    La argumentación en la dinámica del discurso

    The various elements that constitute argumentative discourse that is expressed through speech acts represent a complex construction for the person who attempts to convince someone of something. This discourse has a linguistic, intentional and pragmatic structure, the latter being where the interactive aspect of argumentation is situated. This article brings the study of argumentation to the field of discourse analysis. In order to do this, it begins by defining argumentation as a type of discursive organization chosen by the speaker. The aim is to define what happens in the argumentative process by way of a descriptive operation in which types of speech acts are identified.Los diferentes elementos que intervienen en el discurso argumentativo expresado en actos de habla representan una construcción compleja para el sujeto que se esfuerza por convencer a otro de algo. Dicho discurso se estructura lingüística, intencional y pragmáticamente, en esta última se sitúa lo interaccional de la argumentación. Este artículo acerca el estudio de la argumentación al análisis del discurso y para ello se parte de comprender la argumentación como una forma de organización discursiva que es elegida por el hablante.     In Brazil, the argumentation teaching in primary and secondary education is understood as the teaching of argumentative essay, since such practice was institutionalized by a presidential decree that determined the requirement of a Portuguese language essay in the entrance exams to higher education. Thus, I discuss the conditions that favor the school to teach its students to argue, to take the floor in the public sphere to present, justify, sustain, reject, and (re)evaluate arguments in situations of conflict of perspectives on an argumentative issue. I present a proposal for argumentation teaching in a specific situation of interaction with orientations to develop argumentative capacities and competences in the framework of emancipatory education of the human being, in order to overcome the training model for writing argumentative essay, a practice of legitimization of the exclusion regime in the Brazilian education system.En Brasil, la enseñanza de argumentación en la educación primaria y secundaria es entendida como la enseñanza de ensayo argumentativo, pues tal práctica fue institucionalizada por un Decreto presidencial que determinó la exigencia de un ensayo en lengua portuguesa en los exámenes de ingreso a la educación superior. Discuto las condiciones que favorezcan a la escuela a enseñar a sus educandos a argumentar, a tomar la palabra en la esfera pública para presentar, justificar, sostener, rechazar y (re)evaluar argumentos en situaciones de conflicto de perspectivas sobre una cuestión argumentativa. Presento una propuesta de enseñanza de la argumentación en situación concreta de interacción con orientaciones para desarrollar las capacidades y competencias argumentativas en el marco de la educación emancipatoria del ser humano, con el fines de superar el modelo de capacitación para redacción de ensayo argumentativo, una práctica de legitimación del régimen de exclusión en el sistema educativo brasileño

    Gilbert Plumer (2018) se opone a la existencia de “pretensiones inferenciales” alegando que avocarían a un tipo de regreso al infinito de carácter vicioso como el presentado por Carroll en su célebre artículo sobre Aquiles y la Tortuga (Carroll 1895). Según Plumer, no es solo que los argumentos y los argumentadores no incluyan tales pretensiones inferenciales, sino que no podrían incluirlas so pena de caer en tal regreso. En trabajos posteriores no publicados, Plumer propone la generalización de este resultado: es un error incluir referencias a estándares de validación argumentativa en el contenido del argumento. Tales pretensiones inferenciales (i.e. pretensiones de suficiencia) no existen, ni tampoco las pretensiones de relevancia o de aceptabilidad, básicamente por las mismas razones. Defenderé que tales argumentos no logran mostrar que las pretensiones inferenciales no existan, porque los regresos que propician no son viciosos, ni infinitos, ni inevitables. Espero mostrar, a continuación, basándome en lo que llamo “completud” del argumento, que las pretensiones inferenciales no solo existen sino que deben existir. Esto no quiere decir que necesariamente se aseveren en el acto de argumentar, pero aseverarlas no conllevaría las consecuencias perniciosas que Plumer supone, tal como lo las conlleva su mera existencia.In (2018) Gilbert Plumer argues against the existence of inference-claims on the grounds that they lead to the kind of vicious infinite regress illustrated in Carroll’s famous Achilles and the Tortoise paper (Carroll 1895). In Plumer’s view, it is not simply that neither arguments nor arguers do make inference-claims, but that they can’t do so, on pain of this regress. In further unpublished work Plumer has generalized from this result: it is a mistake to include reference to standards of argument assessment within the content of the argument. Inference-claims (i.e., sufficiency-claims) do not exist, and neither do relevance-claims or acceptability-claims, and all for much the same reason. I will argue that his arguments fail to show that inference-claims do not exist, because the regresses they lead to either are not vicious, not infinite, or can be avoided. Then I hope to show, on the grounds of what I call the ‘completeness’ of the argument, that inference-claims not only do exist but that they must exist. This is not to say that inference-claims are necessarily asserted in an act of arguing, but asserting them would not lead to the kind of harmful consequences Plumer supposes, any more than their mere existence would

