    KEDUDUKAN KREDITOR ASING PEMEGANG CESSIE DALAM PROSES PKPU DAN KEPAILITAN DI INDOENSIA: PERSPEKTIF KEADILAN DAN NEGARA BERDAULAT: The Position of Foreign Creditors Holding Cessie in PKPU and Bankruptcy Process in Indonesia: Perspective of Justice and Sovereign State

    The development of bankruptcy and PKPU law in Indonesia demonstrates the complexity in regulating creditors\u27 rights, particularly foreign creditors holding cessie (assignment of claims). Cessie transactions often involve cross-border elements, which complicate debt settlement for debtors undergoing PKPU or bankruptcy proceedings. Several cases, such as PT Visi Media Asia Tbk (VIVA) suing foreign creditors, highlight challenges related to the recognition of foreign creditors\u27 rights in PKPU processes. Furthermore, Indonesian legal provisions, such as restrictions on foreign ownership of land, exacerbate the recognition of foreign creditors in the assignment of receivables. The author defines two key research questions: First, the position of foreign creditors holding cessie in the PKPU and bankruptcy processes in Indonesia, in relation to the principle of state sovereignty in regulating debt payment obligations involving foreign parties; and second, whether the existing regulations in Indonesia\u27s PKPU and bankruptcy processes concerning cessie holders can provide legal certainty and fairness for foreign creditors. This study employs a normative legal research approach, in which the author examines relevant legal concepts and regulations, and analyzes books, journals, and other necessary documents. The research findings and conclusions indicate that within Indonesia’s legal system, bankruptcy and PKPU are mechanisms designed to settle debtors\u27 debts fairly and proportionally, under the supervision of judges and curators. Cessie, as the transfer of claims between creditors, plays an important role in this process, even though it is not explicitly regulated in the Bankruptcy and PKPU Law. While the assignment of receivables can be carried out without the debtor\u27s consent, it still affects the debtor\u27s obligations and the creditors\u27 rights. Moreover, the involvement of foreign creditors in PKPU and bankruptcy processes presents challenges, especially regarding cross-border insolvency and international legal recognition. Therefore, Indonesia needs to clarify legal mechanisms that accommodate the rights of foreign creditors, ensure equal protection for both domestic and foreign creditors, and avoid legal uncertainty through the harmonization of national regulations with international law

    Implementation Of Gestalt Principles In Designing Textile Motifs Inspired By The Figure Of Dewi Wara Srikandi. In the era of today\u27s modern world, there are many western film worlds that carry heroic stories from figures, such as Superman, Wonder Woman, Spiderman and many more. It is because of this that these western world heroic figures have become popular, especially among today\u27s younger generation, which in the end have been used as inspiration for goods for daily needs into fashion products. Because of this, the author had the idea to make fashion products that brought back local cultural values ​​originating from the story of patriotism in the Indonesian Wayang Purwa world. Apart from that, there are also many heroic stories that are often forgotten by today\u27s millennials, which still have the essence of teaching the values ​​of norms and there is an eastern Indonesian nation. One of the characters who has characteristics and a patriotic attitude that deserves to be reappointed is the figure of Dewi Wara Srikandi. Likewise, to be able to take part in the preservation of Wayang culture as a heritage of world masterpieces in the form of a shadow puppet show with original speech from Indonesian culture and has been crowned by UNESCO in 2003. By bringing up stories from the figure of Dewi Wara Srikandi, the writer hoped to rejuvenate Indonesian wayang stories and accept the essential values ​​and cultural characteristics embedded in the stories related to these characters and pass on the values ​​contained in them to the next generation. This research is also expected to produce an innovative textile motif by implementing Gestalt theory as the foundation of the creative idea through the arrangement of motifs, colors, and proportions of visual elements, while still preserving key principles of the Wayang Purwa culture, which is rich in and closely tied to Indonesian cultural identity. The creation of motif designs refers to the principles of Gestalt theory and is implemented in the form of fashion design that incorporates the essential anatomy of clothing creation—while maintaining comfort and wearability for special occasions as key elements. The method involves literature studies and structured in-depth interviews with expert panelists to explore the essence, characteristics, and cultural values embodied in the story of the character Dewi Wara Srikandi. The outcome is a conceptual design of textile motifs inspired by this figure

