specialmente britannici). Le considerazioni seguenti sono state organizzate intorno a tre temi, che considero essere di importanza centrale per il saggio, precisamente: a) i fondamenti legali di vari tipi di responsabilità dei ministri, b) il dibattito pubblico sulla responsabilità ministeriale e c) i tentativi di rendere i ministri del Regno responsabili. Ciascuna di queste parti principali è stata concettualizzata seguendo un approccio e uno stile diversi. La prima parte può sembrare una presentazione piuttosto asciutta e formale delle norme giuridiche nei più importanti disegni di legge precedenti l’elaborazione della Costituzione del 1815, così come della Costituzione stessa. Comunque, avendo recuperato queste fonti dalla Biblioteca del Principe Czartoryskich, mi sono sentito obbligato ad abbozzare il loro quadro regolamentare per mostrare che essi compongono, come è già stato indicato da alcuni studiosi polacchi, un processo lineare che risale al 1812. L’analisi dei modelli di responsabilità nella norma su menzionata ha rivelato i suoi tre tipi principali: a) responsabilità costituzionale, b) responsabilità penale e c) responsabilità politica. Tuttavia, nei fatti, la distinzione tra le prime due categorie nella prassi costituzionale del Regno di Polonia era confusa, data la mancanza di legislazione che avrebbe dovuto eseguire le rispettive norme costituzionali. Non esisteva neanche responsabilità civile da parte di un ministro o un ministero per i loro reati. Il secondo segmento del saggio tenta non solo di citare passi rilevanti tratti dalla stampa, corrispondenza privata, memorie e documenti legali del tempo concernenti il tema della responsabilità ministeriale, ma presenta anche il panorama generale della stampa e dei media nel Regno di Polonia nel periodo 1815-1830. Ho ampiamente attinto al vasto corpo di letteratura polacca secondaria a questo riguardo, citando e seguendo i lavori preparato dagli storici per i media e per il grande pubblico, quali Zbigniew Anculewicz, Natalia Gąsiorowska, Jerzy Łojek o Tadeusz Mencel, per fare luce sulle limitazioni, molto estese, della libertà di stampa, comprendenti anche una censura spietata. Ciò ridusse enormemente il dibattito pubblico sulla responsabilità ministeriale. In aggiunta una parte importante delle fonti e dei documenti giuridici non pubblicati andò perduta durante la seconda guerra mondiale. Tutto sommato, ciò che sono stato in grado di presentare ai lettori sono citazioni di una manciata fi fonti primarie che si sono salvate. Tuttavia anche questo materiale li- mitato è sufficiente per sottolineare che la questione della responsabilità ministeriale non fu né ignorata, né trascurata nel discorso costituzionale del tempo. Infine, facendo affidamento su documenti ufficiali conservati, comprendenti i protocolli pro- venienti dalla Dieta Generale (Sejm), ho analizzato i tentativi di rendere i ministri responsabili. Si adottarono sia le forme di mozioni formali di accusa nei loro confronti davanti alla Corte Parlamentare (Sąd Sejmowy) che di commenti sul funzionamento di ciascun ministero in un tentativo di renderli politicamente responsabili per le attività dei loro rispettivi ministeri (cioè dipartimenti governativi). Tali tentativi, anche se infrazioni da parte dei ministri erano evidenti e talvolta costituivano atti criminali, non furono né efficaci, né coronati da successo. È conclusione finale di questo saggio che ciò ebbe due ragioni principali: in primo luogo l’atteggiamento strumentale delle autorità russe nei confronti del diritto, che di fatto era rispettato solo se conveniente per lo Zar e le autorità russe; in secondo luogo il concetto erroneo di responsabilità legale dei ministri in Polonia, che seguendo la tradizione risalente al XVIII secolo, come confermato nei disegni di legge precedenti la Costituzione del 1815, richiedeva una decisione a maggioranza dei deputati in Parlamento per muovere un’accusa contro un ministro. Questo modello, intrinsecamente immutato fino ad oggi, rappresenta una debolezza cruciale, che causa violazioni del diritto, incluso quello costituzionale da parte dell’esecutivo – come è stato il caso fin dal 2015 da parte di membri del governo Diritto e Giustizia in Polonia – che restano completamente impunite. Qualora lo stato democratico di diritto venga mantenuto in Polonia e in altri paesi, è urgente emendare questa procedura ed evitare la sua implementazione in una possibile futura Costituzione dell’Unione Europea.The paper is an attempt