    At the end of the Nineteenth century, the scandal of the Banca Romana and several corruption events reported by the press severely jeopardises the reputation of the politicians. In Italy, as well as in other countries, the question on the opportunity to frame a specific provision aimed at protecting the continuity of government raised. The judge, Luigi Ferraioli, proposes to create the crime of political defamation (diffamazione politica), which somehow echoes the British tradition of political libel. As a consequence, the contemporary jurist mindset takes into consideration issues such as popular consensus, government stability, freedom to report and censorship, private life of public men, press freedom, rules of common law on right to smear. All these matters being strictly relevant to the use of justice for political purposes, to the exercise of the right of censorship and, ultimately, to the endurance of the democratic system itself.Alla fine dell’Ottocento, lo scandalo della Banca romana e i molti episodi di corruzione denunciati dagli organi di informazione delegittimano fortemente la classe politica. Anche in Italia si pone il delicato problema se sia opportuno prevedere, come in altri paesi, una specifica figura di reato, volta a tutelare la continuità dell’azione di governo. Il giudice Luigi Ferraioli propone l’istituzione del reato di diffamazione politica, che riecheggia in alcuni punti il political libel della tradizione anglosassone. Al consenso popolare, alla tenuta del sistema di governo, al diritto di cronaca e di censura, alla dimensione privata della vita degli uomini pubblici, alla libertà d’informazione, alle regole di diritto comune sulla diffamazione si collegano le riflessioni dei giuristi sull’argomento, rilevante per le inevitabili connessioni con l’uso della giustizia a fini politici, l’esercizio del diritto di censura, la tenuta stessa del sistema democratico

    The present contribution represents the attempt to give organic and synthetic voice to the fertile and composite debate which flowered during the two days which saw the unwinding of the international Conference “L’Unità d’Italia nel mondo”, organised by the Roberto Ruffilli Foundation and supported in a factive way by the Forlì Cassa dei Risparmi Foundation on the 13th and 14th May 2011. The discussion started from the stimuli offered by the papers delivered by G. Heydemann, M. Isabella, B. Mazohl, C. Lucrezio Monticelli, M. Martinez, M. Filippini and T. Bonazzi, finding then active interlocutors among the academic audience present in the lecture hall, and precisely G. Manca, F. Cammarano, R. Gherardi, L. Blanco, A. Lopez, P. Schiera, M. Moretti, R. Baritono. The method, to which we adhere here in order to realise such an intention of structured collecting work, required the recording and then the integral writing down of the Conference sessions, as well as an effort of selection and elaboration aimed at integrating the multifaceted interventions, which followed one another along with the progression of the dialectical confrontation regarding the international dimension of the Italian process of unification, into the different thematic sections (we have chosen, in such a way, an organisational matrix with a geo-political character). Therefore using the prism of the single State situations referred to the whole Risorgimento event, we intended to gather the whole data and considerations come to surface during the debate in well-defined sections, trying to better highlight the logical-cognitive coherence which could be seen in the background of the same debate. All that without neglecting a modest but profitable work of archival research, which allowed giving documentary value to certain indications concerning more-properly diplomatic aspects of our Risorgimento, as well as its singular and fascinating fortune in India.Il presente contributo rappresenta il tentativo di dare corpo organico e sintetico al fertile e composito dibattito innescatosi a margine delle due giornate in cui si è strutturato il Convegno internazionale “L’Unità d’Italia nel mondo”, organizzato dalla Fondazione Roberto Ruffilli, con il fattivo sostegno della Fondazione Cassa dei Risparmi di Forlì, nelle date del 13 e 14 maggio 2011. La discussione ha preso avvio a partire dagli stimoli offerti dalle relazioni di G. Heydemann, M. Isabella, B. Mazohl, C. Lucrezio Monticelli, M. Martinez, M. Filippini e T. Bonazzi, trovando poi attivi interlocutori fra le fila degli auditori accademici presenti in sala, e per la precisione nelle persone di G. Manca, F. Cammarano, R. Gherardi, L. Blanco, A. Lopez, P. Schiera, M. Moretti, R. Baritono. La metodologia cui si è aderito per far fronte a tale intento di raccolta strutturata, ha richiesto la registrazione e lo sbobinamento integrale delle assise del Convegno, nonché uno sforzo di selezione e di elaborazione volto ad integrare nelle diverse sezioni tematiche (si è scelta in tal senso una matrice organizzativa a carattere geo-politico) gli sfaccettati interventi che si susseguivano al progredire del confronto dialettico relativo alla dimensione internazionale del processo di unificazione italiano. Utilizzando quindi il prisma delle singole realtà statuali rapportate alla vicenda risorgimentale nel suo complesso, si è inteso riunire in paragrafi ben definiti l’interezza dei dati e delle considerazioni emerse in sede di dibattito, cercando di porre al meglio in evidenza la coerenza logico-cognitiva che si lasciava intravedere al fondo dello stesso. Il tutto senza tralasciare un modesto ma proficuo lavoro di ricerca archivistica, che ha permesso di testimoniare con valore documentario alcune indicazioni riguardanti gli aspetti più propriamente diplomatici, oltreché la singolare ed affascinante fortuna in India, del nostro Risorgimento

