Jurisdictions of International Commercial Arbitration in Afghanistan and UNCITRAL Laws
One of the important issues in international commercial arbitration is the arbitration board, which consists of one or more arbitrators to resolve commercial disputes based on the agreement of the parties to the dispute, or by the arbitration organization or the court, and is dissolved after dealing with the commercial disputes. In this research we examine the competence of the arbitration board in international commercial arbitration, focusing on its ability to make decisions regarding jurisdiction and the examination of the existence of the arbitration agreement. The research employs a descriptive-analytical method and relies on library and electronic sources for data collection. The findings designate that the arbitration board, per the Afghanistan Arbitration Law and the UNCITRAl Model Law on International Commercial Arbitration, has the authority to determine its jurisdiction and observe the existence of the arbitration agreement. It is established that the principle of competence-competence is widely accepted by the laws of many countries. However, it is elucidated that the subject matter jurisdiction lies with the agreement of the parties involved. The research highlights the importance of the arbitration board in impartially resolving commercial disputes evolving from economic and commercial contracts and emphasizes its role in achieving quick and fair dispute resolution
Opportunities and Challenges in Development of the Floating Solar Power Plant Project at the Adi Soemarmo Airport
Electrical energy is the most critical need in the defense sector to maintain state sovereignty. The floating PLTS in Cengklik Reservoir can be used as the main electricity source in the Adi Soemarmo Air Base building to support energy security and avoid black outs. Cengklik Reservoir has a total surface area of 253 ha. This research aims to find out what opportunities and challenges there are in developing a floating solar power plant project at Adi Soemarmo Air Base so that it can reduce dependence on fossil energy as a primary energy source. The research method used is descriptive qualitative. The research results show that if the utilization of floating PLTS is assumed to be 5% by the Minister of PUPR's regulations, the area of the Cengklik Reservoir where PLTS is installed is 12.65 ha, then a potential for floating PLTS of 14.80 MWp can be identified. This potential can support more reliable military operations. The challenge in building the floating PLTS project in Adi Soemarmo is that the distance between Cengklik Reservoir and Adi Soemarmo Air Base is 2.6 km, and regulations still need to be perfected in terms of permits
The Role of Accounting And Auditing Organization For Islamic Financial Institutions (AAOIFI) in Sharia Statement Of Fiancial Accounting Standards (PSAK)
This research is intended to provide an understanding of Islamic financial accounting standards. In carrying out its sharia principles, sharia banks must also uphold the values of justice, trust, partnership, transparency and mutual benefit for both the bank and for customers which are the pillars in carrying out muamalah activities . With the rapid growth rate of Islamic Financial Institutions in the world, an appropriate standard is needed in presenting financial reports to overcome differences in the preparation of each country. The role of AAOIFI in this regard has greatly contributed in terms of the formulation of standards, although in practice there are many obstacles to its application, moreover the standard that is widely used by countries is IFRS and it is not easy for countries to adopt AAOIFI standards in a short time . Most of the standards used by Islamic banking follow the AAOIFI standards adopted in the Sharia PSAK but in relation to IFRS standards are also applied as long as they do not conflict with sharia principles and values
Analysis Of The Effectiveness Of Infiltration Wells In Disaster Risk Reduction: Literature Study