to address the question of ministerial responsibility in the Kingdom of Poland from 1815 to 1830. This complicated issue required, in the first place, the key terminology applied throughout the article to be explicated, considering the contributions of Polish and foreign (especially British) authors. The ensuing considerations have been organized around three topics, which I consider to be of central importance to the paper, namely: a) legal foundations of various types of responsibility of ministers, b) the public debate about ministerial responsibility and c) the attempts to make the ministers of the Kingdom responsible. Each of these main parts was conceptualized following a slightly different approach and style. The first part might appear as a rather dry and formalistic presentation of the legal regulations in the major drafts prior to the elaboration of the 1815 Constitution as well as of the Constitution itself. However, having retrieved those sources from the Princes Czartoryskich Library, I felt compelled to sketch out their regulatory framework in order to show that they combine, as already been pointed by some Polish authors, to form a linear process going back to 1812. The analysis of the modes of responsibility in the aforementioned legal act revealed its three major types: a) constitutional responsibility, b) criminal responsibility and c) political answerability. But, in fact, the distinction between those first two categories in the constitutional practice of the Kingdom of Poland was blurred, given the lack of legislation that would have executed the respective constitutional provisions. There also existed no civil responsibility on the part of a minister or a ministry for their wrongdoing. The second segment of the paper endeavours not only to quote relevant excerpts from the press, private correspondence, memoirs and legal documents of the time concerning the issue of the ministerial responsibility, but also presents the general landscape of the press and media in the Kingdom of Poland in the period 1815-1830. I relied heavily on the ample body of Polish secondary literature in this respect, quoting and following the works prepared by the historians in the media and wider society, such as Zbigniew Anculewicz, Natalia Gąsiorowska, Jerzy Łojek or Tadeusz Mencel, to highlight the far-reaching limitations of the freedom of the press, including ruthless censorship. This greatly restricted the public debate on ministerial responsibility. In addition, an important part of the unpublished sources and legal documents was lost during the Second World War. All in all, what I have been able to present to readers are quotations from a handful of preserved primary sources. Yet, even this limited material suffices to underline that the question of ministerial responsibility was neither ignored nor neglected in the constitutional discourse of the time. Finally, relying on preserved and edited official documents, including the protocols from the Sejm, I scrutinized the attempts to make ministers accountable. This adopted both the forms of formal motions to accuse them in front of the Parliamentary Court (Sąd Sejmowy) and comments about the functioning of each ministry in an attempt to make them politically answerable for the activities of their respective ministries (i.e. governmental departments). Such attempts, even though infringements by ministers were evident and sometimes amounted to criminal acts, were neither effective nor successful. It is the conclusion of this paper that it had two major reasons: firstly, the instrumental attitude of Russian authorities to the law, which in fact was respected only when convenient for the Tsar and the Russian authorities; and, secondly, the misconception of the legal responsibility of ministers in Poland, which, following the tradition going back to 18th century, as upheld in the drafts preceding the 1815 Constitution, required a majority decision of the deputies in the Parliament to file a charge against a minister. This model, intrinsically unchanged until now, is a crucial weakness, which causes breaches of the law, including that of the Constitution by the executive – as has been the case since 2015 by members of the Law and Justice government in Poland – to be totally unpunished. Should the democratic state of law be maintained in Poland and other countries, it is urgent to amend this procedure and avoid implementing it in a possible future Constitution of the European Union.

