La tutela della salute e della sicurezza sul lavoro nell’Italia fascista
This essay analyses, the issues, during the fascist regime, relating to work and its safety, the evolution of compulsory insurance against accidents at work and professional diseases, the development of protection institutions, the responsibility of the employer work, comparing the art. 2087 with the pre-existing rules and its first jurisprudential applications.Il presente lavoro intende analizzare, senza alcuna pretesa di esaustività, le tematiche, durante il periodo fascista, relative al lavoro e alla sua sicurezza, all’evoluzione dell’assicurazione obbligatoria contro gli infortuni sul lavoro e le malattie professionali, allo sviluppo degli enti di tutela, alla responsabilità del datore di lavoro, confrontando l’art. 2087 con le norme preesistenti e le sue prime applicazioni giurisprudenziali
Data protection e sicurezza sul lavoro: un documento di valutazione dei rischi (DVR) anche per la privacy?
The introduction of new digitalised automation and/or robotic technologies (also based on artificial intelligence) into the working environment poses the need to apply the provisions of the European Regulation 2016/679 regarding the protection of personal data. In the absence of a national refernce framework for data protection and security in the employment relationship this investigation proposes to adopt workplace safety legislation as a reference model for assessing privacy risk.L’introduzione nell’ambiente di lavoro delle nuove tecnologie di automazione digitalizzata e/o robotica (anche basate sull’intelligenza artificiale) pone l’esigenza di applicare le disposizioni previste dal Regolamento europeo 2016/679 in materia di tutela dei dati personali. In assenza di una cornice nazionale di riferimento per la protezione e sicurezza dei dati nel rapporto di lavoro, questa indagine propone di adottare la normativa sulla sicurezza del lavoro come modello di riferimento per la valutazione del rischio privacy
Le nuove coordinate del sistema assicurativo
The essay aims to analyse the evolutionary perspectives of insurance protection against accidents at work and occupational diseases, focusing in particular on the actuality of the distinction between common and work-related events, which constitutes the foundation, not without constitutional relevance, of insurance protection. Starting from the evolutionary interpretation of the notion of injured at work, which constitutes the assumption for the intervention of insurance protection, the essay addresses the problem of the compatibility of its meaning with the de-structuring of the space-time coordinates of work performance resulting from the spread of digital technologies and, in coherence with similar mechanisms of the insurance discipline, verifies the possibility of a presumptive reinterpretation of the notion of work accident.Il saggio intende approfondire le prospettive evolutive della tutela assicurativa contro gli infortuni sul lavoro le malattie professionali, interrogandosi, in particolare, sull’attualità della distinzione tra evento comuni e lavorativi che costituisce il fondamento non privo di rilevanza costituzionale, della tutela assicurativa. Muovendo dall’interpretazione evolutiva della nozione di occasione di lavoro che costituisce il presupposto di intervento della tutela assicurativa, il saggio affronta il problema della compatibilità del suo significato con la destrutturazione delle coordinate spazio-temporali della prestazione lavorativa derivante dalla diffusione delle tecnologie digitali e, in coerenza con analoghi meccanismi della disciplina assicurativa, verifica la possibilità di una rilettura in senso presuntivo dell’occasionalità lavorativa

Manifold factors, sometimes linked to each other, have determined a potentially dangerous contamination between work in life and life in work.Among the most relevant: we can recall 1-The destructuring of the old organizational style of twentieth-century industry and the advent of new types of market in which to carry out a job; 2-the pulverization of production processes and the employment discontinuity that derives from this; 3-the dissolution of the gaps delimiting the time of work from the time referred to the life activities of the worker; 4-the incessant increase in life expectancy, together with the ineffable needs to contain the amount of public spending allocated to social security.Since the dawn of time, labor law doctrine has approached the issue of safety at work with typical tools of contract law: a) identification of the factual situation, b) assessment of damages, c) identification of the causal link, d) determination of compensation.Subsequently, the same had to begin to discuss safety at work.Today, especially in light of the upheavals mentioned above, the discussion involves broader latitudes. The inference of new pathologies, often long silent, apparently hidden and at first glance difficult to connect to the type of work performed. Or health conditions that are certainly not such as to interrupt the relationship, but adequate to require a personalized approach in the management of the employment relationship, take on importance.The result of this process certainly goes beyond the proclamation that health is something other than the absence of disease, but, rather, of the increasingly narrow porosity between occupational health and public health.Having identified this trait d’union, the context of the actors involved in providing the necessary guarantees for the protection of health broadly understood also changes, with an increasingly necessary synergy between private employers and public decision-makers.Vari fattori, a volte concatenati tra loro, hanno determinato una contaminazione tra il lavoro nella vita e la vita nel lavoro potenzialmente pericolosa.Tra i più rilevanti possono richiamarsi 1-La destrutturazione del vecchio stilema organizzativo dell’industria novecentesca e l’avvento di nuove tipologie di mercato nel quale svolgere un lavoro; 2-la polverizzazione dei processi produttivi e la discontinuità occupazionale che da questa deriva; 3-la dissoluzione delle intercapedini perimetranti il tempo del lavoro dal tempo riferito alle attività di vita proprie del prestatore; 4-l’incessante incremento dell’aspettativa di vita, in uno alle ineffabili esigenze di contenimento della quantità di spesa pubblica destinata alla previdenza sociale.Sin dagli albori la dottrina giuslavoristica ha approcciato il tema della sicurezza sul lavoro con strumenti tipici del diritto dei contratti: a) identificazione della fattispecie, b) accertamento del danno, c) individuazione del nesso causale, d) determinazione del risarcimento.Successivamente, la stessa, ha dovuto cominciare a dibattere di sicurezza nel lavoro.Oggi, soprattutto alla luce degli sconvolgimenti prima richiamati, il discorso involge latitudini più ampie. L’inferire di nuove patologie, spesso lungamente silenti, apparentemente recondite e di primo acchito difficilmente collegabili al tipo di lavoro svolto. Oppure assumono rilievo condizioni di salute sicuramente non tali da interrompere il rapporto, ma adeguate a richiedere un approccio personalizzato nella gestione del rapporto di lavoro.Il risultato di tale processo va sicuramente oltre la conclamazione che la salute sia altro rispetto alla assenza di malattia, quanto, piuttosto, della sempre più stretta porosità tra salute occupazionale e salute pubblica.Individuato tale trait d’union, muta anche il contesto degli attori impegnati nel fornire le garanzie necessarie per la tutela della salute latamente intesa, con una sempre più necessaria sinergia tra datori privati e decisore pubblico

The subject of the essay, here in its English version, is taken from Giacomo Leopardi’s poem to Count Carlo Pepoli (Canti, 1841) and reads in English, “… the truth, when known, / Though sad, has yet its charms”. One type of person accepts the world as it is, seeing only its beautiful side, is transported by dreams and refuses to take into account cruel truths. Others detach themselves from the human herd, not being content with vain appearances; they are driven by the desire to know but risk becoming total sceptics. A third type looks at the world as it is, knowing that the truth they see may be hard to accept, but reason rather than an attack on spurious targets must be used to find it. The real heroism of the “man of thought” is a knowledge of the world as it really is, which entails not hiding unpleasant sides from outsiders, which would amount to a hypocritical “Jesuitism”.
