Transition Of Authority Judicial Institutions Simultaneous National Elections 2024
The decision of the Constitutional Court No. 97/PUU-XI/2013 resulted in changes in the function and authority of the judicial institution that adjudicates Pilkada. The Constitutional Court's decision then gave birth to Article 157 of Law No. 10 of 2016 Amending Law No. 8 of 2015 (Pilkada Law) which contains provisions for the establishment of a special election judicial body that will hear disputes over the results of simultaneous national elections in 2024. However, the establishment of a special election judicial body mandated by the Pilkada Law still faces juridical obstacles if it is linked to Law 48 of 2009 concerning Judicial Power, and laws governing judicial bodies under the auspices of the Supreme Court, especially the general and state administrative courts. Another juridical problem is the Constitutional Court Decision Number 85/PUU-XX/2022 which states that the phrase "until a special judicial body is established" in Article 157 paragraph (3) of the Pilkada Law does not have binding legal force. So that the Constitutional Court's decision can be interpreted as a sign of defining the Constitutional Court as a permanent judicial institution to hear disputes over Pilkada results. This research uses normative research methods as a characteristic of legal research, using statute law approaches, expert opinions. The purpose of this research is to search and find the right norms and have legal arguments in determining the right judicial institution authorized to hear disputes over the results of the 2024 simultaneous regional elections.TRANSISI KEWENANGAN

The New Zealand Government's Efforts in Social Recognition of Motorcycle Gangs as a Social Community in Order to Maintain National Security
New Zealand faces challenges related to motorcycle gang activities that can threaten national security. In addressing this issue, the New Zealand government has made efforts to recognize motorcycle gangs as social communities to uphold national security. The method used in this research is qualitative research, and new findings regarding the research object will be supported by data collection techniques, such as structured interviews and group discussion with the Director of The Toda Peace Institute - Professor Kevin Paul Clements. This approach aims to change the negative perception of motorcycle gangs and involve them in more positive activities. In the government's efforts of social recognition towards motorcycle gangs as social communities, a softer policy approach is adopted. In this context, the government acknowledges the existence of motorcycle gangs as communities within society. This step aims to strengthen the social identity of motorcycle gangs and provide recognition to the community. The presence of motorcycle gangs in New Zealand poses significant security challenges. By enhancing their connection with the wider community, it can help maintain national security by engaging this community in positive and constructive endeavors. With this research, it is also hoped to contribute insights and recommendations to the Indonesian government on appropriate and suitable approaches to tackle the issue of motorbike gangs in Indonesia
Dynamics of Border Conflict Resolution Between Indonesia-Timor Leste
Border areas are areas that are geographically directly adjacent to other countries. The border area is also one of the strategic areas, where the area that nationally concerns the lives of many people, both in terms of political, economic, social, cultural, and hankam interests. Border conflicts are usually particularly vulnerable if the contested territory has excellent natural and economic resource potential. The purpose of this study is to describe the factors that cause conflict and the urgency of boundary affirmation and describe efforts to resolve boundaries through regulation and non-regulation. The method used is a qualitative method with a type of descriptive approach through literature study. Based on the results of the study, it is understood that the settlement of Indonesia's border with Timor-Leste will be carried out peacefully, without the threat of violence, and with full respect for international law. This article seeks to understand the Indonesia-Timor Leste border dispute from the perspective of international relations. Three strategies can be taken by Indonesia to resolve this dispute, namely military confrontation, the use of formal institutions such as international organizations, and the use of informal institutions namely norms, beliefs, ideas, and values. This article argues that to resolve the dispute between Noel Besi/Citrana and Bijael Sunan/Oben it is not enough to rely on international treaties alone, Indonesia needs to put more emphasis on the importance of understanding the norms, beliefs, ideas, and values of indigenous peoples living in the disputed area. The role of the government in efforts to maintain the integrity of the country's territory through bilateral communication and cooperation can then be utilized by local actors to resolve conflicts and participate in defending the territory
Separatism In The Perspective Of International Law And National Security: A Case Study Of The Armed Criminal Group (Kkb) In Papua
