Dekonstruksi Perjanjian Dalam Hukum Perkawinan Islam
No full textAbstractThis paper aims to examine the essence of the contract in marriage, the taklik divorce as an agreement, polygamy agreements as mandated in the Marriage Law and property agreements in marriage. Normatively, everything is understood based on an agreement either by using the term contract or the agreement itself. This is a literature review (library research). The data analysis method used is content analysis. The results of this study indicate that contract law norms as mandated in Article 2 KHI, basically cannot be perceived as an agreement but are "a statement of handing over of responsibility from the guardian to the prospective husband. Taklik Divorce as an integral part of the marriage/marriage series is very counterproductive to Article 1320 of the Civil Code and the principles of agreements such as the principle of consensuality and the principle of freedom of contract. Polygamy agreements are basically accommodated in laws and regulations, but in principle are very counterproductive to the principle of justice and the orientation of the marriage itself as mandated in Article 1 of the Marriage Law and further emphasized by Article 2 KHI. Property agreements in marriage are perceived to prioritize the concept of materialism in marriage and are very counterproductive to Article 1 of the Marriage Law and Article 2 of the KHI. Based on the several points above, the legal norms related to these issues should be reviewed as an effort to place marriage on its true purpose and essence.Keywords: Deconstruction, Agreement, Islamic Marriage LawAbstrak
Tulisan ini bertujuan untuk mencermati esensi akad dalam perkawinan, taklik talak sebagai sebuah perjanjian, perjanjian poligami sebagaimana yang diamanahkan dalam UU Perkawinan serta perjanjian harta dalam perkawinan. Secara normatif semuanya dipahami berbasis perjanjian baik dengan menggunakan istilah akad atau perjanjian itu sendiri. Ini adalah kajian kepustakaan (library research) Metode analisis data yang digunakan adalah content analysis. Hasil dari penelitian ini menunjukkan, bahwa norma hukum akad sebagaimana amanat Pasal 2 KHI, pada dasarnya tidaklah dapat dipersepsikan sebagai perjanjian namun merupakan “Pernyataan penyerahan tanggung jawab dari pihak wali kepada calon suami. Taklik Talak sebagai bagian integral dari rangkaian pernikahan/perkawinan sangat kontraproduktif dengan Pasal 1320 KUHperdata dan asas asas dalam perjanjian seperti asas konsensualitas dan asas kebebasan berkontrak. Perjanjinn Poligami yang pada dasarnya diakomodir dalam peraturan perundang undangan, namun pada prinsipnya sangat kontrapoduktif dengan prinsip keadilan dan orientasi dari perkawinan itu sendiri sebagaimana diamanat Pasal 1 UU Perkawinan dan dipertegas lagi dengan Pasal 2 KHI. Perjanjian harta dalam perkawinan dipersepsikan lebih mengedepankan konsep materialisme dalam perkawinan dan sangat kontraproduktif dengan Pasal 1 UU Perkawinan maupun Pasal 2 KHI. Berdasarkan beberapa point diatas seyogyanya norma hukum yang terkait dengan isu tersebut harus di tinjau ulang sebagai upaya untuk meletakkan perkawinan pada tujuan dan hakikat sesungguhnya.

Analysis of the Financial Statements of PT. Sumber Alfaria Trijaya Tbk. to Assess the Company's Performance Before and During the Covid-19 Pandemic
Get PDFThis study to assess the company’s performance financial uses a quantitative descriptive approach with the object of research on financial statements, where in this study uses four financial ratios, namely liquidity ratios, solvency ratios, profitability ratios and activity ratios for assess the company's performance. The results of the financial ratio analysis, the current ratio in 2018 was 1.15, in 2019, 1.2 and in 2020 it was 0.88. Quick ratio in 2018 was 0.50, in 2019 it was 0.55, and in 2020 it was 0.39. The debt to asset ratio in 2018 was 0.73, in 2019 it was 0.71 and in 2020 it was 0.70 while the debt to equity ratio in 2018 was 2.68, in 2019 it was 2.48 and in 2020 it was 2.40. Return on assets in 2018 was 3.0, in 2019 it was 4.7 and in 2020 it was 4.2. While the return on equity in 2018 was 11.10, in 2019 it was 16.54 and in 2020 it was 14.25 and total asset turnover in 2018 was 3.03, in 2019 it was 3.16 and in 2020 it was 3.03 and working capital growth in 2018 was 11.86, in 2019 it was 11.30 and in 2020 it was 10.44. From the results of the analysis, it shows that there is a decline in company performance during the pandemic.

This study aims to describe the types as well as the functions of illocutionary speech acts performed by characters in the animated series SFH Youtube Channel. Moreover, this study also describes the most and the least used illocutionary speech acts performed in the movie. This study uses qualitative method employing descriptive analysis design. The data sources of this research were collected by watching animated series videos from YouTube and then observing them transcribing speech acts in the video in written form. Furthermore, the data are categorized into some types of illocutionary speech acts. The result showed that there are five kinds of illocutionary speech acts which are performed in Arabic animated series "SFH Youtube Channel" which are representative, declarative, expressive, directive, and commissive

The results of the research are presented in a narrative format based on a study of various sources, including books, journals, and others. material that is relevant to the problem and subject matter regarding the experimental method. Findings from observations also revealed that the majority of children were able to show reactions such as worry, joy, curiosity, spontaneousness, and not giving up easily

