    Marriage Agreement for Indonesian Citizens Involved in Mixed Marriages

    Before the decision of the Constitutional Court of the Republic of Indonesia that led to the amendment of Article 29 paragraphs 1, 3 and 4 of Act No. 1 of 1974 on Marriage, Indonesian citizens involved in mixed marriages who did not enter into a marriage agreement regarding the separation of properties experienced difficulty in obtaining land ownership right. This is due to the Agrarian Law which stipulates that only Indonesian citizens can have ownership rights to land. Also, the agreement can only be done before or at the time the marriage is held. However, the decision of the Constitutional Court opens up the possibility of marriage agreements during the married life of the couple. Finally, with respect to Indonesian citizens who are married to foreigners, the marriage agreement is a welcome solution that will enable them get their rights back as applies to other Indonesian citizens. Despite the changes to the provisions in several articles of the Marriage Law, some problems still exist, such as the problem related to the inheritance rights of children of mixed marriages, who have dual nationality before the age of 18 years. Finally, it is hoped that the changes in the contents of the article will not change the nature of a household regarding the purpose of happiness based on the One Supreme God

    Adult Literacy Education as An Empowerment Tool for Poverty Reduction Among Women in Nigeria

    Poverty is a multi-dimensional problem among women in the countries. This paper looked at adult literacy education as an empowerment tool for poverty reduction among women in Nigeria. The descriptive method using to find the various concepts associated with the study and examined critically the roles of adult literacy education in poverty reduction aimed at empowering the women. The conclusion of this study recommended that there is the need to create awareness on adult literacy education as an empowerment tool for poverty reduction among women and that there is the need for political will and commitment on women empowerment and development

    Public Apology as a Form of Reparation

    Public Apology is recognized as a form of reparation for victims of gross violations of international human rights law and international humanitarian law, alongside other measures, such as monetary compensation and restitution. This paper aims to analyze the effectiveness of public apologies as a form reparation and in doing so, discusses several cases and forms of public apologies. More specifically, this paper extensively analyzes the effectiveness of the public apologies made by the Netherlands to Indonesia, in respect of the post-independence atrocities committed by the Netherlands in Indonesia, during the period of 1945 – 1949. The cases discussed in this paper reveals that the effectiveness of a public apology as a form of reparation varies from cases to cases and depends on a host of factors. The past practice of States which had delivered public apologies for human rights abuses, however, shows that public apology alone is not enough to be an effective form of reparation for the victims of gross human rights violations. In most cases, public apologies must be accompanied by other types of reparations to give effective redress to the victims of human rights violations

    Safety Zones Around Offshore Installations

    In order to protect offshore installations and reduce the risk of accidents, which results in marine pollution, certain areas around offshore installations are designated as exclusion zones and precautionary areas. Article 60 of the United Nations Convention on the Law of the Sea (UNCLOS) of 1982 recognizes the right of coastal states to establish exclusion zones around offshore installations. These zones should extend to a distance not exceeding 500 m from each point of the outer edge of the installation. Also, Resolution A.671(16) of the International Maritime Organization (IMO) (Safety Zones and Safety of Navigation around Offshore Installations and Structures) recommends that governments consider, amongst other things, the establishment of safety zones around offshore installations or structures as well as the establishment and charting of fairways or routing systems through exploration areas. In this regard, this study analyzes the effectiveness of the safety zones prescribed by law in protecting oil installations. It concludes that although UNCLOS 1982 does not stipulate the establishment of safety zones around offshore installations constructed in the territorial sea, the coastal state has a right to establish safety zones in such locations, and its radius may extend beyond 500 m if it is necessary to protect the offshore installation in the territorial sea. &nbsp

    Enforcement of Environmental Law as Fulfillment of Human Rights

    The right to a good and healthy environment is one of the human rights which has been regulated in the 1945 Constitution of the Republic of Indonesia as a state constitution. As a constitutional mandate, the government has ratified several laws and regulations relating to the management and preservation of the environment. The ability of the state to enforce laws relating to the environment has not been carried out optimally. The type of research used in this study is qualitative which seeks to uncover and analyze how law enforcement for environmental damage in the fulfillment of human rights. This type of research is normative research. The results of the study show that not fulfilling the right to a healthy environment is a violation of human rights, so the state needs to enforce the law in order to protect and fulfill the rights to the environment as the responsibility of the state. Law enforcement efforts that need to be done are by changing environmental regulations, synchronizing the environmental management law with the Human Rights Law, as well as the active role between the government, law enforcement and the community in handling environmental issues based on the principles of justice and transparency &nbsp

    Baby Blues : Husband’s Support in Form of Communication

    Baby blues is the mildest form of postpartum mood disorder, and it is a common condition in newborn mothers. Up to 50-80 percent of newborn mother experience baby blues. While it has the mildest effect, such factors as psychiatric history, environmental stressors, cultural context, breastfeeding, and parity may cause baby blues to progress to a more severe depression. The treatment required by mothers who are affected by baby blues is only reassurance. One of its forms is support system from those within the mother’s immediate environment. The form of support that is discussed in this study is communication with husband. This study aims to discover whether communicating with one’s partner, or husband in this context, is effective in decreasing mood disorder for newborn mothers experiencing baby blues. This study was conducted by interviewing 18 female participants who admitted that they experienced baby blues and were willing to participate in the study. The result of the interview showed that only eight of the eighteen participants stated that communication with their husbands was effective in decreasing their mood disorder during baby blues

Verbal bullying can also be done secretly, especially in the current social media era, someone can bully others anonymously, so the term cyber bullying now appears. The cause of verbal bullying occurs because of the weak role of parents in the family, the characteristics of students or negative actors, and the opportunity. The impact of verbal bullying experienced by victims is students experiencing psycho-social disorders. As students withdraw from their surroundings, crises of self-confidence, stress, anger, and depression. In addition to the impacts that occur on the victims there are also impacts experienced by the perpetrators.     The ‘Declared Areas’ Offence: To What Extent Does Australia’s Policy Response to Foreign Fighters Undermine Freedom of Movement?

    The rise of foreign fighters is increasingly becoming an issue of global significance. Numerous figures suggest that over 20000 foreign fighters have joined the fight in Syria and Iraq in the four first years of conflict (Neumann, 2015).  Between 2014 and 2015, deaths in Organisation for Economic Co-operation and Development (OECD) nations escalated from 77 to 577, half of them committed by the Islamic State (IS) (Institute for Economics and Peace, 2016:40). Australia’s concern for its national security has led to substantial developments in enacting severe counter-terrorism laws, such as the Counter-Terrorism Legislation Amendment (Foreign Fighters) Act 2014 (Cth) (‘the Foreign Fighters Act’). Given the undeniable intrusion of counter-terrorism laws into human rights, this paper will evaluate and question the necessity and proportionality of this new Act and in particular, the introduction of the ‘declared areas’ offence in sections 119.2 and 119.3 of the Criminal Code. This offence criminalizes entering or remaining in ‘declared areas’ in certain foreign locations with a very limited list of exemptions (Williams, 2014:1). This paper will argue that this offence is likely to impermissibly infringe upon the right to freedom of movement, which can only be restricted in very few cases. Accordingly, the main question of this paper is; ‘to what extent is justified and proportionate the infringement on the freedom of movement placed by the 'declared areas' offence created by the ‘Foreign Fighters Act’?’ Finally, the author will advocate that to guarantee it’s compliant with its international human rights obligations, the Australian Government must rely upon the independent assessment and recommendations of review bodies