    Il noto decreto del 24 settembre 1810 dichiarava che le persone dei deputati erano inviolabili e che contro di loro nessuna azione poteva essere tentata da alcuna autorità o persona privata, salvo nei termini stabiliti nel regolamento delle Cortes. Nello sviluppo di questo postulato, e con l’obiettivo di salvaguardare l’indipendenza dei parlamentari, è stata stabilita una giurisdizione privilegiata nelle regole del regime interno incaricato di perseguire i crimini commessi dai procuratori. Questa Corte di Cortes è stata riconosciuta dalla Costituzione del 1812 e ha esercitato le sue funzioni durante la fase di Cadice e il periodo liberale del Triennio. Indubbiamente, era una misura eccezionale che supponeva una flagrante contraddizione con il principio della separazione dei poteri esaltato nel testo costituzionale stesso. Il nostro lavoro studia la composizione e il funzionamento della Corte di Cortes durante il Triennio liberale. Nello studio delle competenze, viene prestata particolare attenzione ai conflitti sorti durante il periodo tra la Corte suprema e la Corte di giustizia. Infine, scendiamo nel fascicolo particolare di Pablo Fernández de Castro, uno dei firmatari del noto manifesto dato a Fernando VII nel 1814. Con il ripristino dell’ordine costituzionale questo galiziano non accettò il perdono generale delle Cortes e fu giudicato dal Tribunale speciale.The well-known decree of 24th September 1810 stated that deputies were inviolable, and no attempt could be made to take action against them by any authority or private person except under the terms established in the regulations of the Cortes. On implementing this postulate and to safeguard the independence of the members of parliament, in the regulations governing the internal regime, a special jurisdiction was established which would be entrusted with prosecuting offences committed by procurators. This Tribunal de Cortes was recognised by the 1812 Constitution and exercised its judicial power during the Cadiz period and the Liberal Triennium. Undoubtedly, it was an exceptional measure, which implied a flagrant contradiction of the principle of separation of powers acclaimed in the constitutional text itself. Our article analyses the composition and functions of the Tribunal de Cortes during the Liberal Triennium. On studying its functions, special attention is given to the conflicts of competence that arose between the Supreme Court and the Tribunal de Cortes in this period. Finally, the particular case of Pablo Fernández de Castro is examined, one of the signatories of the famous manifesto handed to Fernando VII in 1814. With the reestablishment of constitutional rule, this Galician did not accept the general pardon of the Cortes and he was judged by the special Tribunal.

    Through a survey of the writings of Carl Schmitt between 1938 and the post-war period, the author identifies a line of self-interpretation of the complex intellectual and political biography of the jurist from Plettenberg, which feeds on traces, implicit quotations and allusions to the reader. The essay on Thomas Hobbes in 1938 thus becomes the sign of a turning point in the relationship between Schmitt and the Nazi regime, as evidenced by the diaries of the writer Ernst Jünger. In addition, it shows a peculiarity of Schmitt’s writings, a double reading level that can be found as well in the post- war years.Attraverso una ricognizione degli scritti di Carl Schmitt tra il 1938 e il dopoguerra, l’Autore individua una linea di auto-interpretazione della complessa biografia intellettuale e politica del giurista di Plettenberg, che si nutre di tracce, citazioni implicite e allusioni al lettore.     Making the constitution more Catholic? Catholic adaptation strategies to the Belgian constitutional liberties of 1831

