Alle origini del plebiscito «dei moderni»
The plebiscite “of modern times”, born at the same time as the two great revolutions at the end of the Eighteenth Century, triggers a short circuit that proves to be difficulty resolved: direct and immediate expression of the sovereign people on the one hand, source of legitimation of a new kind of power on the other. On this field as well, France confirms its vocation of being a laboratory of political modernity. Institutional purposes, practical ways of carrying them out, rhetoric of proposers, holiday celebrations and spectacular frameworks, they all testify to the holistic and at the same time inclusive representative investment of the first plebiscitary votes of the modern period. So much so that the Bonapartist appropriation will consecrate its indispensable role in legitimating the new political system of an authoritarian hue. The issue on the plebiscite, Rousseau permitting, is then overburdened by conflicting expectations. Even if the supporters of the popular vote shared the same nationalistic rhetoric, they place themselves on very different fields: from the hegemonic ambitions of the Jacobins to the attempts of the two Bonapartes to exploit the popular vote, a project developed more under the shade of the Third Republic than during the two Empires. Even though the question has been posed by Renan, the real rediscovery of the plebiscite in a democratic way, as a correction of the possible parliamentarian drifts, will only be in the crisis which invests Europe during the thirties of the Nineteenth century: thanks to a crystal – clear and well – calibrated intervention of Carré de Malberg.Il plebiscito “dei moderni”, nato contestualmente alle due grandi rivoluzioni di fine Settecento, innesca un cortocircuito di difficile soluzione: espressione diretta e immediata del popolo sovrano, da un lato, fonte di legittimazione di un potere di nuovo tipo dall’altro. Anche su questo terreno la Francia conferma la propria vocazione di laboratorio della modernità politica. Finalità istituzionali, modalità pratiche di svolgimento, retoriche dei proponenti, celebrazioni festive e cornici spettacolari, attestano tutte quante l’investimento rappresentativo, olistico e allo stesso tempo inclusivo, delle prime votazioni plebiscitarie dell’età moderna. Così come l’appropriazione bonapartista ne consacrerà il ruolo imprescindibile nella legittimazione dei nuovi sistemi politici di stampo autoritario. Il discorso sul plebiscito, Rousseau permettendo, va poi caricandosi di aspettative contrastanti. Benché accomunati da una medesima retorica nazionalistica, i partigiani del voto popolare si collocano su terreni assai diversi: dalle ambizioni egemoniche dei giacobini si passa ai tentativi dei due Bonaparte di strumentalizzazione del voto popolare, un progetto argomentato più all’ombra della Terza Repubblica che non sotto i due Imperi. Anche se il problema fu posto da Renan, il vero recupero del plebiscito in chiave democratica, come correttivo alle possibili derive del parlamentarismo, si avrà soltanto nella crisi che investe l’Europa negli anni trenta del Novecento: grazie a un lucido e calibrato intervento di Carré de Malberg
Republic and popular sovereignty. The Belgian case: 1830-1831
Questo articolo studia il concetto di sovranità popolare basandosi sui discorsi tenuti dai repubblicani durante il periodo belga di svolta rivoluzionaria e l’emanazione della Costituzione (1830- 1831). Il gruppo dei repubblicani non solo era piuttosto eterogeneo; ma era anche molto piccolo per assumersi la lotta contro la maggioranza di liberali, cattolici e orangisti. Le loro idee corrispondevano sostanzialmente a quelle sostenute dai repubblicani francesi giacobini e babuvisti. La repubblica era per essi il regime ideale, basato su una forma di governo giusta che avrebbe potuto metter fine alla monarchia e garantire che il potere fosse fermamente nelle mani del popolo. La sovranità repubblicana e popolare coincide. Il popolo è il sovrano onnipotente che interviene direttamente negli affari pubblici e controlla il governo. La sovranità popolare dovrebbe pertanto tollerare il minor numero di limitazioni possibili e rimanere uno dei principi fondamentali del nuovo ordine. Nel difendere le loro idee, comunque, i repubblicani inevitabilmente si trovarono ad affrontare una maggioranza determinata ad evitare il ritorno ad un regime repubblicano – un regime associato con i mali del “Terrore”. Attacchi duri, dibattiti e diatribe veementi erano comuni. Come risultato, sia il concetto di repubblica che di sovranità popolare naufragarono. Per eliminare la repubblica, venne introdotto il concetto di monarchia repubblicana, cioè una monarchia costituzionale che privava il re di una grande quantità di potere e lasciava l’ultima parola al popolo. Non esisteva più la questione del popolo sovrano. Invece, un élite benestante garantì che una sovranità scelta e limitata fosse stabilita. Il concetto di sovranità popolare fu rimpiazzato da quello di sovranità nazionale. I repubblicani vennero pertanto chiaramente sconfitti su entrambi questi elementi essenziali ma controversi dopo una lotta aspra e disperata. Comunque, ciò non significa che essi non abbiano influenzato il corso degli eventi. Il loro contributo nella lotta contro il re e la Casa d’Orange fu cruciale e spesso essi supportarono l’ala sinistra dei liberali per assicurare che fossero ottenute conquiste maggiori di quelle che i conservatori erano disposti a concedere. E la loro più grande vittoria sarebbe stata la subordinazione del re e del potere dominante alla sovranità rappresentativa.This article addresses the concept of popular sovereignty on the basis of the discourses of the re- publicans during the Belgian revolutionary watershed moment and the establishment of the Constitution (1830-1831). The group of republicans was not only fairly heterogeneous; it was also very small to take up the fight against the majority of liberals, Catholics and Orangists. Their ideas corresponded by and large to those endorsed by the French republican Jacobins and Babouvists. The republic was for them the ideal regime, based on a just form of government that could put an end to monarchy and ensure power was firmly in the hands of the people. Republic and popular sovereignty coincide. The people are the all-powerful sovereign that intervenes directly in public affairs and controls the government. Popular sovereignty should therefore suffer as few limitations as possible and remain one of the fundamental principles of the new order. In defending their ideas however, the republicans inevitably came up against a majority determined to avoid a return to a republican regime – a regime associated with the evils of the “Terreur”. Harsh attacks, debates and vehement diatribes were not uncommon. As a result, both the concept of republic and popular sovereignty went by the board. To do away with the republic the concept of republican monarchy was introduced, i.e. a constitutional monarchy that deprived the king of a great deal of power and left the final word to the people. No longer was there any question of a sovereign people. Instead, a well-to-do elite ensured that a limited, chosen sovereignty was established. The concept of popular sovereignty was replaced by that of national sovereignty. The republicans were therefore clearly defeated on both these essential but controversial issues after a bitter and desperate struggle. But this does not mean that they did not influence the course of events. Their contribution to the fight against the king and the House of Orange was crucial and often, they supported the left-wing liberals to ensure more gains were made than the conservatives were prepared to concede. And their greatest victory will have been the subordination of the king and the ruling power to representative sovereignty.