Infiltration wells are wells or holes located on the surface of the ground. The rapid urban development has led to a decreasing area of rainwater infiltration, as the increasing coverage of buildings reduces the open space and results in longer accumulation times for water, potentially causing flood disasters. Aside from flooding issues, the availability of groundwater is crucial for the areas where rainwater infiltration occurs. If groundwater decreases, the supply of groundwater will be affected, impacting communities whose clean water needs depend on groundwater in their region. The research method used in this study is an internet-based literature review. Downloaded articles are then imported into Nvivo 12 Plus software. The data is examined and analyzed to draw conclusions. Based on the analysis of the five articles, the author concludes that infiltration wells are effective in reducing disaster risks. Additionally, infiltration wells can be used as a substitute for groundwater and enable communities to adapt to climate change. Efforts from all layers of society are essential to create infiltration wells in their respective areas because infiltration wells are not meaningful if only a few communities implement them
Sebuah MITIGASI AKIBAT PENCEMARAN SENJATA KIMIA SARIN UNTUK MENGURANGI BENCANA NUBIKA
The misuse of chemical weapons can have highly dangerous consequences for both humans and the surrounding environment. One of the deadliest chemical weapons is sarin, which can lead to death within minutes of exposure. To reduce the consequences of a chemical weapons disaster, effective contamination mitigation is required. This research employs a qualitative descriptive method, with a literature review study, to discuss contamination mitigation strategies that can be used to minimize the consequences of a chemical weapons disaster caused by the use of sarin. Some of these strategies include the use of protective clothing, gas masks, and environmental decontamination. In emergency situations, protective clothing and gas masks can help shield individuals from exposure to chemical weapons. Furthermore, timely environmental decontamination can aid in reducing contamination levels and the risk of exposure. In addition to contamination mitigation strategies, preventive efforts are also crucial in lessening the impact of a chemical weapons disaster involving sarin. Prevention efforts involve chemical weapon surveillance, training and education, as well as the development of better detection and protection technologies. By implementing the appropriate contamination mitigation strategies and effective prevention efforts, it is hoped that the consequences of a chemical weapons disaster involving sarin can be significantly reduced.Penyalahgunaan senjata kimia dapat menimbulkan akibat yang sangat berbahaya baik bagi manusia maupun lingkungan sekitar. Salah satu senjata kimia paling mematikan adalah sarin, yang dapat menyebabkan kematian dalam beberapa menit setelah terpapar. Untuk mengurangi dampak bencana senjata kimia, diperlukan mitigasi kontaminasi yang efektif. Penelitian ini menggunakan metode deskriptif kualitatif, dengan studi literatur review, untuk membahas strategi mitigasi kontaminasi yang dapat digunakan untuk meminimalkan dampak bencana senjata kimia akibat penggunaan sarin. Beberapa strategi tersebut antara lain penggunaan pakaian pelindung, masker gas, dan dekontaminasi lingkungan. Dalam situasi darurat, pakaian pelindung dan masker gas dapat membantu melindungi individu dari paparan senjata kimia. Selain itu, dekontaminasi lingkungan yang tepat waktu dapat membantu mengurangi tingkat kontaminasi dan risiko paparan. Selain strategi mitigasi kontaminasi, upaya pencegahan juga penting dalam mengurangi dampak bencana senjata kimia yang melibatkan sarin. Upaya pencegahan mencakup pengawasan, pelatihan dan pendidikan senjata kimia, serta pengembangan teknologi deteksi dan perlindungan yang lebih baik. Dengan menerapkan strategi mitigasi kontaminasi yang tepat dan upaya pencegahan yang efektif, diharapkan dampak bencana senjata kimia yang melibatkan sarin dapat dikurangi secara signifikan
Influence Of Quality Of Work Life, Organizational Culture And Workload On Teacher Performance
The quality of work life influences performance, meaning that the higher the quality of work life can improve performance. Performance is the basis for achieving the goals of an organization. This research aims to look at the influence of quality of work life, organizational culture and workload on teacher performance. The research was carried out using a quantitative approach where quantitative data relies on a population and withdrawal techniques, and uses questionnaires for data collection. The method used in the research is the regression analysis method. The research population was all teachers at SDN schools in Kertasari District, represented by teachers with ASN and PNS status. Number of teachers in 41 schools. So if we describe the total number of teachers, there are 135 who will become population and sample data or will become respondents in further