    La Costituzione belga del 1831 è, a ragione, conosciuta come una costituzione liberale. Introdusse numerose libertà – di religione, istruzione e associazione, fra le altre – che sotto il re olandese Guglielmo I (1815-1830) erano state, più o meno, fortemente limitate. Come risultato, essa lasciò le forze sociali libere di auto-organizzarsi. Tuttavia, così facendo, la Costituzione del 1831, retrospettivamente, aprì anche la strada a frizioni tra visioni sociali contrastanti. Questo articolo ricostruisce il contesto culturale e le strategie organizzative della Chiesa cattolica, uno dei due maggiori poteri dietro l’indipendenza del Belgio, nella cornice dell’ampia libertà costituzionale che era stata concessa. Come si relazionarono i prelati belgi con le evoluzioni internazionali e teologiche contemporanee, come ad esempio la scomunica nel 1832 del Cattolicesimo liberale di Lamennais, una delle più eminenti fonti di ispirazione per i rivoluzionari cattolici nel 1830? Come riuscirono a proteggere la posizione dominante della Chiesa nel settore dell’istruzione rispetto alla crescente mobilizzazione delle forze liberali? E, ultimo ma non meno importante, in che modo strutturarono le loro attività pastorali all’interno di una popolazione linguisticamente plurale? Il compromesso del 1831 fu chiaramente reso possibile dalla convergenza principalmente terminologica sulla libertà fra Liberali e Cattolici. Ciò non significa, però, che il così chiamato consenso unionista degli anni 30 dell’Ottocento rimase libero da frizioni. Da una parte, la costituzione e i suoi effetti positivi per la Chiesa doveva essere sganciata dal Cattolicesimo liberale di Lamennais al fine di evitare uno scontro fra episcopato e Stato. Dall’altra, l’ambiguità di alcuni articoli costituzionali su questioni di comune interesse tra Chiesa e Stato, specialmente l’articolo 17 sull’istruzione, rivela che un certo livello di ambiguità sulla libertà era di per se stesso fonte di possibile conflitto qualora articoli di legge sensibili necessitassero di essere tradotti in norme costituzionali concrete. Il risultato delle negoziazioni variava sulla base delle relazioni di potere del momento. Non sorprende, pertanto, che la difesa degli interessi della Chiesa all’indomani dell’Unionismo ispirò il clero conservatore e reazionario nell’adozione di una strategia più assertiva, come anticipato già negli anni 40 dell’Ottocento nella lotta contro una nuova – più olandese – grafia della lingua fiamminga.The Belgian Constitution of 1831 is known as a liberal constitution, and with good reason. It introduced several freedoms – of religion, education and association, among others – that under the Dutch king William I (1815-1830) had been more or less strongly limited. As a result, it left social forces free to organise themselves. But by doing this, the Constitution of 1831 in retrospect also opened the way to frictions among contrasting social views. This article reconstructs the intellectual background and organisational strategies of the Catholic Church, one of the two major forces behind Belgium’s independence, within the frame of the large constitutional freedom it was granted. How did Belgian prelates relate to contemporary international and theological evolutions, like the excommunication in 1832 of Lamennais’s Liberal Catholicism, one of the most influential sources of inspiration for Catholic revolutionaries in 1830? How did they manage to preserve the dominant position of the Church in the educational sector against the growing mobilisation of Liberal forces? And, last but not least, how did they attempt to shape their pastoral activities among a linguistically plural population? The compromise of 1831 was clearly made possible by the mainly terminological convergence towards freedom amongst Liberals and Catholics. This does not mean, though, that the so-called Unionist consensus of the 1830s remained free from frictions. On one hand, the constitution and its positive effects for the Church had to be unlinked from Lamennais’s Liberal Catholicism in order to avoid a showdown between the episcopate and the state. On the other, the ambiguity of certain constitutional articles on matters of shared interests between Church and State, especially article 17 on education, reveals that a certain degree of ambiguity about liberty was in itself a source of possible conflict whenever sensitive legal articles needed to be translated into the real constitution. The out- come of negotiations varied according to the power relations of the moment. It is no surprise, there- fore, that the defence of the Church’s interests in the aftermath of Unionism inspired conservative and reactionary clergy to adopt a more assertive strategy, as anticipated already in the 1840s in the struggle against a new – more Dutch – spelling for the Flemish language.

