    Implementation of Deradicalization In the Framework of Handling Criminal Acts of Terrorism in the Legal Area of the Central Sulawesi Regional Police

    This study aims to examine the implementation of deradicalization in the context of handling criminal acts of theism in the jurisdiction of the Central Sulawesi Police. The implementation of deradicalization in the jurisdiction of the Central Sulawesi Police is carried out by several parties, namely: Densus, and Ops Madago Raya. Each of these parties in carrying out their activities is not integrated, but coordinates with each other. Activities carried out by Densus are approaching former terrorism prisoners and families, with the aim of repairing and regaining trust, then synergizing with various institutions and district governments, carrying out supervision of former terrorism prisoners who receive assistance, separating former terrorism prisoners and families from radical groups, and mobilizing religious leaders, community leaders, and the community to build resilience so as not to be influenced by radicalism. The research method used is empirical legal research with a qualitative approach. Data collection techniques through observation, interviews and documentation. The location of this research is in 4 districts which are Madago Raya operation areas, namely Sigi-Biromaru Regency, Parigi-Moutong Regency, Poso Regency, and Tojo Una-Una Regency, Central Sulawesi Province. The results of the research are in the implementation of deradicalization in the jurisdiction of Central Sulawesi Police, the stages carried out by Idensos, Ops Madago Raya, and LPMS refer to Law No. 5 of 2018 through the stages of identification and assessment, rehabilitation, social re-integration and economic independence with various positive, persuasive and humanist activities

    Childfree in a Variety of Perspectives: Philosophical Perspectives, Islamic Family Law and Contemporary Social Life

    The childfree phenomenon has become a hot topic in contemporary society. This choice not only reflects the dynamics of modern lifestyles but also raises legal, social, and religious controversies. This research aims to analyze childfree law from various perspectives, namely legal philosophy, Islamic family law, sociology, and anthropology, as well as career and population aspects. A multidisciplinary approach is used to understand this phenomenon in its entirety and comprehensively. From the perspective of Islamic law, child freedom is considered contrary to maqashid al-shariah, especially in safeguarding offspring (hifzh al-nasl), which is one of the purposes of marriage. However, from the perspective of legal philosophy, such decisions can be justified through the principles of personal autonomy and freedom of choice. Meanwhile, sociological and anthropological perspectives view childfree as a reflection of changes in social structure, individualistic values, and the influence of modern economics and lifestyle. In addition, career factors and population density also influence these preferences, which indirectly impact demographics and development. This study shows the importance of a balanced approach between religious norms, individual freedom, and social responsibility in responding to the childfree phenomenon in the modern era.Fenomena childfree telah menjadi topik hangat dalam masyarakat kontemporer. Pilihan tersebut tidak hanya mencerminkan dinamika gaya hidup modern, tetapi juga menimbulkan kontroversi hukum, sosial, dan agama. Penelitian ini bertujuan untuk menganalisis hukum childfree dari berbagai perspektif, yaitu filsafat hukum, hukum keluarga Islam, sosiologi, dan antropologi, serta aspek karier dan kependudukan. Pendekatan multidisiplin digunakan untuk memahami fenomena ini secara utuh dan komprehensif. Dari perspektif hukum Islam, childfree dianggap bertentangan dengan maqashid al-shariah, terutama dalam menjaga keturunan (hifzh al-nasl), yang merupakan salah satu tujuan perkawinan. Namun, dari perspektif filsafat hukum, keputusan tersebut dapat dibenarkan melalui prinsip-prinsip otonomi pribadi dan kebebasan memilih. Sementara itu, perspektif sosiologis dan antropologis memandang childfree sebagai refleksi dari perubahan struktur sosial, nilai-nilai individualistis, dan pengaruh ekonomi dan gaya hidup modern. Selain itu, faktor karier dan kepadatan penduduk juga memengaruhi preferensi tersebut, yang secara tidak langsung berdampak pada demografi dan pembangunan.     The Implementation of the Res Judicata Pro Veritate Habetur Principle to the Investigation of Money Laundering

