This contribution offers a comparative reading of Italian communist leader Palmiro Togliatti’s and German Marxist political scientist Wolfgang Abendroth’s seminal texts on constitutional anti-fascism and their recommendations for societal transformation based on the post-war (West) German respective the Italian constitution as a means of safeguarding and deepening democracy. The contribution further seeks to illuminate how the currently resurgent doctrine of totalitarianism in the alleged name of “democracy” lends a liberal attire to a philo-fascist core.

Il diritto all’istruzione nella giurisprudenza amministrativa
The paper focuses on case law relating to the right to education, with the aim of examining whether and how the administrative court has contributed to defining or unraveling its contents. The analysis highlights the innovative contribution given by the judge, which stems from a work of connecting the right to education with the other values and rights that dot the constitutional landscape. The administrative judge, on the one hand, balance the right to education with other constitutional values and, on the other hand, uses the values expressed in the Constitution as levers to enhance it. Thus, he brings out the connections of the right to education with other rights and other duties and clarifies the framework of public responsibilities, with the effect of developing the different dimensions of the right to education and of defining its spaces and boundaries.Lo scritto analizza la giurisprudenza amministrativa relativa al diritto all’istruzione, allo scopo di verificare se e come il giudice amministrativo abbia contribuito a definirne o disvelarne i contenuti. L’esame compiuto evidenzia l’apporto innovativo della giurisprudenza, che deriva da un’opera di raccordo del diritto all’istruzione con gli altri valori e diritti che costellano il panorama costituzionale. Un raccordo realizzato non solo definendo contesto, limiti e parametri per un bilanciamento, e dunque con il risultato di introdurre limitazioni al diritto all’istruzione, ma anche, in senso opposto, utilizzando i valori espressi dalla Costituzione come leve per potenziarne il contenuto. Così, facendo emergere le connessioni con altri diritti e altri doveri e chiarendo il quadro delle responsabilità pubbliche che presidiano la sua garanzia, il giudice amministrativo ha identificato e sviluppato le diverse dimensioni del diritto all’istruzione, definendo i suoi spazi e i suoi confini
Il Partenariato pubblico-privato nella filosofia del nuovo codice dei contratti pubblici
The paper dwells on the subject of the Public-Private Partnership, analyzing the phenomenon from the perspective problematic angle of the excessive rigidity of the procedures and lack of discretion of the administration that has characterized it, which have contributed to the low use of cooperative instruments. In this sense, moving from the reasons, also economic, for the phenomenon, the work frames the PPP in the new philosophy, even in general, brought by Legislative Decree No. 36/2023, precisely on the subject of greater discretion of the administration and flexibility of procedures. The thesis that such references are necessary for the accomplished use of the PPP is developed with the analysis of the new specific regulations of the Code, with particular reference to the procedures for choosing the concessionaire and project finance, also in the light of the relevant case law. The essay concludes by confirming the need not to read the discipline on public contracting, in general and in particular for PPP, with excessive rigidity, but valuing the flexibility and discretion of the p.a. with a view to efficiency and effectiveness.Il contributo si sofferma sul tema del Partenariato Pubblico-Privato, analizzando il fenomeno dall’angolo prospettico, di carattere problematico, dell’eccessiva rigidità delle procedure e scarsa discrezionalità dell’amministrazione che l’ha caratterizzato sino ad oggi, che hanno contributo allo scarso utilizzo degli strumenti cooperativi. In tal senso, muovendo dalle ragioni, anche economiche, del fenomeno, il lavoro inquadra il PPP nella nuova filosofia, già in generale, portata dal D.lgs. n. 36/2023, proprio in tema di maggiore discrezionalità dell’amministrazione e flessibilità delle procedure. La tesi per cui tali riferimenti sono necessari per un compiuto utilizzo del PPP viene sviluppata e, si ritiene, confermata, con l’analisi della nuova disciplina specifica del Codice, con particolare riferimento alle procedure di scelta del concessionario e alla finanza di progetto, anche alla luce della giurisprudenza in materia. Il saggio si conclude confermando la necessità di non leggere la disciplina in tema di contrattualistica pubblica, in generale e in particolare per il PPP, con eccessiva rigidità, ma valorizzando la flessibilità e discrezionalità della p.a. in un’ottica di efficienza ed efficacia

Among the news included in the new Directive on credit agreements for consumers, debt advice is particularly interesting. CCD II intends to build a regulatory system able to increase protection for subjects receiving funds offering new instruments guaranteeing a correct and efficient use of consumer credit instruments, avoiding lenders’ irresponsible behaviour, limiting over-indebtedness. The new rules are set to redesign the regulatory framework according to new criteria, also for our legal system.
