Filsafat Etika dalam Islam: Antara Akhlak dan Hikmah
Islamic ethics has unique characteristics that distinguish it from other ethical systems, because it is rooted in divine revelation while also making room for the role of reason. Two key concepts that stand out in Islamic philosophy of ethics are morality and wisdom. Morality is understood as a system of values and behaviors that is based on the Qur'an and Sunnah, and reflects the normative and spiritual aspects of Islamic teachings. Morality emphasizes character formation that reflects faith through behaviors such as honesty, patience, and justice. On the other hand, wisdom, which literally means wisdom, is a form of rational and spiritual intelligence that allows individuals to apply moral values precisely, contextually, and proportionally. This paper aims to explore the philosophical relationship between morality and wisdom in the Islamic ethical system. Morality provides a fixed and universal moral direction, while wisdom provides flexibility in the application of these values in the midst of the complexities of real life. In the contemporary context, this blend is essential to form a Muslim personality who is not only spiritually devout, but also intelligent in attitude, adaptive to change, and able to navigate global ethical challenges. Thus, Islamic philosophy of ethics does not clash between revelation and reason, but instead integrates them in a balanced form of moral praxis. This study emphasizes that morality and wisdom are the two main pillars in building a just, civilized, and highly aware society of human values
Legal Implications and Challenges of Informal Sale and Purchase Binding Agreements (PPJB): The Role of Notaries in Ensuring Legal Validity and Protection
The Preliminary Sale and Purchase Agreement (PPJB) is often executed informally, primarily due to practical considerations such as incomplete payments or unfinished land administration. Although legally binding, informal PPJB agreements are vulnerable to legal challenges, especially when there is ambiguity regarding the subject matter or failure to fulfill obligations. Therefore, the role of notaries in ensuring legal validity is crucial. This study aims to explore the legal implications and challenges in drafting PPJB, particularly concerning the notary's role in ensuring that the agreement meets legal standards and provides sufficient protection for the involved parties. This research adopts a normative legal methodology, utilizing secondary data sources, including relevant legal provisions, scholarly articles, and case studies. The analysis is conducted descriptively, focusing on the legal framework governing PPJB and the involvement of notaries. The findings indicate that PPJB, while legally binding, can be easily contested if executed informally. Notarial PPJB offers stronger legal protection. However, challenges such as differing interpretations and unclear property rights transfer procedures persist. Notaries play a critical role in ensuring the legal validity of PPJB. Legal clarity and proper documentation are essential to avoid disputes in land transaction
DZAWIL ARHAM'S LEGACY: The Urgency of Clear Arrangement In the Compilation of Islamic Law
Abstract: This study discusses the inheritance of dzawil arham (distant relatives) in the Compilation of Islamic Law (KHI) in Indonesia, which is identified as not regulated in existing regulations. Although KHI regulates the distribution of inheritance in detail for the closer heirs, the lack of clarity regarding inheritance rights for dzawil arham creates legal uncertainty in the implementation of inheritance distribution. This research aims to examine the importance of clearer arrangements regarding the inheritance rights of Dzawil Arham in KHI to provide legal certainty and justice for all related parties. Through a qualitative approach and normative analysis, it was found that more specific and detailed regulations regarding dzawil arham were needed so that the distribution of inheritance could be fairer and more equitable. This study recommends that KHI accommodate clearer rules related to the inheritance rights of dzawil arham, to ensure justice in the application of Islamic inheritance law in Indonesia. Keywords: Inheritance, Dzawil Arham, Compilation of Islamic Law, Distribution of Inheritance, Legal Certaint
