Saint Jerome, Praefatio in libro Iosue (translation into Polish)
Około 390 r. św. Hieronim zarzucił pracę nad tłumaczeniem greckiej Septuaginty na łacinę i zaczął przekładać tekst Starego Testamentu – jak sam wielokrotnie mówi – bezpośrednio z języka hebrajskiego. Z zapewnień samego Hieronima wynika jednoznacznie, że w tej pracy translatorskiej kieruje się ‘hebrajską prawdą’ (Hebraica veritas) i podaje, że chodzi o hebrajski oryginał, a nie greckie tłumaczenia heksaplarne oparte o hebrajski tekst Biblii. Hieronim odchodzi więc od Septuaginty na rzecz sensu, który niesie za sobą znany w jego czasach tekst hebrajski. Robi to, jak zapewnia, dzięki znajomości języka hebrajskiego i w odniesieniu do tekstu hebrajskiego, na którym bazuje jego przekład Starego Testamentu. Po śmierci Pauli Rzymianki, przyjaciółki św. Hieronima, przetłumaczył Strydończyk księgi Jozuego, Sędziów i Rut. Miało to miejsce ok. 404/405 r., a więc pod koniec jego pracy nad przekładem z hebrajskiego. Niniejszy artykuł prezentuje tłumaczenie krótkiego pisma, które betlejemski mnich dołączył do przekładu trzech ostatnich ksiąg Oktateuchu, a które znane jest jako Praefatio in libro Iosue. Przekład jest poprzedzony wstępem, który wprowadza w problemy, na jakie napotykamy podczas lektury tego Hieronimowego opusculum.
Around the year 390, St Jerome abandoned his work on translating the Greek Septuagint into Latin and began rendering the Old Testament – as he repeatedly claims – directly from the Hebrew. His own statements make it abundantly clear that in this translational endeavour he is guided by the principle of the Hebraica veritas (“Hebrew truth”), and that he refers to the Hebrew original rather than to the Greek Hexaplaric versions based on the Hebrew Bible. Jerome thus departs from the Septuagint in favour of the meaning conveyed by the Hebrew text known in his time. As he himself affirms, he is able to do so thanks to his knowledge of Hebrew and with reference to the Hebrew source text, on which his Latin translation of the Old Testament is based. After the death of Paula of Rome, his close companion, Jerome of Stridon translated the books of Joshua, Judges, and Ruth – a task he undertook around 404/405, toward the end of his work on the Hebrew Bible. The present article offers a translation of a short text which the Bethlehem monk attached to his Latin version of the last three books of the Octateuch, and which has come down to us under the title Praefatio in libro Iosue. The translation is preceded by an introduction that outlines the interpretative issues encountered in reading this opusculum by Jerome, as well as by a description of the manuscript fragment containing the oldest extant copy of the text preserved in Polish collections
Media Competencies in the Communication of Faith in Pope Francis' Messages for World Communications Day (2014–2025). Part One: Cognitive and Ethical Competencies
The article offers partial results of research on media competencies in the communication of faith, reconstructed on the basis of Pope Francis’ Messages for the World Communications Day (2014–2025). The research problem focuses on identifying the competencies deemed essential for the Christian proclamation within the digital culture and on analysing their theological and anthropological grounds in the face of such contemporary challenges as disinformation, social polarisation, and the development of artificial intelligence. A three-stage qualitative content analysis (exploration— categorisation—interpretation) was supported by contextual validation through comparison with the relevant literature and the teaching of the Church. The analysis helped to define five equivalent categories of media competencies: cognitive, ethical, relational, technical, and spiritual (each with four subcategories). This article discusses the first two of them, i.e. cognitive competencies (related to the search for truth, critical discernment, and reflection) and ethical competencies (responsibility, the culture of encounter, the ethics of technology, resistance to disinformation). Their mutual complementarity and deep grounding in Christian anthropology and Francis’ theology of communication were demonstrated. The messages show communication of the faith as an act of love, witness, and community-building, in which cognition and ethics constitute two inseparable dimensions of the mature presence of Christians in the media. The article concludes with seven findings and formative recommendations for media education and pastoral ministry in the context of digital culture. Los principales testimonios patrísticos presuponen que Tomás toca el cuerpo de Cristo para verificar la realidad de la resurrección a pesar de que en el texto joánico no se hace alusión a contacto alguno por parte del discípulo. Sin necesidad de alterar el relato original, Hilario de Poitiers no atribuye al apóstol una acción no atestiguada en el Cuarto Evangelio al tiempo que subraya el hecho de que el Hijo se adapta a la debilidad de la naturaleza humana con el fin de proporcionar una respuesta a los incrédulos. Así, el motivo de la duda de Tomás se convierte en una reflexión sobre el efecto transformador del milagro y la función soteriológica de la fe.