Debt advice represents a real novelty, both for the role it is given and for the needs it will meet.
It is a particular kind of advice that is characterised by some distinctive features: anticipatory protection against potential situations of crisis, the heterogeneity of the activities through which it is offered, advisors’ independence, their professionalism.
The new model should meet on the one hand consumers’ needs and on the other creditors and the system’s needs, joining at the same time private and public interests.
It will be necessary to design a regulatory framework able to put into practice the meritorious principles outlined by European legislators.Tra le novità contemplate dalla nuova Direttiva relativa ai contratti di credito ai consumatori, la consulenza sul debito assume una portata di assoluto interesse. La CCD II, nell’intento di costruire un rinnovato sistema normativo capace di incrementare la protezione del soggetto finanziato, prevede nuovi strumenti in grado di garantire un corretto ed efficiente accesso al credito al consumo, limitare pratiche che possono causare un eccessivo indebitamento, evitare comportamenti irresponsabili dei finanziatori. Le nuove disposizioni sono destinate a ridisegnare il quadro normativo vigente, secondo criteri nuovi anche per il nostro ordinamento.
La consulenza sul debito rappresenta un istituto di assoluta novità per il ruolo che le viene riconosciuto e per le diverse esigenze cui dovrà rispondere. La sua particolare operatività si caratterizza per alcuni tratti distintivi: la tutela anticipatoria rispetto al verificarsi di situazioni di crisi, l’eterogeneità delle attività attraverso le quali viene offerta, l’indipendenza dei consulenti, la loro professionalità.
Il nuovo modello dovrebbe rispondere da un lato alle esigenze più strettamente legate ai consumatori e, dall’altro, anche a quelle dei creditori e del sistema, potendo coniugare allo stesso tempo interessi di carattere privato con altri di carattere pubblico.
Sarà necessario tracciare un framework normativo adatto a dare concreta attuazione ai meritori principi delineati dal legislatore europeo
Sui «Princìpi generali»: riflessioni filosofico-giuridiche a margine del Codice dei Contratti Pubblici
The contribution examines the General Principles of the Code from a theoretical standpoint. The first section analyses key principles set forth in Articles 1-4 of the Code, with a focus on their syntactic and structural coherence. The second section addresses renown issues in the application and reasoning based on principles: starting with technical questions related to formulations and statements, it progresses to the roles these principles play in legal reasoning, culminating in their impact on the Rule of Law. The analysis primarily explores the complex interconnections between the principles of the delegating law and those articulated within the Code, emphasizing the implicit dimension of principles and the role of legisprudence in elucidating the binding nature of legislative principles with respect to legislative intent. Following this, the analysis shifts to examine the broad applicability of the principles codified in Articles 1-11, alongside the scope of “External Reference” in Article 12. It further assesses the principle of outcomes and the axiological hierarchies in relation to other principles—chiefly legality, transparency, and competition, as well as good administration, efficiency, effectiveness, and economy, along with principles that reflect community interests and align with the objectives of the European Union. The contribution underscores the instrumental rationality underlying these principles and the broader Codification. It clarifies that the principle of outcomes (cf. Article 1, para. 4) is defeasible—that is, open to exceptions that necessitate case-specific determinations. Additionally, the study emphasizes that the General Principles operate on two traditional fronts: the preventive-repressive function and the rewarding-promotional function to uphold legal compliance. The principle of trust is similarly explored, including its symbolic-expressive significance and the conceptualization of the legal order it reflects. The study recalls the ethical and anthropological orientation embedded in the ideal of a legal system grounded in mutual trust, encompassing public institutions among its stakeholders. Moreover, Article 4 is analyzed as a meta-principle guiding both the interpretation and application of the Code’s