La disciplina delle indagini transfrontaliere della nuova Procura europea al “banco di prova” della Corte di Giustizia dell’Unione europea
The discipline of cross-border investigations of the new European Public Prosecutor\u27s Office at the "test bench" of the Court of Justice of the European Union] This paper aims to analyze the recent decision of the Court of Justice of the EU on the discipline of cross-border investigations of the European Public Prosecutor\u27s Office and its effects with respect to national legal system and future EPPO proceedings. In particular, the case from which the preliminary ruling question originated, the relevant legislation, the hermeneutic options and the judgment will be explained. Whilst the Court has embraced the systematic approach, it has also provided that measures seriously intrusive of fundamental rights enshrined in the Nice Charter must be subject to judicial review in the State where the investigation takes place. This clarification, while aimed at protecting the rights of suspects in these proceedings, achieves contradictory results.
Key words: EPPO; Court of Justice of the European Union; European Investigation Order; Cross-border investigations; Fundamental rights.Il presente lavoro si propone di analizzare la recente decisione della Corte di Giustizia UE sulla disciplina delle indagini transfrontaliere della Procura europea e dei suoi effetti nei confronti degli ordinamenti statali e nei futuri procedimenti EPPO. In particolare, verrà delineato il caso da cui è originata la domanda pregiudiziale, la normativa di riferimento, le opzioni ermeneutiche e la sentenza. La Corte ha accolto l’approccio sistematico, ma ha altresì previsto che le misure gravemente intrusive dei diritti fondamentali previsti dalla Carta di Nizza devono essere sottoposti all’esame giurisdizionale nello Stato in cui è condotta l’indagine. Tale precisazione, pur finalizzata a tutelare i diritti degli indagati in questi procedimenti, realizza risultati contraddittori.

The reduction of democracy to a simple set of institutions has been instrumental in its reconciliation with capitalist society, allowing the masking of domination relations, although it opened loopholes for the expression of interests of the dominated. On the left, the denunciation of the limitations of representative democracy gradually gave way to an uncritical acceptance of its institutionality. Therefore, at present, when even the most limited electoral democracy becomes uncomfortable for the ruling class (the so-called «de-democratization»), the left seems constrained to be its guardian. In order for democracy to recover its position as the vector of a transformative project, it is necessary to seek a different path, deepening the critique of the limits of liberal representative democracy and reaffirming an expanded concept of democracy that goes beyond a political sphere disassociated from the lived world.

Diritti fondamentali e potere amministrativo: per una teoria giuridica del pubblico interesse
The study starts by highlighting the importance of practices (and, in particular, of judicial practices) as a tool for analyzing public power in concrete terms. It is clear from the observation of practices, that the administrative judge very frequently decides disputes concerning fundamental rights.
Consequently, one must ask oneself whether these practices conflict with positive law, or whether they highlight problems that allow for a different interpretation of positive law itself.
From a methodological perspective, therefore, it is necessary to compare practices with dogmatics.
This reflection, therefore, after some further methodological premises, starts with the problem of defining fundamental rights. Limiting the general discussion about fundamental rights as much as possible, the study questions their reconstruction in traditional doctrine. In particular, the aim is to show that freedoms and social rights have the same structure and thus make up the unitary category of fundamental rights. To do this, the traditional notions of both constitutional freedom and social rights are criticized. Their unitary reconstruction places freedom and social rights in relation to public power. This analysis shows that fundamental rights always stand in relation to executive power. The consequence of this is that the administrative judge ordinarily decides disputes concerning fundamental rights and that this practice is entirely consistent with the dogmatic system.
The second area of analysis concerns the structure of executive power according to the Italian constitution. The study starts from the methodological premise of highlighting how the theories of executive power traditionally proposed and still upheld today have a mythical or ideological foundation. Even as regards executive power, it is necessary to proceed to its reconstruction in terms of its relationship with fundamental rights. This procedure highlights the reasons why both administrative organization and executive power are entirely a function of the enjoyment of fundamental rights. This conclusion derives from setting the problem of public power in its relationship with sovereignty. Positive law sheds light on the reasons why the most significant feature of popular sovereignty lies in the fact that sovereignty is permanently retained in fundamental rights as legal entities recognized by the Constitution, i.e. existing as rights independently of being posited by positive constitutional law. Since public organization and the exercise of public powers are functional to the objectives and purposes of the sovereign, and since in positive law the sovereign is to be identified in the human person as the holder of fundamental rights, it necessarily follows that administrative action and executive power are functional to the enjoyment of fundamental rights by people.
The consequence on administrative jurisdiction is that it always deals with fundamental rights because it is the judge of power and power only fulfils the function of maximizing the enjoyment of fundamental rights.