The main patristic witnesses assume that Thomas touched the body of Christ in order to verify the truth of his resurrection, even though this contact by the disciple is not stated in the Johannine account. By refusing to alter the original account, Hilary of Poitiers does not attributed an action that is not documented by the Gospel to the apostle and highlights the fact that the Son adapts to the weakness of man’s intelligence, providing an answer to unbelievers using the motif of doubting Thomas to reflect on the transformative effect of miracles and the soteriological function of faith
Basic Anthropological Concepts in the Macarian Corpus
The study analyzes the Macarian corpus of homilies from an anthropological perspective. As the author of these parenetic discourses relies on imagery rather than on terminology, his vocabulary is highly unsystematic. The aim of this article is to highlight the key anthropological concepts of the Macarian corpus and elucidate their meaning. The article consists of three parts: the first explores the Macarian use of anthropological terms such as body, soul, mind, and heart; the second focuses on the interrelation of these concepts, and the third considers the type of anthropology the author of the corpus developed. The analysis is based on the three main Greek collections: I (63 logoi), II (50 homilies), and III (43 discourses). It shows that the meanings of basic anthropological terms are blurred and cannot be determined by definition, but only through context. While their different aspects and nuances are revealed in their interplay, Macarian anthropology should be seen as a holistic one, in which basic anthropological terms usually imply the whole person. The study has also revealed the incomplete character of Macarian anthropology

Wyzwania, trudności i dokonania Komisji Kodyfikacyjnej Rzeczypospolitej Polskiej (1919–1939) w obrębie prawa spadkowego
The objective of this article is twofold: first, to examine the challenges and difficulties encountered by the Codification Commission of the Republic of Poland during its work on succession law; and, second, to present the Commission’s accomplishments in this domain. The article offers a comprehensive analysis of the principal assumptions advanced by individual rapporteurs on succession law, taking into account their proposed amendments. This approach enables a concise identification of the areas in which the Commission’s work was undertaken, as well as those whose outcomes proved particularly significant from the perspective of post-war codification efforts.
Celem niniejszego artykułu jest, po pierwsze, przeanalizowanie wyzwań i trudności, z jakimi borykała się Komisja Kodyfikacyjna Rzeczypospolitej Polskiej podczas prac nad prawem spadkowym, a po drugie przedstawienie osiągnięć Komisji w tej dziedzinie. Artykuł zawiera kompleksową analizę głównych założeń przedstawionych przez poszczególnych sprawozdawców w zakresie prawa spadkowego, z uwzględnieniem proponowanych przez nich zmian. Takie podejście pozwala na zwięzłe określenie obszarów, w których Komisja podjęła prace, a także tych, których wyniki okazały się szczególnie istotne z punktu widzenia powojennych wysiłków kodyfikacyjnych
Legal Features of Children's Rights and Duties During Armed Conflict: The Ukrainian Case
It is universally recognized that children are the most vulnerable and unprotected category of civilians. Moreover, when it comes to the period of any armed conflict. The twientieth century is the Century of the Child. The international community’s actions, which were reflected in the adoption of a numer of international legal treaties establishing the legal status of the child in general and securing the rights of each child, are evidence of this. The rights of a child are one of the key elements of the legal construct of the legal status of a child. This article analyzes children’s rights both during the peaceful period and during the armed conflict. The article examines a numer of international legal treaties which enshrine children’s rights during armed conflict. Conventional wisdom does not refer to children’s duties. However, the period of armed conflict is fundamentally opposite to the peaceful period of the State’s existence. During an armed conflict, it is not