No full textAbstract:This article examines the scope of the Danish opt-out within the field of EU criminal law. It analyzes the historical and legal origins of the opt-out and provides a doctrinal assessment of key issues concerning its scope, including the significance of judgments from the Court of Justice of the European Union rendered within the framework of the opt-out. Subsequently, Denmark’s position is compared with that of the other Nordic countries, concluding that Denmark’s relationship to EU criminal law is closely comparable to Norway’s. Finally, the article identifies key future challenges that Denmark may face due to its position outside the EU criminal law cooperation. It argues that Denmark’s non-participation in the development of a common EU standard for criminal procedural rights may affect its ability to participate in EU instruments founded on the principle of mutual trust.
I denne artikel undersøges rækkevidden af det danske retsforbehold på det strafferetlige område. Artiklen analyserer rets forbeholdets historiske- og juridiske oprindelse, og leverer en retsdogmatisk gennemgang af centrale problemstillinger vedrørende dets anvendelsesområde, herunder betydningen af domme fra EU-Domstolen, der afsiges indenfor for rammerne af retsforbeholdet. Herefter sammen holdes Danmarks position med de øvrige nordiske landes. Det konstateres, at Danmarks status i forhold til EU-straffe retten i vidt omfang kan sammenlignes med Norges. Afslutningsvist udpeges en række fremtidige udfordringer, som Danmarks position uden for EU-strafferetssamarbejdet kan medføre. Det konkluderes, at Danmarks manglende deltagelse i opbygningen af en fælles EU-standard for strafprocessuelle rettigheder potentielt kan få konsekvenser for Danmarks mulighed for at deltage i EU-instrumenter, der bygger på princippet om gensidig tillid (mutual trust)

No full textAbstract:The article suggests combining script analysis and crime prevention theories to tackle economic and organised crime. These formsof crime often consist of a series of interconnected steps – like a script – and usually occur within the context of complex legal or illegal operations. By using script analysis, the crime process is broken down into a series of steps, including preparation and follow-up work. With the various steps of the crime process revealed, the next phase is to identify appropriate crime prevention measures. In this part of the analysis, it is beneficial to apply routine activity theory, situational crime prevention, and crime pattern theory. The combination of script analysis with the aforementioned theories functions as a multitool. This approach has been tested on specific cases across several crime types, for instance, the illegal diesel trade. One study showed that in addition to crime prevention measures, suggestions for detecting criminal activity could also be identified
Visionsledelse: udviklingsdialoger der øger værdikongruens, visionsvalens og medarbejderengagement
No full textEngagerede medarbejdere er en central del af en velfungerende offentlig organisation. Når ledere udøver visionsledelse, kan de være med til at understøtte værdikongruens, visionsvalens og medarbejderengagement. Men det kan være svært at udøve denne form for ledelse, og litteraturen kommer ikke med mange bud på, hvordan opgaven kan gribes an i praksis. Denne artikel udfolder, hvordan målorienterede udviklingsdialoger kan være en god ramme for udøvelse af visionsledelse, og tilbyder en konkret model for denne type dialoger. Artiklen bygger på et 15 måneder langt felteksperiment med 226 danske ledere og 4.442 beskæftigelsesmedarbejdere. De empiriske fund viser, at målorienterede udviklingsdialoger øger overensstemmelsen mellem medarbejdernes personlige værdier og organisationens værdier samt styrker medarbejdernes visionsvalens og arbejdsengagement. Fundene viser også, at ledelsestræningsprogrammer designet med en kombination af klasserumsundervisning, aktionslæringselementer og digitale ledelsesredskaber kan fremme lederes brug af sådanne udviklingsdialoger

No full textVælgernes holdninger og de folkevalgtes responsivitet over for disse er grundpiller i det moderne demokrati. Men hvilken rolle spiller de politiske partier i holdningsdannelsen, og er partiernes mulighed for at yde påvirkning uafhængig af påvirkningens ideologiske retning? Jeg argumenterer i denne artikel for, at vælgerne benytter deres partitilhør som en social gruppeidentitet, der muliggør en adoption af deres partis holdning til konkrete politiske forslag. Artiklen finder på baggrund af et surveyeksperiment med deltagelse af mere end 3000 danske vælgere (771 socialdemokratiske vælgere), at socialdemokratiske vælgere udtrykker mere ideologisk højreorienterede (venstreorienterede) holdninger, når de eksponeres for højreorienterede (venstreorienterede) politikpositioner fra Socialdemokratiet. Gennem en adskillelse af parti og ideologi giver artiklens design mulighed for at undersøge partipåvirkningen af vælgernes holdninger i begge ideologiske retninger i en virkelighedsnær dansk kontekst
Using the vignette technique to research health communication in linguistically and culturally discordant settings
No full textBackground: The linguistic diversity of today’s societies presents challenges to ensuring that everyone, regardless of their linguistic background, can access and understand health information. The vignette technique offers an approach to exploring these challenges and collecting rich data through contextualized scenarios. Aim: To explore the use of the vignette technique for data collection in linguistically and culturally diverse healthcare settings involving migrants. Methods: To contextualize the vignette technique, the article reviews studies that have employed this method for data collection, and illustrates its application through a study that used vignette-based interviews. Results: In the first part of the paper, the rapid scoping review identified recurring topics, research approaches and measured constructs in vignette-based studies. In the second part, through the “Maria” vignette, the paper further illustrated key methodological considerations for applying the vignette technique in future research. Conclusion: While using the vignette technique is not novel in healthcare communication, its use in the context of qualitative interviews with migrants can prove helpful in eliciting individuals’ stories and experiences in high-risk and sensitive contexts
A pentadic analysis of the “Vax That Thang Up” COVID-19 vaccination campaign