La Germania di Merker
On 6th June 2017 many colleagues, friends and pupils of Nicolao Merker met at the Department of Philosophy of the University “La Sapienza” in Rome, in order to remember the great scholar after few months of his death. It was the occasion for reflecting on the important role played by Merker in the Italian culture of the last decades, as well as on the most relevant themes which were at the core of his long and prolific intellectual path: from the political and cultural history of modern Germany to the transformations of Marxism, from the nationalism/colonialism nexus to the populist issue. The focus published in this issue of the «Journal of Constitutional History» gathers the contributions of that day of studies, in a polyphonic dialogue which is also an endorsement of the extraordinary richness and modernity of that research path.Il 6 giugno 2017 molti colleghi, amici e allievi di Nicolao Merker si sono riuniti presso il Dipartimento di Filosofia dell’Università “La Sapienza” di Roma, per ricordare il grande studioso a pochi mesi dalla sua scomparsa. È stata l’occasione per riflettere sull’importante ruolo svolto da Merker nella cultura italiana degli ultimi decenni oltre che sulle più rilevanti tematiche poste al centro del suo lungo e prolifico itinerario intellettuale: dalla storia politica e culturale della Germania moderna alle trasformazioni del marxismo, dal nesso nazionalismo/colonialismo alla questione populista. Il focus pubblicato in questo numero del «Giornale di storia costituzionale» raccoglie i contributi di quella giornata di studi, in un dialogo a più voci che è anche una testimonianza della straordinaria ricchezza e attualità di quel percorso di ricerca.

The Treatment of Italians Abroad in the Le- gal Opinions of the Consiglio del Contenzioso Diplomatico of the Italian Ministry of Foreign Affairs (1861-1907)
L’articolo ricostruisce lo sviluppo delle norme di diritto internazionale relative alla tutela degli individui attraverso l’analisi di fonti inedite relative ad alcuni casi di protezione diplomatica di cittadini italiani residenti all’estero dalla proclamazione del Regno d’Italia sino allo scoppio della prima guerra mondiale. Le fonti primarie della ricerca sono i pareri elaborati dal Consiglio del contenzioso diplomatico (una commissione di alti burocrati, giuristi, in particolare internazionalisti, e diplomatici) su richiesta del Governo italiano, che avrebbe dovuto agire per la protezione diplomatica dei propri sudditi. Oltre ai pareri, l’articolo prende in considerazioni le consulenze fornite dagli organi consultivi dei ministeri degli affari esteri degli altri paesi coinvolti in simili casi, i progetti e le risoluzioni dell’Institut de droit international e le opere pubblicate dalla dottrina coeva. Tali fonti, per quanto costrette fra esigenze di politica estera e ambizioni scientifiche (o, forse, proprio per questa ragione) offrono una prospettiva originale su una delle branche del diritto internazionale pubblico che più si è sviluppata fra la seconda metà del diciannovesimo secolo e l’inizio del secolo successivo.The paper seeks to reconstruct the development of international law rules concerning the protection of individuals through the discussion of fresh sources concerning a number of cases of diplomatic protection of Italian nationals residing abroad between the proclamation of the Kingdom of Italy and the outbreak of WWI. The primary sources of the research are the legal opinions delivered by the Consiglio del contenzioso diplomatico (an advisory committee of statesmen, international lawyers and diplomats established at the Italian Ministry of Foreign Affairs in 1857) for the use of the Italian Government acting on behalf of its nationals in these disputes. The legal opinions delivered for the other Governments involved in the cases, as well as the reports of the Institut de droit international and other international law works of the time on the subject of the treatment of foreigners and diplomatic protection are likewise taken into consideration. These opinions, these reports and these works, albeit oscillating between political considerations and scientific aspirations (or, arguably, for this very reason), offer a valuable insight into one of the branches of public international law that developed more distinctly between the second half of the XIX Century and the beginning of the XX Century.
