Corruption and Marriage Agreements Legal Analysis of Property Ownership
Major corruption cases such as the Bank Century, e-KTP, Tambang and BLBI scandals are examples of how corruption can involve high-ranking officials and cost the state trillions of rupiah long marriage Agreement made by a husband and wife before or during marriage which regulates the Purpose of the Marriage Agreement Regulates separation or division of assets acquired during and before marriage. Prevent disputes related to assets in the event of divorce, corruption or death of one of the partners. The research method used is Normative Juridical. Separation of Assets Based on the Marriage Agreement. Assets are based on Article 29 of Law Number 1 of 1974 concerning Marriage and Articles 119-131 of the Civil Code. Relationship with Assets Assets obtained from corruption can be confiscated by the state if they are proven to be related to a criminal act. Legal Responsibility If one spouse is involved in a corruption case, the assets obtained from the corruption act can be separated from the assets of the other spouse who is not involved.

The Urgency of Developing E-Law Consult Application for Legal Protection of Female Migrant Workers in Central Java
Indonesian migrant workers often receive less than proper treatment and some of them are caught in several cases so that they are threatened with severe punishment and some are even sentenced to death. The essence of providing legal protection for Indonesian female migrant workers is protection against security guarantees from all forms of violence, both physical and psychological, or in other words to provide protection against arbitrary actions by an individual or group. The purpose of this study is to determine the urgency of the e-law consult application for legal protection of female migrant workers in Central Java. The e-law application is expected to help female migrant workers to communicate more easily with the migrant service. The results obtained from this study are based on the questionnaire that has been distributed to respondents, namely an average percentage of 90%, meaning that respondents strongly agree if the e-law consult application is made and designed according to respondent input. Reconstruction of Tax Case Investigations to Avoid Business Crimes Based on Legal Certainty
Based on the tax revenue report submitted by the Minister of Finance, it is necessary to improve professionalism in managing state finances, especially when related to taxation. In addition to professionalism, supervision also needs to be improved, both preventive and repressive, to prevent deviations or abuse of office in managing state finances, especially related to tax management. The criminal law policy in the field of taxation in the future should be in line with the principle of criminal taxation, "that criminal sanctions in taxation are Ultimum Remidium, meaning that in enforcing violations of tax law, administrative sanctions are prioritized, while the application of criminal sanctions is carried out if the methods used are no longer effective in making Taxpayers comply with tax provisions. The form of handling criminal acts in the field of taxation by the Directorate General of Taxes in the future developments is intended to change criminal taxation as a general act that is included as an independent crime (independent crimes), it should be done carefully and thought out carefully, it may be able to increase state revenue from the tax sector effectively and efficiently, but it can disrupt the aspect of legal justice for taxpayers and at the same time the legal rights of Taxpayers (society) as a whole. Analysis of the Press Law and the Authority of Local Journalists in Mining Issues in East Kalimantan
Indonesia is endowed with abundant natural resources (SDA); however, unsustainable exploitation has resulted in severe environmental consequences. East Kalimantan, as a major hub for the coal mining industry, faces significant challenges related to illegal mining, which is spread across 168 locations. The negative impacts extend beyond environmental degradation, leading to fatalities due to abandoned mining pits that were never reclaimed. In this context, mass media serves as a public watchdog through critical and in-depth reporting. However, local journalists encounter various challenges in covering mining issues, including pressure from capital owners, risks of criminalization, and limited access to resources. This study aims to analyze the implementation of the Press Law in supporting press freedom and the challenges local journalists face in exposing mining realities in East Kalimantan. A qualitative approach with literature review methods was employed. The study results indicate that although local media such as RRI, Kaltim Post, Kaltim Kece, and TVRI fulfill their supervisory role as mandated by the Press Law, pressure from mining companies and political interests often obstruct objective and balanced reporting. Therefore, strengthening regulations and legal protections for journalists is essential to ensure that they can carry out their journalistic duties professionally, transparently, and responsibly, in line with the principles of environmental journalism
Online Business Ethics Violations: The Unspoken Danger Behind Medan City\u27 Digital Screens
The phenomenon of online business in Medan City is growing rapidly, but it is accompanied by various violations of business ethics that harm consumers and reduce public trust. This research aims to analyze the forms of online business ethics violations, the factors causing them, and their impact on the digital trade ecosystem. Using a qualitative approach through case studies, data was collected from in-depth interviews with business actors, consumers, and sharia economic experts. The results identified various forms of violations such as price manipulation, data misuse, and fraudulent practices. The main factors that trigger violations include weak regulations, low digital literacy, and unfair business competition. The resulting impacts include a decline in consumer confidence and a slowdown in the development of the digital economy. The novelty of this research lies in the integration of the perspectives of business actors, consumers, and sharia economic experts in understanding the dynamics of online business ethics violations in Medan City.
