Disabilità, malattia cronica, fragilità: il lavoro agile come accomodamento ragionevole
This paper is intended to explore the potential of smart working as a reasonable accommodation, highlighting its implications in terms of fulfilment and remedy. Particular attention is then paid to the field of beneficiaries, unravelling the complex intertwining of disability and chronic illness caught up in the “rising” notion of fragility. In the light of this reconstructive framework, the perimeter of the employer’s obligations arising from the combined reading of anti-discrimination and prevention regulations is analysed. Finally, the role of collective autonomy is explored for the declination of smart working as an instrument of inclusion, prevention and (social) protection for disabled workers and their surroundings.Con il presente contributo si intendono sondare le potenzialità del lavoro agile come accomodamento ragionevole, mettendone in evidenza le implicazioni sul piano degli adempimenti e su quello rimediale. Particolare attenzione è poi riservata al campo dei beneficiari, districando il complesso intreccio tra disabilità e malattia cronica calamitate nella “grezza” nozione di fragilità. Alla luce di questo quadro ricostruttivo, è analizzato il perimetro delle obbligazioni datoriali che discendono dalla lettura combinata della disciplina antidiscriminatoria e di quella prevenzionistica. Infine, è esplorato il ruolo dell’autonomia collettiva per la declinazione del lavoro agile come strumento di inclusione, prevenzione e protezione (sociale) a beneficio dei lavoratori disabili e dintorni
La certificazione dei contratti di lavoro in ambienti confinati e sospetti di inquinamento alla luce delle recenti note dell’INL
Decree No. 177/2011 requires the certification of employment contracts as a tool to ensure the use of specialized personnel in activities with a high risk of injury, such as those carried out in confined and/or pollution-suspected environments. Despite the clarity in its purpose of promoting a better prevention culture in a sector marked by the strong danger of tragic injury events, the regulation has generated several perplexities since its introduction, starting with the definition of the subject of the certification obligation. The INL Administrative Annotations Nos. 694 and 1937 of 2024 attempt to dispel such doubts by providing a literal and restrictive interpretation of the scope of application of the provision contained in the 2011 regulation. The objective of the essay is to investigate the impact of these annotations, reflecting on the possible permanence of critical application issues, advocating an extensive interpretation of the certification obligation in confined and/or pollution-suspected environments, also suggested by the enhancement of the certification tool in terms of maximum promotion of legality in the field of health and safety in the workplace.Il d.P.R. n. 177/2011 prescrive la certificazione dei contratti di lavoro come strumento per garantire l’utilizzo di personale specializzato in attività ad alto rischio infortuni, come quelle che si svolgono negli ambienti confinati e/o sospetti di inquinamento. La norma, sebbene chiara nella finalità di promozione di una migliore cultura prevenzionistica in un settore connotato dal forte pericolo di tragici eventi lesivi, ha generato, sin dalla sua introduzione, diverse perplessità, a partire dalla definizione dell’oggetto dell’obbligo certificatorio. Si tratta di dubbi che le note dell’INL n. 694 e 1937 del 2024 cercano di dipanare, fornendo un’interpretazione letterale e restrittiva del perimetro applicativo della previsione contenuta nel regolamento del 2011. L’obiettivo del saggio è di verificare l’impatto di queste note, riflettendo sull’eventuale permanenza di criticità applicative, caldeggiando un’interpretazione estensiva dell’obbligo certificatorio in ambienti confinati e/o sospetti di inquinamento, suggerita anche dalla valorizzazione dello strumento certificatorio in chiave di massima promozione della legalità in tema di salute e sicurezza nei luoghi di lavoro
La gestione algoritmica dell’impresa tra tutele dei lavoratori e prospettive partecipative (sul modello della sicurezza sul lavoro?)