    This study aims to determine the position of court rulings on predicate crimes under the principle of Res Judicata Pro Veritate Habetur in money laundering cases, along with the legal rationale utilized by judges in adjudicating TPPU cases involving predicate crimes as specified in Article 127 paragraph (1) of the Narcotics Law. This study utilizes a normative-empirical approach through a case study method. This research is supported by the review of case files, the observation of trial proceedings, and the analysis of literature from various criminal law sources and relevant statutes and regulations. The utilized data analysis method is judicial-normative. The findings of this study reveal a violation of the principle of Res Judicata Pro Veritate Habetur in the evaluation of money laundering offenses, as demonstrated by the Mataram District Court Decision No. 516/Pid.Sus/2022/PN.Mtr, alongside the NTB High Court Decision No. 23/PID.Sus. 2023/PT.MTR, and the MARI Decision No. 4075 K/PID.Sus/2023, which neglected to account for the legally binding narcotics criminal ruling that serves as the predicate crime for the money laundering allegation. Both panels of judges committed errors in their legal reasoning by inadequately and incompletely assessing the predicate crime of narcotics offenses under Article 127, paragraph 1 of the Narcotics Law, concerning the evidence of 0.17 grams in relation to the sentencing and confiscation of the defendant\u27s assets

    A Regulatory and Implementative Study on Women\u27s Rights, Lactation Spaces, and the Role of State Responsibility

    This study aims to examine and analyze the existence of lactation rooms as a form of legal protection for female workers from the perspective of labor law and health law in Indonesia. Descriptive-analytical method is used in this research, with a juridical-normative approach and qualitative research data. Primary, secondary, and tertiary data are obtained from relevant regulations and literature. The results of this study indicate that the provision of lactation rooms is regulated in Law No. 13 of 2003 on Employment, Law No. 17 of 2023 on Health, and Government Regulation No. 33 of 2012 on Exclusive Breastfeeding and its derivative regulations, the legal provision of lactation rooms remains limited and lacks comprehensive scope. This leads to the absence of adequate facilities in many workplaces, contributing to the low success rate of exclusive breastfeeding among employed mothers. Meanwhile, countries such as Sweden and Singapore, despite lacking explicit regulations mandating lactation rooms, have implemented successful workplace lactation policies through broader worker welfare frameworks. The barriers to implementation in Indonesia include unsupportive organizational culture, insufficient budget allocation, and weak government oversight. This study recommends explicit regulatory reform, widespread policy dissemination, and multi-stakeholder collaboration to strengthen the protection of female workers’ health rights

    Legal Protection of The Executory Rights of Separatist Creditors as Holders of Material Guarantees in Credit Agreements in The State of Bankruptcy Debtors

    This study examines the legal protection of the executorial rights of separatist creditors as holders of security rights in credit agreements when the debtor is declared bankrupt. As separatist creditors possess preferential rights over certain collateral objects, the implementation of their executorial rights often faces legal and procedural challenges in bankruptcy proceedings. The research analyzes the legal framework provided by Indonesian bankruptcy law, particularly concerning the position and priority rights of secured creditors. It also evaluates judicial practices and obstacles encountered during the execution of collateral. The findings highlight the importance of strengthening legal certainty and protection for secured creditors to ensure the fair enforcement of their rights without undermining the principles of bankruptcy distribution and debtor rehabilitation. Recommendations are proposed to harmonize the execution process with creditor protection mechanisms in insolvency law.Penelitian ini mengkaji perlindungan hukum atas hak eksekutorial kreditor separatis sebagai pemegang hak jaminan dalam perjanjian kredit ketika debitur dinyatakan pailit. Karena kreditor separatis memiliki hak istimewa atas objek agunan tertentu, pelaksanaan hak eksekutorial mereka sering menghadapi tantangan hukum dan prosedural dalam proses kepailitan. Penelitian ini menganalisis kerangka hukum yang disediakan oleh hukum kepailitan Indonesia, khususnya mengenai posisi dan hak prioritas kreditor yang dijamin. Ini juga mengevaluasi praktik peradilan dan hambatan yang dihadapi selama eksekusi agunan. Temuan menyoroti pentingnya memperkuat kepastian hukum dan perlindungan bagi kreditor yang dijamin untuk memastikan penegakan hak-hak mereka yang adil tanpa merusak prinsip-prinsip distribusi kepailitan dan rehabilitasi debitur. Rekomendasi diusulkan untuk menyelaraskan proses eksekusi dengan mekanisme perlindungan kreditor dalam hukum kepailitan