Optimizing the Intellectual Property Rights as Banking Credit Collateral by Art Workers in Karawang
As proprietors of Intellectual Property Rights (IPR), creative professionals (designers, creators, and inventors) in Karawang regency own exclusive rights that enable them to independently profit from their works in the form of royalties or licensing. However, in reality, they have difficulties in accessing capital needed to expand their business. Some financial institutions might not accept IPR as collateral for credit even though the law principally states that they are valuable assets and therefore eligible as collateral. Copyright Law No. 28 of 2014 (Article 16) and Patent Law No. 13 of 2016 (Article 108) both permit owners and holders of intellectual property rights to utilize such rights as collateral for loans under a fiduciary arrangement. The laws should apply to copyrights and patents, but so far they haven\u27t, which is a shame because in theory they should. The lack of a change to Article 43 of BI Regulation Number 14/15/PBI/2012, which pertains to the forms of credit collateral, makes it difficult to use intellectual property rights as security for loans. Legal Protection for Migrant Workers Under National and International Law
The purpose of this study is to analyze and evaluate the implementation of legal protection for Indonesian Migrant Workers (PMI) according to national and international laws. This research aims to identify and understand the steps taken by the government in protecting migrant workers, especially those facing legal problems abroad, as well as explore effective and applicable legal protection models. Through this research, it is hoped that in-depth insights into policies and practices for the protection of migrant workers, as well as recommendations to strengthen existing legal protection in accordance with national and international standards. The research used is a normative research method with literature research involving the collection and analysis of primary, secondary, and tertiary legal materials. The results of the study show that the implementation of legal protection for Indonesian Migrant Workers (PMI) is regulated in national law through Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, which includes the placement, rights, and obligations of PMI, as well as the responsibilities of various related parties. At the international level, the 1990 International Convention on the Protection of the Rights of All Migrant Workers and Their Family Members serves as the main legal instrument. To address the legal problems faced by migrant workers abroad, the Indonesian government, through BP2MI and the Ministry of Foreign Affairs, provides legal and advocacy services, including working with Indonesian advocates and negotiating with destination countries. An effective legal protection model includes the presence of BP2MI representatives in the countries of placement and the improvement of the quality and competitiveness of PMI through training and education, in line with the constitutional mandate to protect all Indonesian citizens
CONVERGENCE OF MARRIAGE BETWEEN ISLAMIC LAW AND CUSTOMARY LAW
Customary law is a collection of norms and rules derived from the habits or customs of the community, both written and unwritten. Marriage is a physical and mental bond between a man and a woman with the aim of building a family that is sakīnah, mawaddah, rahmah and barakah. The provisions of customary law and Islamic law have significant differences. Marriage in Islamic law regarding joint property and mutual inheritance between adopted children and adopted parents can be done through the institution of mandatory wills. These two legal provisions adopted from customary law are the result of the ijtihad of Indonesian scholars, because the second issue is not found in fiqh. This innovative creation of Indonesian scholars, apart from being a manifestation of the dynamic and creative characteristics of Islamic law, is also the identity of Islam Nusantara in the field of law. Seen from this aspect, the Indonesian KHI, in the language of the Law, can be referred to as Indonesian Jurisprudence because in addition to having an Indonesian personality, it also adopts customary law that lives in local traditions
THE APPLICATION OF DIVERSION IN THE INVESTIGATION OF CRIMINAL OFFENCES IN THE FIELD OF TRAFFIC AGAINST CHILDREN