research. When conducting this research, when collecting data, you can use field studies to come directly to the research object. Then by distributing and giving questionnaires directly to respondents. Data analysis used to determine the influence of independent variables and dependent variables is descriptive statistical analysis, validity test, reliability test, simple linear regression analysis, followed by a significant test, namely the t test. This research explains the influence of Quality of work life, organizational culture, workload on the performance of elementary school teachers in Kertasari District. From the problem formulation presented in chapter 1 and the results of data testing that has been carried out as well as the discussion presented in chapter IV previously, the following conclusions can be drawn. Simultaneously, the calculated F-value is 2.967 and the F-table value is 3.18, so that the F-count value (8.945) < F-table (2.67) with a significant value of 0.000 < 0.05, then, H0 is rejected and H4 is accepted. The Influence Of Incentives And Intrinsic Motivation On The Work Spirit Of Employees Of In Regional Public Company West Java: PENGARUH INSENTIF DAN MOTIVASI INTRINSIC TERHADAP SEMANGAT KERJA KARYAWAN PT PDAM TIRTA JATI KOTA CIREBON
This study investigates the impact of incentives and intrinsic motivation on employee morale at PDAM Tirta Jati Cirebon Regency. The research used quantitative techniques, including observational data gathering and questionnaires, with 149 participants. The study used SPSS Version 25.0 for data analysis. The results indicated that incentives (β = 0.360, t = 5.623, p = 0.000) did not significantly influence employee morale on an individual level, but they did positively contribute to it when combined with intrinsic motivation. Intrinsic motivation (β = 0.490, t = 3.586, p = 0.000) showed a significant positive impact on employee morale. The simultaneous significance test revealed that employee morale is significantly impacted by the combination of incentives, intrinsic motivation, and job excitement (F = 32.926, p < 0.001), with these factors collectively explaining 30.3% of the variance in employee morale (Adjusted R² = 0.303). This highlights the importance of intrinsic motivation and work enthusiasm in improving employees in the PDAM Tirta Jati Cirebon District environment. The research's limitations include its focus on PDAM Tirta Jati Cirebon district employees, which may limit its generalizability. Future research could explore other organizational contexts to increase the generalizability of the resultsTujuan: Penelitian ini mengetahui pengaruh insentif dan motivasi intrinsik terhadap semangat kerja pegawai PDAM Tirta Jati Kabupaten CirebonDesain/Metodologi/Pendekatan: Penelitian ini menggunakan metode penelitian kuantitatif. Dengan teknik pengumpulan data angket dan observasi. Sampel yang digunakan dalam penelitian ini sebanyak 149 responden. Teknik pengambilan sampel dilakukan dengan cara purposive sampling. Dengan teknik analisis data menggunakan uji validitas, uji reliabilitas, uji asumsi klasik berupa uji normalitas, uji multikolinearitas, uji heteroskedastisitas, uji determinasi, dan uji hipotesis. Metode analisis yang digunakan adalah metode Statistical Product and Service Solution (SPSS) Versi 25.0.Keterbatasan/Implikasi Penelitian: Salah satu keterbatasan penelitian ini adalah penelitian ini hanya berfokus pada pegawai PDAM Tirta Jati Kabupaten Cirebon, sehingga membatasi kemampuan generalisasi temuan. Penelitian di masa depan dapat mengeksplorasi konteks organisasi lain untuk meningkatkan kemampuan generalisasi hasil.Berdasarkan hasil penelitian disimpulkan bahwa meskipun pengaruh insentif tidak memberikan pengaruh yang signifikan terhadap pengaruh insentif (B 0,360, t 0,412, p=0,412 9,051 P=0,010) memberikan kontribusi positif yang signifikan terhadap semangat kerja karyawan. Hasil uji signifikansi secara simultan menunjukkan bahwa secara bersama-sama pengaruh insentif, motivasi intrinsik, semangat kerja berpengaruh signifikan terhadap semangat kerja karyawan (F=32,926, p<0,001). Temuan ini menyoroti pentingnya motivasi intrinsik dan semangat kerja dalam meningkatkan kinerja pegawai di lingkungan PDAM TIRTA JATI KABUPATEN CIREBON
Deterrence Strategy Through Deploying KRI in the North Natuna Sea to Support the National Defense System
