Geschlechtliche Vielfalt zwischen Transformation und Tradition
Full text linkGeschlechterrollen, -rechte und -vielfalt gehören zu den großen Polarisierungsthemen unserer Zeit. Sprache und Vorstellungen von Geschlecht befinden sich im Wandel, werden immer häufiger angefragt, stoßen auf Ablehnung. Weil Geschlechtlichkeit unsere Lebenserfahrung grundlegend prägt, können all diese Veränderungen starke Gefühle auslösen – vor allem dann, wenn sie moralisch aufgeladen werden. Der Artikel reflektiert aus einer Erfahrungsperspektive über die Spannungslinien und Herausforderungen, die sich für Kirche und Pastoraltheologie ergeben. Dafür wird ein bedürfnisorientierter Ansatz verfolgt, der versucht, Impulse für Lernräume zu geben, ohne die Prekarität der Debatte für geschlechtliche Minderheiten aus dem Blick zu verlieren.
Few topics of our time are more polarizing than the debates on gender roles, gender diversity and equal rights. The ways in which we talk about matters of sex and gender are changing rapidly, traditional and recent models alike get challenged more and more aggressively. Since gender identity is a fundamental part of the human experience, all these controversies may trigger strong emotions – especially if they are connected to moral judgement. In an experience-based approach, this chapter reflects on tensions and challenges that arise from these debates for the Church and for pastoral theology. By focusing on different needs within the debate, a point will be made for the construction of spaces “in between” that encourage learning and self-reflection without losing sight of the existential struggles of gender minorities
Bringing hidden abuse to light: Punishing sexual and reproductive abuse of adult women by priests through canon penal law
Full text linkDie Missbrauchskrise in der römisch-katholischen Kirche wird oft mit dem sexuellen Missbrauch von Minderjährigen gleichgestellt. Langsam wächst jedoch das Bewusstsein, dass sich unter den Betroffenen sexueller Gewalt auch Erwachsene befinden. Wenn die sexuelle Gewalt zu einer ungewünschten Schwangerschaft führt, erfahren weibliche Betroffene zudem reprodukiven Missbrauch. Vor diesem Hintergrund ist es das Ziel dieser Studie zu untersuchen, wie wirksam das kirchliche Strafrecht erwachsene Frauen schützt, die in der römisch-katholischen Kirche von Priestern sexuell und reprodukiv missbraucht wurden. Um diese Frage zu beantworten, wird zunächst die Prävalenz des sexuellen und reprodukiven Missbrauchs in der Kirche erfasst, bevor die Wirksamkeit des kirchlichen Strafrechts durch die Linse der europäischen Menschenrechte analysiert wird. Aufgrund des begrenzten Umfangs dieser Studie beschränkt sich diese Analyse auf die Frage, ob der sexuelle und reprodukive Missbrauch erwachsener Frauen im kirchlichen Strafrecht unter Strafe gestellt wird.The abuse crisis in the Roman Catholic Church is often equated with the sexual abuse of minors. However, there is growing awareness that adults are also among those affected by sexual violence in the Church. Furthermore, when sexual abuse leads to unwanted pregnancies, female victims also experience reproductive abuse. This study aims to explore the effectiveness of canon penal law in giving protection to adult women, who were sexually and reproductively abused by Roman Catholic priests. To answer this question, an attempt will first be made to delineate the occurrence of sexual and reproductive abuse of adult women before the effectiveness of canon penal law is analyzed through the lens of European human rights law. Due to the limited scope of this study, this analysis will be limited to the question whether the sexual and reproductive abuse of adult women is punishable under canon penal law

No full textDer Beitrag analysiert den sogenannten Eigenschaftsirrtum nach c. 1097 § 2 CIC/1983 im katholischen Kirchenrecht. Im Fokus steht die Frage, was eine „Eigenschaft“ im Sinne des Canons ist und unter welchen Voraussetzungen ihr Irrtum zur Nichtigkeit einer Ehe führen kann. Die Untersuchung umfasst kirchenrechtliche, historische und profane Perspektiven sowie die Rechtsprechung der Rota Romana und deutscher Diözesangerichte. Dabei zeigt sich: Der Begriff der „Eigenschaft“ bleibt in der Rechtsprechung und Literatur weitgehend undefiniert. Als Eigenschaften gelten dauerhaft zuordenbare Merkmale physischer, psychischer, sozialer oder moralischer Natur – sofern sie direkt und hauptsächlich angestrebt wurden.This article analyses the concept of error of quality according to c. 1097 § 2 Code/1983. It focuses on the question of what constitutes a ‘quality’ within the meaning of the canon and under what conditions an error in this regard can lead to the nullity of a marriage. The study covers canonical, historical and secular perspectives as well as the case law of the Rota Romana and German diocesan courts. It shows that the term ‘quality’ remains largely unde-fined in case law and literature. Qualities are considered to be permanently assignable characteristics of a physical, psychological, social or moral nature – provided that they were directly and primarily sought after

No full textfor the whole time i thought i belonged here. i moved through the world convinced that home was not a question i had to answer. but the older i grew, the more i realised that what stops me from fully belonging here is that my existence and identity will always be politicised. my being will always be simplified due to a symbol i wear, which will always be the first thing people notice about me. i will never be seen as the person i am — my symbol will always speak for me instead.
this simplification of my personhood deforms me. not just in how others see me, but in how i begin to see myself. the pressure to explain, to justify, to shrink myself into something legible and unthreatening, is relentless. to protect myself from being hurt, i began withdrawing. i chose isolation over exposure. i chose jobs where i could disappear. i no longer enter spaces where i might become a surface of attack. my growth contorted into survival.
out of spite, i began turning towards my roots. but even this return has been a painful experience. while reality continues here, i am stuck in the memories i made there. neither did i arrive in the reality of here — instead, i live in delusions to distract my physical being from this foreign land. countless mornings i yearn to walk the same streets my father walked when he was my age. countless nights i cried because the colonial project succeeded in tearing me away from my homeland.
the childhood there, that could have shaped me into the person i could have become, was taken from me. the most heartbreaking part is that i will never be fully able to reclaim her as my homeland. the distance has alienated me even from the place i long for. i mourn a version of myself that never had the chance to exist. my only sense of homeland is the memories, the fictions, the paintings, and the pictures i make of her. escaping into my own imaginary world becomes the way to survive the dissonance.
