Analysis of The Legal Frameworks of Indigenous People’s Rights Over Their Natural Resources And The Impacts of Extractive Industries
Extractive industries are gradually demolishing indigenous people’s lands for collecting natural resources including gold, iron, copper, oil, coal and other natural minerals, from the earth though some international conventions protect their rights. Over the past decades, many international conventions had recognised some legal rights of indigenous people over their lands and also developed some legal protections to safeguard those rights. This paper aims to examine some international legal frameworks of indigenous people’s rights over their natural resources and analyse some significant impacts of the extractive industries on the legal rights of indigenous people over their lands. The qualitative doctrinal research method has been employed to find out the data and analyse them. This study has identified that human rights risks are linked with mining, oil, and gas extraction falling unreasonably on indigenous people. This research has found that extractive industries violate the UNDRIP and the ILO (convention 169) conventions by taking possession of the lands of indigenous people and extracting natural resources from their lands. This paper has settled by recommending, among other things that the UNDRIP and the ILO (convention 169) take the incentives to progress a region wide framework for extractive industries where the human rights of indigenous people are well protected specially the rights of their lands
The Rise of China and The Division of ASEAN
International relations theorists have long been envisioning the durability of ASEAN. ASEAN members have successfully formed a strong collective identity as the result of political and functional interactions and norms internalisation amongst its members through the ‘ASEAN way’. This paper investigates the effectiveness of ASEAN’s decision-making mechanism amidst the rise of China. It explores China’s new assertiveness and its strategy to control the regional order in East Asia, in particular, over the South China Sea (SCS) territory. It further explores the SCS dispute by one ASEAN member – the Philippines – at the Permanent Court of Arbitration (PCA). This paper concludes that the outdated principles underpinning ASEAN’s internal political practices and norms are ineffective in solving issues emerging as a result of the rise of China. China’s strategy to ‘divide and rule’ ASEAN through coercion and inducement has undermined the ASEAN consensus principle by threatening the spirit of solidarity and regional unity of ASEAN members
Gender Equality In Islam: Discourse Analysis of Text In The Book of "Buya Hamka Berbicara Tentang Perempuan"
The notion of equality of men and women was much discussed by Buya Hamka during his lifetime in a serial writing in Panji Masyarakat magazine in the 1990s. In 2014, publisher Gema Insani Jakarta republished Buya Hamka's thought in his book entitled 'Buya Hamka Berbicara tentang Perempuan’. This is considering the importance of the Muslims in this century about Buya Hamka's idea of gender equality, so that Muslims, especially women, can safeguard aqidah, morals, and thoughts referring to the Qur'an and Hadith, and are proud of their Islam. The specific purpose of this study was to find out the textual discourse on gender equality in Islam contained in the book 'Buya Hamka Berbicara tentang Perempuan’. Furthermore, the benefits of this research are theoretically for the development of knowledge and analysis related to contemporary issues required by Muhammadiyah and stimulates further researchers in Muhammadiyah Higher Education to study and explore more about gender in Islamic view. The study used the van Dijk model discourse analysis method which analyzed the microstructure of a text by observing semantics, syntax, stylism, and rhetorical. Applied Neuroleadership in Indonesia
The relationship between brain and behaviour has perplexed philosophers and recent technological advances have allowed neuroscience to flourish, alongside growing romanticism that reductionist studies will allow us to understand complex interpersonal behaviours. Organizational cognitive neuroscience and neuroleadership are newly established interdisciplinary fields that use neuroscientific techniques to answer questions about behaviours within organizations. Neuroleadership aims to discover screening tools for good leaders, to improve leadership skills, and to identify unconscious factors affecting behaviour in hopes of improving management and leadership practices. Indonesian democracy is currently in a positive developmental condition and deserves to be appreciated. This opinion refers to several political realities such as the implementation of elections that develop from the district /city, provincial level, and finally at the national level, which takes place in relatively safe and controlled environment, without causing turmoil or violence and does not cause chaos. A successful democracy and great leaders have brought Indonesia to have economic growth and has provided it the resources and clout to exercise a greater regional and global role
Cyberterrorism's Dilemma: Renewal of Conventional Terrorism
Utilization of cyberspace is increasingly developing along with the advancement of information technology in the current era of globalization. bourderless, low cost, fast access, encouraging terrorists to use cyberspace to facilitate their actions by combining direct attacks and through the internet network. The convergence of physical and virtual world by these terrorists has resulted in the creation of new threats called cyberterrorism. This study aims to explain what cyberterrorism is, what they do, conventions that regulate cyberterrorism, and how to deal with cyberterrorism. This study used qualitative research methods with descriptive explanations sourced from journals, books, conventions, laws and regulations and other sources relating to cyberterrorism. The result of this study explained that cyberterrorism unlawful use of information, computer systems and networks to intimidate or coerce government, civilians for political or social purposes. Constitutional Court in Facing the Industrial Revolution 4.0
Technological development has an important role and cannot be separated from the development of law throughout the world which resulted in the Industrial Revolution in countries. The Industrial Revolution developed according to its era, which began with the Industrial Revolution 1.0 to the Industrial Revolution 4.0. The Indonesian people also do not want to be left behind with the countries in the world in facing the Industrial Revolution 4.0 era, so the government strongly supports the era of the Industrial Revolution 4.0. But an important problem faced by the Indonesian people is the problem of human resources or the challenge of talent development for the Industrial Revolution 4.0, while the field needs for human resources in the fields of data scientist, coding, and software development continue to increase.