provisions. This comprehensive analysis highlights how Codification articulates two significant, cross-cutting dimensions of contemporary law: promotionality and particularism. In the second section, the contribution addresses a critical issue in contemporary principles theory—how to reconcile the inherent indeterminacy of principles with the expectation of correctness they are assumed to uphold. For analytical clarity, it is proposed that “(general) principle” denotes a norm that (i) serves as a comparatively superior reason, though not in absolute terms, but rather always ceteris paribus, integrating values that are in some respect self-evident and reinforcing acceptance; and (ii) supports a multiplicity of ancillary uses and functions on a pragmatic level. Based on this framework, the study reflects on how principles transition into concrete cases and the justifiability and verifiability of the correct (or justified) (non-)application. The study observes that reconciling the Rule of Law—with its corollaries of separation of powers and democratic representation—and the inevitability of discretion can be achieved by adhering to methodological guidelines such as neutrality and interpretative charity. The latter is viewed as an expression of the interconnected principles of universalizability and trust. Neutrality is not understood as the absence of values or evaluations; rather, intellectual and moral honesty demands that the choices inherent in the legal method be made explicit. The analysis offers a pragmatic explanation for why reasoning in terms of a “right answer” is unavoidable, and that this bolsters the significance of argumentation and justification. The burden of justification should be stronger and more stringent as the certainty that the answer provided is indeed the most correct decreases. It is emphasized that legal practice relies upon—and requires from participants—two seemingly contradictory attitudes: a moderate legalism, or the expectation of obtaining justice through correct decisions according to the law, and a moderate hypocrisy, or a general tendency to obscure the status quo, with the understanding that it does not always conform to the ideal. Ultimately, the contribution advances certain theses. Recognizing the inescapability of discretion, it contends that not every dispute has a correct solution according to its own principles, and that relying solely on principles to guarantee this would be illusory and potentially dangerous. The pursuit of correctness remains a critical ideal precisely because reality does not reflect the Alexian vision of law or the “Herculean” judge. From a legal-philosophical perspective, the Codification of Principles reflects a mindset in which Apollonian-irenic perspectives prevail over conflictualist ones. In this, it embodies an ambitious neoconstitutionalism of principles which, to avoid implosion from hubris, must preserve a sense of its own limitations. The culture of neoconstitutionalism of principles finds its philosophical grounding in practical reason, which, by nature, rests on premises that are neither demonstrable nor foundational and, thus, are inherently limited. This limitation, and the corresponding variability in reasoning, logically necessitates recognizing the equally limited reasons of others. Within this framework, the public exchange of reasons becomes crucial, as do the techniques of reasoning and justification. Thus, the foundations of legislation and practices based on principles that align with the Rule of Law present an ethical challenge that places greater demands on those tasked with making concrete decisions. The neoconstitutionalism of principles, therefore, underscores the (self-)responsibility of every individual—whether vested with public or private powers. This assertion culminates in the conclusion that there can be no Rule of Law without a claim to correctness and justice, understood in its two facets: justice as generality and equality, and equity.Il contributo riflette sui «Princìpi generali» del Codice da una prospettiva teorico-generale. La prima parte esamina alcuni princìpi sanciti agli artt. 1-4 del Codice, indagandone la sintassi e la sistematica. La seconda tocca questioni classiche relative all’applicazione e argomentazione basata sui princìpi: cominciando da quelle più tecnico-redazionali, relative a enunciazioni e formulazioni testuali, proseguendo con le funzioni svolte in seno al ragionamento giuridico, fino a giungere alla chiave di volta, ossia i