    It was especially from the beginning of the second half of 20th century that the «Imperial Presidency», as denounced by Arthur M. Schlesinger in his acclaimed book (1973), began to raise its menacing head in more conspicuous a way: one of the foremost argument put forth by subsequent post-war administrations to foster that expansion of executive authority was the claim of powers vested in the office of the President by the Constitution without an express clause. Even after Youngstown (1952), the Presidents continued to assert this privilege: but the origin of such a pretension is indeed quite older. In a case about the nature of presidential powers, the Supreme Court split on the proper allocation of duties pertaining to the preservation of public order (if those duties pertain to the President or Congress) but all the justices agreed that there are powers not explicitly conferred by the Constitution to the great departments of the Union but implied in a reasonable construction of the constitutional text. Contrary to what is currently claimed, the doctrine of implied powers forged by the Court in this landmark case (In re Neagle, 1890) can provide valuable guidance for future disputes about the extent of presidential powers, help the fight against vague and general assertions of executive authority and firmly ground a vigorous presidency in the text of the Constitution.È specie a partire dalla seconda metà del ventesimo secolo che quella che Arthur Schlesinger chiamò «Presidenza Imperiale» in un fortunato studio degli anni ’70 cominciò a farsi percepire più minacciosa: uno dei principali argomenti proposti dalle varie amministrazioni succedutesi nel periodo postbellico a sostegno di tale espansione dell’autorità esecutiva è stata la pretesa che, alla presidenza, l’ordinamento avrebbe assegnato dei poteri non esplicitamente enumerati nella Carta costituzionale. Anche dopo Youngstown (1952), i Presidenti hanno seguitato a reclamare questo speciale privilegio ma le origini di tale presa di posizione sono ben più risalenti. In uno specifico caso giudiziario intorno alla natura dei poteri presidenziali, la Corte Suprema si divise circa l’assegnazione di doveri relativi al mantenimento dell’ordine pubblico (se essi appartenessero al Presidente o al Congresso) ma tutti i giudici riconobbero l’esistenza di poteri non esplicitamente conferiti dalla Costituzione ma impliciti alla luce di una ragionevole interpretazione del testo fondamentale. Contrariamente a quanto si ritiene correntemente, la dottrina dei poteri impliciti elaborata dalla corte in questo caso, che fa ancora oggi giurisprudenza (In re Neagle, 1890), può costituire un valido orientamento per la soluzione di future dispute sull’estensione dei poteri presidenziali, per contrastare vaghe e generiche rivendicazioni di autorità esecutiva e per fondare saldamente una presidenza energica ma rispettosa dell’architettura costituzionale voluta dai padri costituenti

    Rousseau e l’ideale della trasparenza. Nascita di un mito moderno

    Transparency is a key concept in understanding the shift from an ancient régime society to a bourgeois society. Although it refers to a subject which is unbound to traditional constraints, transparency is also a measure of assessing the pathological effects of civilisation. It is with Rousseau that this double meaning unfolds in the modern theatrum philosophicum. In Rousseau’s thought, transparency performs an argumentative function, unveiling the ideological link between Enlightenment and civilisation: where the Enlightenment’s self-perception praises its own act of enlightening, Rousseau sees the opacity of alienating relationships. Rousseau moves from this argumentative element to build a regulatory framework that refers to both the foundation of moral principles, as in the Discours sur l’inégalité, and the foundation of a democratic community, as in the Contrat social. Hence, this paper intends to investigate Rousseau’s argument in reference to the concept of transparency. The thesis underlying this work is that if it is true that the idea that Rousseau “discovers” is typically modern, however this idea is eminently critical of modernity. This means that it cannot be immediately related to the “transparent society” that, according to some contemporary thinkers, would characterise our society in a totalitarian way.Quella di trasparenza è una nozione chiave per comprendere il passaggio dalla società di ancien régime alla società borghese. Se, da una parte, essa si riferisce a un soggetto slegato da vincoli tradizionali, dall’altra, è già un criterio valutativo degli effetti patologici della civilisation. È in questo duplice senso che, con Rousseau, appare per la prima volta nel