The Effectiveness of Diversion in Resolving Juvenile Breast Groping Cases
Sexual harassment committed by minors, particularly in the form of breast-grabbing, is a complex phenomenon due to the offender’s ongoing psychosocial development. The legal handling of such cases requires not only a repressive approach but also the application of restorative justice through diversion mechanisms. This study aims to analyze the effectiveness of diversion in resolving a breast-grabbing case committed by a minor in Semarang. This research uses a juridical-empirical method with a qualitative approach, focusing on a case study at the Class I Correctional Center (Bapas) in Semarang. Data were collected through interviews and the analysis of legal documents related to the diversion process. The findings indicate that the diversion was conducted in accordance with legal provisions and resulted in an agreement involving an apology, financial compensation, and a commitment to rehabilitate the offender. However, the study also identifies limitations in the victim’s recovery and the continuity of the offender’s rehabilitation. It further questions whether justice is truly achieved when the victim remains psychologically affected, and highlights the risk of behavioral normalization if rehabilitation is not effectively implemented. Therefore, the effectiveness of diversion in sexual offense cases should be understood not only from a procedural standpoint but also in terms of achieving substantive justice for all parties involved
From Confiscation to Prevention: Asset Confiscation and the Impoverishment of Corruptors in Islamic Jurisprudence
This research is motivated by the weak deterrent effect on corruption perpetrators in Indonesia, where imprisonment, fines, and compensation have not been able to eliminate economic benefits or recover state losses. The formulation of this research problem involves two key aspects: first, how Islamic jurisprudence views the policy of impoverishing corruptors through asset confiscation; second, how the concept and mechanism of impoverishing corruptors are applied in the Indonesian positive legal system and Islamic jurisprudence. This study employs a normative juridical approach, utilizing statutory guidelines, conceptual designs, case studies, and a comparative analysis of asset forfeiture models in Malaysia, Singapore, the UAE, and Saudi Arabia. Research findings suggest that depriving corruptors of their assets is effective in stripping them of their economic benefits, recovering state losses, and enhancing the deterrent effect. From a fiqh jinayah perspective, this policy is legitimate as a form of ta'zīr punishment that is relevant to the maqāṣid al-sharī‘ah, especially in safeguarding assets (ḥifẓ al-māl) and preventing public harm. This study emphasizes the need to strengthen asset confiscation through the ratification of the Asset Confiscation Bill and the implementation of proportional and accountable non-conviction-based asset forfeiture. The novelty of this study lies in the comprehensive integration of positive law, deterrence theory, and the principles of fiqh al-jinayah to establish moral, juridical, and Sharia legitimacy for the strategy of impoverishing corruptors
Legal Protection of Personal Data and Virtual Assets in the Metaverse: A Comparative Study of the United States, China, and South Korea
The development of the metaverse as a new digital interaction space has given rise to increasingly complex legal challenges regarding the protection of personal data and virtual assets. This situation demonstrates the regulatory gap between countries in responding to the dynamics of the global digital economy. This study examines the comparison of regulations on personal data protection and virtual asset protection in the United States, China, and South Korea, and identifies lessons that can be applied to the Indonesian legal system. Utilizing a normative legal research method through a comparative approach, this study examines primary and secondary legal sources, including laws, national policies, and digital legal doctrines, in each country. The results show that the United States applies a liberal sectoral regulatory model, China adopts a centralistic model based on state control, while South Korea develops a hybrid model that balances innovation and legal protection. The comparative analysis reveals gaps in institutional aspects, regulatory integration, and legal recognition of activities and assets in the metaverse. The results of the study indicate that Indonesia should adopt an adaptive legal framework that comprehensively integrates personal data and virtual asset protection as a guiding principle for ius constituendum in establishing a safe, equitable, and globally competitive metaverse governance
The Role of Zakat, Waqf, and Education in Reducing Urban Poverty: Evidence from Jakarta
Jakarta, the capital and most densely populated region of Indonesia, continues to struggle with urban poverty despite consistent economic growth. Factors such as high migration, limited employment opportunities, and unequal access to education and social services have deepened socio-economic inequality. This study investigates the key drivers of poverty in DKI Jakarta from 2012 to 2022, incorporating insights from Islamic economics. Utilizing time-series data and the Error Correction Model (ECM), the research explores both short-term and long-term impacts of education, Gross Regional Domestic Product (GRDP), zakat, and waqf on poverty levels. Findings reveal that all variables significantly affect poverty in the long run, while GRDP shows no notable short-term influence. Education and waqf are positively correlated with poverty over time, indicating that structural issues—such as low labor absorption and inefficient waqf management—limit their effectiveness in reducing poverty. In contrast, zakat demonstrates a strong negative relationship with poverty, highlighting its role as a powerful redistributive tool in Islamic economics. The study emphasizes the importance of inclusive education and economic policies, alongside better governance of zakat and waqf through formal institutions like BAZNAS, to improve transparency, optimize resource use, and support sustainable poverty reduction in Jakarta.