riflessi rispetto all’ideale dello Stato di diritto. L’analisi si sofferma anzitutto sui nessi esistenti tra i princìpi della legge delega e quelli esplicitati nel Codice, ricordando la dimensione implicita dei princìpi e la rilevanza degli studi di legisprudence per chiarire la cogenza dei princìpi legislativi rispetto alla motivazione legislativa. L’analisi si concentra poi sulla estensione generale dei princìpi sanciti ex artt. 1-11 del Codice e sulla portata del «Rinvio esterno» ex art. 12. Viene dunque esaminato il principio del risultato e le gerarchie assiologiche rispetto agli altri princìpi (in primis, legalità, trasparenza e concorrenza, nonché buon andamento, efficienza, efficacia ed economicità, oltre a quelli dell’interesse della comunità e degli obiettivi dell’Unione europea). Si evidenzia la razionalità strumentale soggiacente alla Codificazione. Si chiarisce inoltre che il principio del risultato (cfr. art. 1, co. 4) è defettibile (defeasible), vale a dire suscettibile di eccezioni aperte che implicano una determinazione di caso in caso. Lo studio sottolinea anche quanto i Princìpi generali operino sui due versanti tradizionali a presidio della conformità al diritto: funzione preventiva-repressiva e funzione premiale-promozionale. Analoga attenzione è rivolta al principio della fiducia, alla sua carica simbolico-espressiva e alla concezione del giuridico di cui è proiezione. Lo studio ricorda così la opzione etico-antropologica sottesa all’ideale di un diritto il cui perno è la fiducia tra tutti i consociati, incluse le istituzioni, tra cui le pp.aa.. Viene infine indagato l’art. 4 quale meta-principio funzionale a guidare interpretazione e applicazione delle disposizioni del Codice. La complessiva analisi pone in risalto quanto la Codificazione dia voce a due aspetti salienti trasversali del diritto vigente: promozionalità e particolarismo. La seconda parte del contributo muove da un nervo scoperto della teoria contemporanea dei princìpi: come sia possibile conciliarne la indeterminatezza-discrezionalità con la pretesa di correttezza che si avanza mediante essi. In via ridefinitoria, si propone d’intendere per ‘principio’ (generale) una norma che si assume (i) poter fungere da buona ragione, cioè comparativamente migliore di altre, mai in assoluto, ma sempre ceteris paribus, incorporando valori in un certo qual modo autoevidenti, che alimentano l’accettazione e (ii) suscettibile, a rinforzo, di una pluralità d’usi-funzioni, ancillari, a livello pragmatico. Su questa base, si riflette su come si passa dai princìpi ai casi concreti e la giustificabilità e verificabilità della corretta (giustificata) (dis)applicazione. Nello studio si osserva che la convivenza dello Stato di diritto (con i suoi corollari: separazione dei poteri e rappresentanza democratica) con la inevitabilità della discrezionalità può darsi adottando alcune direttrici metodologiche quali neutralità e carità interpretativa. Quest’ultima si considera espressione dei princìpi, interconnessi, di universalizzabilità e fiducia. La neutralità non viene concepita come assenza di valori-valutazioni, onestà intellettuale e morale esigendo di palesare chiaramente le scelte insite nel metodo giuridico. L’analisi spiega a livello pragmatico perché sia inevitabile ragionare in termini di (unica) risposta corretta o migliore, preferibile (la cosiddetta “right answer”), e che questo estende la rilevanza dell’argomentazione-giustificazione. L’onere di giustificare dovrebbe essere tanto più forte e rigoroso quanto più è opinabile che effettivamente quella che si vuole dare sia la unica risposta (più) corretta. Dal punto di vista interno, si rimarca che la pratica giuridica poggia su, e richiede ai partecipanti (consociati, funzionari, autorità), due generali atteggiamenti solo apparentemente contraddittori: un moderato legalismo, cioè l’aspettativa di poter ottenere giustizia, i.e. decisioni corrette secondo diritto; una moderata ipocrisia, cioè una generalizzata tendenza a occultare lo status quo, nella consapevolezza che non sempre è conforme all’ideale. Il contributo difende in definitiva alcune tesi. Sapendo che la discrezionalità è ineliminabile, ogni controversia non ha sempre una soluzione corretta iuxta propria principia e sarebbe pericoloso illudersi che ciò possa avvenire per il tramite dei princìpi. La pretesa di correttezza è un ideale cruciale al quale tendere, proprio perché la realtà non corrisponde al diritto alexiano o del giudice Hercules. Guardando alla Codificazione