theatrum philosophicum moderno. Nel pensiero del Ginevrino questa nozione svolge dapprima una funzione polemica, smascherando il nesso ideologico fra illuminismo e civilisation: lì dove l’autopercezione dell’illuminismo glorifica la propria opera di rischiaramento, Rousseau vede l’opacità di rapporti alienanti. A partire da questo elemento critico, Rousseau costruisce tutto un sistema normativo che si rivolge sia alla fondazione dei princìpi morali, come nel Discours sur l’inégalité, sia alla fondazione di una comunità democratica, come nel Contrat social. Questo saggio intende, pertanto, ricostruire il modo in cui Rousseau articola le proprie ragioni intorno alla nozione di trasparenza. La tesi che vi si intende sostenere è che se è vero che l’idea “scoperta” da Rousseau è tipicamente moderna, essa svolge tuttavia una funzione eminentemente critica proprio nei confronti della modernità. Ciò significa che non può essere immediatamente assimilata alla “società trasparente” che secondo alcuni interpreti contemporanei caratterizzerebbe in modo totalitario la nostra società

    Tra obblighi di trasparenza e diritto alla riservatezza: verso una trasparenza di tipo “funzionale”

    Secondo alcune letture il sistema italiano, con l’entrata in vigore della legge del 2013, si sarebbe evoluto dal modello dell’accessibilità parziale con legittimazione soggettiva al modello dell’accessibilità parziale con legittimazione oggettiva. Obiettivo del contributo è confermare che tale conclusione ad oggi non può essere condivisa e che, se indubbiamente la trasparenza amministrativa si è ampliata con il decreto Lgs. n. 33/2013 e si amplierà ancora con l’attuazione della cd. legge Madia, non si può dire che si sia già operato il transito al modello di accessibilità alle informazioni di tipo oggettivo, che non prevede una legittimazione soggettiva per poter chiedere l’accesso ai documenti amministrativi. Al “contenimento” della trasparenza e al “salvataggio” dell’interesse soggettivo come presupposto per l’accesso ha contribuito l’art. 24 comma 2 lett. d) della legge n. 241/90 che fa salva l’esigenza di tutelare la “riservatezza di terzi, persone, gruppi e imprese” ma soprattutto la costante azione dal Garante della Privacy e in particolare le linee Guida da questo approvate nel maggio del 2014.According to some readings, the Italian system, with the entry into force of the Act of 2013, would have evolved from a partial accessibility model with a subjective legitimacy to a partial accessibility model with objective legitimacy. Aim of this contribution is to confirm that this conclusion today cannot be shared and that, though undoubtedly administrative transparency has expanded with the legislative decree no. 33/2013 and it will expand to include the implementation of the so called Madia law, one cannot say that the Italian system has already operated the transition to the accessibility model to information of an objective type, which does not provide for a subjective legitimacy to ask for access to administrative documents. The art. 24 paragraph 2 letter d) of Law No. 241/90, which is without prejudice to the need of protecting the “privacy of third parties, persons, groups and businesses”, together with the Guidelines approved by the Data Protection in May 2014 have helped the “containment” of transparency and the “rescue” of the subjective interest as a prerequisite for access.

    Objective of the essay is to analyse the theory of power drawn from A. Paternostro. In his writings on constitutional law, the jurist, animated by his ideas in politics, develops the theory of “social power”, affirming a democratic system guaranteed by clear rights and duties constitutionally enshrined. The constitution, rather than a written document, consists of a wealth of culturally relevant principles. Observing the US model, the jurist calls for a Supreme Court guarantor of those principles. The freedom of the citizens resides in the conscious exercise of their sovereignty; it should be sympathetic with public institutions and supported by a judiciary independent from any other power than that of popular legitimacy, set out in the constitutional Charter.Scopo del saggio è analizzare la teoria del potere elaborata da A. Paternostro. Nei suoi scritti di di- ritto costituzionale, il giurista, animato dalle sue idee politiche di una sinistra non estrema, formula la teoria del “potere sociale”, nell’affermazione di un sistema democratico garantito da precisi diritti e doveri costituzionalmente sanciti. La costituzione, prima che scritta, consiste in un bagaglio di principi culturalmente rilevanti. Nell’osservazione del modello statunitense, il giurista auspica una corte suprema garante dei suddetti principi.