No full textBackground: Amid the COVID-19 pandemic, vaccination campaigns have proliferated, with an emergence of non-health organizations endeavoring to sway vaccine skeptics. Aim: This paper analyzes the rhetorical strategies and audience response of one campaign - "Vax That Thang Up" - by BLK, a dating app for black singles. Method: Using a pentadic analysis, I examine how and why “Vax That Thang Up” attempts to persuade its target population - single black people - to get vaccinated, what the ad suggests about how this population makes health decisions, and how these individuals identify (or not) with the campaign’s message. Results/Discussion: Ultimately, this research sheds light on how contemporary health campaigns targeted toward minority populations can inadvertently reinforce stigmatized narratives, undermine audience agency, and lead to a resistant audience. Health promotion strategies must be sensitive to the historical conditions that have influenced an audience's attitude towards the American healthcare system. Conclusions: Health messaging aimed at historically marginalized and underserved populations, which have had to navigate difficult messaging in the past, highlights the importance of providing health information that fosters greater understanding, curiosity, and empowerment among these groups
The railway landscape and more-than-human heritage : – an Essay
No full textIn the contemporary Finnish inventories and discussion on cultural heritage and heritage environments, it has becomesomewhat commonplace to distinguish three discrete, yet interrelated aspects: Architectural history, history itself and the value of the landscape. Within these three different aspects of heritage values listed above, the landscape-related one are apparently the most vaguely elaborated, and generally accepted and satisfactory criteria have not been developed so far.In this essay I will be focusing on landscape-related heritage values as a category, that has the potential to transcend the nature-culture dichotomy, thus also paving the way for a new understanding of “culture” in cultural heritage studies.I will employ the concept ”more-than-human”, notably proposed by David Abram in 1996, simply as a substitute for “nature”. In the mainstream environmental philosophy of the recent decades, the latter has been seen as increasingly problematic, as it appears to imply humanity as being separate from the rest of nature (and historically has been used exactly for the purpose of such demarcation). These recent post-humanist critiques, questioning the culturenature dichotomy, have also echoed through heritage discourses during the recent years. Especially inspired by the concept of ruderal heritage developed by the human geographer Caitlin DeSilvey, heritage is here understood as products of human – non-human relations, past and present, that are manifested in the landscape.I will ask, how the more-than-human heritage becomes visible in the Finnish railway landscapes, through selected case examples presented through photographic material. This photographic material has been mostly produced during the ongoing heritage inventories of the Finnish railway network carried at the Finnish Railway Museum, while also accompanied by examples produced in relation to my arts-based doctoral research project, still undergoing in the Aalto University School of Arts, Design and Architecture, Finland.Firstly, I will discuss the relation between heritage and landscape, and then move on towards heritage dimensions of the (Finnish) railway landscape. I will begin by noting the difference between landscape as a panoramic view from the train, and the railway as tangible heritage environment, or landscape. It is claimed that these two are interlinked, and the connection is made visible through Wolfgang Schivelbush’s notion of ‘foreground’, as well as that of ‘proximity’, proposed by Finnish geographer J.G. Granö already in the early 20th century.The emergent qualities in the proximity of railway, especially vegetation in the railway embankment and its surroundings, are seen as important contributors of landscape heritage values – both as the foreground of the passenger’s view, and as material and living “objects” or properties in the railway environment as a heritage landscape. I will discuss their connections, before finally taking on examples of more-than-human heritage in some more limited, distinctive heritage “sites” related to the railway, such as abandoned alignments and railway guard’s cottage sites. These may not be relevant to the passenger experience of landscapes, but they still offer an insightful, parallel perspective to the more-than human heritage in railway landscapes.My methodological orientation also emphasizes the importance of the visual and photographic medium. Photographs are not innocent “windows” to the reality of things, although under certain conditions they may enable the sensory, material world to speak for itself, through its own forms. The assertive, argumentative power of photographs, however, seems dependent on the visual qualities of the photographs themselves.This essay emphasizes the connection between heritage and landscape. My main argument in this essay is that heritage in general, but especially that of the railway, involves a strong more-than-human dimension, which suggests looking at heritage in new ways, to make sense of the historical relations between human and non-human worlds, while also embracing change, emergence and resulting temporal depth, that is constantly being produced by temporal processes and non-human agencies, at work in the landscape. This kind of dynamic understanding of heritage also opens towards a utopian, future-oriented view; that of an increasing awareness of coexistence between human and nonhuman worlds.The structure of this essay is the following: before discussing empirical cases, I will set the ground by discussing the landscape dimension of railway heritage, by briefly addressing the landscape in the railway journey experience, and how railway landscape has been addressed in Finnish heritage discourse thus far, moving then on to recent critiques of anthropocentric heritage understandings, that also seem to underline the fundamental connectedness of heritage and landscape. Then I will discuss the concepts of landscape and the related notion of proximity or foreground, as that is the spatial range where material qualities of the railway environment and the panoramic view from the moving train are interlinked. Then, through a set of empirical cases, I finally turn towards the railway as heritage landscape, as well as to a few heritage ‘sites’ related to the railway – the typical heritage approach – and discuss the more than human aspects and processes like vegetation and ruination for their landscape-related heritage value
