L’amministrazione condivisa nel nuovo codice dei contratti pubblici: matrici teoriche, disallineamenti sistematici e profili innovativi
The essay analyses art. 6 of the new public contracts code that codifies the category of shared administration, defining the coordinates of a particular type of public-private partnership (here defined as \u27collaborative\u27) that is grounded in the principles of social solidarity and horizontal subsidiarity. The provision is very important on a systematic level because it recognises the \u27collaborative\u27 partnership as a model that can generally be used and is equally coordinated with the other possible forms of management of public goods and services owned by public administrations. However, the text of the rule contains some ambiguities and inconsistencies that could reduce the ordering function that - as a general principle - it should perform. The aim of the study is therefore to offer an interpretative key to its contents in order to systematically frame the critical profiles and highlight the innovative aspects.Il saggio analizza l’art. 6 del nuovo codice dei contratti pubblici che codifica la categoria dell’amministrazione condivisa, definendo le coordinate di una particolare tipologia di partenariato pubblico-privato (qui definito “collaborativo”) che trova fondamento nei principi di solidarietà sociale e sussidiarietà orizzontale. La previsione ha un grande rilievo sistematico nella misura in cui riconosce il partenariato “collaborativo” come modello generalmente utilizzabile ed equi-ordinato rispetto alle altre possibili forme di gestione dei beni e servizi pubblici di cui le pubbliche amministrazioni sono titolari. Tuttavia, il testo della norma contiene alcune ambiguità e incoerenze che potrebbero ridurne la funzione ordinante che - in quanto principio generale - dovrebbe svolgere. L’obiettivo dello studio è quindi offrire una chiave interpretativa dei suoi contenuti per inquadrare in via sistematica i profili critici e mettere in evidenza gli aspetti innovativi
Il controllo degli investimenti in uscita: prime riflessioni sulla nuova frontiera delle funzioni economico-securitarie
The paper concerns the economic-security function of outbound investments screening, subject of a White Paper published by the European Commission and an Executive Order in the US. The paper aims to investigate the role this possible administrative power may have in the Italian legal system, on the basis of what competencies and in what relationship with the current economic-security functions: Italian FDI screening regulation (“golden power”) and dual-use items regulation.
A study of early regulatory interventions and European and U.S. security strategies enables the elaboration of three categories of objectives for which outbound investment control is functional. These are countering technology leakages and the pursuit of economic autonomy and technological supremacy. Each of these objectives is related to a particular scope of application and in relation to the other economic-security functions. The first two objectives are characterized by defensive needs in the face of geopolitical risk, while the third, that of technological supremacy, evident in U.S. regulation and not unrelated to EU strategy as well, is more clearly situated in the perspective of interstate competition. It will be shown how pursuing this goal in turn requires a fundamental political decision inherent in the countries to which the regulation under consideration is to be applied, according to a list approach peculiar to the U.S. Executive Order but unlikely to be adopted in the EU system.
Based on the purposes to be pursued, the contribution then investigates the relationship with the economic-security functions of “golden power” and dual-use items regulation. In doing so, it finds that, also in light of the current irrational overlap between “golden power” and export control regulation, the current economic-security functions already enable the pursuit of most of the goals of outbound investment control. There are transactions and cases falling outside the scope of current regulations, but the monitoring of these events presents issues under the the principle of proportionality.
The relationship with other economic-security functions also allows for an assessment of how outbound investments control should be regulated considering the relationship between national and EU competencies. Control of inbound investments and dual-use items offer two different models, both of which are based on the relationship between common trade policy - an exclusive EU competence - and national security. It seems that, pending the adoption of any EU regulation, member states may adopt national measures, and, in any case, any EU regulation can only delegate the administrative decision to the national authority.
It remains that the economic-security function under consideration and others already regulated at the EU and national levels are based on a problematic relationship between national security and economic regulation, and the concept of “economic security” now governing EU action reflects the constitutive ambiguity of the concept of “security.” Any discussion of the relationship that may be shaped between EU and Italy, and between State and market, demonstrates the need to define what is meant by a securitarian requirement, and how far a line can be drawn between market protection and fundamental community interests. The regulations on outbound investments control, which are still at an early stage, could shift this boundary, extending the national or EU interest also to the development of economic activities abroad.Il contributo riguarda la funzione economico-securitaria di controllo degli investimenti in uscita, oggetto di un Libro Bianco pubblicato alla Commissione Europea e di un Ordine Esecutivo negli USA. Il presente contributo intende allora indagare come un tale potere amministrativo possa inserirsi nell’ordinamento italiano, sulla base di quali competenze e in che rapporto con le attuali funzioni economico-securitarie: golden power e controllo dei prodotti e duplice uso.
