TINJAUAN YURIDIS PEMBATALAN PUTUSAN ARBITRASE OLEH PENGADILAN NEGERI DITINJAU DARI UU NO 30 TAHUN 1999 TENTANG ARBITRASE DAN ALTERNATIF PENYELESAIAN SENGKETA (Studi Kasus Perkara Nomor 861/Pdt.Sus-Arbt/2023/PN.Jkt.Brt)
Arbitration as an alternative to resolving business disputes offers a fast, confidential, and final process, but this finality is limited by the provisions of Law Number 30 of 1999 which allows for cancellation under certain conditions. This normative legal research analyzes the legal basis for the cancellation of an arbitration award through a case study of the West Jakarta District Court Decision Number 861/Pdt.Sus-Arbt/2023/PN.Jkt.Brt. The results of the study show that cancellation is only permitted based on three limiting reasons in Article 70 of the Arbitration Law. In the case of PT Talkindo Selaksa Anugrah, the judge annulled the BANI decision based on the discovery of important hidden documents and the existence of trickery. The judge\u27s considerations reflect the balance between maintaining the principle of finality of arbitration and upholding substantive justice, although the standard of proof applied is more flexible than international standards. The annulment of an arbitration award must still be seen as an extraordinary corrective mechanism that is applied strictly, without sacrificing the integrity of the arbitration process, because finality should not protect dishonest practices in dispute resolution.Arbitrase sebagai alternatif penyelesaian sengketa bisnis menawarkan proses yang cepat, rahasia, dan final, namun finalitas tersebut dibatasi oleh ketentuan Undang-Undang Nomor 30 Tahun 1999 yang memungkinkan pembatalan dalam kondisi tertentu. Penelitian yuridis normatif ini menganalisis dasar hukum pembatalan putusan arbitrase melalui studi kasus Putusan Pengadilan Negeri Jakarta Barat Nomor 861/Pdt.Sus-Arbt/2023/PN.Jkt.Brt. Hasil penelitian menunjukkan bahwa pembatalan hanya diperbolehkan berdasarkan tiga alasan limitatif dalam Pasal 70 Undang-Undang Arbitrase. Dalam kasus PT Talkindo Selaksa Anugrah, hakim membatalkan putusan BANI berdasarkan penemuan dokumen penting yang disembunyikan serta adanya tipu muslihat. Pertimbangan hakim mencerminkan keseimbangan antara mempertahankan prinsip finalitas arbitrase dan menegakkan keadilan substantif, meskipun standar pembuktian yang diterapkan lebih fleksibel dibandingkan standar internasional. Pembatalan putusan arbitrase harus tetap dipandang sebagai mekanisme korektif luar biasa yang diterapkan secara ketat, tanpa mengorbankan integritas proses arbitrase, karena finalitas tidak boleh melindungi praktik ketidakjujuran dalam penyelesaian sengketa
Crime of Collective Violence in Ambon City: Criminological Study of Locus Delicti, Time Patterns and Social Motives
Collective violence remains a significant social issue in Ambon City, particularly over the past two years. The increasing intensity and spread of group violence incidents underscore the importance of spatial, temporal, and social analysis in understanding the emerging patterns. This study aims to identify the distribution patterns of locus delicti, temporal trends, and the underlying social motives behind collective violence in Ambon during 2023–2024. This research employed a descriptive qualitative method with data collected through field observations, informal interviews with community members and security personnel, as well as documentation from police reports and local media. The results indicate that collective violence incidents were concentrated in densely populated urban areas, public facilities, and nightlife zones. By 2024, the locus of violence began shifting to suburban and symbolic locations such as Merdeka Square. Temporally, most incidents occurred at night until early morning, coinciding with weakened social control. Contributing criminogenic factors include weak community social control, subcultural violence within village-based youth groups, neglected environments, and the contagion effect of crowds in public spaces. This study concludes that collective violence in Ambon City is driven not only by situational and individual factors but also by environmental conditions, crime opportunities, and collective norms that legitimize violent behavior. This study recommends intensifying nighttime patrols, initiating inter-community youth dialogues, and fostering community-based early warning systems to prevent the escalation of group violence in the future.Pidana Kekerasan bersama masih tetap menjadi masalah sosial yang signifikan di Kota Ambon, terutama dalam dua tahun terakhir. Peningkatan intensitas dan penyebaran kejadian kekerasan penting untuk dkaji, terutama menyoroti analisis spasial, temporal, dan sosial dalam memahami pola-pola yang muncul. Penelitian ini bertujuan untuk mengidentifikasi pola distribusi locus delicti, tren temporal, dan motif sosial yang mendasari kekerasan kolektif di Ambon pada tahun 2023–2024. Penelitian ini menggunakan metode deskriptif kualitatif dengan pengumpulan data melalui observasi lapangan, wawancara informal dengan anggota masyarakat dan personel keamanan, serta dokumentasi