    The problem in this study is focused on how the Legal Regulations on Consumer Protection for Objections to Sealing kWh Meters carried out by the Implementation of P2TL by PT PLN UIW North Sumatra and the Judge\u27s Considerations in consumer protection for objections to sealing kWh meters carried out by the implementation of P2TI by PT PLN UIW North Sumatra (study decision number: 428 / Pdt.Sus-BPSK / 2023 / PN-Mdn). This study aims to determine the Legal Regulations and Judge\u27s Considerations. The research method used in this study is normative juridical, the results of this study indicate that the Legal Regulations are regulated in Article 56 Paragraph 2 of Law Number 8 of 1999 concerning Consumer Protection, Article 5 Paragraph 1 of Perma 1 of 2006 concerning Procedures for Submitting Objections and Article 29 Paragraphs (2) and (3) of Law Number 30 of 2009 concerning Electricity. The Judge\u27s considerations consist of legal considerations, including, granting the Applicant\u27s objection request to cancel the Decision of the Medan City Consumer Dispute Resolution Agency Number 022/Arbitration/2023/BPSK. Mdn Dated May 17, 2023 and stating that the Medan City Consumer Dispute Resolution Agency is not authorized to try this case. And filed an objection to the Medan District Court with Registration Number 428/Pdt.Sus- BPSK/2023/PN Mdn

    Concept Of Terms In Understanding Absolute Water Law Contemporary Legal Study Modern Fiqh Perspective

    The interpretation of the concept of istihalah in the context of modern technology, such as wastewater treatment and recycling, triggers new problems. Although the concept of istihalah has been accepted in classical fiqh, its application in the contemporary world raises challenges related to the scientific validity and practice of water treatment that changes the nature of water. This research uses a library research method , which focuses on the study of literature and written documents relevant to the research topic. The main data sources in this research are scientific journal articles and published research reports. The research results show that: 1). The form of the concept of istihalah in understanding the law of absolute water is that istihalah is the change of an impure substance into a new substance that is totally holy and in absolute water fiqh, this means that unclean water that has completely changed its nature can again be considered holy and purifying. 2). The application of the concept of istihalah in understanding absolute water law in contemporary legal studies is that in the modern context, istihalah is used to authorize the use of recycled water, as long as the purification process removes all unclean properties and meets purity standards. 3). The Ulama\u27s view of the concept of istihalah in understanding absolute water law in contemporary legal studies is that contemporary Ulama generally accept the concept of istihalah as the basis for the ability to use recycled water for purification, provided that the change in the substance is complete and scientifically proven

    The Preferential Concept of Pro bono Publico as a Guarantee of Legal Certainty of Copyright Waqf in the perspective of Indonesian Law

    The declarative principle in copyright protection and the constitutive principle in waqf implementation within Indonesia’s legal system have created a normative disharmony, obstructing the legal recognition of intellectual property-based waqf. This misalignment has led to the absence of a clear legal mechanism for facilitating copyright as a valid and productive waqf object. This study aims to formulate an alternative concept, Preferensial Pro Bono Publico, as an administrative framework that ensures legal certainty in the waqf of copyright without compromising the core declarative nature of copyright law. Employing a normative legal research method that combines conceptual and statutory approaches, and supported by qualitative juridical analysis of primary and secondary legal sources, the findings reveal that this concept can fill the regulatory vacuum by providing a functional administrative registration pathway for socially-driven rights transfers. The analysis indicates that the model aligns with responsive legal theory, legal functionalism, and the maqashid al-shariah framework in Islamic jurisprudence, while contributing to the advancement of progressive legal doctrine. Its broader implications include opportunities for regulatory reform, inter-agency system integration, and the strengthening of intellectual property-based philanthropy in the digital era. Thus, Preferensial Pro Bono Publico functions not only as a normative legal innovation, but also as a social instrument for the equitable redistribution of copyright benefits in a sustainable manner

    International Law and Cyber Technology: Challenges of Global Regulation in the Digital Diplomacy Era