Lo studio dei primi interventi normativi e delle strategie europea e statunitense sulla sicurezza consente di elaborare tre categorie di obbiettivi a cui è funzionale il controllo degli investimenti in uscita. Si tratta del contrasto alla fuga di tecnologie ed il perseguimento dell’autonomia economica e della supremazia tecnologica. Ognuno di questi obbiettivi è collegato ad un particolare ambito di applicazione della normativa, in rapporto con le altre funzioni economico-securitarie. I primi due obbiettivi si caratterizzano per esigenze difensive a fronte di rischio geopolitici, mentre il terzo, quello della supremazia tecnologica, evidente nella normativa statunitense e non estraneo anche alla strategia europea, si colloca in una prospettiva più chiaramente di competizione fra Stati. Si dimostrerà come perseguire questo obbiettivo richieda a sua volta una decisione politica fondamentale inerente ai Paesi a cui applicare la normativa in esame, secondo un list approach proprio dell’Ordine esecutivo statunitense ma di improbabile adozione nel sistema europeo.
Sulla base delle finalità da perseguire, il contributo indaga poi il rapporto con le funzioni economico-securitarie della golden power e del controllo dei prodotti a duplice uso. In tal modo si rileva che, anche alla luce della attuale e irrazionale sovrapposizione tra disciplina di golden power e di controllo delle esportazioni, le attuali funzioni economico-securitarie già permettono di perseguire gran parte degli obbiettivi del controllo degli investimenti in uscita. Residuano ipotesi che esulano dalla normativa attuale ma il cui monitoraggio si pone in rapporto problematico con il principio di proporzionalità.
Il rapporto con le altre funzioni economico-securitarie permette anche di valutare la modalità di regolazione di un’eventuale disciplina sul controllo degli investimenti in uscita, in ragione del rapporto tra competenze nazionali ed europee. Il controllo degli investimenti in entrata e dei prodotti a duplice uso offrono due modelli diversi, entrambi basati sul rapporto tra politica commerciale comune – di competenza esclusiva europea – e sicurezza nazionale. Sembra che, nelle more dell’adozione di una eventuale disciplina europea, gli Stati membri possano adottare misure nazionali e, in ogni caso, una eventuale normativa europea non possa che delegare la decisione amministrativa all’autorità nazionale.
Resta che la funzione economico-securitaria in esame e le altre già disciplinate a livello europeo e nazionale si basano su un problematico rapporto tra sicurezza nazionale e regolazione economica, ed il concetto di “sicurezza economica” che governa ora l’azione europea riflette la costitutiva ambiguità del concetto di “sicurezza”. Ogni discorso sul rapporto che si potrà configurare tra Europa e Italia, e tra Stato e mercato, dimostra l’esigenza di definire cosa si intende per esigenza securitaria, e fin dove può tracciarsi un confine tra tutela del mercato e interessi fondamentali della collettività. La disciplina sul controllo degli investimenti in uscita, ancora oggi in una fase iniziale, potrebbe spostare questo confine, estendendo l’interesse nazionale o europeo anche allo sviluppo di attività economiche all’estero
Demitizzazione della concorrenza e principio del risultato nella contrattualistica pubblica
In Legislative Decree 36/20023 the result does not consist of a unique primary interest satisfaction. Rather, it has to be balanced with other codified and non-codified principles representing neutral values of the subject and in cases in which behavioral duty and result duty coexist.
On this premise, the investigation focuses on the impact of the result in the balance between solidarity and competition in the service award procedures devoted to “activities with strong social value” where the “result” is expressed not only in a “competitive” key, but also in a “solidaristic” one. Thus, the Administration is made responsible for choosing the “equiordinate” tools to be used to achieve the results and on the Third Sector bodies being charged with specific structural, training, and competence obligations and liabilities for violation of the principle of good organisation. The scrutiny on this principle is subject to verification in the ambit of a legitimacy review extended to opportunity and adequacy of the choice.Nel D.Lgs. 36/20023 il risultato non si risolve nella soddisfazione di un unico interesse primario, ma va bilanciato con altri principi e valori codificati che rappresentano valori neutri della materia e nelle fattispecie in cui doverosità comportamentale e doverosità di risultato coesistono.