    La Guerra Civile americana, il Risorgimento italiano e i nazionalismi europei dell’Ottocento: histoire croisée e histoire comparée

    Recently, there has been a growing interest by American historians toward the historiography of European nationalisms, with a view to relating the American Civil War (1861-1865) to the wider context of nineteenth-century nation-building. In exploring the possibilities of such a connection, it is useful to refer to two particular research methods in the “transnational” analysis of historical phenomena in Europe and America: histoire croisée – or “entangled history”, centred upon the investigation of links and contacts – and histoire comparée – or “comparative history”, focused on the study of similarities and differences. In relating both the causes of the American Civil War and the war to nineteenth-century nationalisms, we can start from the acknowledgement that the North-American restructuring following a warfare of continental scale led to the new foundation of a national American state based upon principles and ideals analogous – and therefore suitable to an investigation through the histoire croisée method – to those of contemporary European nations, and thus comparable to them through the use of the histoire comparée. With particular reference to Italy in the age of Risorgimento, we can see, for example, how, among American Abolitionists and Italian Democrats, William Lloyd Garrison and Giuseppe Mazzini had a lot in common in terms of ideals; also in the past, historians had already noted a certain ideological affinity between Abraham Lincoln’s Republican Party and Camillo Cavour’s Moderate Liberals. All in all, the American Civil War represented a crucial episode in the phenomenon concerning the advancing of liberal and democratic nationalisms, which shook the western world, Europe and Italy, between 1848 and 1870; thus, the Civil War was an event whose significance in political terms can only be defined by using the adjective “global”.Di recente, si è assistito ad un fiorire di interessi da parte degli storici degli Stati Uniti nei confronti della storiografia relativa ai nazionalismi europei, con l’intento di ricondurre la Guerra Civile americana (1861-1865) al più vasto contesto della formazione di nazioni caratteristica dell’Ottocento. Nell’esplorare le possibilità di attuare tale collegamento, è utile fare riferimento a due particolari metodi di ricerca nell’analisi di fenomeni storici in Europa e America in prospettiva “transnazionale”: histoire croisée – o “storia incrociata”, incentrato sullo studio di legami e connessioni – e histoire comparée – o “storia comparata”, incentrato, invece, sullo studio di somiglianze e differenze. Nel collegare sia le cause della Guerra Civile americana, sia la guerra vera e propria ai nazionalismi dell’Ottocento, si può partire dalla constatazione che la ristrutturazione dell’intero Nord America, conseguente ad un evento bellico di dimensioni continentali, portò alla ‘riformazione’ di uno stato nazionale americano impostato secondo principi e ideali analoghi – e quindi collegabili tramite la histoire croisée – a quelli delle nazioni europee contemporanee, e perciò ad esse paragonabile tramite l’utilizzo della histoire comparée. Con particolare riferimento all’Italia risorgimentale, si può notare come, per esempio, tra gli Abolizionisti americani e i democratici italiani, William Lloyd Garrison e Giuseppe Mazzini avessero parecchie affinità in termini di ideali, mentre una certa affinità ideologica è stata anche rilevata, in passato, tra il Partito Repubblicano di Abraham Lincoln e i Liberali Moderati capeggiati da Camillo Cavour. In generale, quindi, la vittoria del Nord unionista e antischiavista nella Guerra Civile americana rappresentò un episodio di importanza capitale nel fenomeno dell’avanzata dei nazionalismi liberali e democratici che agitò il mondo occidentale, l’Europa e l’Italia, durante gli anni compresi tra il 1848 e il 1870, e, allo stesso tempo, tale episodio rappresentò un evento la cui portata in senso politico non può che essere definita come “globale”

