    Local Wisdom-Based Water Resources Conservation: Enhancing Local Wisdom in Society 5.0

    Local wisdom as capital for sustainable water resource conservation is becoming increasingly important in the era of Society 5.0. It is characterized by technological transformation and extensive interconnection. In this context, implementing local wisdom values in the conservation of water resources is a significant challenge. This paper discusses the challenges faced in conserving sustainable local wisdom-based water resources in the era of Society 5.0, such as cultural and technological changes. This paper also examines legal regulations in water resource conservation based on local wisdom, such as how laws regulate water use and budget arrangements for water resource conservation. The method used is a literature study of several legal materials using concept and statutory approaches, then analyzed to answer the problems studied. The results show that it is necessary to strengthen the recognition and protection of local wisdom through the preparation or revision of laws and regulations that recognize the values of local wisdom in the conservation of water resources, a collaboration between stakeholders to build citizen communication and consultation; and regulatory adjustments to support the conservation of water resources in the era of society 5.0

    In the Question of Geospatial Information Data Use in the Forestry Legislation Making in Indonesia

    The high rate of deforestation and many forest disputes in Indonesia show that forest management in Indonesia is not based on the principles of good forest governance. It also shows that there is still a lack of attention to the aspect of sustainable forest development which focuses on a balanced sustainability condition between the three forest functions (production, ecology, and socio-economic functions). Geospatial Information is expected to be the solution to help provide an accurate data and information which mapping forest development in accordance with the conditions of each forest area, so that the three functions can operate coherently. Furthermore, with the presence of integrated geospatial data, it can be used as a tool in policy formulation, decision making, and/or dispute resolution in the forestry sector. This paper applies empirical juridical research consisting participatory methods through discussions and interviews with related parties.  In practice, the legal materials are firstly collected by using inventory and documentation. Then, it’s completed by interviews and Focus Group Discussion data. Moreover, it also applies statutory, conceptual, and case approaches. This paper highlights the use of geospatial information data in the forestry legislation making in Indonesia.  Hence, this paper will present new information about the model of forestry dispute resolution based on geospatial information

    The Early Warning System in Preventing Human Trafficking: Border (In) Security and Challenges for Indonesia

    This article aims to find out how the early warning system is constructed in detecting human trafficking. This research discusses human trafficking in Indonesia, where most of the victims were trafficked to neighboring countries in the border area. One of the unsolved problem exist today is human trafficking in frontier areas; hence, there are three major factors causing the number of human trafficking in Indonesia is in high level according to data from the International Organization for Migration. This article is using empirical legal research method. The results show that the construction of an early warning system can be formed by studying the methods or modes used by the perpetrators in committing the crime of human trafficking. However, for this concept to succeed, good synchronization is needed between filters that include potential victims, agencies or institutions that can represent administrative functions, and officers at border area guard posts

    EXTRACTING THE PLANNING ELEMENTS OF MINORITY TOURISM DESTINATIONS IN SOUTHWEST CHINA BASED ON AVC THEORY

    In the process of rural modernization, great changes have taken place in rural landscapes throughout the world, but there is a lack of a universal comprehensive evaluation index system for landscapes. AVC theory is the ternary theory of tourism destination landscapes proposed by Professor Binyi Liu. “A†represents attractiveness, “V†represents vitality, and “C†represents ability. Undeveloped minority villages have good tourism destination potential. Therefore, AVC theory can be used to extract the elements of rural sustainable development planning. Taking Nongying Village, a Buyi village in southwest China, as an example, AVC theory is combined with AHP and a comprehensive evaluation model of the rural environment in Nongying Village is constructed using a multiobjective linear weighting function. A comprehensive assessment and extraction of its unique rural environmental conditions is undertaken. The results show that the rural economy has obvious vitality advantages, and Camellia oleifera can be used as a key planning element for sustainable development. The advantages of environmental carrying capacity are obvious, and the overall ecological environment is at a good level. The social attraction is relatively weak. The innovation of this paper is to study the planning and development elements of ethnic minority villages in Southwest China from the perspective of tourism AVC and to conduct an in-depth investigation on the revitalization of oil-tea agricultural resources and Buyi culture in local villages. This study can provide a certain planning reference for the development of tourism destinations and villages with similar agricultural resources and ethnic minority characteristics in the region

    The Effect of Work Placement and Compensation on Employee Performance through Work Motivation

    This research aims to analyze Job Placement which has an indirect influence on employee performance through work motivation and to analyze Compensation which has an indirect influence on employee performance through work motivation at the at the First-class SFR Monitoring Hall Office Makassar. This study uses a quantitative approach. The data used is primary data. The sample was 30 respondents. The respondents are permanent employees who work within the First-class SFR Monitoring Hall Office Makassar. Data collection was carried out through surveys using questionnaires distributed to respondents. Data were analyzed using multiple regression analysis and path analysis with the Statistical Package for the Social Sciences (SPSS) version 26. The research results show that work placement and compensation have a direct influence on employee performance through work motivation. at the First-class SFR Monitoring Hall Office Makassar, and there is an indirect influence on employee performance through work motivation at the Makassar Class I SFR Monitoring Office. This shows that when work placement and high compensation are followed by high work motivation, employee performance will increase and vice versa

    Impact of Indonesian Sustainable Palm Oil (ISPO) Certification to Environmental Behavior of Palm Oil Plantation Companies