    ANALISIS GARIS SEMPADAN BANGUNAN PADA BANGUNAN BERTINGKAT: Analysis of Building Boundary Lines in Multi-Storey Buildings

    Many multi-storey buildings in the Special Capital Region of Jakarta have been constructed in violation of building setback lines, resulting in conflicts with surrounding communities. The issues examined in this study are: how is the regulation of building setback lines for multi-storey buildings in Jakarta governed under Regional Regulation Number 7 of 2010, Regional Regulation Number 1 of 2014, and Governor Regulation Number 128 of 2012? and what measures have been taken by the Provincial Government of Jakarta to address violations of these setback line regulations? The legal research method used is normative juridical research with a descriptive approach, relying on secondary data analyzed qualitatively. Based on the discussion, it is concluded that non-compliance with building setback lines in multi-storey buildings in Jakarta has led to conflicts that negatively affect the surrounding communities. The provisions set forth in Regional Regulation Number 7 of 2010, Regional Regulation Number 1 of 2014, and Governor Regulation Number 128 of 2012 have not been effectively enforced. Therefore, enhanced legal enforcement efforts, oversight, and coordination among relevant stakeholders are required to halt ongoing violations and prevent further losses

    PT. Bank Perkreditan Rakyat Puskopat Palembang entered into a credit agreement with a debtor without optimally applying the 5C analysis principle as mandated by banking regulations. This gives rise to legal issues, particularly regarding negligence in collateral procedures and violations of regulations on the registration of security rights. The issues examined in this study are: how is the application of the 5C analysis principle in the credit agreement between PT. BPR Puskopat Palembang and the debtor based on Decision Number 90/Pdt.G/2021/PN Plg? and what are the legal consequences of failing to apply the 5C analysis principle in the said credit agreement? The legal research method employed is normative juridical research with a descriptive approach. It is concluded that there is no implementation of the 5C analysis principle in accordance with banking regulations, particularly in the matter of collateral, due to the absence of an adequate standard operating procedure for credit agreements.     Identification Of The Role Of Bamboo Plants As Riverbank Protection: A Case Study In The Krueng Meuh Watershed

    The problem of riverbank degradation due to erosion and landslides is an important problem in river basin management, especially in the Krueng Meuh Sub-watershed. Bamboo plants have a strong root system and a dense clump structure, so they have great potential in soil and air conservation on riverbanks. This study aims to identify the types of bamboo that grow on riverbanks and analyze their role in riverbank conservation in the Krueng Meuh Sub-watershed. This study is a descriptive exploratory study by exploring the riverbank along 50 meters from the left and right banks of the river. The methods used include direct observation of bamboo morphology, collection of plant characteristic data, and assessment of conservation potential based on clump density and root system strength. The results of the study found five types of bamboo in the Krueng Meuh Sub-watershed, namely Duri Bamboo (Bambusa bluemeana), Talang Bamboo (Schizostachyum Brachcladum), Betung Bamboo (Dendrocalamus asper), Ampel Bamboo (Bambusa vulgaris), and Regen Bamboo (Gigantochloa pruriens). Each species has different morphological characteristics and root systems, and contributes to the stability of riverbanks. The bamboo species with the highest potential in protecting riverbanks are Dendrocalamus asper and Schizostachyum Brachcladum based on root strength and clump density. In conclusion, betung bamboo and talang bamboo have the highest effectiveness in protecting riverbanks due to their deep roots and dense clump structure. Riverbank vegetation management by considering local bamboo species can be an effective and sustainable conservation strategy