Abstrak
Peran Zakat, Wakaf, dan Pendidikan dalam Mengurangi Kemiskinan Perkotaan: Studi Kasus Kota Jakarta. Jakarta, ibu kota sekaligus provinsi terpadat di Indonesia, masih menghadapi tantangan kemiskinan perkotaan meskipun pertumbuhan ekonomi terus berlangsung. Tingginya angka migrasi, terbatasnya daya serap tenaga kerja, serta ketimpangan akses terhadap pendidikan dan layanan sosial memperparah kesenjangan sosial-ekonomi. Studi ini menganalisis faktor-faktor yang memengaruhi kemiskinan di Provinsi DKI Jakarta selama periode 2012–2022 dengan pendekatan ekonomi Islam. Menggunakan data runtun waktu dan model Error Correction Model (ECM), penelitian ini menelaah dampak jangka pendek dan jangka panjang dari pendidikan, Produk Domestik Regional Bruto (PDRB), zakat, dan wakaf terhadap tingkat kemiskinan. Hasil menunjukkan bahwa seluruh variabel berpengaruh signifikan dalam jangka panjang, sementara PDRB tidak menunjukkan pengaruh berarti dalam jangka pendek. Pendidikan dan wakaf memiliki hubungan positif dengan kemiskinan dalam jangka panjang, yang mengindikasikan adanya hambatan struktural seperti rendahnya daya serap tenaga kerja dan pengelolaan wakaf yang belum optimal. Sebaliknya, zakat menunjukkan hubungan negatif yang kuat dan signifikan terhadap kemiskinan, menegaskan efektivitasnya sebagai instrumen distribusi dalam ekonomi Islam. Temuan ini menyoroti perlunya kebijakan pendidikan dan ekonomi yang lebih inklusif, serta peningkatan tata kelola zakat dan wakaf melalui lembaga formal seperti BAZNAS untuk meningkatkan transparansi, efisiensi pemanfaatan sumber daya, dan mendukung pengentasan kemiskinan yang berkelanjutan di Jakarta
MEASURING BETWEEN TRADITION, LAW, AND MASLAHAT VALUE:: An Ideal Solution For Divorce Settlement In Mandailing Natal Society
This research analyzes the dynamics of divorce in Mandailing Natal society by focusing on the interaction between customary traditions, positive law, and the principle of maslahat in Islamic law. Divorce in Mandailing Natal Regency is not only a legal matter, but also a social phenomenon rooted in customary values and religious teachings, with significant impacts on women, children, and social balance. The research used a descriptive-analytical qualitative method through interviews, observation, and literature study. The results show that the majority of divorces are filed by the wife with causal factors including economic problems, household disharmony, infidelity, and domestic violence. Although customary deliberation traditions such as marpokat/martahi are still practiced, the legal awareness of the community to pursue official procedures through the Religious Court is still low, often causing legal harm to women and children. The maslahat approach, which prioritizes benefit and prevents harm, is the ideal solution in resolving divorce, by balancing aspects of state law, Islamic law, and local wisdom. The research recommends strengthening legal awareness, optimizing the role of customary deliberation, and protecting post-divorce rights for women and children as steps towards a more just and humane divorce settlement system
DEVELOPMENT OF EDUCATIONAL UNIT (KSP) CURRICULUM GUIDELINES BASED ON RELIGIOUS MODERATION IN EARLY CHILDHOOD INSTITUTIONS IN LAMPUNG
Penelitian ini dilatarbelakangi belum terintegrasinya nilai moderasi beragama secara eksplisit dalam dokumen Kurikulum Satuan Pendidikan (KSP) PAUD di Lampung, meskipun regulasi nasional tentang penguatan moderasi beragama sudah kuat. Penelitian ini bertujuan mengembangkan panduan Pengembangan Kurikulum Satuan Pendidikan (KSP) berbasis moderasi beragama bagi lembaga PAUD sebagai acuan penyusunan kurikulum. Metode yang digunakan adalah penelitian dan pengembangan (R&D) dengan model Borg & Gall yang mencakup Analisis masalah, Perencanaan desain produk, Pengembangan draf produk, Validitas desain produk, Revisi desain produk, Uji Coba skala terbatas, Revisi, Uji coba sekola luas, Revisi produk, dan penyempurnaan produk akhir. Responden pada Penelitian ini berjumlah 23 responden yang terdiri dari 4 kepala sekolah dan 19 guru. Hasil penelitian menghasilkan modul panduan pembuatan Kurikulum Satuan Pendidikan (KSP) yang memuat pengorganisasian dan perencanaan pembelajaran berlandaskan indikator dan nilai moderasi beragama. Validasi tiga ahli memperoleh rata-rata kelayakan 90% (sangat layak), sedangkan uji coba terbatas dan skala luas pada guru dan kepala PAUD menunjukkan panduan mudah dipahami, praktis, dan bermanfaat untuk mengintegrasikan moderasi beragama dalam KSP.This study arises from the fact that religious moderation values are not yet explicitly integrated into Early Childhood Education (ECE) School Curriculum (KSP) documents in Lampung, despite strong national regulations on strengthening religious moderation. The main objective is to develop a religious-moderation-based KSP guideline for ECE institutions to serve as a reference for curriculum development. The research employed a Research and Development (R&D) method using the Borg & Gall model, including needs analysis, design, expert validation, revision, limited trial, and large-scale trial. The study produced a KSP guideline module that organizes and plans learning based on indicators and values of religious moderation. Expert validation from three validators yielded an average feasibility of 90% (very feasible). At the same time, trials with teachers and principals indicated that the guideline is understandable, practical, and effective for integrating religious moderation into KSP
