Social movements and mobilizations: The case of the independentist cycle
La dècada que va del 2008 al 2018 ha estat d’alta intensitat política. Ho podem constatar amb diferents indicadors de protesta i mobilització social disponibles, confirmades a partir del seguiment de l’actualitat política. Centenars de manifestacions, protestes, concentracions, i tot el repertori imaginable d’acció col·lectiva que despleguen els moviments socials han format part del paisatge polític del país. Dos grans eixos han protagonitzat aquest cicle intens de mobilització social, producte del que Macià, Martí i Ubassart (2018) anomenen la triple crisi –econòmica, de representació i territorial. D’una banda, en l’eix nacional, el vinculat al moviment sobiranista/independentista amb un procés de mobilització que va comptar amb un cicle de consultes, multitudinàries manifestacions, sorgiment de nous actors, i finalment un pols amb l’estat que va derivar en la suspensióm de l’autonomia - via aplicació de l’article 155-, presó incondicional i exili de dirigents independentistes,que va comportar una etapa mb la de desestabilització institucional i social de conseqüències encara imprevisibles. I de l’altra, en l’eix social, les protestes del 15-M, que van enllaçar amb les protestes per la retallades en la prestació de serveis realitzades pel govern de CiU en el període 2010-2014, i en la constitució d’unes candidatures municipalistes amb molta presència d’activistes de moviments socials. En aquest article, a partir de la caracterització dels dos grans agents de mobilització d’aquesta darrera dècada 2008-2018- analitzarem com aquest doble cicle ha pogut canviar la configuració dels moviments socials.La década que va del 2008 al 2018 ha sido de alta intensidad política. Lo podemos constatar con diferentes indicadores de protesta y movilización social disponibles, confirmadas a partir del seguimiento de la actualidad política. Cientos de manifestaciones, protestas, concentraciones, y todo el repertorio imaginable de acción colectiva que desarrollan los movimientos sociales han formado parte del paisaje político del país. Dos grandes ejes han protagonizado este ciclo intenso de movilización social, producto del que Macià, Martí y Ubassart (2018) llaman la triple crisis -económica, de representación y territorial. Por un lado, en el eje nacional, el vinculado al movimiento soberanista / independentista con un proceso de movilización que contó con un ciclo de consultas, multitudinarias manifestaciones, surgimiento de nuevos actores, y finalmente un pulso con el estado que derivó en la suspensión de la autonomía - vía aplicación del artículo 155-, prisión incondicional y exilio de dirigentes independentistas, que comportó una etapa con la de desestabilización institucional y social de consecuencias todavía imprevisibles. Y por otro, en el eje social, las protestas del 15-M, que enlazaron con las protestas por los recortes en la prestación de servicios realizadas por el gobierno de CiU en el periodo 2010-2014, y en la constitución de unas candidaturas municipalistas con mucha presencia de activistas de movimientos sociales. En este artículo, a partir de la caracterización de los dos grandes agentes de movilización de esta última década 2008-2018- analizaremos como este doble ciclo ha podido cambiar la configuración de los movimientos sociales.The decade from 2008 to 2018 has been one of high political intensity. We can see this with different indicators of protest and social mobilization available, confirmed from the monitoring of current political events. Hundreds of demonstrations, protests, rallies, and every imaginable repertoire of collective action displayed by social movements have formed part of the country’s political landscape. Two main issues have started in this intense cycle of social mobilization, a product of what Macià, Martí and Ubassart (2018) called the triple crisis - economic, representative and territorial. On the one hand, on the national issue, the one linked to the sovereignty / independence movement with a process of mobilization that had a cycle of consultations, mass demonstrations, the emergence of new actors, and finally a pulse with the state that lead to the suspension of autonomy - by the application of article 155 -, unconditional imprisonment and exile of pro-independence leaders, which led to a stage with institutional and social destabilization of still unpredictable consequences. And on the other, in the social issue, the protests of 15-M, which were linked to the protests by the cuts in the provision of services carried out by the CiU government in the period 2010- 2014, and in the constitution of ‘municipalist candidacies with a large presence of activists from social movements. In this article, based on the characterization of the two major mobilization agents of the last decade 2008-2018, we will analyze how this double cycle has been able to change the configuration of social movements
Judging Expert Testimony: From Verbal Formalism to Practical Advice
Appraising the worth of others’ testimony is always complex; appraising the worth of expert testimony is even harder; appraising the worth of expert testimony in a legal context is harder yet. Legal efforts to assess the reliability of expert testimony—I’ll focus on evolving U.S. law governing the admissibility of such testimony—seem far from adequate, offering little effective practical guidance. My purpose in this paper is to think through what might be done to offer courts more real, operational help. The first step is to explain why the legal formulae that have evolved over the years may seem reassuring, but aren’t really of much practical use. The next is to suggest that we might do better not by amending evidentiary rules but by helping judges and attorneys understand what questions they should ask about expert evidence. I focus here on (i) epidemiological testimony, and (ii) the process of peer review