    In order to realize sustainable palm oil plantations and to overcome negative impacts of it, Indonesian government has required Indonesian Sustainable Palm Oil (ISPO) certification to palm oil plantation companies. After 10 years of implementation, it is important to know the impact of ISPO certification on environmental behavior of palm oil plantation companies, especially related to deforestation and land fires. Using qualitative method, this study investigates environmental behavior changes in seven palm oil plantation company related to deforestation, and land fires as results of ISPO certification and to analyze the cause of the changes. This study showed that the implementations of ISPO certification are able to change the company's environmental behavior to reduce forest conversion in concession areas and increase conservation areas as a fulfillment of ISPO principles and criteria. The change of those company’s environmental behavior caused by the pressure to issue ISPO regulation, the influence of the company's internal stakeholders in responding and understanding ISPO, and encouragement to get easy finance  access from banks

    Comparison of DNA Isolation Methods that Derived from Leaves of a Potential Anti-Cancer Rodent Tuber (Typhonium flagelliforme) Plant

    The content of polysaccharides, polyphenols, proteins, and RNA compounds is the main problem often found in Plants DNA isolation, which inhibit the process of DNA isolation. Comparing the methods of plant DNA isolation is necessary for obtaining the DNA with good quality, purity, high concentration and efficiency time and cost. This study aimed to determine the best DNA isolation method that derived from leaves of a potential anti-cancer Rodent Tuber (Typhonium flagelliforme) plant by comparing the conventional DNA isolation method (cetyl trimethyl ammonium bromide/CTAB) and 2 commercial kits (Promega Wizard™ Genomic DNA Purification Kits, and Geneaid Genomic Mini Kit). The results showed that the CTAB method yielded a higher amount of DNA (>100 ng/µL) at the cost of 0.49 USD per sample, in comparison with Promega method (69.19 to 157.68 ng/µL) at 3.28 USD per sample and Geneaid method (8.15 to 18.52 ng/µL) at 2.06 USD per sample. Based on the purity of isolated DNA (A260/280), CTAB method produced relatively similar DNA quality to Promega kit (1.8-2.0). On the other hand, Geneaid method resulted in a lower purity value at 1.15 to 1.60

    Phenomenon of the Increasing Single Candidates and Backsliding Democratic Values in Indonesia

    One interesting thing to discuss regarding the holding of regional head elections in 2020 is the increasing number of single candidates participating in democracy contestation. This article offers a comprehensive assessment of the theoretical and practical connections between the number of single candidates in holding regional head elections to the weakening of democratic values in regional head elections. The research methodology adopted for this research was normative. The results show that the factors causing the increase in the number of single candidates are the high threshold that must be met by political parties, an expensive political dowry, and the failure of political parties in carrying out the regeneration function. The increasing number of single candidates in regional head elections is synonymous with the decline in democratic values because the closure of the freedom space for the people to choose candidates. A single pair of candidates will close the freedom space for the people to elect their candidate for leader. A single pair of candidates in regional head elections can close the freedom space for the people to know and discuss the vision, mission, and work program of the single candidate pair. A single candidate in the regional head election is a violation of human rights because it has the potential to block the opportunity for the lower middle class to compete in the elections. The regional head elections with a single candidate will limit broader community participation

    The Policy on Illegal Oil Palm Plantation Reform in Forest Area during Jokowi’s Presidency

    Indonesia is the largest oil palm producer. The area of oil palm plantations is approximately 3.4 million. However, this large potential is not part away from legal issues such as illegal oil palm plantations. It is also implied by overlapping regulations and permits. This study aims to examine the policy of illegal oil palm plantations reform and the rooted regulation problem in forest areas during Joko Widodo era. This research relies on a normative legal approach. Data was collected through the investigation of legal material regarding oil palm policies. The results of this study indicate that the overlapping regulation contributes negatively to the reformation attempt. Yet, there are no legal products and policies regarding the dispute settlement of illegal oil palm in forest areas. Repressive implementation of criminal law does not solve the problem at the grassroots. The establishment of Job Creation Law provides new hope for the settlement of oil palm plantations problem by mainstreaming the nonlitigation mechanism, namely administrative sanctions

    The Creation of the Right of Real Servitude: Derivative and Original Method Based on the Kosovo and Some European Countries

    Legal provisions define the right of servitude as a real right both in local legislation and in the legislation of European countries. Based on the local legislation, some shortcomings are encountered when it comes to the right of servitude, particularly the right of servitude in kind. An issue that will have to be addressed and compared with the legislation of other countries is the crime of the right of real servitude, based on the ways of creating this right. Based on the local legislation, it is emphasized that the right of real servitude can be created based on a legal title, the decision of a state body and based on the law. At the same time, no more detailed division is made to show which legal title belongs in which way, that of derivatives or original. In comparison, legislation of European countries such as Germany, Austria and France, as well as regional countries, it is emphasized that there are two ways for the crime of the right of real servitude. After the ways are mentioned, the separation of legal titles is done; such a thing should be defined in the legislation of Kosovo. Nevertheless, based on the provisions of the legislation in force, we note that where the legal titles for the creation of the right of real servitude are mentioned, there it is known that there are two ways of creating the right of real servitude that the derivative way and the original way of obtaining the right of real servitude, only that it would be more correct if they specified which legal title is considered a derivative title, which in our case is the contract and testament, and which would be considered an original title, which could be the decision of the state body such as that of the court or any administrative body