No full textAlignment of education and care between Early Childhood Education institutions and families is an important factor in a child's success. Parenting activities are one of the programs run by early childhood education institutions as an effort to harmonize education and care between parents and educators. The implementation of parenting programs needs to be innovated to provide awareness and knowledge about appropriate stimulation for child development, so that there is continuity of education and care at home and in early childhood education institutions. This research examines the blended parenting program as an innovative parenting program implemented by the Istiqomah at Sambas Purbalingga. This qualitative research was conducted by interviews, observations and document searches to collect data. The proscess of data analysis is done through reduction, analysis and classification. The purpose of this research is to explore and describe the implementation of the blended parenting program conducted by the Istiqomah Sambas Purbalingga Early Childhood Education institution. The results of the research show that the blended parenting program is carried out through the stages of planning, organizing, implementing and evaluating the program. The blended parenting program provides knowledge to parents about stimulating education and proper parenting, strengthens cooperation between parents and institutions, aligns education and care at home and at institutions and realizes children's learning readiness towards basic education

Based on the results of the research that has been done, it shows that Creating Youtube Vlog Videos activities can stimulate the physical-motor development of early childhood. Because in the process of making videos that will be uploaded on YouTube, it allows children to carry out various physical motor movements and then record them in video form. Through this activity, children become excited about doing motor-physical activities because they can watch videos of the movements they have done
Tradisi Pisuke Pada Perkawinan Adat Masyarakat Lombok Perspektif Hukum Islam

This research uses qualitative methods and qualitative descriptive design. Data collection was carried out using field observation techniques, interviews, and documentation. Data analysis techniques used include data collection, data presentation, and data verification. Analysis of research data, the results of the research are as follows: 1) Pisuke tradition processes, starting to involve village heads and local traditional leaders as representatives of both parties to discuss the number of pisuke that will be distributed by the male side for the female side, in determining the number of pisuke there are certain categories that support the high or low number of pisuke, namely the education level of women and the economic level of men but things This is not absolute as a reference because it goes back to the deliberative decision of both parties in determining the number of pisuke. 2) Pisuke is a custom or habit that is carried out for generations. Pisuke is one of the customs used for the settlement of Lombok customary nikhan, although pisuke is not contained in Islamic law but pisuke has become a tradition that is considered good to be applied among the community because it does not violate nash or syara If it is related to living, in this case pisuke has no relationship at all with living because there are several points that make it cannot be equated with living, That is the gift of pisuke which is sometimes given after the contract and before the contractLombok has a wedding tradition called pisuke. Get PDFDisaster situations require new strategies that are relevant to the problem context. The Disaster Resilient Village Program (Destana) is a disaster management effort that uses a Community-Based Disaster Risk Management (PRBBK) strategy. This research aims to look at implementing the Destana program in Garon Village, Balerejo District, Madiun Regency. This research method uses descriptive qualitative, data mining techniques using in-depth interviews, observation, and documentation studies. The research results show that the implementation of the Destana program in Garon Village has not demonstrated a Community-Based Disaster Management approach, considering that there is no active participation from the community in the entire disaster management series. Community capacity in disaster management is also still not visible because there is no community organization, in this case, the community is still used as an object. The preparedness of the Garon Village community is still low in facing flood disasters, due to the lack of active community participation in the program. Thus, program managers need evaluation so that the approach used can be implemented substantively, and community capacity can be increased in dealing with disaster situations.

An Art-Historical Analysis of Selected Sacred Sufi Paintings in Kano, Nigeria
Get PDF‘Iconoclasm’, which may simply be defined as the destruction of artworks as a result of hatred towards them is a common phenomenon in all the three major Abrahamic desert religions; Judaism, Christianity and Islam. Because Islam frowns at representational art, especially sculptures in the round, many Muslim artists pursue and develop their creativity in the elegant Arabic calligraphic embellishments used to adorn the walls of mosques, palaces and the covers of Islamic books. However, despite the growing nature of iconoclasm amongst mainstream Muslims, the Sufis see no harm in visually and artistically representing their saints and hermits as a way to honour them and seek their barakah (blessings). It is on this basis that this paper examines selected sacred Sufi paintings of Kano, Nigeria. Relying heavily on oral interviews and written sources this paper traces the historical development of sacred Sufi paintings in Kano, Nigeria, focusing largely on the art historical appreciation and contextualization of such paintings. The paper also found out that despite the importance of sacred Sufi paintings in the reconstruction of history, they receive little or no scholarly attention.
 
Reading Tradition in Informative and Symbolic Theory: The Case of Robo-Robo Tradition in Nuguk Hamlet, Melawi District, West Kalimantan
Get PDFResearch on the Robo-robo tradition of Nuguk hamlet has never been done by researchers. Therefore, this research is important to be conducted. This research is a type of field research with a narrative-analytic method and uses anthropo-sociological theory as a framework for analysis. The research locus is Nuguk hamlet, Melawi district, West Kalimantan. The conclusions of this article are: First, the implementation of the Robo-robo tradition in Nuguk hamlet, is quite different from the implementation in other places, both in the means, processions, and prayers that are read in the tradition. Second, historically-archeologically, the rising of the Robo-robo tradition in Nuguk hamlet was inspired by information from the texts of the Qur’an that were understood by the community. Third, in the construction of the symbolic interpretation theory, there are several meanings or receptions by the Nuguk hamlet community regarding the implementation of the Robo-robo tradition, both in the procession, the ingredients, and the prayers in it
