Pratiques inconstitutionnelles françaises à la lumière de l’histoire
The 1958 Constitution has regularly been the subject of a practice that goes beyond the text. So that the reflection on unconstitutional practices, although old, remains strong. Two visions are opposed in this case: a normativist vision, for which practice cannot replace the norm in the name of a presidentialist reading, and a political vision, for which texts cannot be the subject of a literal interpretation, their meaning depending less on the arrangement of constitutional provisions than on the practice made of them. Deciding on these different approaches requires leaving the perimeter of the Fifth Republic and taking a step back that only a historical approach allows, all the more opportune as the constitutional history of France offers an unusual richness. What method should be adopted to carry out an analysis of these unconstitutional practices? What can be observed from their observation over the long term? What means do we have to sanction them? These are the questions that this article undertakes to answer.La Constitution de 1958 a régulièrement été l’objet d’une pratique allant au-delà du texte. De sorte que la réflexion sur les pratiques inconstitutionnelles, quoiqu’ancienne, demeure forte. S’opposent en l’espèce deux visions : une vision normativiste, pour qui la pratique ne saurait se substituer à la norme au nom d’une lecture présidentialiste, et une vision politique, pour qui les textes ne peuvent faire l’objet d’une interprétation littérale, leur sens dépendant moins de l’agencement des dispositions constitutionnelles que de la pratique qui en est faite. Trancher sur ces différentes approches requiert de sortir du périmètre de la Ve République et de prendre le recul que seule permet une approche historique, d’autant plus opportune que l’histoire constitutionnelle de la France offre une richesse peu commune. Quelle méthode adopter pour mener à bien une analyse de ces pratiques inconstitutionnelles ? Quel constat dresser à partir de leur observation sur le temps long ? De quels moyens dispose-t-on pour les sanctionner? C’est à ces questions qu’entreprend de répondre cet article
La transparence administrative et le code des relations entre le public et l’administration
Désormais régie par le nouveau code des relations entre le public et l’administration, la transparence administrative n’a cessé, en France, de se renforcer. Elle s’est d’abord appliquée aux documents administratifs. Elle s’est ensuite imposée aux services de l’administration et aux décisions des autorités administratives. Ce renforcement de la transparence illustre le rééquilibrage d’un droit administratif qui se déplace progressivement de l’administration vers l’administré. Administrative transparency in France is now regulated by the new code on the relationships between the public and the administration and its field of application is steadying. In the past it was applicable to administrative documents. Then it has been imposed to all public services and to all decisions of administrative authorities. This shows the progressive rebalancing of administrative law which progressively goes from the administration to the administered people
I Catechismi costituzionali del 1820: strumenti di propaganda e di diffusione della Costituzione spagnola nel Regno delle Due Sicilie
The analysis of four surviving examples of Constitutional Catechisms of the Kingdom of the Two Sicilies printed in 1820 is an important moment of consideration matured in those years on issues related to the reformulation of the relationship between rulers and ruled and the establishment of consensus to the constitutional regime. In particular, it is possible, to recognize two distinct phases: one preceding the granting of the Constitution of Cadiz and the other, instead, immediately following it. We can see, in fact, how the first two catechisms, printed shortly before the publication of the Spanish Constitution, are distinguished for the attention paid to the figure of the sovereign, guarantor of religion. On the contrary, the other two catechisms, in a sharply polemical dialogue, were also the voice of reformist and enlightened tendencies. They represented a liberal society, which emphasized the importance of work and of property and where the references to religion disappeared to give way to issues such as freedom of worship and of the press. This seems appropriate in order to throw light on a historical subject of great value for the study of the attempts made by the intellectuals of the time, that, besides explaining and educating the population about the precepts of the Constitution of Cadiz, had in view the task of making changes to “adapt” it to the new demands of the Kingdom.L’analisi di quattro esemplari