dei Princìpi in chiave giusfilosofica, essa esprime una mentalità in cui le visioni apollinee-ireniste prevalgono su quelle conflittualiste. In ciò incarna un neocostituzionalismo principialista ambizioso che, perché non deflagri per eccesso d’hybris, deve conservare la idea di limite. La cultura del neocostituzionalismo principialista trova giustificazione filosofica in una ragion pratica, che è tale entro premesse, non dimostrabili né fondabili, necessariamente limitata. Questa limitazione e, quindi, la diversa possibilità di ragioni impone, per coerenza logica, di riconoscere le ragioni (ugualmente limitate) degli altri. In questo contesto il gioco pubblico delle ragioni è decisivo e, con esso, le tecniche di ragionamento e giustificazione. Le basi, dunque, di una legislazione e prassi fatta per princìpi compatibili con lo Stato di diritto implicano una sfida etica che pone maggiori oneri sulle spalle di chi si trova più prossimo alla decisione concreta. Il neocostituzionalismo principialista esalta così l’(auto)responsabilità di ogni soggetto, investito e non, di poteri pubblici o privati. Di qui, l’assunzione che non vi può essere Stato di diritto senza pretesa di correttezza/giustizia nei suoi due volti: giustizia generalità-eguaglianza ed equità
L’amministrazione pubblica condivisa: terzo settore, contratti, servizi
The essay is structured into two sections, corresponding to different objectives of analysis, interconnected.
The first section examines the evolution of the institutions governed by Title VII of the Third Sector Code (co-programming, co-planning, and conventions), and their relationship with the market-driven logic underpinning public procurement law. This analysis departs both from pan-competitive approaches – admirably represented by Opinion no. 2052/2018 of the Council of State — and from perspectives that, in emphasizing the preferential treatment for non-profit entities, see an absolute and non-graded dichotomy between third sector law and public procurement law. From this "middle ground" perspective, the analysis of the institutions established by articles 55 and subs. of the Third Sector Code is conducted through a comparison with European Union law and its categories. In particular, the essay explores the relationship between these institutions and the models of in-house providing and public-public partnerships (paragraphs 1 and 1.1), highlighting their shared reliance on the principle of self-organization of the public administration, as an extension of the constitutional principle of good governance and the principle of result.
In the subsequent paragraphs (2 and 2.1), this essay analyses the effects of the balance achieved at the European level between the values of competition and solidarity and its implications on the domestic legal system. Paragraph 3 focuses on “co-planning for implementation”, an form of shared administration that demonstrates more intensely the tension between European public procurement law and Third Sector law. The analysis seeks to emphasize the collaborative and non-synallagmatic nature of this institution, highlighting its objective differences from traditional outsourcing mechanisms. In this regard, the essay criticizes the administrative case law which identifies the gratuitous or non-onerous nature of the relationship as a distinctive feature: paragraph 4 is precisely dedicated to demonstrating the limitations of this approach and to identifying the “authenticity” of expense reimbursement as the constitutive element of the privileged relationships between public administration and the Third Sector.
The second section of the essay develops a theoretical reconstruction of this new way of administration (shared administration), with the aim of deepening its function and its systematic implications on the administrative action plan. Starting from the framing of the co-planning for implementation as an organizational tool for the delivery of public functions and services (paragraph 5), the essay examines the consequences of this reconstruction for the legal regime governing the activities of Third Sector Entities. In the subsequent paragraphs (6 and 6.1), the institutions under study are analysed in relation to specific theories regarding the relationship between State and civil society, addressing questions such as: what corollaries of horizontal subsidiarity emerge in co-programming and co-planning? And what are the points of contact with the conception of “objective administration”?