These conclusions necessarily pose the problem of developing a legal theory of the public interest. Having highlighted the inadequacy of both traditional and more recent theories of public interest, the study proposes an articulate legal theory of the public interest. In particular, it denies that there is a public interest belonging to the executive power. Rather, the public interest consists solely and exclusively in the settlement and maximization of the enjoyment of claims concerning people\u27s fundamental rights. In this perspective, the paper concludes with a definition of the techniques of settlement and balancing of fundamental rights.Lo studio prende le mosse mettendo in luce il rilievo delle pratiche (e, particolarmente, di quelle giurisdizionali) come strumento di analisi in concreto del potere pubblico. Dalla osservazione delle pratiche emerge in modo chiaro il fatto che il giudice amministrativo decida assai di frequente controversie riferite a diritti fondamentali.
Per conseguenza, ci si deve chiedere se queste pratiche siano contrastanti con il diritto positivo ovvero mettano in luce problemi che consentono una diversa interpretazione del diritto positivo medesimo. In prospettiva metodologica, quindi, è necessario confrontare le pratiche con la dogmatica.
Questa riflessione, quindi, dopo aver posto alcune ulteriori premesse di metodo, prende avvio dal problema della definizione dei diritti fondamentali. Limitando quanto più possibile la discussione generale circa i diritti fondamentali, lo studio mette in discussione la loro ricostruzione nella dottrina tradizionale. In particolare, si pone l\u27obiettivo di dimostrare che le libertà e i diritti sociali presentano la medesima struttura e quindi, compongono la categoria unitaria dei diritti fondamentali. Per fare questo vengono criticate le nozioni tradizionali sia libertà costituzionale che di diritto sociale. La loro ricostruzione unitaria mettendo libertà e diritti sociali in relazione con il potere pubblico. Da questa analisi si dimostra che i diritti fondamentali si pongono sempre in relazione con il potere esecutivo.
Ne deriva la conseguenza che il giudice amministrativo in via ordinaria decide controversie attinenti diritti fondamentali e che questa pratica è del tutto coerente con il sistema dogmatico.
Il secondo terreno di analisi riguarda la struttura del potere esecutivo secondo la costituzione italiana. Lo studio muove dalla premessa metodologica di evidenziare come le teorie del potere esecutivo tradizionalmente proposte e ancora oggi sostenute hanno un fondamento mitico o ideologico. Anche quanto al potere esecutivo è necessario procedere alla sua ricostruzione in termini relazionali con i diritti fondamentali.
Attraverso questo procedimento si mettono in luce le ragioni per le quali sia l\u27organizzazione amministrativa che il potere esecutivo sono interamente in funzione del godimento dei diritti fondamentali. Questa conclusione deriva dall\u27aver impostato il problema del potere pubblico nella sua relazione con la sovranità. Il diritto positivo mette in luce le ragioni per le quali il tratto più significativo della sovranità popolare risiede nel fatto che la sovranità si trattiene permanentemente nei diritti fondamentali in quanto entità giuridiche riconosciute dalla costituzione, vale a dire esistenti come diritti indipendentemente dall\u27essere posti dal diritto costituzionale positivo. Poiché l\u27organizzazione pubblica e l\u27esercizio di pubblici poteri sono funzionali agli obiettivi e scopi del sovrano e poiché nel diritto positivo il sovrano deve essere individuato nella persona umana titolare di diritti fondamentali, ne consegue necessariamente che azione amministrativa che il potere esecutivo sono funzionali al godimento dei diritti fondamentali da parte delle persone.
La conseguenza sulla giurisdizione amministrativa è che essa si occupa sempre di diritti fondamentali perché è il giudice del potere e il potere assolve alla sola funzione della massimizzazione del godimento dei diritti fondamentali.
