    Divorce in the Digital Era: Legal Analysis of Divorce via WhatsApp in the Perspective of Fiqh and Indonesian Positive Law

    This study aims to analyze the phenomenon of divorce carried out throughdigital communication media, especially the WhatsApp application, fromthe perspective of fiqh and positive Indonesian law. Along with thedevelopment of information technology, many couples have broken offtheir marital relationship through text messages, which raises questionsabout the legal validity of talaq carried out through the media. In fiqhstudies, talaq via WhatsApp is considered valid by some scholars if it meets the requirements of clear intentions and deliberate delivery. However, there is an opinion that direct interaction is more recommended. In Indonesia\u27s legal system, divorce must be processed through religious court procedures to be considered legally valid. At the same time, talaq carried out via WhatsApp has not been explicitly regulated in the applicable laws and regulations. The study also identified the legal impact of digital divorce, including the difficulties faced by individuals who divorce without a court decision, such as the inability to prove divorce status and difficulties in remarriage.     This study aims to explore the role of notaries in ensuring legal certainty and promoting fairness and transparency in consumer financing. Using a qualitative approach and analyzing several consumer financing cases, the study finds that notaries play a critical role in ensuring the validity and legal protection of the agreements made. The main challenge lies in balancing the interests of creditors and debtors while ensuring that all relevant information about the agreements is disclosed transparently. Regulations such as Law No. 30 of 2004 on the Notary Position and Law No. 2 of 2014 on Amendments to Law No. 30 of 2004 on the Notary Position provide the legal framework for notaries\u27 authority and responsibilities in consumer financing, although there is still a gap in regulations specifically addressing the notary\u27s role in such transactions. This study recommends updating regulations and enhancing notary professionalism to better address these challenges. While the role of notaries is crucial, significant challenges in maintaining fairness and transparency still need to be addressed for consumer financing to be carried out equitably and transparently. Keywords: Notary; Legal Security; Consumer Financing  Penelitian ini bertujuan untuk mengeksplorasi peran notaris dalam menjaga kepastian hukum serta memastikan adanya keadilan dan keterbukaan dalam pembiayaan perorangan. Dengan menggunakan pendekatan kualitatif dan menganalisis beberapa kasus pembiayaan perorangan, penelitian ini menemukan bahwa notaris memegang peranan penting dalam memastikan keabsahan dan perlindungan hukum atas perjanjian yang dibuat. Tantangan utama yang dihadapi adalah bagaimana menjaga keseimbangan antara kepentingan kreditur dan debitur serta memastikan bahwa seluruh informasi terkait perjanjian disampaikan secara jelas dan transparan. Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan Undang-Undang Nomor 2 Tahun 2014 memberikan dasar hukum terkait kewenangan dan tanggung jawab notaris dalam pembiayaan perorangan, meskipun masih terdapat kekosongan dalam regulasi yang secara spesifik mengatur peran notaris dalam transaksi tersebut. Penelitian ini merekomendasikan perlunya pembaruan regulasi dan peningkatan kapasitas profesional notaris untuk menghadapi tantangan ini. Peran notaris sangat krusial, tantangan besar dalam menjaga keadilan dan keterbukaan masih perlu diperbaiki agar proses pembiayaan perorangan berjalan secara adil dan transparan.     Reconstruction of Coercive Measures in the Indonesian Corruption Criminal Justice System

    This study examines the reconstruction of coercive measures within Indonesia’s criminal justice system for corruption cases, with a focus on procedural disparities among law enforcement agencies and the urgency for reform in criminal procedural law. The legal issues addressed include the disharmony in implementing coercive actions—such as arrest, detention, search, and seizure—among institutions like the Police, the Prosecutor\u27s Office, and the Corruption Eradication Commission (KPK). The aim of this research is to formulate a direction for reconstructing a more integrated and just system of coercive measures in handling corruption cases. The study adopts a normative juridical method, utilizing statutory and conceptual approaches, and is analyzed qualitatively. The novelty of this research lies in its proposed design of a coercive measures system based on institutional integration and the principle of due process of law, which has not yet been explicitly regulated in Indonesia\u27s current legal framework. The findings reveal overlapping authorities and procedural inconsistencies that hinder the effectiveness of law enforcement. The main recommendation is to revise the Indonesian Code of Criminal Procedure (KUHAP) by incorporating coordinating norms among institutions and standardized procedures for coercive measures in corruption cases, in order to ensure accountability and the protection of suspects\u27 fundamental rights

    Implementation of Legal Justice in the Implementation of Inclusive Education at Elementary and Secondary School Levels in Indonesia

    This study discusses the implementation of the principle of legal justice in inclusive education at the elementary and secondary school levels in Indonesia. Inclusive education is a form of fulfilling the rights of every citizen to non-discriminatory and equitable education, as guaranteed in the 1945 Constitution and other laws and regulations. Although normatively, there have been regulations that support it, such as Law No. 20 of 2003, Law No. 8 of 2016, and Permendikbud No. 70 of 2009, implementation in the field still faces many obstacles. This study uses a normative legal method with a statutory and conceptual approach. The results of the survey show that limited human resources, infrastructure, low budget allocation, and weak supervision and coordination between the central and regional governments still constrain the implementation of inclusive education. This study recommends the need for more operational policy reformulation, increased training for educators, strengthening the supervision system, and integration of cross-sectoral policies in order to realize fair and sustainable inclusive education