Business and labour management is increasingly oriented towards the use of algorithmic management systems, tools that support the employer-entrepreneur in making decisions, thanks to the processing of an enormous amount of data. In the face of such technological power, which is added to the typical power of the entrepreneur, the worker is exposed to increasing risks, which perhaps ex ante and ex post information rights are not sufficient to mitigate, and certainly not to exclude. The present work therefore, having examined the Italian and European regulatory panorama, particularly with regard to the protections guaranteed to workers in the face of new technologies, attempts to summarise the critical issues, arising from the algorithmic management of business and labour, which have repercussions on the employment relationship, and questions the feasibility of a solution that provides for a form of participation of workers or their representatives in the algorithmic (co)management of the enterprise, as a way of enabling the latter to exercise a central role in order to ensure a transparent, reliable and supervised use of algorithmic and artificial intelligence mechanisms in the workplace, with particular regard to the issue of safety at work.La gestione dell’impresa e del lavoro è sempre più orientata all’utilizzo di sistemi di management algoritmico, strumenti che supportano il datore di lavoro-imprenditore nell’assunzione di decisioni, grazie alla processazione di una enorme mole di dati. A fronte di tale potere tecnologico, che si aggiunge a quelli tipici dell’imprenditore, il lavoratore è esposto a sempre maggiori rischi, che forse i diritti di informativa ex ante ed ex post non sono sufficienti a mitigare, e certamente non ad escludere. Il presente lavoro dunque, esaminato il panorama normativo italiano ed europeo, in particolare per quanto attiene alle tutele garantite ai lavoratori dinanzi alle nuove tecnologie, tenta di compendiare le criticità, scaturenti dal management algoritmico dell’impresa e del lavoro, che si ripercuotono sul rapporto di lavoro, e si interroga sulla percorribilità di una soluzione che preveda una forma di partecipazione dei lavoratori o dei loro rappresentanti alla (co)gestione algoritmica dell’impresa, come strada che consenta a questi ultimi di esercitare un ruolo centrale al fine di garantire un utilizzo trasparente, affidabile e sorvegliato dei meccanismi algoritmici e di intelligenza artificiale in ambito lavorativo, con particolare riguardo al tema della sicurezza sul lavoro
L\u27 idolatria secondo Filone di Alessandria
In età ellenistica e romana è abituale, per gli autori ebrei, confrontarsi con il tema dell’idolatria. Tra i vari autori che ne parlano, emblematico è Filone di Alessandria. Presenta il culto degli astri, la venerazione di animali, l\u27adorazione di statue, il culto degli imperatori.
Accanto alla presentazione “letterale” di molte di tali pratiche e al giudizio negativo con cui le descrive, Filone dà una lettura “filosofica” di alcune convinzioni e di riti. Così l’adorazione degli astri, che è stato uno dei momenti del percorso conoscitivo di Abramo verso la conoscenza delle realtà superiori, è attribuita ai “Caldei”, il culto degli animali e il dominio del corpo e delle passioni agli “Egiziani”. Caldei ed Egiziani appaiono come emblemi di tipi filosofici: c\u27è chi li identifica con gli aristotelici, chi con gli stoici, chi con gli epicurei. Altri li considerano esponenti della religione cosmica.
Per Filone, negatori e idolatri sono coloro che avanzano nel loro percorso senza temere l\u27intervento divino. Se, come sostiene Harl, negare Dio vuol dire non tanto negarne l\u27esistenza, quanto la possibilità di punire i malvagi, e se gli idoli sono caratterizzati dal non avere potere, idolatri sono coloro che ritengono Dio incapace di intervenire e lo equiparano, in questo, agli idoli. Filone parla sì, dunque, degli adoratori di idoli, della costruzione di immagini, di divinizzazione delle stelle, ma anche di coloro che perseguono l\u27amore per sé anziché l\u27amore per Dio. Una forma forte di idolatria è, poi, data dalla pretesa di fissare l\u27immagine divina, di rappresentare l\u27inconoscibile.
Nella mia lettura, le differenti forme idolatriche non sono per Filone legate a differenti momenti cronologici, a una sorta di "storia dell\u27idolatria", né sono riconducibili a individui o gruppi filosofici precisamente determinati e individuati: sono espressione dell\u27incapacità di cogliere il vero e riconoscere la divinità. Mio obiettivo è cercare di determinare cosa intenda Filone con queste categorie e come queste si relazionino al tema del divieto delle immagini, della invisibilità e inconoscibilità di Dio, della affermazione della provvidenza divina.