The Industrial Revolutionary Era was marked by everything digitalizing and automating. Therefore, Indonesian people must also be prepared to face this era and most importantly want to change their mindset in dealing with change, not shut down and willing to accept input or changes from outside, including the judiciary, The Supreme Court and the Constitutional Court have implemented a judicial system based on digital technology known as the Electronic Court (e-Court), namely justice services that implement the use of internet-based computer technology in providing justice services to the justice seekers community. For this reason, it is necessary to study how the Constitutional Court as a high state institution played a role in the 4.0 Industrial Revolution. The Constitutional Court and its human resources are ready to face and undergo the Industrial Revolution 4.0 by continuing to improve knowledge and skills and which are the core business of the Constitutional Court conducted with the ICT system based on Pancasila and the 1945 Constitution
Trends of Political Reporters Writing Hoax on The Online Media in South Sulawesi
This article explains about hoax trends written by online media journalists in South Sulawesi. The level of trend of political journalists writing hoaxes on online media in South Sulawesi is measured by five indicators, namely: aspects of confirmation bias, aspects of incorrect information, aspects of misleading information, aspects of incorrect connections, and aspects of satire.
This research is a quantitative study that obtained data from 28 journalists working in a variety of different online media spread in South Sulawesi. Data collection techniques were carried out using checklist sheets and literature studies. The data obtained will be analyzed using frequency distribution, simple linear regression, and the SPSS program in order to refer to a conclusion. The results of this study indicate that the trend of online media political journalists in South Sulawesi is low.
The low trend of confirmation bias, misinformation, misleading information, wrong connection and satire have implications for the results of the final accumulation, namely the trend of journalists writing lies in the low category. Political journalists in online media in South Sulawesi write news in a coherent manner with appropriate and capacity speakers in their fields. In other words, journalists do not write news by interpreting recent events as evidence of existing beliefs
Cross-cultural Communication Barrier at Southeast Sulawesi
The purpose of this research is to find out obstacles of cross-cultural communication between Chinese workers and local workers at PT. Virtue Dragon Nickel Industrial in Sulawesi Tenggara Indonesia. This study methodology uses a qualitative descriptive approach to describing social phenomena. The study depicts the social reality in which the author performs directly in the field. Samples of this study were taken by the snowball sampling method. Findings showed that cross-cultural communication barriers between Chinese workers and local workers at PT. Virtue Naga Nickel industry in southeast Sulawesi are differences in language, Nonverbal Communication, the group's likelihood and cultural differences. This paper contributes to the literacy of foreign workers and local workers in Indonesia and for the development of Science in communication sciences, especially intercultural communication
The Role of Public Relations in Crisis Management in the Social Media Era
The purposes of this study are to understand the public relations activities in the management of the public outcry against the reclamation project known as Centre Point of Indonesian (CPI) and to determine the supporting and inhibiting factors of the Makassar City public relations campaign regarding the management of the crises arising from the reclamation project. This study uses the qualitative descriptive method and the case study approach. The phenomenon was explained, and the research data was sourced through interviews, observation, and documentation. The results showed that the management of the Makassar City public relations crisis regarding the reclamation project involves identification of complaints, processing of public complaints, and adherence to standard operational procedures to improve the image and reputation of the government. This study found that the supporting factors of the public relations campaign include cultural similarity, advanced education, and social media, while the inhibiting factor is the negative perception of the government by the community. In general, this paper contributes to the research on crisis management and is a thought-provoking contribution to the development of communication science and public relations crisis management. In particular, this research is expected to contribute to the public relations management of Makassar City
Legality of The Use of Lethal Autonomous Weapon System In The International Humanitarian Law Perspectives
Abstract
International law in the world involves most international treaties as a step to limit the violations that occur. Where recently emerged new autonomous weapons. Where this weapon can choose and aim at targets without human intervention. The weapon is the Lethal Autonomous Weapon System, which, once activated, cannot isolate any of it to be attacked, whether combatants or non-combatants will even attack wherever they are regardless of the situation.
This research is legal research that aims to examine how the legality of the Lethal Autonomous Weapon System is seen from International Humanitarian Law. This paper uses a normative legal research method with a qualitative approach to descriptive data analysis. The weapon's mechanism is to defend when war is not to become an arena of unnecessary destruction and even cause casualties to civilians. There is a need for legal rules that limit or prohibit these weapons from operating. The Lethal Autonomous Weapon System is still very far away to fulfill the principles of International Humanitarian Law. It is unlikely that this weapon would be legal if there were no human intervention in its operation