The vast maritime territory of Indonesia, rich in natural resources, has attracted interest from various parties, both domestic and international, to exploit its potential, even if it means violating established regulations at the national and international levels. One of the maritime areas facing complex challenges, considering the numerous legal violations and threats to the sovereignty of the Republic of Indonesia (NKRI), is the North Natuna Sea. The objective of this research is to analyze the operational patterns and preparations patterns of the Indonesian Navy Vessels (KRI) for deterrence strategies in supporting the national defense system. This study employs a qualitative method, utilizing interviews as a research instrument, supported by literature reviews, including books and other written references related to the research object. The results of this research indicate that the deterrence strategy has not been optimally implemented. This is due to various encountered challenges in the efforts made, highlighting the need for evaluation and improvement of both operational and preparedness patterns of KRI. This is essential to ensure that the deterrence strategy in the North Natuna Sea region, supporting the national defense system, can be carried out effectively and efficiently
The The Effectiveness Of English Capacity Building In Developing Tourist Destination
Hotels are one of the mandatory accommodations. Optimal hotel management was a guide for every tourist to get comfort during their stay. This study aims to examine the performance of hotel managers in North Tapanuli regency through three variables: English capability, human resources development, and tourism destination.This study used a quantitative descriptive approach, with scoring and reduction data analysis techniques. The research samples were 50 hotel managers in North Tapanuli regency. Accidental sampling technique was used to select based on their categories. The sample was 50 respondents.The results showed English capacity building (X1) had a positive and significant effect on tourist destinations (X1) tcount 4.353 > ttable 2.01174 and a significant value of 4.353 > α 0.05, destination development (X2) had a positive and significant effect on tourist destination tcount 2,167 > ttable 1,992 and a significant value of 2,011 > α 0.05 and English capacity building (X1) and regional development (X2) simultaneously had a significant effect on tourist destinations (Y) that Fcount > Ftable or 26,285 > 3,200 and a significant level of 0.000 < 0.05. The research implications provide an overview of hotel performance in North Tapanuli as a reference in improving human resources development for hotel managers
Enhancing Maritime Security In Indonesia: A Case Study Of Indonesian Coastguard Approach To People Smuggling In Strategic Ocean
In the face of globalization and increasing maritime trade, the Maritime Security Agency of the Republic of Indonesia (Indonesian Coast GuardRI) plays an important role in safeguarding the country's waters, particularly the Makassar Strait, against the threat of people smuggling . This study evaluated Indonesian Coast Guard RI's strategy to combat people smuggling , focusing on personnel capacity building, interagency collaboration, and strict regulatory enforcement. This research uses normative legal research methods, using legislative, conceptual, and historical approaches. It belongs to the category of descriptive research, using secondary data consisting mainly of primary legal material (legislation) and secondary legal material in the form of textbooks and scientific journals on people smuggling. The analysis shows (1) indonesian maritime security agency by joint operations and interagency synergy, personnel capacity enhancement, security and safety patrol mandate (2) maritime routes poses through analysis of specific incidents, evaluation of countermeasures, utilization of technology and intelligenc, (3) evaluation of method and strategy effectiveness through training impact on personnel, interagency collaboration, implementation and regulatory compliance, (4) exploration of new technology potential through advanced surveillance system utilization, integration of artificial intelligence, data-driven approaches, (4) analysis of motivations and tactics through analysis of perpetrator motivations, analysis of smuggling and people smuggling tactics. Conclusion of this research is that Indonesian Coast Guard holistic approach, coupled with collaboration with relevant agencies, has positively impacted the reduction of people smuggling incidence. Nevertheless, challenges remain, requiring further research to optimize strategies to more effectively ensure Indonesia's maritime security against the threat of people smuggling