    Penelitian ini di latarbelakangi adanya perubahan era digital saat ini, pengaruh ulasan pelanggan online dan dukungan selebriti menjadi faktor penting dalam membentuk persepsi konsumen terhadap merek dan produk tata rias. Konsumen cenderung mempercayai ulasan dari konsumen lain dan dukungan dari selebriti karena dianggap autentik dan memberikan wawasan yang berharga terhadap produk. Sehingga  dapat dirumuskan bagaimana opini pelanggan online dan dukungan selebriti memengaruhi niat pembelian konsumen muda di sektor tata rias. Tujuan penelitian ini adalah untuk menganalisis pengaruh celebrity influencer’s credibility, celebrity influencer’s attractiveness, online customer riview, influencer’s ads, attitude, terhadap purchase intention pada produk tata rias. Penelitian ini mengandalkan data numerik. Peneliti menggunakan platform Google Form untuk mendistribusikan kuesioner dan mengumpulkan data. peneliti menggunakan teknik convenience sampling untuk penelitian ini. Penduduk wilayah JABODETABEK yang menggunakan atau membeli kosmetik merupakan 210 dari peserta dalam penelitian ini. Theory of Planned Behavior (TPB) adalah kerangka teoritis yang digunakan dalam penelitian ini. Pendapat konsumen terhadap barang dan legitimasi influencer selebriti secara signifikan memengaruhi niat beli mereka, menurut temuan penelitian. Persepsi pelanggan tentang barang dan keinginan mereka untuk membelinya keduanya dipengaruhi oleh legitimasi selebriti yang mendukungnya. Profesional di sektor kosmetik dapat mengambil manfaat dari pemahaman yang lebih baik tentang perilaku pelanggan jika hasil ini digunakan untuk pengembangan strategi pemasaran

    Strategi positioning merek merupakan faktor krusial dalam keberhasilan merek olahraga di pasar yang kompetitif seperti Indonesia, seiring dengan meningkatnya kesadaran masyarakat akan gaya hidup sehat. Penelitian ini bertujuan untuk menganalisis dan mengevaluasi strategi positioning yang diterapkan oleh beberapa sport brand di Indonesia, termasuk Nike, Adidas, Puma, Skechers, dan New Balance. Penelitian ini menggunakan pendekatan kuantitatif deskriptif dengan metode survei melalui kuesioner terstruktur kepada 154 responden yang pernah membeli dan menggunakan sport brand di Indonesia. Data dianalisis menggunakan metode pendekatan atribut (attribute-based approach) dengan analisis diskriminan untuk memahami perbedaan antar brand berdasarkan atribut-atribut tertentu. Hasil penelitian menunjukkan bahwa atribut "Desain" dan "Variasi" adalah yang paling penting bagi konsumen. Nike unggul dalam "Variasi" dan "Ketersediaan" , Adidas menonjol dalam "Desain" dan "Kualitas" , Skechers unggul dalam "Harga" dan "Daya Tahan" , dan Puma unggul dalam "Kenyamanan". New Balance menunjukkan kinerja yang baik dalam "Kualitas" dan "Ketersediaan"

    This study aims to examine the legal reasoning in Supreme Court Decision Number 465K/Pdt.Sus-HKI/2023 concerning the use of evidence in a trademark dispute. The main focus is to assess whether the evidentiary process aligns with the provisions of the Indonesian Civil Procedure Code (HIR/RBG), and to analyze the legal consequences of trademark protection granted to the prevailing party in cases where the judicial reasoning does not fully satisfy the procedural standards of evidence. This normative juridical research employs a qualitative approach, utilizing both primary and secondary legal sources analyzed descriptively. The identification of the issue in this study lies in the procedural inadequacy of trademark certificates submitted as legal evidence. Based on the findings and conclusion, it is concluded that in Decision Number 465K/Pdt.Sus-HKI/2023, Mohindar H.B, as the registered trademark holder of Number 173934 "Polobyralphlauren" along with the horse-riding logo, retains legal protection despite the certificate failing to meet formal evidentiary standards. The Supreme Court’s rejection of the cassation filed by PT. Polo Ralph Lauren Indonesia further strengthened Mohindar H.B\u27s legal standing as the legitimate trademark holder

    Sexual violence against children, particularly in the form of forced sexual intercourse, is a critical issue worldwide, as perpetrators of such crimes are often individuals close to the child victim, such as family members. The identification problem discusses the legal provisions that should be applied in cases where the child is the victim and a family member is the perpetrator, as well as the appropriate sentencing measures to address similar issues. The research employs a descriptive normative approach, using secondary data which is processed qualitatively through deductive reasoning. The result and conclusion of the study indicate that the imposition of an 8-year prison sentence does not align with the objectives of criminal punishment, as there should have been an aggravated sentence with an additional one-third of the primary sentence, considering that the perpetrator had a familial relationship with the child victim
