Righting a Reproductive Wrong: A Statutory Tort Solution to Misrepresentation by Reproductive Tissue Providers
No full textFraud, misrepresentation, and other unfair trade practices plague the market for human reproductive tissue. The sale of sperm, eggs, and embryos is virtually unregulated in almost all states, and courts have been inhospitable to victims. As a result, children are born with genetic disorders that impose extreme financial and personal hardship. Proposals for direct government oversight have, for the most part, failed to gain traction, and litigation has yielded inadequate remedies. This Article assesses these problems and proposes model legislation that would eliminate doctrinal obstacles to holding unscrupulous reproductive tissue providers liable. By making it easier for parents to bring tort claims, we aim to jump-start more effective government oversight and industry self-regulation. The proposed legislation is also responsive to political dynamics surrounding the abortion debate and, thus, stands a better chance of adoption than have prior proposals
Fair Housing Protections and Barriers to Access to Affordable Housing and Supportive Housing (GSHA 12th Annual Supportive Housing Conference)
No full textThe Federal and Georgia Fair Housing Acts proscribe practices, laws, and policies that discriminate based upon the disability or familial status of residents who live in a dwelling, as well as other protected classes, including race, color, religion, national origin, gender identity, sexual orientation, pregnancy, and minor children. Advocates are looking at ways to use these protections to address discrimination against renters based on prior evictions, justice involved history, and use of vouchers and other sources of income that limit access to affordable housing. In addition, the Acts bar zoning ordinances that treat uses such as supportive housing or group homes for people with disabilities differently and less favorably than other similar uses. Still, Georgia’s 159 counties have enacted many variations of zoning codes that adversely impact the development and renovation of supportive housing. Zoning ordinances are repeatedly identified by providers and prospective providers of supportive housing as real barriers to development. These barriers directly impede the development of critically needed affordable, supportive housing units and they implicate racial inequity and the rights of people with disabilities

No full textImportance: The US faces a pivotal moment of opportunity and risk regarding issues affecting children (aged 0-17 years). Although the US remains the only United Nations member state to not have ratified the Convention on the Rights of the Child (CRC), a child rights framework is essential for child health professionals seeking to advance many issues affecting children in the US. The Reimagining Children\u27s Rights project (2020-2021) conducted an in-depth environmental scan of relevant literature and policy analysis using the Three Horizons design process to assess strategies that could advance the rights and well-being of children in the US. The project was overseen by a steering committee and informed by an advisory committee composed of youth leaders and experts in children\u27s rights, advocacy, health, law, and a range of child-specific issues (eg, youth justice, early childhood development), who provided expert input on strategic considerations for advancing children\u27s rights.
Observations: Seven findings about advancing children\u27s rights in the US are notable, all reflecting current gaps and opportunities for using a whole-child rights framework in the US, even without formal adoption of the CRC. Actionable strategies, tactics, and tools to leverage sustainable change in the multitude of issue areas can advance the current state of children\u27s rights. High-potential strategies for catalyzing advancement of children\u27s rights include youth activism, innovations in governance and accountability, legislative action, impact litigation, place-based initiatives, education and public awareness, alignment with other children\u27s movements, and research. The child rights framework is unifying and adaptive to future unforeseen challenges.
Conclusions and Relevance: Children\u27s rights provide a powerful, synergistic framework for child health professionals-in partnership with youth and other leaders-to increase equity and protect the rights and well-being of all children in the US