Digital-age PAUD management innovations: Meeting children's needs through technology
Management innovations in Early childhood education programs or the so called PAUD (Pendidikan Anak Usia Dini) management based on children's needs in the digital era have become very relevant for improving the quality of early childhood education. Technological developments provide opportunities for educational institutions to adapt learning methods that are more interactive and appropriate to children's developmental needs. This research explored the implementation of technology-based management innovations at PAUD Plamboyan 3, West Karawang, and evaluated their impact on children's learning and parental involvement. The study aims to determine the implementation of technology-based management innovations and to identify their effects on the learning process, parental involvement, and curriculum management. This research used a qualitative approach with a case study method. This qualitative research employs a case study method, with data collected through observations. The sample in this interview consisted of one school principal, five teachers, ten parents, and documents related to technology integration in learning. The research results show that using technology, such as learning applications and e-learning platforms, increases children's learning motivation and strengthens parental involvement in children's education. Curriculum management tailored to children's needs also supports children's cognitive, social, and motoric development. However, some parents need attention to challenges related to limited access to technology at home. This research is essential for the development of PAUD in the digital era by emphasizing the importance of teacher training, increasing access to technology, and the active role of parents in supporting children's learning process
Psychological Well-Being in Building Organizational Commitment
This study aims to determine the effect of psychological well-being on the commitment of the Intraschool Student Organization (OSIS) administrators at SMKN 2 Bandar Lampung. Low commitment of the Intra-School Student Organization (OSIS) administrators can impact the effectiveness of implementing organizational programs. One of the factors influencing this commitment is psychological well-being, which encompasses self-acceptance, good interpersonal relationships, and personal growth. This study employs a quantitative approach. Data analysis was conducted using simple linear regression to assess the extent to which psychological well-being affects OSIS commitment. The results showed a significant positive influence of psychological well-being on the commitment of OSIS administrators. This indicates that the higher the level of psychological wellbeing, the greater the commitment of OSIS administrators in carrying out organizational activities. Based on these findings, it is recommended that schools pay more attention to student development to enhance commitment to the organization.

Adversity Quotient and Future Orientation of Adolescents at LPKA Class II Bandar Lampung
Adolescents serving time in LPKA face psychological pressure in the form of low self-esteem and pessimism that can hinder future orientation. Adversity quotient, the ability to face and overcome difficulties, is believed to play an important role in shaping a positive future direction. This study aims to analyze the relationship between adversity quotient and future orientation in 40 adolescents aged 18-21 years in LPKA Class II Bandar Lampung. The method used was quantitative correlation with data collection through the future orientation scale (Nurmi, 1991) and the adversity quotient scale (Stoltz, 2000). The analysis used Spearman's rank correlation test because the data were not normally distributed. Results showed a significant positive relationship between adversity quotient and future orientation (r = 0.616; p < 0.05), so the hypothesis was accepted. This finding confirms the novelty of the study by highlighting the importance of psychological factors in the rehabilitation of juveniles with legal problems, as well as its practical implications in the design of coaching programs based on increasing adversity quotient.

Psychometric Evaluation of The Walsh Family Resilience Questionnaire (WFRQ) Using the Rasch Model
The Walsh Family Resilience Questionnaire (WFRQ) is a widely used instrument for measuring family resilience in various cultural contexts. However, research on its psychometric quality using the Rasch model approach is still limited, especially in Indonesia. This study aims to examine the item fit, unidimensionality, difficulty level, and reliability of the WFRQ by involving 355 adult respondents living with their nuclear or extended families. Data analysis was performed using WINSTEP software. The results show that most WFRQ items meet the fit criteria with Mean Square (MNSQ) values ranging from 0.5 to 1.5. Two items (8 and 20) were eliminated because they did not meet the fit criteria. The reliability value was excellent, with a person reliability of 0.94 and an item reliability of 0.96. The Wright Map showed that the majority of respondents were at a moderate to high level of resilience, while the item difficulty level was relatively low, making the instrument easy for respondents with high resilience.