Su tale premessa l’indagine si focalizza sull’impatto del risultato nel bilanciamento tra solidarietà e concorrenza nelle procedure di affidamento dei servizi per “attività a spiccata valenza sociale” ove il “risultato” si declina non solo in chiave “concorrenziale”, ma anche “solidaristica” responsabilizzando così l’Amministrazione nella scelta degli strumenti “equiordinati” da utilizzare per il raggiungimento del risultato e gli ETS su cui incombono precisi obblighi strutturali, formativi e competenziali e responsabilità per violazione del principio di buona organizzazione, il cui accertamento è oggetto di verifica nell’ambito di un sindacato di legittimità esteso al merito

Literary Translation as Agent of Globalization
Literature is artistic expression through the medium of language. It provides a lens into a particular place and time, and illuminates the values and practices of a certain culture. Its translations need to reconstruct the original accurately. Globalization, or essentially country interconnectedness and the spread of information around the globe, has been a factor in connecting people throughout history. Today’s spread of information at the speed of fiberoptics globalizes, connecting cultures, and has resulted in an ever-increasing need for translations. Globalization relies upon translation to occur – in order for people to connect, they need to be able to communicate, and the primary mode of communication is a common language. Thus, translators are placed squarely in the middle of the globalization equation, and their translation decisions become acts of globalization, for better or for worse. As agents of globalization, they carry tremendous onus to contribute to globalization responsibly. This paper presents translation’s key elements and considerations in the field, looks at the role translation plays within globalization, and contemplates the translator’s responsibility as an agent of globalization, arguing that foreignization techniques further healthy globalization while domestication choices promote ethnocentrism and warped constructions of source culture and writer

Un suggestivo ma solitario ‘et cetera’
The essay deals with the ‘etc.’ (et cetera) which can be read at the end of Int. CTh. 2.18.1 in the Haenel edition of the Lex Romana Visigothorum. It is the only case in which this formula occurs in the Interpretationes of the Breviarium. In theory it could play a relevant role in the debeated problem of the authorship of these interpretationes: whether they are the work of the Visigothic compilers or are taken from earlier texts, as that ‘etc.’ would suggest. But, even in the light of the more reliable Mommsen edition of the Theodosian Code, the author believes that, although suggestive, this formula cannot be a convincing argument
Senso comune, buon senso, and Philosophy in Gramsci
The vast and intricate theoretical development of Gramsci’s concept of senso comune intersects with diverse themes in his thought, from hegemony and political parties to civil society, the state, and the role of intellectuals, to name but a few. This article contributes to the analysis of the concepts of senso comune and buon senso in Gramsci’s pre-prison writings, Prison Letters, and Prison Notebooks, through its relationship with the development of his conception of philosophy. Engaging with the recent season of historico-philological studies of Gramsci’s writings to pursue the diachronic development of Gramsci’s conception of senso comune, this investigation reconsiders prevailing anglophone «images» of his thought, in relation to senso comune, in light of the resources of the critical editions of Gramsci’s writings. While acknowledging the pitfalls of the unmediated and de-contextualised application of Gramsci’s ideas to the present, this study suggests that a philological reading of Gramsci’s conception of senso comune has value as a pre requisite for a «dialogue with the present», and a strategic analysis of the contemporary conjuncture.Il vasto e intricato sviluppo teorico del concetto di senso comune di Gramsci si interseca con diversi temi del suo pensiero, dall’egemonia e dai partiti politici alla società civile, allo Stato e al ruolo degli intellettuali, per citarne solo alcuni. Questo articolo contribuisce all’analisi dei concetti di senso comune e buon senso negli scritti di Gramsci prima del carcere, nelle Lettere dal carcere e nei Quaderni del carcere, attraverso il loro rapporto con lo sviluppo della sua concezione della filosofia. Prendendo spunto dalla recente stagione di studi storico-filologici degli scritti di Gramsci, per perseguire lo sviluppo diacronico della concezione gramsciana del senso comune, questa indagine riconsidera, alla luce delle risorse delle edizioni critiche degli scritti di Gramsci, le “immagini” anglofone prevalenti del suo pensiero in relazione al senso comune. Pur riconoscendo le insidie di un’applicazione immediata e non contestualizzata delle idee di Gramsci al tempo presente, questo studio suggerisce che una lettura filologica della concezione gramsciana del senso comune ha valore come pre-requisito per un “dialogo con il presente” e un’analisi strategica della congiuntura contemporanea
