Combating Drug Abuse through Rehabilitation for Foreign Nationals with the SMART Method (Self-Management and Recovery Training) at the Drug Rehabilitation Foundation in Denpasar City
Drug abuse is a serious problem faced by many countries, including Indonesia. To overcome this problem, the Indonesian government provides rehabilitation sanctions for drug users, including foreign citizens living in Indonesia. This research aims to analyze the regulation of drug rehabilitation for foreign nationals in criminal acts of drug abuse in Denpasar City and this research also highlights the importance of the Self Management and Recovery Training (SMART) method as an effective solution in the rehabilitation of foreign nationals caught in drug abuse in Indonesia. The research method used is empirical legal research with a critical qualitative approach. The data collection technique was carried out by interviews where informants were selected purposively. Data processing analysis techniques are carried out in a qualitative descriptive manner. The research results show that foreign citizens involved in drug abuse crimes in Denpasar City can undergo the same rehabilitation program as Indonesian citizens. This process begins with applying to local authorities, such as the police or authorized agencies. However, rehabilitation policies for foreign nationals depend on various factors, including the severity of the offense and whether they are willing to cooperate with authorities, and drug rehabilitation for foreign nationals is important. The SMART method is an effective rehabilitation method for foreign nationals because this program can be adapted to different individual needs, languages, and cultures. This program also emphasizes individual responsibility in the recovery process, so that it can help individuals to build a better sense of self-confidence and self-control.Penyalahgunaan narkoba merupakan masalah serius yang dihadapi oleh banyak negara, termasuk Indonesia. Untuk mengatasi masalah ini, pemerintah Indonesia memberikan sanksi rehabilitasi bagi pengguna narkoba, termasuk bagi warga negara asing yang tinggal di Indonesia. Tujuan penelitian ini adalah menganalisis pengaturan tentang rehabilitasi narkoba bagi warga negara asing dalam tindak pidana penyalahgunaan narkoba di Kota Denpasar dan penelitian ini juga menyoroti pentingnya metode Self Management and Recovery Training (SMART) sebagai solusi efektif dalam rehabilitasi warga negara asing yang terjerat dalam penyalahgunaan narkoba di Indonesia. Metode penelitian yang digunakan penelitian hukum empiris dengan pendekatan kualitaif kritis. Teknik pengumpulan data dilakukan dengan wawancara dimana informan dipilih secara purposive. Teknik pengolahan dan analisis data dilakukan secara deskriftif kualitatif. Hasil penelitian menunjukan bahwa warga negara asing yang terlibat dalam tindak pidana penyalahgunaan narkoba di Kota Denpasar dapat menjalani program rehabilitasi yang sama seperti warga negara Indonesia. Proses ini dimulai dengan pengajuan permohonan kepada pihak berwenang setempat, seperti kepolisian atau instansi yang berwenang. Namun, kebijakan rehabilitasi bagi warga negara asing tergantung pada berbagai faktor, termasuk tingkat pelanggaran dan apakah mereka bersedia bekerja sama dengan pihak berwenang dan rehabilitasi narkoba untuk warga negara asing penting untuk dilakukan. Metode SMART merupakan metode rehabilitasi yang efektif untuk warga negara asing karena program ini dapat disesuaikan dengan kebutuhan individu, bahasa, dan budaya yang berbeda. Program ini juga menekankan pada tanggung jawab individu dalam proses pemulihan, sehingga dapat membantu individu untuk membangun rasa percaya diri dan kontrol diri yang lebih baik
The Impact of Song Piracy on Digital Platforms on the Income of Indonesian Artists
The advancement of digital technology has facilitated music access through various platforms but also presents a significant challenge in the form of song piracy, which greatly impacts the income and career sustainability of Indonesian artists. This study employs a qualitative approach with normative analysis of copyright regulations, music industry reports, and secondary data to identify the impacts and driving factors of piracy and to formulate strategic steps to address it. The findings reveal that song piracy reduces royalties, diminishes the commercial appeal of artists, and is exacerbated by low public awareness, weak law enforcement, and ineffective copyright protection mechanisms on digital platforms. This study recommends synergy between the government, digital platforms, and the public through education, stricter law enforcement, and innovation to create a safer and more sustainable music ecosystem
Comparison of Railway Regulations Between Indonesia and Japan from a Consumer Protection Perspective: What and How?