alway spossible to fulfill children’s rights. On the contrary, this period is marked by increased risks to children’s lives and health. Moreover, it is necessary to take into account the nature og contemporary armed conflicts (their methods and means). Te period of armed conflict produces new rules of behawior (which may be restrictive) that are intended to maximize the life and health of each child. The behavioral rules form a numer of duties that are collective in nature (their fulfillment is entrusted to the children’s legal representatives, public administration bodies, and children themselves with due regard to their age). Based on the Ukrainian case study, the author analyzes a numer of duties arising during an armed conflict, and the fulfillment of which is entrusted to several actors, including children. During the course of writing the article, the author used the method of document analysis. First of all, the researcher analyzed international legal acts related to the topic of the study. The second level of legal acts that were analyzed were Ukrainian legal acts depending on their legal force. Simultaneously with the anaysis of regulatory acts, the author reviewed the academic literaturę that formed the scientific basis of this study. This helped to analyze the children’s rights and duties during armed conflicts. The scientific basis of the study is based on scientific publications in the field of children’s rights in general. The author used a systematic proces during the writing of the article, involving reading, identifying specific provisions, and categorizing information. The generalization method was applied on the basis of the comparison, which helped to formulate the relevant conclusions to the article

The article is devoted to the issues related to the supervision of court enforcement officers’ activities, in particular judicial and administrative supervision, and the interrelationship between these types of supervision. The protection of the rights of participants in enforcement proceedings within the framework of substantive supervision is possible not only thanks to appropriate appeal measures, but also thanks to the introduction of permanent judicial supervision exercised ex officio, referred to in Article 759 § 2 of the Code of Civil Procedure. The powers of the president of the regional court at which the enforcement officer operates – within the framework of administrative supervision include, among others, notifying the court of the need to issue orders to the court enforcement officer under Article 759 § 2 of the Code of Civil Procedure, as well as examining the correctness of the implementation of court orders issued under Article 759 § 2 of the Code of Civil Procedure. Therefore, even a cursory analysis of the provisions regulating the institution of supervision over the activities of court enforcement officers leads to the conclusion that judicial and extrajudicial supervisory measures may overlap. Nevertheless, it is necessary to set a boundary preventing administrative supervision from interfering with the activities falling within the scope of judicial supervision. The considerations presented in this article are based on M. Dziewulska’s monograph concerning this issue.
Artykuł jest poświęcony problematyce związanej z nadzorem nad działalnością komorników sądowych, w szczególności z nadzorem judykacyjnym i nadzorem administracyjnym, oraz kwestią wzajemnych powiązań między wymienionymi rodzajami nadzoru. Ochrona praw uczestników postępowania egzekucyjnego w ramach nadzoru merytorycznego jest możliwa nie tylko dzięki stosownym środkom zaskarżenia, lecz także dzięki wprowadzeniu stałego nadzoru sądowego sprawowanego z urzędu, o którym mowa w art. 759 § 2 k.p.c. Uprawnienia prezesa sądu rejonowego, przy którym komornik działa – w ramach nadzoru administracyjnego – obejmują m.in. zawiadamianie sądu o potrzebie wydania komornikowi zarządzeń w trybie art. 759 § 2 k.p.c., jak i badanie prawidłowości realizacji zarządzeń sądu wydanych w trybie art. 759 § 2 k.p.c. Już zatem nawet pobieżna analiza przepisów regulujących instytucję nadzoru nad działalnością komorników sądowych prowadzi do wniosku, że środki nadzoru judykacyjnego i pozajudykacyjnego mogą się ze sobą krzyżować. Celem artykułu jest odpowiedź na pytanie o możliwość wyznaczenia granicy, która przeciwdziałałaby wkroczeniu nadzoru administracyjnego w działania wchodzące w zakres nadzoru judykacyjnego. O prawie oskarżonego do obrońcy w rzymskim procesie karnym