In the Hellenistic and Roman Period it is obvious for Jewish authors to deal with the theme of idolatry. Philo talks about it in many passages presenting the cult of the stars, the animals, the statues, the cult of the emperors.
Alongside the "literal" presentation of many of these practices and the negative judgment with which he describes them, there is also a "philosophical" reading of some beliefs and rites.
Thus, the adoration of the stars, for example, which was one of the moments in Abraham\u27s cognitive journey, is attributed to the "Chaldeans", the cult of animals and the domination by the body and passions to the "Egyptians". Chaldeans and Egyptians appear as emblems of philosophical types: there are scholars who identify them with the Aristotelians, with the Stoics, with the Epicureans. Others consider them exponents of the cosmic religion.
For Philo, deniers and idolaters are those who advance on their path without fearing God\u27s intervention. If, as Harl argues, denying God means not denying his existence, but his possibility of punishing the wicked, and idols are characterized by not having power, idolaters are those who consider God incapable of intervening and equate him, in this, to idols. Philo speaks, therefore, of idol worshipers, of the construction of images, of the divinization of the stars, but also of those who pursue love of self instead of love of God. Besides that, a strong form of idolatry is constituted by the claim to fix the divine image, to represent the unknowable. The different idolatrous forms are not, therefore, linked to different chronological moments, to a sort of "history of idolatry", nor can they be traced back to precisely determined and identified individuals or philosophical groups: they are an expression of the inability to grasp the truth and recognize the divine dimension.
My aim is to try to determine what Philo means by these categories and how they relate to the theme of the prohibition of images, the invisibility and unknowability of God, the affirmation of divine providence.

Idolatria e violenza. Riflessioni nel solco di Levinas e Riveline
Il saggio esplora il divieto dell’idolatria in ambito ebraico alla luce delle riflessioni di due studiosi, Emmanuel Levinas e Claude Riveline, e l’idea che l’idolatria sia causa di violenza e schiavitù. In particolare si analizzano tre archetipi idolatrici: quello dell’Egitto, che è idolatria del potere; quello dell’Assiria, che è idolatria del denaro; e quello di Canaan, che è celebrazione dell’istinto e delle forze irrazionali della natura. Sono queste le tre forme di “abominio” che la Bibbia ebraica stigmatizza. Gli autori citati suggeriscono un riscatto di queste derive idolatriche per mezzo della Trascendenza, al fine di superare la potenziale virulenza anti-umana di ogni paradigma idolatrico.

The essay explores the Jewish prohibition of idolatry in the light of the reflections offered by Emmanuel Levinas and Claude Riveline. The main idea is that idolatry is cause of violence and slavery. To such an aim, three archetypes are analyzed: Egypt as the symbol of the idolatry of power; Assyria as the symbol of the idolatry of money; and Canaan as the symbol of the idolatry of human instincts and irrationalities. The Bible defines all of them as abominations. The two scholars suggest, however, to rescue all of these paradigms through the Transcendence, so to overcome their potential anti-human virulence.

Dalla materia al pensiero. Il valore gnoseologico del lavoro in Simone Weil e Antonio Gramsci
This essay explores the gnoseological value attributed to manual labor in the thought of Simone Weil and Antonio Gramsci. Simone Weil conceives manual labor as a fundamental vehicle for accessing ontological truth, thereby promoting an integration between bodily experience and intellectual activity that facilitates a deep and authentic understanding of reality, while also denying any possible hierarchy between manual labor and intellectual work. Gramsci, within the framework of his theory of praxis, considers labor as an essential component of the historical-social process and the formation of individual consciousness, not only as a productive activity but also as an intellectual and creative act that contributes to the transformation of social and political reality. Both philosophers identify the body as the element that connects the merely productive and mechanical dimension of manual labor with its theoretical and ethical-practical dimension, even in a political sense.