    In this article I answer a question that often arises when presenting the meta-argumentative theory of argumentation by analogy, namely: are all arguments by analogy meta-arguments? The answer is yes, but in defending this I do not suggest that what other authors have labelled as such are not arguments at all. Here I start from the hypothesis that there is a wide family of forms of arguing in which a comparison between two elements is presented as a reason for assigning to one of them a property of the other. I call this “comparison argumentation” and distinguish six varieties based on the criteria of the object, degree, and purpose of the comparison: arguments by resemblance, argumentation by analogy –which I further divide into argumentation by parity of reasons and argumentation by parity of weighings–, arguments of degree, argumentation a fortiori, explanations by comparison, and illustrations. This classification is not intended to be exhaustive or definitive, but it does clarify what is, and above all, what is not, an argument by analogy. A fundamental part of the work is the analysis of cases: it is from the recognition of similarities and differences that any classification, in this case of arguments, arises.En este artículo respondo a una pregunta que suele surgir al exponer la teoría metaargumentativa de la argumentación por analogía, a saber: ¿son todos los argumentos por analogía metaargumentos? La respuesta es que sí, pero al defender esto no sugiero que aquello que otros autores han calificado como tal no sean argumentos en absoluto. Aquí parto de la hipótesis de que existe una familia amplia de formas de argumentar en las que una comparación entre dos elementos se presenta como una razón para asignar a uno de ellos una propiedad del otro. Denomino esto “argumentación por comparación” y distingo seis variedades en base a los criterios del objeto, el grado y el propósito de la comparación: los argumentos por semejanza, la argumentación por analogía –que a su vez divido en argumentación por paridad de razones y argumentación por paridad de ponderaciones–, los argumentos de grado, la argumentación a fortiori, las explicaciones por comparación y las ilustraciones. Esta clasificación no pretende ser ni exhaustiva ni definitiva, pero sí clarificar qué es y, sobre todo, qué no es, una argumentación por analogía. Una pieza fundamental del trabajo es el análisis de casos: es a partir del reconocimiento de semejanzas y diferencias de donde surge toda clasificación, en este caso de argumentos

    This article approaches the analysis and characterization of conscientious objection, taking into account that its delimitation could be exclusive of those other practices that transgress the law for reasons unrelated to obtaining justice or some particular or common benefit. It will happen that, when trying to approach the conceptual delimitation of conscientious objection, which by its nature transgresses any definition made, it will have to be redefined or reconceptualized, that is, we will take into account that the spectrum of disobedience to the law (including conscientious objection) goes far beyond any possible definition because the contexts and situations have meant that the cases are left out of a single and finished conceptual delimitation. In this way, we will think about its motives, scope, validity, legitimacy, viability and consequences of this disobedience to the law.Este artículo es una aproximación al análisis y caracterización de la objeción de conciencia, teniendo en cuenta que su delimitación podría ser excluyente de aquellas otras prácticas que trasgreden la ley por motivos ajenos de obtener justicia o algún beneficio particular o común. Sucederá que, al tratar de aproximarnos a la delimitación conceptual de la objeción de conciencia, que por su naturaleza trasgrede cualquier definición hecha, tendrá que ser redefinida o vuelta a conceptualizar, es decir, tendremos en cuenta que el espectro de las desobediencias al derecho (entre ellas la objeción de conciencia) va mucho más allá de cualquier definición posible, pues los contextos y situaciones han hecho que los casos queden fuera de una delimitación conceptual única y acabada. De este modo, pensaremos en sus motivos, alcance, validez, legitimidad, viabilidad y consecuencias de esta desobediencia al derecho