Queste conclusioni pongono necessariamente il problema di elaborare una teoria giuridica dell\u27interesse pubblico. Una volta messa in luce l’insufficienza sia delle teorie tradizionali che di quelle più recenti relativamente all\u27interesse pubblico, lo studio propone una articolata teoria giuridica del pubblico interesse. In particolare si nega che esista un interesse pubblico appartenente al potere esecutivo. Piuttosto, il pubblico interesse consiste solo ed esclusivamente nella composizione e massimizzazione del godimento delle pretese concernenti i diritti fondamentali delle persone. In questa prospettiva il paper sì conclude con la definizione delle tecniche di composizione e bilanciamento dei diritti fondamentali
Libertà d’iniziativa economica privata e Giudice amministrativo
The mixed economic model designed by the Italian Constitution was born despite a distrust of the market that was somewhat shared by the main political forces present in the Constituent Assembly. The principle of competition, which informs the European Union legal system as a cardinal principle of the market economy, has found full implementation in the Italian legal system as part of the progressive process of EU integration. This has posed a number of problems in applying that principle to the many cases inevitably linked to the interpretation of Article 41 of the Constitution, many of which fall under the jurisdiction of the administrative courts.Il modello economico misto disegnato dalla Costituzione italiana nasce nonostante una diffidenza nei confronti del mercato in qualche modo condivisa dalle principali forze politiche presenti in Assemblea costituente. Il principio di concorrenza, che informa l’ordinamento eurounitario quale principio cardine dell’economia di mercato, ha trovato piena attuazione nell’ordinamento giuridico italiano nel quadro del progressivo processo di integrazione comunitaria. Ciò ha posto diversi problemi applicativi di quel principio alle tante fattispecie inevitabilmente legate all’interpretazione dell’articolo 41 della Costituzione, molte delle quali di competenza del Giudice amministrativ
L’ambiente quale diritto fondamentale a titolarità diffusa
The essay is aimed at verifying whether and in what terms - also considering the recent reform of the articles 9 and 41 of the Italian Constitution - the qualification of the right to an intact and healthy environment as a fundamental right can be envisaged from a theoretical perspective and, above all, whether this has a concrete consequential scope from the perspective of the ecological transition. In this context, the author especially examines the absence of a clear system of legal standing in the environmental protection field, suggesting the overcoming of the current centralized legal standing regime. In this perspective – and through the enhancement of the horizontal subsidiarity principle and the vicinitas criterion in an axiological and not merely physical sense – the essay outlines a new classification of environmental interests, from interests with no titular to common interests, and the related configuration of a meta-individual fundamental right to environmental protection, consequently extending even to the individuals the environmental legal standing.Lo scritto è volto a verificare se e in che termini – anche alla luce della recente riforma degli artt. 9 e 41 Cost. – la qualificazione del diritto ad un ambiente integro e salubre come diritto fondamentale sia prospettabile in chiave teorica e, soprattutto, se questa abbia una concreta portata consequenziale nell’ottica del processo di transizione ecologica. In particolare, l’autore si sofferma sulle criticità concernenti l’individuazione dei soggetti legittimati ad agire in sede processuale a tutela delle risorse ambientali, prospettando il superamento dell’attuale regime accentrato di legittimazione processuale. In tale ottica – attraverso la valorizzazione del principio di sussidiarietà orizzontale e del criterio della vicinitas in senso assiologico e non meramente fisico – si prospetta il passaggio della qualificazione degli interessi ambientali da interessi adespoti a interessi comuni e la connessa configurazione di un diritto fondamentale meta-individuale alla tutela dell’ambiente, con la consequenziale estensibilità della legittimazione ad agire anche al singolo cittadino

The work offers a reflection on what the new definition of the State chosen by politics could be and what role will be reserved for administration and the market in its implementation. It is an era of great changes made necessary by the succession of emergencies that push towards global solutions and the downsizing of national sovereignty. The market takes on a primary role, the administration and the citizen seem to be caught in the grip of digitization and control. We therefore want to highlight some assessments of possible risks and underline the essential role of the Constitution and the administration in guaranteeing the respect and implementation of rights and freedoms.Il lavoro offre una riflessione su quale potrà essere la nuova definizione di Stato scelta dalla politica e quale ruolo sarà riservato nella sua concretizzazione ad amministrazione e mercato. E’ un’epoca di grandi cambiamenti resisi necessari dal susseguirsi di emergenze che spingono verso soluzioni globali e ridimensionamento della sovranità nazionale. Il mercato assume un ruolo di primordine, l’amministrazione come il cittadino paiono stretti nella morsa di digitalizzazione e controllo. Si vogliono quindi mettere in evidenza alcune valutazioni dei possibili rischi e sottolineare l’imprescindibile ruolo della Costituzione e dell’amministrazione nel garantire il rispetto e l’attuazione di diritti e libertà
Legittimazione ed interesse del terzo interveniente nel processo di legittimità: profili evolutivi
Article 28 of the Administrative Process Code, if on the one hand it has introduced a more detailed regulation of intervention, on the other hand it has not resolved the numerous doubts as to the conditions of admissibility of intervention. The purpose of this contribution is to ascertain in what terms the principles of Article 81 and Article 100 of the Code of Civil Procedure can be extended to intervention and to what extent they apply to administrative proceedings for the purpose of selecting the third parties actually entitled to participate, in relation to the generic notion of third party consociate with respect to res inter alios acta.L’art. 28 c.p.a., se per un verso, ha introdotto una disciplina più dettagliata dell’intervento, dall’altro, non ha risolto i numerosi dubbi in ordine alle condizioni di ammissibilità dell’intervento nel processo amministrativo. Scopo del contributo è verificare in che termini e in che misura i principi dell’art. 81 c.p.c. e dell’art. 100 c.p.c. siano estensibili all’intervento nel giudizio di legittimità con finalità di selezione dei terzi effettivamente legittimati a partecipare, in rapporto alla generica nozione di terzo consociato rispetto alla res inter alios acta. A tal fine, ricostruito il dibattito giurisprudenziale e dottrinale in ordine ai tipi d’intervento esperibili nel processo di legittimità, lo scritto individua la posizione legittimante in relazione a ciascun tipo d’intervento consentito dall’art. 28 c.p.a