    Law No. 2 of 2004 concerning the Settlement of Industrial Relations Disputes is the legal umbrella that regulates the procedures for resolving industrial relations disputes between employers/companies and workers/laborers. The duties of an industrial relations mediator are to foster industrial relations, develop industrial relations, and resolve Industrial Relations Disputes. The Mediator is obliged to provide written recommendations to the disputing parties to resolve disputes over rights, interests, termination of employment, and disputes between trade unions/labor unions. The study results indicate that in the implementation of industrial relations dispute mediation, the provisions regarding the time to provide written recommendations from the Mediator in the event of no agreement in resolving the dispute to the parties have not been adequate because they often exceed the specified period. The obstacles faced by industrial relations mediators in resolving dispute cases are the difficulty of bringing together the two disputing parties and the difficulty of the disputing parties. Employers who are domiciled abroad or out of town find it difficult to spare their time. And the limited authority given by the company to personnel hinders the mediation process

    The rapid growth of e-commerce has created both opportunities and challenges in consumer protection, particularly in cases where products do not match the images displayed on digital platforms. This situation raises legal concerns because consumers often find themselves in a weak position to prove the fault of business actors. The prevailing paradigm of fault-based liability is considered less effective in ensuring access to justice, thereby necessitating a more inclusive legal mechanism. This study aims to analyze the liability of business actors within the framework of Indonesian positive law and to formulate the doctrine of strict liability as an inclusive legal mechanism in e-commerce transactions. The research employs a normative juridical method with both conceptual and statutory approaches. The findings indicate that although Law No. 8 of 1999 on Consumer Protection, the Indonesian Civil Code, and Law No. 11 of 2008 as amended by Law No. 19 of 2016 on Electronic Information and Transactions regulate the obligations of business actors, the fault-based paradigm still hinders consumers from obtaining effective protection. The novelty of this research lies in proposing the formulation of strict liability within an inclusive legal framework, where liability is automatically attached to business actors without requiring proof of fault.     is study examines the implementation of the Pancasila Student Profile Strengthening Project (P5) with the theme Voice of Democracy at SMA DEK Padang as a vehicle for cross-curricular political education. Political education is considered crucial for shaping young citizens who are knowledgeable, critical, and participatory in democratic life. However, it often remains limited to cognitive aspects, neglecting democratic practices and participatory skills. Using a qualitative descriptive approach, this research collected data through interviews, participatory observation, and questionnaires involving teachers, student council administrators, and eleventh-grade students. The findings reveal that the Voice of Democracy project provided students with meaningful experiences in understanding and practicing democracy through activities such as election simulations, open debates, campaign design, and collaborative decision-making. These activities successfully integrated multiple subjects, including Civic Education, Indonesian Language, and Visual Communication Design, enriching students’ political literacy, communication, and creativity. Moreover, the project fostered deliberative participation, negotiation skills, and political efficacy, as students not only learned concepts theoretically but also experienced democratic processes in practice. The reflection stage enabled critical evaluation, encouraging students to internalize values of justice, tolerance, and responsibility. Despite challenges such as uneven student engagement and cross-subject coordination, the project demonstrated significant potential in developing democratic attitudes and participatory skills. Ultimately, this study highlights the strategic role of schools as agents of political education in the Merdeka Curriculum era, showing how project-based learning can transform abstract democratic principles into lived experiences for students

    Pelestarian hutan mangrove sangat penting untuk kehidupan masyarakat, namun upaya yang dilakukan untuk hal tersebut membutuhkan biaya yang tidak sedikit baik untuk biaya perawatan dan biaya lainnya maka diharapkan pengunjung dapat berpartisipasi dalam menjaga lingkungan .penelitian ini bertujuan untuk mengestimasi besaran nilai maksimum Willingness to pay di Wisata Mangrove Center Graha Indah Kota Balikpapan.Teknik pengambilan sampel menggunakan Accidental sampling dan pengambilan sampel menggunakan puposive sampling. Data di analisis menggunakan metode deskriptif dan metode non parametrik yaitu Model Turnbull, Kaplan-Meier-Turnbull dan Spearman-Karber. Hasil penelitian menyatakan Nilai rata-rata Willingness To Pay dengan metode Turnbull yaitu rata-rata WTP sejumlah Rp.11.000 per orang. Metode K-M-T memperoleh hasil sejumlah Rp. 11.000 per orang.     Penelitian ini bertujuan untuk mengetahui nilai kelayakan dan tingkat risiko pada usaha pembenihan ikan nila. Penelitian ini dilaksanakan pada bulan Juni 2024-November 2024 di Pokdakan Cahaya Ulam Desa Ponoragan Kecamatan Loa Kulu Kabupaten Kutai Kartanegara. Metode pengambilan sampel yang digunakan dalam penelitian ini adalah metode sensus, dengan jumlah 14 pembudidaya. Jenis data yang digunakan dalam penelitian ini adalah primer dan sekunder. Analisis data menggunakan analisis kelayakan dengan indikator Break Event Point (BEP) produksi dan harga dan analisis varian. Hasil penelitian pada usaha pembenihan ikan nila dengan nilai BEP produksi sebesar 34.032, BEP harga sebesar 80,75 layak dan menguntungkan untuk dijalankan secara finansial. Pada tingkat risiko terdapat risiko produksi, harga, dan pendapatan diperoleh nilai CV 0, nilai ini menunjukkan hasil positif, dapat disimpulkan bahwa usaha pembenihan ikan nila di Pokdakan Cahaya Ulam mengalami keuntungan dan terhindar dari kerugian.Kegiatan pembenihan ikan nila (O. niloticus) merupakan kegiatan agrobisnis penting yang banyak dilakukan pada rantai bisnis usaha perikanan di Indonesia. Penelitian ini bertujuan untuk mengetahui nilai kelayakan dan tingkat risiko pada usaha pembenihan ikan nila.