Scientific Questions of Fact Between Free Evaluation of Evidence and Proof Beyond any Reasonable Doubt in the Criminal Trial
In contemporary legal epistemology it is common to talk about the “paradox of expert testimony”, which can be formulated as follows: “how can the judge assess information provided by an expert witness if he needs him precisely because of his own lack of adequate specialist knowledge?”. The goal of the paper is to show that this paradox is only apparent. To pursue it I first of all review the history of the ideas of free evaluation of evidence and proof beyond any reasonable doubt in the civil law and common law traditions, in order to address the theoretical problem of their nature in contemporary law systems. Then I propose a taxonomy of the judicial approaches to the role of experts at trial, concluding that none of these approaches, except one (“the gatekeeper judge”), is consistent with both above-mentioned principles. Lastly, I look in depth at the gatekeeper judge approach, showing that a real assessment of expert information is possible, so that the paradox of expert testimony depends only on a faulty understanding of both activities
La prueba ilícita ante la bifurcación del tribunal penal
El artículo propone aproximarse a la prueba ilícita atendiendo al diseño institucional del sistema de justicia penal, a fin de mostrar problemas que de otra manera son ignorados. Utilizando las herramientas analíticas desarrolladas por la teoría racional de la prueba, se examinan las implicaciones de la bifurcación del tribunal penal en un tribunal de control de admisibilidad de las pruebas y un tribunal de juicio. Se emplea el proceso penal chileno como caso de estudio y se revisa críticamente el trasplante de excepciones a la regla de exclusión de prueba ilícita y la prohibición de valoración de prueba ilícita.The paper argues for an approach to the topic of illegally obtained evidence that focuses on the institutional design of the criminal justice system, in order to highlight some issues that otherwise remain ignored. Using the analytical tools developed by the rationalist theory of evidence law, the paper examines the implications of a criminal court divided into two tribunals, both professionals, one in charge of the admission of evidence and the other functioning as trial court. By using the Chilean criminal procedure as a case study, the paper criticizes the transplant of exceptions to the exclusionary rule, and the prohibition of assessment of illegally obtained evidence
Realidad Aumentada en The New York Times: la experiencia del contenido periodístico a la vista de los brasileños
This article analyzes and seeks to reflect on Brazilian users’ immersive experience with content available in virtual (VR) and augmented reality (AR), on the New York Times. The goal is to verify the perception of the immersive news stories made available by the newspaper in two articles that deal with fashion and behavior: “Augmented Reality: David Bowie in three dimensions”, published on March 20, 2018, which examines the costumes of the musician and composer based on the catalog of the exhibition “David Bowie Is” and “Ashley Graham: unfiltered”, published on September 5, 2018, which explores digital imaging resources to illustrate the model’s interview on the plus size fashion theme and acceptance of the body. The text begins with a literature review and research on the adoption of such technology by journalistic vehicles and proposes a study based on the investigation of the meaning/pertinence of the simulations for the interpretation of contexts and themes in journalistic matters. Additionally, the text questions how these technological resources affect the processes of communication and perception, through a research dynamic with a group of Brazilian volunteers, to verify how these new technological resources explore the degree of immersion and the strategies of these experiences, with the preliminary results described at the end.Este artículo analiza y busca reflexionar sobre la experiencia inmersiva de los usuarios concontenido disponible en realidad virtual (VR) y aumentado (AR), mediante vehículos periodísticosque imprimen una nueva cultura visual, tomando como objeto el New York Times (NYT)con un enfoque en editorial inmersiva. El objetivo es verificar la percepción de los contenidospuestos a disposición por el periódico en dos informes que tratan sobre la moda y el comportamiento,son: “Realidad aumentada: David Bowie en tres dimensiones”, publicado el 20 demarzo de 2018, cuyo tema es explorar los disfraces del músico y compositor basado en el catálogode la exposición “David Bowie Is” y el artículo “Ashley Graham: sin filtro”, publicado el 5 de septiembre de 2018, que explora los recursos de imágenes para ilustrar una entrevista sobre eltema del plus size y la aceptación del cuerpo. Con este fin, considera una revisión bibliográficae investigación sobre la adopción de esta tecnología por los medios periodísticos y proponeun estudio respaldado por la investigación sobre el significado/relevancia de las simulacionespara la interpretación de contextos y temas en asuntos periodísticos y cómo afectan los procesosde comunicación y percepción, a través de una dinámica de investigación con un grupode voluntarios brasileños, para verificar cómo estos nuevos recursos tecnológicos exploran elgrado de inmersión y las estrategias de estas experiencias

Análisis de un modelo de ciudad turística según las fuentes del relato: prensa versus plataformas ciudadanas. ¿Especulación o desarrollo?