This study examines the comparative regulatory framework governing the railway systems in Indonesia and Japan from the perspective of consumer protection. The research is grounded in the significance of ensuring quality public services in the railway transportation sector and the necessity of safeguarding consumer rights as service users. The primary objective of this research is to analyze the differences and similarities in railway regulations between Indonesia and Japan and to evaluate the extent to which consumer protection is accommodated within policy and implementation frameworks. This study employs a normative legal research method, utilizing a comparative law approach and a conceptual approach. Data analysis techniques include document review, statutory and regulatory analysis, and literature study related to transport regulation and public policy. The novelty of this study lies in its specific focus on consumer protection within railway transport regulation—an aspect that has rarely been studied comparatively between two countries with differing legal systems and infrastructure frameworks. The findings indicate that Japan has developed a more integrated consumer protection system, emphasizing service standards, compensation mechanisms, and operator accountability. In contrast, consumer protection in Indonesia remains general in nature and has yet to be regulated specifically within the railway sector. The study recommends that Indonesian policymakers strengthen railway regulations by explicitly incorporating principles of consumer protection and adopting best legal practices from Japan’s more consumer-oriented regulatory system
Baselines Issues In Determining The Delimitation Of Indonesia\u27s Maritime Boundaries With Neighboring States
Maritime boundaries play a strategic role in determining a state\u27s sovereignty limits, managing natural resources, and maintaining national security and stability. The establishment of a baseline is a crucial element in maritime boundary delimitation, especially for archipelagic states such as Indonesia. This study aims to identify the legal effects of the baseline and analyze the challenges Indonesia faces in applying the maritime delimitation provisions under the 1982 United Nations Convention on the Law of the Sea (UNCLOS). Based on the analysis, the findings reveal two primary factors influencing Indonesia\u27s application of baseline provisions under UNCLOS 1982. First, the supporting factors include: the legal certainty of a maximum 12-nautical-mile territorial sea; the legal guarantee for the exploration and exploitation of marine natural resources that better fulfills the element of equity for developing countries; and UNCLOS 1982’s flexibility in accommodating the geographical and geological uniqueness of coastal states through various baseline classifications and state types. Second, there are challenges in implementation, including: vague interpretations of several UNCLOS provisions, which lead to divergent state practices in drawing baselines; the absence of sanctions or formal reprimands for violations, leaving such deviations uncorrected unless resolved through international adjudication; and technical inconsistencies in determining maritime boundary coordinates, which complicate consensus between neighboring states. This study underscores the importance of adopting innovative legal approaches and enhancing coordination among national and international institutions to ensure the legitimate and sustainable enforcement of Indonesia’s maritime boundaries
Restorative Justice at the Grassroots: Exploring Cultural Integration and Police Facilitation in Criminal Case Settlements in Waesala, Indonesia
This study examines the effectiveness of Restorative Justice (RJ) implementation in resolving criminal cases in the jurisdiction of Waesala Police, West Seram Regency, Maluku Province. The study used a Mixed Methods Sequential Explanatory Design approach, combining quantitative analysis based on Structural Equation Modeling (SEM) and qualitative analysis through in-depth interviews and thematic coding with NVivo 12 Plus. The quantitative stage focuses on dimensions such as Police Socialization (SP), Victim Involvement (KK), Process Effectiveness (EP), and Satisfaction and Sense of Justice (KRK). The results of the CFA test showed high validity and reliability of the measurement model, with the dimensions of Empathy (EP) and Cultural Restorative Justice (KRK) as dominant contributors based on a factor loading value of 0.97. Qualitative findings revealed important themes such as barriers to victim education, the role of the police as a facilitator, perceptions of justice, and case criteria that are eligible for RJ. Data triangulation ensured depth of context and theoretical confirmation. The results of the study prove that RJ not only increases procedural satisfaction and social harmony, but is also in line with local cultural values when facilitated properly. This study provides academic contributions as well as practical recommendations for law enforcement institutions in designing RJ policies that are relevant to local conditions.Penelitian ini mengkaji efektivitas penerapan Restorative Justice (RJ) dalam menyelesaikan perkara pidana di wilayah hukum Polsek Waesala, Kabupaten Seram Bagian Barat, Provinsi Maluku. Penelitian menggunakan pendekatan Mixed Methods Sequential Explanatory Design, menggabungkan analisis kuantitatif berbasis Structural Equation Modeling (SEM) dan analisis kualitatif melalui wawancara mendalam serta coding tematik dengan NVivo 12 Plus. Tahap kuantitatif menitikberatkan pada dimensi-dimensi seperti Sosialisasi Polisi (SP), Keterlibatan Korban (KK), Efektivitas Proses (EP), dan Kepuasan serta Rasa Keadilan (KRK). Hasil uji CFA menunjukkan validitas dan reliabilitas model pengukuran yang tinggi, dengan dimensi Empati (EP) dan Keadilan Restoratif Kultural (KRK) sebagai kontributor dominan berdasarkan nilai loading faktor sebesar 0.97. Temuan kualitatif mengungkap tema-tema penting seperti hambatan edukasi korban, peran kepolisian sebagai fasilitator, persepsi keadilan, serta kriteria kasus yang layak diterapkan RJ. Triangulasi data memastikan kedalaman konteks dan konfirmasi teoretis. Hasil penelitian membuktikan bahwa RJ tidak hanya meningkatkan kepuasan prosedural dan harmoni sosial, tetapi juga selaras dengan nilai-nilai budaya lokal bila difasilitasi secara tepat. Studi ini memberikan kontribusi akademik sekaligus rekomendasi praktis bagi institusi penegak hukum dalam merancang kebijakan RJ yang relevan dengan kondisi lokal