Restorative justice is a diversion process in which all parties involved in a particular criminal offence together solve problems, create an event to make things better by involving child victims, children and the community in finding solutions to repair, reconciliation and reassurance that are not based on revenge. The purpose of this study is the application of diversion in the investigation of criminal offences in the field of traffic against children and the application of diversion by investigators has been effective to be able to handle children as perpetrators of criminal offences in the field of traffic. The research method used is normative juridical research method. The Police in order to provide protection to Children Against the Law through the discretionary authority granted by the law have made various best efforts in handling child criminal cases as a whole and this can be seen from the various child criminal cases that can be resolved through the concept of restorative justice or through diversion and various rules / guidelines made to support the implementation of handling child crimes.Keadilan restorastif merupakan suatu proses diversi dimana semua pihak yang terlibat didalam suatu tindak pidana tertentu bersama-sama memecahkan masalah, menciptakan suatu kejadian untuk membuat segala sesuatunya lebih baik dengan melibatkan anak korban, anak dan masyarakat dalam mencari solusi untuk memperbaiki, rekonsiliasi dan menentramkan hati yang tidak mendasarkan balas dendam. Tujuan penelitian ini adalah penerapan diversi dalam penyidikan tindak pidana dibidang Lalu Lintas terhadap anak dan penerapan diversi oleh penyidik telah efektif untuk dapat menangani anak sebagai pelaku tindak pidana dibidang lalu lintas. Metode penelitian ysng digunakan adalah metode penelitian normatif yuridis. The Contribution of the North Sumatra Regional Broadcasting Commission (KPID) in Supervising the Broadcast of the Governor\u27s Election Campaign North Sumatra in 2024
Law No. 32 of 2002 gave birth to a new chapter in the world of broadcasting in Indonesia, through which it is regulated regarding all matters related to the world of broadcasting. Including the establishment of all independent institutions that regulate and control national broadcasting. The institution was named the North Sumatra Indonesian Broadcasting Commission. This research aims to find out the contribution of the North Sumatra KPID in supervising campaign broadcasts in the 2024 North Sumatra Governor Election. Then to analyze what strategy is used by the North Sumatra KPID in supervising campaign broadcasts in the 2024 North Sumatra Governor Election. The research used is descriptive. Data collection was carried out through in-depth interviews with the Commissioner of the Indonesian Broadcasting Commission of North Sumatra. The results of the study show that the Indonesian Broadcasting Commission of North Sumatra has made a very positive contribution in carrying out the supervision of campaign broadcasts. This is strengthened by the work carried out by KPI D North Sumatra which was positively welcomed by the community. The Indonesian Broadcasting Commission of North Sumatra also took strategic steps in supervising campaign broadcasts in the Governor and Deputy Governor Elections of North SumatraUndang-Undang Nomor 32 Tahun 2002 melahirkan babak baru dalam dunia penyiaran di Indonesia yang melaluinya diatur mengenai segala hal yang berkaitan dengan dunia penyiaran. Termasuk pembentukan seluruh lembaga independen yang mengatur dan mengendalikan penyiaran nasional. Lembaga itu bernama Komisi Penyiaran Indonesia Sumut. Penelitian ini bertujuan untuk mengetahui kontribusi KPID Sumut dalam mengawasi siaran kampanye pada Pilgub Sumut Tahun 2024. Kemudian menganalisis strategi apa yang digunakan KPID Sumut dalam mengawasi siaran kampanye pada Pilgub Sumut 2024. Penelitian yang digunakan adalah deskriptif. Pengumpulan data dilakukan melalui wawancara mendalam dengan Komisioner Komisi Penyiaran Indonesia Sumut. Hasil penelitian menunjukkan bahwa Komisi Penyiaran Indonesia Sumut telah memberikan kontribusi yang sangat positif dalam melaksanakan pengawasan siaran kampanye. Hal ini diperkuat dengan kerja yang dilakukan KPI D Sumut disambut positif masyarakat. Komisi Penyiaran Indonesia Sumut juga mengambil langkah strategis dalam pengawasan siaran kampanye pada Pemilihan Gubernur dan Wakil Gubernur Sumut