Este estudio analiza las fuentes de las que parten las informaciones en dos proyectos que cuestionan el modelo turístico de Málaga (España): Bosque Urbano para Málaga (2016) y la Torre del Puerto (2016). El primero de ellos hace referencia a una construcción descontrolada donde demandan un bosque urbano de 177.000 metros cuadrados y, el segundo, a la edificación de un hotel de 150 metros en el puerto de la ciudad. Los objetivos de la investigación son: analizar y comparar las fuentes en tres diarios de referencia en la provincia y en las redes sociales de dos plataformas ciudadanas. La metodología utilizada es mixta, cualitativa y cuantitativa, análisis de contenido de las noticias y mensajes en redes sociales. Como conclusión principal se aprecia una confrontación de relatos de los medios y los ciudadanos, que reclaman un modelo de ciudad sostenible frente a la prensa, que muestra una defensa de los proyectos urbanísticos analizados esgrimidos por posturas interesadas de fuentes institucionales y privadas.This study analyzes the sources of informationused in two projects that question the tourist model of Malaga (Spain): Urban Forest for Málaga (2016) and Torre del Puerto (2016). Approach to chocolate and promotion of the territory. A comparative analysis between Mexico and Spain
Se analizan dos modelos de promoción y desarrollo del chocolate en regiones con aprovechamiento turístico en Latinoamérica y Europa: México y España. A través de un planteamiento cualitativo basado en un estudio de caso comparativo y en la aplicación de técnicas etnográficas, se documentaron los paralelismos y las diferencias entre ambos, para identificar cómo se promociona y desarrolla el turismo gastronómico en contextos con características similares, pero también con fuertes contrastes que develan formas diferenciadas de activación turística de los recursos y su promoción. Two models for the promotion and developmentof chocolate in regions with tourist use in LatinAmerica and Europe are analyzed: Mexico andSpain. Through a qualitative approach based ona comparative case study and the application ofethnographic techniques, the parallels and differencesbetween the two were documented toidentify how gastronomic tourism is promoted anddeveloped in contexts with similar characteristics,but also with strong contrasts that reveal differentiatedforms of tourist activation of resources andtheir promotion
New challenges for healthy democracy: Triple spanish crisis and economic, social and cultural change
El movimiento global, que da inicio con la revuelta de Seattle en 1999, supone el punto de partida de una nueva era en la que se empiezan a materializar importantes transformaciones productivas, sociales y culturales en curso. Este cambio epocal internacional se superpone con el agotamiento de un ciclo político en la historia contemporánea española que abarca desde la aprobación de la Constitución (1978) hasta la irrupción de la triple crisis española a partir de 2008. En este artículo se analiza esta crisis en su declinación económica, política y territorial, así como también las corrientes de fondo que la originan. Quiere ponerse el foco en evaluar la salud de la democracia. Para avanzar en este objetivo se ha realizado un doble ejercicio. Por un lado, caracterizar la cultura política española durante los 30 años de estabilidad y describir las transformaciones que se producen en ella a partir del cambio de milenio. Por otro lado, explorar aquellas formas de participación que van más allá de la democracia representativa y que se experimentan ya desde la recuperación democrática.The global movement, which began with the Seattle revolt in 1999, is the starting point of a new era in which to materialize important productive, social and cultural transformations in progress. This international epochal change overlaps with the exhaustion of a political cycle in Spanish contemporary history that ranges from the approval of the Constitution (1978) to the emergence of the Spanish triple crisis from 2008. This article analyzes this economic, political and territorial crisis as well as the background currents that originate them. We want to focus on assessing the health of democracy. To advance this objective, a double exercise has been carried out. On the one hand, characterize the Spanish political culture during the 30 years of stability and describe the transformations that occur in it from the turn of the millennium. On the other hand, explore forms of participation that go beyond representative democracy and that are experienced since