Plato\u27s Justice in Business Law: A Study from the Perspective of Legal Philosophy

    Get PDF
This article aims to explore the concept of justice according to Plato and how its application can be relevant in the context of business law. In his philosophical works, especially in the Republic, Plato describes justice as a condition in which each individual carries out his role in a way that is appropriate to his abilities and characteristics. According to Plato, justice is achieved when each part of society performs its proper function without interfering with each other, which can also be adapted to the business world which has complex social and economic dynamics. In the context of business law, justice can be understood as an effort to ensure that all business actors, whether large companies or small businesses, are treated fairly and given balanced rights and obligations. The application of Plato\u27s principles of justice in business law can involve rules that encourage ethical behavior, fair distribution of resources, and protection of the interests of weaker parties, such as consumers and workers. Business law must ensure that economic activity does not only benefit a few parties, but also creates balance and justice for all parties involved. For example, regulations regarding business competition (anti-monopoly) aim to prevent the domination of one party which can harm other parties, thereby creating harmony in the market. Through a legal philosophy approach, this study will analyze the relevance of Plato\u27s ideas of justice in creating legal regulations that are not only profitable for big business actors, but also provide social and economic justice to society as a whole. Thus, Plato\u27s concept of justice can be a strong basis for designing fair and sustainable business laws. examines Plato\u27s concept of justice and its relevance in business law from the perspective of legal philosophy. Through this approach, we will explore how Plato\u27s principles of justice, such as justice as harmony, distributive justice, and justice as virtue, can be applied in the context of modern busines

    Get PDF
This study aims to analyze the legal status and authority of Kompolnas within Indonesia’s constitutional law system and to evaluate the effectiveness of its role in protecting and ensuring the respect of human rights in police practices. The research employs normative legal methods with a conceptual approach. Primary, secondary, and tertiary legal materials were collected and analyzed using a descriptive-analytical method to understand Kompolnas’ position within the framework of constitutional law and human rights protection principles. The findings indicate that while Kompolnas holds a significant normative position as a manifestation of the principle of checks and balances in a constitutional state, its functional role remains weak because its authority is merely recommendatory. In terms of human rights protection, Kompolnas has yet to achieve full effectiveness, as its role appears more symbolic than substantive. The originality of this research lies in its integrative analysis combining constitutional law and human rights perspectives, emphasizing the necessity of regulatory reform to strengthen Kompolnas’ authority. These findings provide an important contribution to reinforcing external oversight of the police to ensure accountability and the protection of human rights

The digital era has brought both new opportunities and challenges for da\u27wah activities. The rapid development of information technology facilitates the dissemination of da\u27wah messages, but at the same time, it has also given rise to a proliferation of disinformation and hoaxes that have the potential to mislead the public. This paper aims to analyze the challenges of da\u27wah amidst the rapid flow of information that is not always valid, and to formulate relevant strategies for da\u27wah (Islamic preachers) in dealing with this situation. Using a qualitative approach based on a literature review, the research results show that hoaxes not only obscure the truth but can also weaken the moral authority of da\u27wah and divide the community. Da\u27wah in the era of disinformation and hoaxes faces complex challenges due to the rapid, massive, and often unverified flow of digital information. Hoaxes disguised as religious narratives can undermine the authority of da\u27wah (Islamic preachers), cause polarization, and even carry legal consequences. Therefore, adaptive, critical, and digital literacy-based da\u27wah strategies are needed, including prioritizing information clarification, strengthening communication ethics, and building collaborative da\u27wah networks. Preaching in the era of disinformation requires preachers to be not only skilled in conveying religious messages but also proficient in media and technology literacy, so that their preaching remains relevant, authentic, and effective for societyEra digital telah membawa peluang sekaligus tantangan baru bagi kegiatan dakwah.

    Get PDF
This study aims to examine the ethical dimensions of asset repossession practices in credit sales from the perspective of Islamic law. In the context of Islamic law, credit transactions must adhere to principles of justice, honesty, and transparency, where the repossession of goods by the seller when the buyer fails to fulfill their obligations requires a thorough ethical review. This research employs a qualitative approach with a case study method focusing on companies that implement credit systems in their sales. Data were collected through in-depth interviews with business practitioners and consumers, as well as through the analysis of related documents. The results indicate that although asset repossession in credit sales is recognized as a seller’s right, this practice often conflicts with Sharia principles if it is not carried out with fair consideration for the interests of both parties. The study concludes that there is a need for a more just and transparent mechanism in the repossession process to ensure that the rights of all parties are protected in accordance with Islamic business ethics principles. As a recommendation, it is proposed to develop more detailed ethical guidelines regarding asset repossession in credit sales so that they can be applied consistently and fairly in Sharia business practices

Reviewing Law Enforcement on Small and Medium Enterprise Partnerships in Indonesia from a Competition Law Perspective

    Get PDF
Micro, small, and medium enterprises (MSMEs) play a crucial role in the economic development of Indonesia. One activity MSMEs can engage in is forming partnerships. These partnerships are established through innominate contracts, which, in principle, constitute partnership agreements. The Business Competition Supervision Commission, or Komisi Pengawasan Persaingan Usaha (KPPU), holds the authority to oversee both the formation and performance of partnership agreements entered into by MSMEs. This article uses a normative juridical approach with qualitative data to evaluate the supervisory role of KPPU in overseeing the performance of partnership agreements and the amicable settlement of disputes through changes in behavior under competition law. The results conclude that KPPU oversees compliance with the agreements and performance in accordance with general contractual principles, specifically those that must be included in partnership agreements. KPPU’s supervision, as part of law enforcement, occurs in two phases: the preliminary stage and the subsequent stage. In the subsequent stage, KPPU may impose administrative sanctions and criminal compensation based on the material facts of the proceedings. If the reported party changes their behavior during the preliminary stage, the proceeding may be terminated, allowing the dispute to be settled amicably. This approach should be prioritized as part of restorative justice, as it emphasizes law enforcement focused on restoring the original state and reestablishing harmonious relationships within society