    Between the late 17th century and the second half of the 18th century Scotland faced most important constitutional changes, involving the relationships between the State and the Churches. In this context, the “religious question” continued to play a crucial role, finding its place – as so often in the past – at the heart of the political agenda. However, this agenda was also influenced by the intellectual movement called Scottish Enlightenment, which provided an important contribution to the evolution of the Scottish Established Church that was Calvinist in its official documents, but Presbyterian as regards its ecclesiastical order. Following general considerations about the process of secularization (which was widespread in Europe at that time), the author analyses the peculiar evolution of relationships between the Scottish Established Church and the Scottish Enlightenment, which also affected the constitutional system in that country.Fra la fine del XVII secolo e la seconda metà del XVIII secolo la Scozia affrontò mutamenti costituzionali molto rilevanti, concernenti la relazione fra Stato e Chiese. In questo contesto, la “questione religiosa” continuò a giocare un ruolo cruciale, ponendosi – come spesso nel passato – in cima all’agenda politica. Comunque tale agenda era influenzata anche dal movimento intellettuale chiamato Illuminismo scozzese, che diede un contributo importante all’evoluzione della Chiesa Scozzese che era Calvinista nei documenti ufficiali, ma Presbiteriana nel suo ordine ecclesiastico. Dopo considerazioni generali sul processo di secolarizzazione (diffuso in Europa al tempo) l’autore analizza la peculiare evoluzione delle relazioni tra la Chiesa Scozzese e l’illuminismo scozzese, che influenzarono anche il sistema costituzionale di questo paese

    La costituzione belga del 1831 che fu il risultato dell’indipendenza proclamata l’anno prima, non fu la prima costituzione scritta che governò il popolo belga. A parte differenti regimi costituzionali provinciali durante l’Antico Regime, che talvolta inclusero atti costituzionali, i belgi furono governati dalle successive costituzioni francesi durante l’annessione dei territori belgi alla Francia fra il 1795 e il 1814/1815, cioè le costituzioni del Direttorio, del Consolato e dell’Impero. Dal 1815 fino al 1830, il Belgio formò un regno unito con i Paesi Bassi. La costituzione belga-olandese del 1815 fu essa stessa il risultato dei diversi regimi costituzionali che sono stati applicabili nella Repubblica Batava, nel Regno d’Olanda durante l’annessione francese, e della costituzione adottata nel 1814 quando i Paesi Bassi furono liberati dalla dominazione francese. Questa rapida e complessa successione di diverse costituzioni nello spazio di 35 anni di dominazione straniera, e la pratica costituzionale durante il periodo 1815-1830, furono parte dei riferimenti (a parte i riferimenti ad altri modelli, quali le costituzioni americana, britannica e francese post- napoleonica) che formarono le concezioni del Costituente belga del 1830-1831.The Belgian Constitution of 1831 which resulted from the independence proclaimed the year before, was not the first written constitution which governed the Belgian people. Apart from different provincial constitutional regimes under the Ancien Régime, which sometimes included constitutional acts, the Belgians were governed by the successive French constitutions while the Belgian territories were annexed to France between 1795 and 1814/1815, viz. the constitutions of the Directoire, the Consulate, and the Empire. From 1815 until 1830, Belgium formed a united kingdom with the Netherlands. The 1815 Dutch-Belgian Constitution was itself the result of the different constitutional regimes which had been applicable in the Batavian Republic, the Kingdom of Holland, during the French annexation, and of the Constitution adopted in 1814 when the Netherlands were liberated from the French rule. This rapid and complex succession of different constitutions in the space of 35 years under foreign rule, and the constitutional practice during the 1815-1830 period, were part of the references (apart from references to other models, such as the American, British and post-Napoleonic French constitutions) which shaped the views of the Belgian Constituent in 1830-1831.