superstiti dei catechismi costituzionali del Regno delle Due Sicilie pubblicati nel 1820 rappresenta un momento importante della riflessione maturata in quegli anni sulle tematiche relative alla riformulazione dei rapporti fra governanti e governati e sulla creazione del consenso al regime costituzionale. In particolare, è possibile, ravvisare due momenti distinti: quello che ha preceduto la concessione della carta costituzionale gaditana e quello, invece, a questo immediatamente successivo. Vediamo, infatti, come i primi due Catechismi, editi poco prima della pubblicazione della costituzione spagnola, si contraddistinguessero proprio per l’attenzione particolare riposta nella figura del sovrano, garante della religione. Di contro, gli altri due Catechismi, in un dialogo aspramente polemico, si facevano portavoce d’istanze riformistiche ed illuminate. Rappresentavano una società liberale, in cui si ribadiva l’importanza del lavoro e della proprietà e in cui scomparivano i riferimenti alla religione per lasciare posto a temi quali la libertà di culto e di stampa. Ciò sembra utile allo scopo di far luce su uno spaccato storico d’indubbio valore per lo studio dei tentativi compiuti dagli intellettuali del tempo che, oltre che spiegare ed istruire la popolazione sui precetti della carta costituzionale gaditana, si proponevano il compito di avanzare delle modifiche per “adattarla” alle nuove esigenze del Regno
Traditions and Changes and the Role of Legal History
La storia del diritto è divenuta visibile fin dal XVI secolo con la storicizzazione dello “ius commune” ad opera degli umanisti. Durante l’epoca del nazionalismo nell’Europa del XIX secolo, la storia del diritto è spesso utilizzata come strumento per trovare una identità nazionale. Lo stesso uso della storia (del diritto) lo troviamo nelle nuove nazioni dopo il crollo dei grandi imperi coloniali e dopo il 1989 nell’ex-Unione Sovietica. Il processo di unificazione europea dopo il 1945 genera una rinascita dell’idea di “ius commune” e nuovi compiti per la storia europea del diritto. Oggi sono percepibili nuove tendenze di espansione verso una storia globale comparata del diritto, che scorre dentro una storia culturale generale comparata.Legal history has become evident since the 16th century with the historization of the “ius commune” through the humanists. During the epoch of nationalism in 19th century Europe, legal history serves often as an instrument to find a national identity. The same utilization of (legal) history we find in the new nations after the fall of the great colonial empires and after 1989 in the former Soviet-Union. The process of Europe unification after 1945 generates a revival of the idea of “ius commune” and new tasks for the European legal history. Today new tendencies of expanding to a global comparative legal history are visible, flowing into a general comparative cultural history.
Burke e la Rivoluzione in Francia, ovvero la sublimazione del panta rei
The basic commitment of this paper is to deliver an analysis of the cultural and political path that led Edmund Burke, also by some influential of parliamentary speeches, to stand proudly and publicly against the revolutionary event that, for better or worse, has occurred in France and influenced the evolution of constitutional experiences of continental Europe. Shines through all his thought the need to tie the balance of political institutions to the respect of legal tradition and to bind each other the genesis of ideas, historical values and ethical principles of society.In questo saggio si analizza il percorso culturale e politico che ha condotto Edmund Burke a schierarsi fieramente e pubblicamente, anche attraverso una serie di discorsi parlamentari, contro l’evento rivoluzionario che nel bene o nel male ha influenzato l’evoluzione delle esperienze costituzionali dell’Europa continentale. Traspare da tutto il suo pensiero l’esigenza di legare il bilanciamento delle istituzioni politiche all’equilibrio tra rispetto della tradizione e avvento dell’innovazione giuridica e di alimentare la genesi di idee ancorate al recupero dei valori storici e ai principi etici della società