dari laporan polisi dan media lokal. Hasil penelitian menunjukkan bahwa insiden kekerasan bersama terkonsentrasi di daerah perkotaan yang padat penduduk, fasilitas umum, dan zona kehidupan malam. Pada tahun 2024, lokus kekerasan mulai bergeser ke daerah pinggiran kota dan lokasi simbolik seperti Lapangan Merdeka. Secara temporal, sebagian besar kejadian terjadi pada malam hari hingga pagi hari, bertepatan dengan melemahnya kontrol sosial. Faktor-faktor kriminogen yang berkontribusi antara lain lemahnya kontrol sosial komunitas, kekerasan subkultural dalam kelompok pemuda berbasis desa, lingkungan yang terabaikan, dan efek penularan massal di ruang publik. Penelitian ini menyimpulkan bahwa kekerasan kolektif di Kota Ambon dipengaruhi tidak hanya oleh faktor situasional dan individu, tetapi juga oleh kondisi lingkungan, peluang kejahatan, dan norma kolektif yang melegitimasi perilaku kekerasan. Penelitian ini merekomendasikan peningkatan patroli malam, memulai dialog antar pemuda lintas komunitas, dan membangun sistem peringatan dini berbasis komunitas untuk mencegah eskalasi kekerasan kelompok di masa depan.

Legal Certainty in the Resolution of Disputes in the Sharia Capital Market in Indonesia
This article examines the concept and implementation of legal certainty in the resolution of disputes in Indonesia\u27s Sharia capital market. As part of the national financial system, the Sharia capital market adheres not only to general capital market regulations but also to Islamic legal principles. The article identifies normative and practical challenges in ensuring dispute resolution mechanisms that are consistent with both positive law and Islamic values. Using a normative juridical approach supported by secondary legal materials, this study reveals that legal certainty in the Sharia capital market is still evolving, particularly in terms of institutional authority, procedural clarity, and the enforceability of Sharia-based decisions. The role of the Indonesian Ulema Council (MUI), the Financial Services Authority (OJK), and religious arbitration institutions such as Basyarnas is analyzed in depth. The findings highlight the need for an integrated regulatory and institutional framework that ensures both compliance with Sharia and the protection of investor rights. The article concludes that the future of dispute resolution in the Sharia capital market depends on harmonizing positive law with Islamic jurisprudence to foster a more just, transparent, and legally certain investment climate
The Influence Of Digital Service Quality On Loyality With Digital Satisfaction As A Mediating Variable Among Generation X In Bandung City On The Bukalapak E-Commerce Platform
This study examines the influence of digital service quality on customer loyalty, with digital satisfaction as a mediating variable, focusing on Generation X users (born 1965–1980) of the Bukalapak e-commerce platform in Bandung, Indonesia. The research was motivated by the surge in e-commerce adoption during the COVID-19 pandemic and Bukalapak’s concurrent decline in market share. Using a quantitative explanatory design, data were collected via an online survey of 150 eligible respondents and analyzed through path analysis with SmartPLS 3.2.9. The results demonstrate that digital service quality significantly enhances digital satisfaction (β = 0.782, *p* < 0.001) and directly impacts loyalty (β = 0.288, *p* = 0.001). Digital satisfaction further exerts a strong positive effect on loyalty (β = 0.674, *p* < 0.001) and partially mediates the relationship between service quality and loyalty. These findings contribute to the literature by validating a partial mediation model in the e-commerce context and offer practical insights for platforms targeting Generation X, emphasizing the need for user-centric digital features to foster satisfaction and sustained loyalty
The Effectiveness of The Competence of Islamic Religious Extension Workers in Increasing The Religious Diversity of The Community in North Nias Regency
This study aims to see the effectiveness of Islamic Religious Extension Competence in increasing community religiosity. The method used is qualitative, with the research location in North Nias Regency, from September 2023 to August 2024. Data collection techniques include observation, interviews, and documentation. Research informants comprised the Head of the North Nias Ministry of Religion, the District KUA, the North Nias Pokjapaluh, and representatives from the Muhammadiyah and Nahdlatul Ulama community organisations. Data analysis was carried out through a coding process and integration of data units at the stage of writing the results. The results of the study show: (1) The competence of Islamic religious extension workers includes mastery of religious knowledge, communication skills, technology, and social and psychological skills. They can also design extension programs that suit the community\u27s needs. (2) The communication messages must be relevant, inspiring, touch people\u27s lives, and contain applicable religious motivation. (3) The effects of communication extension include increased understanding of religion, changes in religious attitudes, and social and economic empowerment. Religious instructors have a strategic role in forming a religious, tolerant, and caring society. They can positively influence people\u27s behaviour and quality of life through communication based on moderate Islamic values
