第1条（名称）本会は大谷大学西洋文学研究会と称する。 
第2条（目的）本会は欧米の文学・文化の研究と発表とを行い、それら各分野の交流を
図り学会に寄与することを目的とする。 
第3条（事業）本会は次の事業を行う。 
1 会誌「西洋文学研究」の発行 
2 その他必要な事業
第4条（会員）本会には正会員、準会員、名誉会員をおく。 
1 正会員は、大谷大学の欧米文学・文化各分野に属する教員及び任期
制助教とする。退職後は、本人の希望と総会出席者の二分の一以上
の賛成とをもって、正会員、準会員、もしくは名誉会員として本会
に留まることができる。 
2 本会に入会を希望し、総会出席者の二分の一以上の同意を得た者は、 
準会貝となることができる。但し総会の議決には加わらないものと
する。 
3 満65歳以上の正会員は、総会出席者の二分の一以上の賛成による承
認後、2年分の会費相当額を支払うことで名誉会員（終身）になるこ
とができる。但し総会の議決には加わらないものとする。また、学
会誌に投稿する場合は所定の投稿料を支払うものとする。 
第5条（役員）本会に次の役員をおく。 
1 会長1名、学会委員若干名とする。 
2 会長は本会を代表し、運営における責任を負う。 
3 学会委員は委員会を組織し、総会の決議に従い本会の運営にあたる。 
4 役員の任期は2年とし再任を妨げない。 
第6条（総会） 
1 総会では次の事項を審議しこれを議決する。 
イ 会長・学会委員の選出
ロ 予算及び決算
ハ 事業方針
ニ その他必要な事項 
2 総会は会長がこれを招集し、会員の二分の一以上をもって成立する。 
第7条（経費）本会の経費は会費及びその他の収入をもってこれに充てる。2年間会費
納入のなかった会員は自動的に退会したものとみなす。ただし退会した
のち会費納入の上、会員に復帰することができる。 
第8条（会計報告）各年度の会計は総会においてこれを報告し承認を要する。 
第9条（所在地）本会の所在地は「京都市北区小山上総町22大谷大学内」 とする。 
第10条（会則の変更）本会則の変更は総会において出席者の二分の一以上の同意を必要
とする。 
付則1 本会則は昭和61年4月1日より施行する。

Abstract
Since the 1990s, the concept of traditional knowledge (TK) has been gaining
popularity in global intellectual property systems for plant genetic resources. The
concept is that when creating medicines or products with physiological benefits
based on TK, mainly held by indigenous peoples around the world, those
identified as holders of the TK can claim a series of rights, such as ‘prior
informed consent’, ‘mutual agreement’, and ‘royalty payment’. Beginning with
the 1992 Convention on Biological Diversity (CBD) , followed by the 2001
International Treaty on Plant Genetic Resources for Food and Agriculture
(ITPGR) and the 2010 Nagoya Protocol, the concept has been stipulated as a
basis for recognition of indigenous peoples’ rights.
An example to which this paper refers is the establishment of a benefit-
sharing system for the commercial exploitation of rooibos in South Africa: in
2019, an agreement was signed among the South African government and the
indigenous Khoisan groups, a rooibos growers’ association run mainly by
Afrikaner companies. Based on the agreement, an annual levy of 1.5% of the
farm gate price of rooibos is to be delivered by the rooibos producers to a
government trust fund, which would then be transferred to the Khoisan
organization.
However, compared to the traditional concept of intellectual property rights,

the TK concept leaves a number of ambiguities, such as the scope of ownership
and the duration of the rights. Why, then, has the concept of TK, which has so
many ambiguous points, been institutionalized as a global norm in recent years?
What background and context can be recognised for this change? Through
answering these questions, this paper will shed light on the contemporary nature
of the concept of TK.
In previous studies, the institutionalization of the TK concept has tended to
be discussed in terms of North-South issues or postcolonial politics, which reflect
political tensions between developed and developing countries. In contrast, this
paper takes a different angle. In particular, regarding the epistemological
peculiarity of TK on the use of plant genetic resources, this paper focuses on ‘the
fact that the subject of the rights is an aggregation whose extension of the
elements cannot be determined’ and the ‘entities to whom intellectual property
rights are granted are increasingly recognized as improvers, stewards, and
innovators’ rather than inventors as envisioned by industrial patents. These are
very different from the modern institutional criteria for recognizing the concept of
creativity. This paper suggests that these are not only the result of international
political trends in the late 20th century, against the backdrop of the North-South
conflict, but also the result of contemporary epistemological changes regarding
the concept of creativity, which are being reflected in the transformation of global
intellectual property systems.