This article is dedicated to the issue of the defendant's right to appoint a defense attorney in a Roman criminal trial. The purpose of this publication was to show how the ancient Romans understood the most important procedural right of the accused, i.e. the right to appoint a defense attorney, and especially to answer such detailed questions as when such a right was granted to him, i.e. at what stage of the criminal process he could use it. Furthermore, did we also deal with compulsory defense in the Roman criminal proces. Finally, the purpose of this study will also be to show what changes have occurred in the discussed issue in the historical development of the Roman criminal process (between the ordinary and extraordinary process), and what were the reasons for these changes. The studies presented in this paper were conducted using the historical-legal method, but the dogmatic-legal method was used in parallel. As shown in the proceedings before the quaestiones perpetuae, the praetor was obligated to appoint a defender for the accused if the latter could not find one himself and requested it, but only when the reus became a party to the process, i.e. when the so-called inscriptio inter reos took place. The defendant's right to appoint a defense attorney, as shown, became a universal procedural guarantee in the criminal cognition procedure, and during the period of the Dominate, it was transformed into universal compulsory defense. Furthermore, as shown, the reasons for these changes were dictated by the fact that in the criminal cognition procedure, the jurisdictional body deciding the case was finally equipped with the right of evidence initiative, and the fact that the defendant's right to appoint a defense attorney was transformed into a universal "legal" obligation during the post-classical period, as proven, should be treated as a manifestation of the phenomenon of unifying the rules and principles of the criminal cognition procedure during the post-classical period, but also as a manifestation of strengthening the procedural guarantees of the defendant.
Niniejszy artykuł został poświęcony zagadnieniu prawa oskarżonego do ustanowienia obrońcy w rzymskim procesie karnym. Celem publikacji jest ukazanie, jak starożytni Rzymianie rozumieli najważniejsze obecnie uprawnienie procesowe oskarżonego, czyli prawo do ustanowienia obrońcy, a zwłaszcza udzielenie odpowiedzi na tak szczegółowe kwestie, jak m.in. kiedy takie prawo mu przysługiwało, mianowicie na jakim etapie procesu karnego oskarżony mógł z niego skorzystać, a także czy rzymski proces karny znał instytucję obrony obligatoryjnej. Celem niniejszego opracowania jest również ukazanie, jakie zmiany zaszły w zakresie omawianego zagadnienia w historycznym rozwoju rzymskiego procesu karnego (pomiędzy procesem zwyczajnym a nadzwyczajnym) i jakie były przyczyny owych przemian. Przedstawione w niniejszym opracowaniu badania zostały przeprowadzone przy wykorzystaniu metody historyczno-prawnej, niemniej drugą, zastosowaną równolegle, była metoda dogmatyczno-prawna. W postępowaniu przed quaestiones perpetuae pretor miał obowiązek ustanowienia obrońcy na rzecz oskarżonego, jeżeli ten ostatni nie mógł sam go sobie znaleźć i zażądałby tego, ale dopiero wówczas, kiedy reus stał się stroną procesu, czyli kiedy miało miejsce tzw. inscriptio inter reos. Prawo oskarżonego do ustanowienia obrońcy stało się zaś jego powszechną gwarancją procesową w kognicyjnym procesie karnym, a w okresie dominatu zostało przekształcone w powszechny przymus obrończy. Ponadto przyczyny tych zmian były podyktowane faktem, iż w kognicyjnym procesie karnym organ jurysdykcyjny rozstrzygający sprawę został w końcu wyposażony w prawo inicjatywy dowodowej. Z kolei fakt przekształcenia prawa oskarżonego do ustanowienia obrońcy w powszechny przymus „adwokacki” w okresie poklasycznym należy potraktować jako przejaw postępującego w okresie poklasycznym zjawiska ujednolicania reguł i zasad kognicyjnego procesu karnego, ale również jako przejaw wzmacniania gwarancji procesowych oskarżonego