the democratic recovery.El moviment global, que s’inicia amb la revolta de Seattle el 1999, suposa el punt de partida d'una nova era en la qual es comencen a materialitzar importants transformacions productives, socials i culturals en curs. Aquest canvi d'època internacional es superposa amb l'esgotament d'un cicle polític en la història contemporània espanyola que abraça des de l'aprovació de la Constitució (1978) fins a la irrupció de la triple crisi espanyola a partir de 2008.En aquest article s'analitza aquesta crisi en la seva declinació econòmica, política i territorial, així com també els corrents de fons que l'originen. Vol posar-se el focus en avaluar la salut de la democràcia. Per avançar en aquest objectiu s'ha realitzat un doble exercici. D'una banda, caracteritzar la cultura política espanyola durant els 30 anys d'estabilitat i descriure les transformacions que es produeixen en ella a partir del canvi de mil·lenni. D'altra banda, explorar aquelles formes de participació que van més enllà de la democràcia representativa i que s'experimenten ja des de la recuperació democràtica
La necessitat de la integralitat en les polítiques públiques d'immigració
Aquest article pretén analitzar el que considerem que és un dels aspectes rellevants de les polítiques públiques orientades a la integració de les persones immigrades: com aconseguir que les polítiques d’immigració siguin una política pública integral en el si de les administracions públiques. És a dir, que no depenguin d’una única unitat administrativa, sinó que cadascun dels departaments i àrees l’assumeixin com una realitat que els és pròpia i que, al mateix temps, es dissenyin estructures organitzatives, participatives i d’intervenció que assegurin el desenvolupament d’una estratègia única, coordinada i compartida. Aquesta qüestió no és menor i en bona mesura denota la mirada que tenim sobre el fenomen migratori: si pensem la immigració i les persones immigrades des de l’estereotip de la pobresa i l’exclusió, té tot el sentit que plantegem polítiques assistencialistes pensades per a la seva execució des dels serveis socials; si les pensem des de la seva complexitat (pensem, per exemple, que implica totes les dimensions de les persones que d’una manera o altra participen del fenomen), entendrem que precisen d’un abordatge integral, global, multidisciplinar. En la mesura que estem convençuts que el que és necessari és aquest segon abordatge, plantejarem la necessitat de desenvolupar estratègies de gestió i implementació de polítiques d’immigració integrals i que afavoreixin que les persones immigrades puguin superar les desigualtats que els afecten en múltiples dimensions. També explicarem quins són alguns dels obstacles a superar més habituals i apuntarem algunes recomanacions que permetin superar-los. Finalment, presentarem un parell de casos que exemplifiquen bones pràctiques en el desenvolupament de polítiques públiques integrals.This paper aims to analyze what we consider to be one of the relevant aspects of public policies aimed at the integration of immigrants: how to make immigration policies a comprehensive public policy within public administrations. That is, policies that do not depend on a single administrative unit, but that each of the departments and areas assume it as a reality that is their own and that, at the same time, they design organizational, participatory and intervention structures that ensure the development of a single, coordinated and shared strategy. This is not a minor issue and largely denotes the view we have on the migratory phenomenon: if we think of immigration and immigrants from the stereotype of poverty and exclusion, it makes perfect sense to propose welfare policies designed for its execution from the social services; if we think of them from their complexity (we think, for example, that it involves all the dimensions of the people who, in one way or another, participate in the phenomenon), we will understand that they need a comprehensive, global, multidisciplinary approach. To the extent that we are convinced that what is needed is this second approach, we will raise the need to develop strategies for managing and implementing comprehensive immigration policies to promote immigrants to overcome the inequalities that affect them in many dimensions. We will also explain some of the most common obstacles to overcome and we will point out some recommendations to overcome them. Finally, we will present a couple of cases that exemplify good practices in the development of comprehensive public policie