Exploring the Theory of State Sovereignty over Stratatitle and Marine Cadastre Regulations as Instruments for Protecting Spatial Rights
The urgency of regulating strata title and marine cadastre in Indonesia is increasingly important in line with rapid urbanization and the need for sustainable marine spatial management. This study aims to analyze the application of state sovereignty theory in the regulation of vertical and marine space, as well as to propose a more comprehensive and integrated legal framework. This approach is expected to identify normative solutions to strengthen the protection of rights to space and prevent ownership conflicts or regulatory overlaps. Through this study, it is hoped that clearer and fairer regulations on the utilization of vertical and marine space in Indonesia can be achieved. The research method used is normative juridical, analyzing legislation, legal doctrines, and state sovereignty theory to explore existing legal gaps and regulatory fragmentation. This study finds that state sovereignty plays an important role in the regulation of vertical and maritime space through regulations that ensure space management is carried out in an orderly, fair, and sustainable manner. Through the Marine Cadastre, the state can strengthen legal certainty and marine spatial management in accordance with national policies outlined in Law No. 32 of 2014 on Marine Affairs. Harmonisasi Perlindungan Tumpang Tindih Hak Cipta dan Hak Desain Industri: Studi Perbandingan antara Indonesia dan Australia
One of the crucial problems in the scope of intellectual property today is the phenomenon of overlap between copyright and industrial design rights. One of the important things to study is the existence of legal regulations that have been harmonized and effective to overcome these problems. In this research, the method used is a statutory and comparative approach with analytical descriptive specifications. This study found that the overlap of copyright and industrial design rights law has not been regulated and harmonized properly in Indonesian positive law. The results of this study indicate that by not harmonizing the protection of copyright with industrial design rights in Indonesia, Indonesia does not have legal certainty and has a legal gap in the enforcement of rights and settlement of disputes when compared to Australia. Therefore, harmonization between copyright and industrial design rights law is needed, including the necessary reforms to provide legal certainty for creators and industry players in the future.Salah satu masalah krusial dalam lingkup hak kekayaan intelektual saat ini adalah fenomena tumpang tindih antara hak cipta dan hak desain industri. Salah satu hal penting yang perlu diteliti adalah keberadaan peraturan perundang-undangan yang telah diharmonisasikan dan efektif untuk mengatasi masalah-masalah tersebut. Dalam penelitian ini, metode yang digunakan adalah pendekatan yuridis dan komparatif dengan spesifikasi deskriptif analitis. Penelitian ini menemukan bahwa tumpang tindih antara hukum hak cipta dan hak desain industri belum diatur dan diharmonisasikan dengan baik dalam hukum positif Indonesia. Hasil penelitian ini menunjukkan bahwa dengan tidak mengharmonisasikan perlindungan hak cipta dengan hak desain industri di Indonesia, Indonesia tidak memiliki kepastian hukum dan terdapat celah hukum dalam penegakan hak dan penyelesaian sengketa dibandingkan dengan Australia. Oleh karena itu, harmonisasi antara hukum hak cipta dan hak desain industri diperlukan, termasuk reformasi yang diperlukan untuk memberikan kepastian hukum bagi pencipta dan pelaku industri di masa depan
Legal Policy on Strengthening the Existence of the Indonesian National Border Management Agency (BNPP RI) in Resolving Border Area Disputes of the Unitary State of the Republic of Indonesia Based on Law Number 43 of 2008 Concerning State Territory
The method used in this study is a normative research type based on the study of border area law analysis, research specifications focus on discussing the challenges and existence carried out by the BNPP RI. Primary data from the study and analysis of legislation and secondary data based on in-depth analysis of literature sources in books, journals, proceedings and other scientific article sources. The analysis in this study uses descriptive analysis of laws and cases that have occurred in the field analyzed based on sources of settlement of agreements and decisions. The results of the first study, that BNPP has many challenges related to the problems of border disputes both domestically and abroad, these challenges can be resolved by BNPP. However, the limitations of budget problems, human resources, coordination between border areas in all provinces that are too broad and the development of technology for borders between regions is still not optimal. Second, the existence of the National Border Management Agency of the Republic of Indonesia (BNPP RI) must be strengthened, based on Article 14 Paragraph (2) BNPP is directly responsible to the President, but in its implementation there needs to be coordination with other institutions and Regional Governments in carrying out its duties and authorities. as if it does not have the principle of independence in accordance with the mandate of the law
Paradigm Changes in Proving Unlawful Acts in Corruption Crimes Following Constitutional Court Decision Number 25/PUU-XIV/2016
The Constitutional Court Decision Number 25/PUU-XIV/2016 has marked an important turning point in the enforcement of corruption law in Indonesia, especially in proving the element of state financial loss. Before this decision, the formal approach that emphasized procedural violations without the need to prove actual losses was still commonly used. However, after the decision, the legal interpretation shifted towards a material approach that required actual loss to prove corruption. This change has quite complex legal and practical consequences, ranging from increasing the burden of proof for public prosecutors, and dependence on the results of audits of state financial institutions to technical challenges in coordination between law enforcers. This study comprehensively examines the development of legal interpretation before and after the Constitutional Court decision, and its impact on the evidentiary process, and formulates strategic steps that can be taken to strengthen the effectiveness of corruption eradication while ensuring legal certainty for the parties