In the concluding paragraph (7), a synthesis of the argumentative trajectory is provided, along with critical observations regarding the approach — endorsed by decision no. 131/2020 of the Constitutional Court — that considers shared administration and public procurement as two separate worlds. Although widespread, this approach appears unsatisfactory both operationally and theoretically, since it seems to support the return of a dichotomous vision of the relationship between competition and solidarity and it neglects the shared objective of co-planning and traditional outsourcing solutions: the implementation of social rights enshrined in the Constitution.Il saggio si articola in due sezioni, corrispondenti a distinti, ma interconnessi, obiettivi di analisi.
Nella prima sezione, si esamina l’evoluzione degli istituti disciplinati dal Titolo VII del Codice del Terzo Settore (co-programmazione, co-progettazione e convenzioni), e il loro rapporto con le logiche di mercato che informano il diritto dei contratti pubblici. Tale analisi si distanzia sia dagli approcci pan-concorrenziali – esemplarmente rappresentati dal parere n. 2052/2018 del Consiglio di Stato – sia dalle prospettive che, nel valorizzare il favor per il non profit, concepiscono un’alternatività assoluta e non graduata tra diritto del Terzo settore e diritto dei contratti pubblici. In questa prospettiva “mediana”, l’analisi degli istituti previsti dagli artt. 55 e ss. del Codice del Terzo settore è condotta attraverso un confronto con il diritto dell’Unione Europea e le sue categorie. In particolare, si esplora la relazione tra questi istituti e i modelli dell’in house providing e della cooperazione pubblico-pubblico (par. 1 e 1.1), evidenziandone il comune riferimento al principio di auto-organizzazione della pubblica amministrazione, inteso quale sviluppo del principio costituzionale di buon andamento e del principio del risultato.
Nei paragrafi successivi (2 e 2.1), si analizzano gli effetti dell’equilibrio, realizzato a livello europeo tra i valori della concorrenza e della solidarietà, e i riflessi di tale bilanciamento nell’ordinamento nazionale. Il paragrafo 3 è invece dedicato alla c.d. co-progettazione realizzativa, istituto di amministrazione condivisa in cui si manifesta con maggiore intensità la tensione tra il diritto europeo dei contratti pubblici e il diritto del Terzo settore. L’analisi si propone di valorizzare la natura collaborativa e non sinallagmatica dell’istituto, ponendo in evidenza le oggettive differenze rispetto alle tradizionali modalità di esternalizzazione. A tale proposito, si critica l’orientamento della giurisprudenza amministrativa che individua nella gratuità o non onerosità del rapporto un elemento distintivo: il paragrafo 4 è appunto dedicato alla dimostrazione dei limiti di tale impostazione e all’individuazione nella “genuinità” del rimborso spese dell’elemento costitutivo dei rapporti riservati tra p.a. e Terzo settore.
La seconda sezione del saggio elabora una ricostruzione teorica di questo nuovo modo di amministrare (l’amministrazione condivisa), con l’intento di approfondirne la funzione e le implicazioni sistematiche sul piano dell’azione amministrativa. Muovendo dall’inquadramento della co-progettazione realizzativa quale strumento organizzativo per l’erogazione di funzioni e servizi pubblici (par. 5), si analizzano le conseguenze di tale ricostruzione sul regime giuridico delle attività degli enti del Terzo settore. Nei successivi paragrafi (6 e 6.1), gli istituti oggetto di studio sono esaminati in relazione a determinate teorie sul rapporto tra Stato e società civile, cercando di rispondere ai seguenti quesiti: quali corollari della sussidiarietà orizzontale emergono nella co-programmazione e co-progettazione? Quali sono i punti di contatto con la tesi dell’amministrazione obiettivata?
Nel paragrafo conclusivo (7), si fornisce una sintesi del percorso svolto e si sviluppano alcune notazioni critiche nei confronti dell’impostazione, sostenuta anche dalla sentenza n. 131/2020 della Corte costituzionale, che considera l’amministrazione condivisa e i contratti pubblici come due universi distinti. Se l’equiparazione dell’idolatria all’assenza di veracità porta a riconoscere in essa una perversione della cultura etica, inconciliabile con la struttura epistemologica del diritto pubblico (Nahme), Cohen non invoca però sugli idolatri rovina né umiliazione, bensì vergogna, sintomo della ritrovata veracità che l’idolatria aveva represso.