At the beginning of the French Revolution, the executive function is defined not like a true pow- er but like a subordinate function, and it could not be exercised in a democratic way, both because Democracy is not aimed at, like in 1791, and because the regime, that is, according to conceptions of the time, the Legislative Power, is democratic and it is important to preserve the separation of powers. However, the dualist structure of the executive power brings us to distinguish, within this function, an executive function stricto sensu, consisting in the strict execution of the Laws, trusted into the hands of the ministers, and an executive function lato sensu, or government function, trusted into the hands of a higher authority, that is the Executive Council or Directory, consisting in directing ministers’ action and in managing international relations.Au début de la Révolution, la fonction exécutive est conçue non comme un véritable pouvoir mais comme une fonction subordonnée et elle ne saurait être exercée de façon démocratique, soit parce que, comme en 1791, on n’a pas voulu de la démocratie, soit parce que le régime, c’est-à-dire, selon les idées de l’époque, le pouvoir législatif, est démocratique et qu’il importe de préserver la séparation des pouvoirs. Cependant, la structure dualiste du pouvoir exécutif conduit à distinguer au sein de la fonction une fonction exécutive stricto sensu, consistant dans la stricte exécution des lois et confiée aux ministres et une fonction exécutive lato sensu, ou fonction gouvernementale, confiée à une autorité supérieure, conseil exécutif ou directoire, et consistant dans la direction de l’action des ministres et la conduite des relations internationales
Georges Sorel e la psicologia del giudice
In the biennium 1894/1895, Georges Sorel wrote two articles for the Italian periodical «Archivio di psichiatria», edited by the famous psychiatrist Cesare Lombroso. One of them was given over to the judge’s psychology. The subject was decidedly original. Georges Sorel was interested not only in politics and philosophy in his life, but also in law and psychology. In this article he put both these two branches of knowledge to good use for outlining a profile of the psychology of this professional category. Despite always being a fervent advocate of the centrality of the intervention of the courts in the construction of law, the portrait painted by Sorel of the psychology of the judge is not so edifying. The judge, according to the French philosopher, is often suffering from a superiority complex that brings him to abuse his authority. This complex, in general, is able to pervert those who wield great power toward other subjects, and judges, from this point of view, are no an exception.Nel biennio 1894/1895, Georges Sorel scrisse due articoli per la rivista italiana «Archivio di psichiatria», diretta dal famoso psichiatra Cesare Lombroso. Uno di essi era dedicato alla psicologia del giudice. L’argomento era decisamente originale. Georges Sorel nella sua vita non si interessò solo di politica e filosofia, ma anche di diritto e psicologia. In questo articolo egli mette a frutto entrambe queste due conoscenze per tracciare un profilo di questa categoria professionale. Nonostante fu sempre un deciso sostenitore della centralità dell’intervento della magistratura nell’ambito della formazione del diritto, il quadro tracciato da Sorel della psicologia del giudice non è poi così edificante. Il giudice, per il filosofo francese, soffre spesso di un complesso di superiorità che lo porta ad abusare della sua autorità. Questo complesso, in generale, è capace di pervertire le persone che esercitano un grande potere nei confronti di altri soggetti, e i giudici da questo punto di vista non fanno eccezione
La “non-intervention” comme alternative à la “guerre civile européenne”: une lecture croisée de John Stuart Mill, Benjamin Constant et Alphonse de Lamartine
The article aims at examining the genesis of the “principle of non-intervention”, with particular reference to that formulated by John Stuart Mill in “A Few Words on Non-intervention” in 1859. It examines how the English philosopher forged his arguments through a fruitful dialogue with some “liberal” thinkers of his time, such as Alphonse de Lamartine and Benjamin Constant, and it shows how their interpretation of some conflicts could have been a real issue for posing the question of military intervention. In addition, this work highlights how the principle of “non-intervention” could paradoxically be an instrument of liberation of oppressed peoples, as well as an alternative to a “European civil war”, for John Stuart Mill.L’articolo vuole prendere in esame la genesi del “principio di non intervento”, con particolare riguardo alla versione formulata nel 1859 da John Stuart Mill in “A Few Words on Non-intervention”. Esso esamina come il filosofo inglese abbia forgiato le sue argomentazioni grazie ad un dialogo fecondo con alcuni pensatori “liberali” del suo tempo, come Alphonse de Lamartine e Benjamin Constant, e mostra come la loro interpretazione di alcuni conflitti avrebbe potuto rappresentare un importante contributo per la discussione dell’intervento militare. Inoltre, il lavoro evidenzia come il principio di “nonintervento” potrebbe paradossalmente essere per John Stuart Mill uno strumento di liberazione di popoli oppressi oltreché una alternativa alla “guerra civile europea”