    The rapid development of information technology has driven a major transformation in international relations, particularly through digital diplomacy. On the other hand, this progress has also posed serious challenges to international law, which has yet to fully regulate cross-border cyber activities. This study aims to examine the main challenges faced by international law in responding to the dynamics of global cyberspace, as well as to evaluate the role of digital diplomacy in shaping fair and inclusive cyber regulations. The research employs a qualitative method using a literature review approach, analyzing scholarly sources, policy reports, and official international documents. The findings reveal a significant legal vacuum in addressing cyberattack attribution, state responsibility, and the protection of human rights in the digital space. Current cyber diplomacy efforts remain hindered by ideological differences between major powers and developing countries, as well as by the dominance of non-state actors such as global technology companies. The conclusion of this study highlights the urgency of establishing a responsive, multistakeholder international legal framework that ensures global digital justice. Without collective efforts and international compromise, cyberspace risks becoming a battlefield of conflict without clear legal boundaries

    Political Dynasties and Legal Loopholes in Regional Elections: a Case Study of Families of Regional Officials in the 2024 Political Year

    The phenomenon of political dynasties in regional head elections continues to show an upward trend, especially in the lead-up to the 2024 Simultaneous Regional Elections. In an electoral democracy, the domination of power by incumbent families poses a serious threat to the principles of meritocracy, fair competition, and public accountability. The re-emergence of prominent names from the inner circles of regional political families indicates that power is no longer contested through open mechanisms, but rather inherited structurally through kinship networks and political patronage. This research employs a qualitative approach with a normative-empirical design. Data were obtained through a literature review of legislation, Constitutional Court rulings, as well as research reports and scholarly publications related to political dynasties and regional elections. The primary aim of this research is to examine the relationship between legal loopholes in regional election regulations and the rise of political dynasties, as well as their impact on the quality of democracy and local governance. The findings reveal that the absence of substantive norms limiting the candidacy of incumbent family members creates a legal gap that is exploited to perpetuate power. The annulment of Article 7 letter r of Law No. 8 of 2015 by the Constitutional Court has further legitimized political dynasties within a system that remains democratically unconsolidated. The consequences include declining leadership quality, increased conflicts of interest, weakened oversight, and a growing number of corruption cases in regions dominated by political dynasties. This phenomenon also narrows the space for political competition and strengthens the dominance of local oligarchies in electoral contests.Fenomena politik dinasti dalam pemilihan kepala daerah terus menunjukkan tren peningkatan, terutama pada Pilkada Serentak 2024. Dalam sistem demokrasi elektoral, dominasi kekuasaan oleh keluarga petahana menjadi ancaman serius terhadap prinsip meritokrasi, persaingan sehat, dan akuntabilitas publik. Munculnya kembali nama-nama besar dari lingkaran keluarga pejabat daerah menunjukkan bahwa kekuasaan tidak lagi direbut melalui mekanisme terbuka, melainkan diwariskan secara struktural melalui jejaring kekerabatan dan patronase politik. Penelitian ini menggunakan pendekatan kualitatif dengan desain normatif-empiris. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, putusan Mahkamah Konstitusi, serta laporan riset dan publikasi ilmiah terkait politik dinasti dan pilkada. Tujuan utama penelitian ini adalah untuk mengkaji keterkaitan antara celah hukum dalam regulasi pilkada dengan menguatnya politik dinasti, serta dampaknya terhadap kualitas demokrasi dan tata kelola pemerintahan daerah.Hasil penelitian menunjukkan bahwa absennya norma substantif yang membatasi pencalonan keluarga petahana menjadi celah legal yang dimanfaatkan untuk melanggengkan kekuasaan. Pembatalan Pasal 7 huruf r UU No. 8 Tahun 2015 oleh Mahkamah Konstitusi memperkuat legitimasi politik dinasti dalam sistem yang belum terkonsolidasi secara demokratis. Dampaknya mencakup menurunnya kualitas kepemimpinan, meningkatnya konflik kepentingan, lemahnya pengawasan, dan bertambahnya kasus korupsi di daerah yang dikuasai oleh dinasti politik. Fenomena ini juga mempersempit ruang kompetisi politik dan memperbesar dominasi oligarki lokal dalam kontestasi elektoral