Strengthening Digital Literacy: Leveraging Elaboration Likelihood Model and Participatory Communication in Online Fraud Prevention Videos
The recent rise in online fraud requires concrete measures to promote public education on cybersecurity. This study aimed to analyze how BCA’s campaign employs ELM’s central and peripheral routes to persuade and educate customers about phishing prevention. Using a qualitative approach, this research examined the application of the Elaboration Likelihood Model (ELM) and Participatory Communication Theory in building customer awareness of phishing threats. The findings showed that combining persuasive messages through ELM’s central and peripheral routes, along with interactive elements of participatory communication, played a significant role in improving customers’ digital literacy. Short and dynamic video media prove to be adaptive for digital audiences in educating about online fraud prevention. However, challenges such as information overload and the evolving nature of phishing require ongoing innovation. This study provides insights into the role of participatory communication that can be applied in cybersecurity education
Misbruik van Omstandigheden sebagai Dokrin Legitimasi Pembatalan Perjanjian Sewa-Menyewa akibat Penyalahgunaan Keadaan
The doctrine of Misbruik van Omstandigheden is a phenomenon that frequently arises in the dynamics of agreements between parties, especially as a legal justification for the annulment of contracts, including rental agreements. The main issue in this study focuses on the conceptualization and actualization of the doctrine of Misbruik van Omstandigheden as the primary basis for contract annulment, as well as an analysis of the judicial arguments that use this doctrine as a legal foundation for canceling rental agreements. This research adopts a normative legal method with a legislative approach, case studies, and in-depth conceptual analysis. The findings reveal that although the doctrine of Misbruik van Omstandigheden does not have explicit regulation in the Civil Code, jurisprudence has established it as a valid form of defect in will for annulment of a contract in Indonesia. Furthermore, judges\u27 considerations in applying this doctrine as a basis for the annulment of rental agreements must meet strict legal standards and be based on Van Dunne\u27s Theory as a fundamental parameter in assessing the validity and legality of judicial decisions.Doktrin Misbruik van Omstandigheden merupakan fenomena yang sering muncul dalam dinamika perjanjian antara para pihak, khususnya sebagai justifikasi hukum pembatalan perjanjian, termasuk perjanjian sewa-menyewa. Pokok permasalahan dalam penelitian ini berfokus pada konseptualisasi dan aktualisasi doktrin Misbruik van Omstandigheden sebagai dasar utama pembatalan perjanjian, serta analisis terhadap argumentasi yuridis yang menggunakan doktrin tersebut sebagai landasan hukum pembatalan perjanjian sewa-menyewa. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, studi kasus, dan analisis konseptual yang mendalam. Hasil penelitian menunjukkan bahwa meskipun doktrin Misbruik van Omstandigheden tidak memiliki pengaturan secara eksplisit di dalam Kitab Undang-Undang Hukum Perdata, namun yurisprudensi telah menetapkannya sebagai salah satu bentuk cacat kehendak yang sah untuk pembatalan perjanjian di Indonesia. Lebih lanjut, pertimbangan hakim dalam menerapkan doktrin ini sebagai dasar pembatalan perjanjian sewa-menyewa harus memenuhi standar hukum yang ketat dan didasarkan pada Teori Van Dunne sebagai parameter fundamental dalam menilai keabsahan dan legalitas putusan pengadilan

This research aims to find out about legal regulations related to playing victims who cause harm to other parties, to find out the steps taken by POLRI in dealing with playing victims, and to analyze cases of spreading hoax news by playing victims at Percut Sei Tuan Police Station. By using empirical legal research methods, this research examines the problem by taking examples of real cases that have occurred in the community. Empirical legal research methods study law as actual behavior and unwritten social phenomena, which occur in the midst of community life. Therefore, empirical legal research is also known as sociological legal research. The results showed that positive law in Indonesia does not provide a detailed explanation of the sanctions for playing victim. Such actions can have serious implications and can be punished by various articles in the Criminal Code, for example Article 311 of the Criminal Code, Article 378 of the Criminal Code, and others. The handling of perpetrators who pretend to be victims or known as “playing victim” is part of the responsibility of the National Police in maintaining public order and security.Penelitian ini