The separatist movement in Papua, known as the Armed Criminal Group (KKB), has been a phenomenon in recent years. The KKB is a group of armed individuals advocating for the independence of West Papua from Indonesia. They engage in a series of activities including attacks on security forces, extortion, facility burnings, and human rights violations. Addressing the separatist movement of the KKB in Papua involves efforts to resolve the conflict peacefully, promote dialogue, strengthen regional autonomy, and address the root causes of the conflict. Long-term solutions require collaboration between the Indonesian government, Papuan community leaders, and separatist groups willing to adopt peaceful political approaches and respect international law. This paper will investigate the issue of separatism in the context of international law, focusing on the case study of the armed criminal group in Papua. The research aims to analyze the international legal responses to separatist movements that employ violence and illegal methods to achieve their goals, involving the analysis of international law concerning state sovereignty, human rights, and enforcement of international law. Communication Of The Crisis Of Hotel Ibis Budget Daan Mogot Jakarta In Facing The Covid-19 Pandemic
This study aims to understand the crisis response strategy that occurred at the Ibis Daan Mogot Hotel Jakarta in dealing with the Covid-19 pandemic. The research method used is case study research with a descriptive approach with qualitative data types. Researchers use a post-positivism paradigm because researchers want to build understanding regarding the crisis communication strategy of the Ibis Budget Daan Mogot Hotel Jakarta in dealing with the Covid-19 pandemic. The post-positivism paradigm trusts more in the process of verifying a finding of results using various methods so that researchers choose this paradigm. In this study the researcher is the key instrument, the data collection technique is carried out by triangulation or combination, the data analysis is inductive or qualitative, and the results of qualitative research emphasize meaning rather than generalization. In this study, Miles and Huberman's analytical techniques were used which consisted of data reduction, data presentation, and drawing conclusions. In this study the researchers explored the truth of the information through interviews with various parties. In addition, researchers also make observations, archives, and photographs, as well as observing news and websites. The crisis that occurred at the Ibis Budget Hotel Jakarta Daan Mogot Jakarta was a crisis caused by the Covid-19 pandemic so that the crisis that occurred could be categorized as a victim cluster type of crisis because it was caused by the Covid-19 pandemic. In the victim cluster, it means that the Ibis Budget Hotel Jakarta Daan Mogot Jakarta positions itself as a victim so that the attribution that the company is responsible for the crisis is very weak. MEMPERKUAT KESADARAN BELA NEGARA GENERASI MILENIAL MELALUI MANAJEMEN PERTAHANAN TERHADAP ANCAMAN EKONOMI PASCA PANDEMI COVID-19
The Covid-19 pandemic that hit globally at the end of 2019 had a significant impact on the Indonesian economy. The PSBB (Large-Scale Social Restrictions) policy enacted at that time caused various economic problems such as increasing commodity prices in the market and increasing unemployment due to layoffs (Termination of Employment) which occurred due to the declining economic growth rate. This research uses a qualitative approach that aims to identify how the economic impact of the post-Covid-19 pandemic in Indonesia and outline how appropriate state defense efforts for the millennial generation to face economic threats as non-military threats that affect national resilience. The results of this study confirm that the concept of state defense efforts must be implemented gradually and continuously in order to instill awareness of state defense in the younger generation. This approach can be done through various channels, both through formal and non-formal education. Promoting the concept of universal defense by involving all potential national resources is key in strengthening national character building. This is done by fostering awareness and state defense skills for every Indonesian citizen, so that they are ready to become part of the human resources that defend the country. Moreover, this approach also strengthens national identity that is rooted in personality and culture based on the values of Pancasila. Given the impact of the Covid-19 pandemic on Indonesia's economy, including rising prices of basic necessities, high unemployment rates, and declining investment, it is important that we raise state defense awareness and educate Millennials about their role in maintaining the country's resilience.ABSTRAK
Pandemi Covid-19 yang melanda global pada akhir tahun 2019 memberikan dampak yang cukup signifikan bagi perekonomian Indonesia. Kebijakan PSBB (Pembatasan Sosial Berskala Besar) yang diberlakukan pada saat itu menimbulkan berbagai masalah ekonomi seperti meningkatnya harga komoditas di pasar dan meningkatkan angka pengangguran akibat PHK (Pemutusan Hubungan Kerja) yang banyak terjadi akibat laju pertumbuhan ekonomi yang menurun. Penelitian ini menggunakan pendekatan kualitatif yang bertujuan untuk mengidentifikasi bagaimana dampak ekonomi pasca pandemi Covid-19 di Indonesia dan menguraikan bagaimana upaya bela negara yang tepat bagi generasi milenial untuk menghadapi ancaman ekonomi sebagai ancaman non militer yang memengaruhi ketahanan nasional. Hasil penelitian ini menunjukkan bahwa diperlukan konsep upaya bela negara yang dilakukan secara bertahap dan berkelanjutan untuk menanamkan kesadaran bela negara bagi generasi muda baik melalui pendidikan formal dan non formal. Konsep pertahanan semesta dengan melibatkan seluruh potensi sumber daya nasional menjadi kunci dengan meningkatkan pembangunan karakter bangsa melalui pembinaan kesadaran dan kemampuan bela negara bagi setiap warga negara Indonesia untuk menyiapkan sumber daya manusia pertahanan negara, serta penguatan jati diri bangsa yang berdasarkan kepribadian dan berkebudayaan berasaskan Pancasila.

PERAN BELANJA MODAL DALAM MEMODERASI PENGARUH MANAJEMEN LABA RIIL DAN MANAJEMEN LABA AKRUAL TERHADAP NILAI PERUSAHAAN
This study aims to obtain empirical evidence on the effect of real earnings management and accrual earnings management on firm value moderated by capital expenditures, as well as using control variables in the form of company size, female directors and financial flexibility. The research method used in this research is panel data regression analysis with the research sample, namely all energy and raw goods sector companies listed on the Indonesia Stock Exchange during 2019-2022. The results of the study show that real earnings management has a negative effect on firm value. Meanwhile, accrual earnings management and moderating role do not have a negative effect on firm value. In addition, only firm size as a control variable has an effect on firm valuePenelitian ini bertujuan untuk memperoleh bukti empiris atas pengaruh manajemen laba riil dan manajemen laba akrual terhadap nilai perusahaan yang dimoderasi oleh belanja modal, serta menggunakan variabel kontrol berupa ukuran perusahaan, Direksi Wanita dan kelonggaran keuangan. Metode penelitian yang digunakan dalam penelitian ini yaitu analisis regresi data panel dengan sampel penelitian yaitu seluruh perusahaan sektor energi dan barang baku yang terdaftar di Bursa Efek Indonesia selama 2019-2022. Hasil penelitian menunjukkan bahwa manajemen laba riil berpengaruh negatif terhadap nilai perusahaan. Sedangkan, manajemen laba akrual dan peran pemoderasi tidak berpengaruh negatif terhadap nilai perusahaan. Selain itu, hanya ukuran perusahaan sebagai variabel Kontrol yang berpengaruh terhadap nilai perusahaan
Student’s Experiences on Their Thesis Proposal Seminar
This study aims to investigate students’ experiences based on their thesis proposal seminar for Economic Education Students’ Department Study Program at Universitas PGRI Wiranegara. The researcher used the questionnaire to get the data from the students’ experiences based on their thesis proposal seminar at three stages, starting from the beginning up to the end. Based on the result shown that for the first table explained before the thesis proposal seminar presentation exposed that most students’ good understanding of the learning objective of the seminar course (83,3%) and that they felt confident and supported by many resources. For the second table explained during the seminar session, most students agree (70,9%) that seminar encouraged their ideas to share and learn from others, but (45,8%) disagree that group discussion in a presentation session seminar is better than lecturing. The last table explained after the seminar session, showed the students that (93,8%) believe that post-seminar questions and feedback are informative both from lectures and from their friends, also (70,8%) agree that the seminar success through good preparation, and (81,3%) that classmates’ participation supported the seminar’s success
Improvement Efforts Of Indonesia's Defense Diplomacy Performance Via Deterrence Strategy In Dealing North Natuna Sea Conflict (2016-2021)
One of Indonesia's most actual maritime border disputes is the border dispute between Indonesia and China in the North Natuna Sea. This research focuses this on examining how to improve the performance of Indonesia's defense diplomacy through deterrence strategies in dealing with conflicts in the North Natuna Sea. This research uses qualitative-descriptive. The location of this research was carried out in Jakarta, in this case the Ministry of Defense of the Republic of Indonesia. Research time for six months. The research subjects were six sources. The object of this research is about improving the performance of defense diplomacy through deterrence strategies in the North Natuna Sea. The primary data collection technique is an in-depth interview method, while the secondary data collection technique uses a literature study. The results show that the performance of Indonesia's defense diplomacy in the North Natuna Sea for the 2016-2021 period is still relatively weak, especially if it is related to the potential threat from the Chinese side. Indonesia's deterrence strategy in the North Natuna Sea for the 2016-2021 period has so far been carried out with external policies, namely cooperating with foreign parties, both bilaterally, regionally, and globally. Indonesia's efforts to improve defense diplomacy in the North Natuna Sea through a deterrence strategy can be carried out with at least 10 items of deterrence strategy, including conducting joint military exercises; enhance joint surveillance and patrols; increase the discussion of maritime issues in regional and international forums; and increase advocacy for the law of the sea
The Effect of the Performance of TNI-AU Search and Rescue Team Personnel during the Cianjur Regency Earthquake Emergency Response
Earthquakes are natural phenomena that have the potential to result in physical damage and loss of life. In an emergency like this, the performance of the TNI-AU Search and Rescue team has a direct influence on the effectiveness and efficiency of rescue efforts, as happened during the earthquake emergency response period in Cianjur Regency. A quick and precise response from the TNI-AU Search and Rescue team in emergency situations such as earthquakes can have a direct impact on the safety of victims. This study aims to evaluate the ability of personnel to deal with earthquake emergency response situations in Cianjur, West Java. The research method used is a qualitative approach that involves in-depth document analysis. In general, the TNI-AU has succeeded in achieving effectiveness and efficiency in rescue efforts during the earthquake emergency response period in Cianjur Regency, including in terms of fast and appropriate victim handling, coordination with related institutions, monitoring the latest information, and the availability of equipment and defense equipment support. The results of SAR training applied by the TNI-AU have proven to provide positive results, as can be seen from direct actions taken in a short time after the earthquake