bertujuan untuk mengetahui peraturan hukum terkait playing victim yang menimbulkan kerugian bagi pihak lain, untuk mengetahui langkah-langkah yang dilakukan POLRI dalam menangani playing victim, dan untuk menganalisis kasus penyebaran berita hoax dengan modus playing victim di Polsek Percut Sei Tuan. Dengan menggunakan metode penelitian hukum empiris, penelitian ini mengkaji permasalahan dengan mengambil contoh kasus nyata yang terjadi di masyarakat. Metode penelitian hukum empiris mempelajari hukum sebagai perilaku nyata dan fenomena sosial yang tidak tertulis, yang terjadi di tengah-tengah kehidupan masyarakat. Oleh karena itu, penelitian hukum empiris juga dikenal sebagai penelitian hukum sosiologis. Hasil penelitian menunjukkan bahwa hukum positif di Indonesia tidak memberikan penjelasan secara rinci mengenai sanksi bagi pelaku playing victim. Tindakan tersebut dapat berimplikasi serius dan dapat diancam dengan berbagai pasal dalam KUHP, misalnya Pasal 311 KUHP, Pasal 378 KUHP, dan lain-lain. Penanganan pelaku yang berpura-pura menjadi korban atau dikenal dengan istilah “playing victim” merupakan bagian dari tanggung jawab Polri dalam menjaga ketertiban dan keamanan masyarakat
The losses of state-owned subsidiaries that are equal to state-owned enterprises in the perspective of corruption in indonesia after the third amendment to the law on state-owned enterprises
Indonesia restructures State-Owned Enterprises (SOEs) in the form of a holding company through Government Regulation Number 44 of 2005 in conjunction with Government Regulation Number 72 of 2016 on the Procedures of Participation and Administration of state capital in SOEs and Limited Liability Companies. It is stipulated that the Subsidiaries of SOEs shall be treated in the same way as SOEs in performing public services or obtaining specific policies from the state, including natural resource management with certain treatment as applied to SOEs. This equality of treatment opens the possibility of equal treatment in terms of accountability between SOEs finances and Subsidiaries of State-Owned Enterprises finances. In early February 2025, the Representative Council of the Republic of Indonesia took a strategic step by ratifying the Revised Law on SOEs. There was a new provision that emphasized that SOEs losses were not state losses. The problem is, whether the act against the law by the Board of Directors of a Subsidiaries of SOEs that causes losses to a SOEs are a criminal act of corruption. The method of writing is normative. State finances in the explanation of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 on Corruption Eradication constitute all state assets arising from being in the control, management, and accountability of SOEs. Whereas the juridical between SOEs and SOEs is 2 (two) independent limited liability companies which have their own corporate organs as regulated in Law Number 40 of 2007 on Limited Liability Company so that the unlawful acts committed by the Board of Directors of Subsidiaries of SOEs Causing corporate losses is not a criminal act of corruption if it does not meet the criteria stipulated in the Circular of the Supreme Court Number 10 of 2020
Localizing the Green Transition: Policy Implementation and Challenges of Renewable Energy Development in West Nusa Tenggara, Indonesia
This study explores the dynamics of green energy transition policy in Indonesia, with a specific focus on the Province of West Nusa Tenggara (NTB) as a pioneering region in promoting renewable energy at the local level. Against the backdrop of global energy crises and climate change, Indonesia has committed to increasing its share of renewable energy to 23% by 2025 through various national policies and regulations. At the subnational level, NTB has taken proactive steps by issuing Governor Regulation No. 13 of 2024 on Green Energy Development, as part of its broader “Green NTB” vision and the implementation of its Regional Energy General Plan (RUED). The research adopts a qualitative approach, analyzing policy documents, government reports, and relevant literature to examine how green energy policy is formulated and implemented at the local level. The findings reveal that while NTB demonstrates strong political will and regulatory frameworks, the implementation phase faces several challenges, including limited infrastructure, high investment costs, low public energy literacy, and weak institutional coordination. Moreover, green energy initiatives are often symbolic and confined to pilot projects without comprehensive long-term planning. Nevertheless, NTB’s abundant renewable energy potential, commitment from local authorities, and support from national frameworks provide significant opportunities to accelerate the energy transition. The study concludes that a more adaptive, inclusive, and evidence-based policy approach is essential to overcoming implementation barriers. The NTB case offers valuable insights for other provinces aiming to develop locally contextualized strategies for sustainable energy transformation, contributing to Indonesia’s national and international climate goals
