La proposta di introdurre un art. 254-ter nel codice di procedura penale si colloca nell’alveo di un più ampio processo di aggiornamento del diritto processuale penale, volto a garantire l’effettività dell’azione investigativa senza sacrificare le garanzie fondamentali del soggetto sottoposto ad indagine. In particolare, l’intervento si propone di colmare le lacune interpretative e applicative che l’attuale formulazione degli articoli 253 e seguenti del codice di procedura penale presenta in relazione al sequestro di dispositivi elettronici, server, archivi digitali e contenuti in cloud.
Tali strumenti, oggi sempre più frequentemente utilizzati per la comunicazione, la conservazione di informazioni e l’esercizio di attività personali o professionali, rappresentano contenitori di dati sensibili, molto spesso sovrabbondanti rispetto alle finalità dell’accertamento penale: ciò è dovuto al fatto, ben noto, per cui attraverso la raccolta dei dati contenuti in un dispositivo digitale si ottiene una fotografia estremamente accurata dell’individuo coinvolto (e anche di soggetti terzi), in molteplici ambiti della vita personale (salute, orientamenti politici, preferenze sessuali, condizioni economiche e così via). Di qui, la necessità di una disciplina che rafforzi i presidi di legalità e proporzionalità, come in qualche maniera già anticipato dalla giurisprudenza della Corte Suprema statunitense, che, già dal 2014 sancì la necessità di un judicial warrant perché la polizia, in caso di arresto in flagranza, potesse accedere allo smartphone della persona arrestata (Caso Riley v. California, 2014).
Idealmente, è evidente il legame tra la riforma in corso e il decreto-legge 30 settembre 2021, n. 132, conv. in l. 23 novembre 2021, n. 178, con il quale è stato modificato l’art. 132 del codice della privacy, per venire incontro ad alcune indicazioni estrapolabili dalla giurisprudenza della Corte europea dei diritti dell’uomo e, soprattutto, della Corte di giustizia dell’Unione europea

Through the pain of the gaze. Multiple publics and the broken grammar of testimony in the visual representation of political violence in Palestine
The article aims to draw critical reflections on the production, circulation and reception of images in
Palestine, given the recent rise of political violence in the context of the Israeli military occupation and settler
colonialization of Gaza and the West Bank. Reflections move from the author’s personal relations built
during fieldwork in the occupied West Bank, and from the exchange of pictures, messages and video calls
as a sort of “protracted ethnography”. In the context of Israel’s control on images and the ban on
international journalists to enter Gaza, the first part of the article questions Palestinian images as a mode of
testifying to Israeli state violence. By contrast, in the second part, the representation of Palestinian suffering
is considered through visual contents produced by Israelis, who made them circulating through social
media. Ultimately, the article explores the performative character of images in creating multiple publics who
differently relate to the visual grammar of testimony in the globally contested field of Palestinian memory.
From this global perspective, “the pain of the gaze” is thought as a necessary although uncomfortable
standpoint, from which to grasp traces of presence, life aspirations and the quest for justice
Adaptive potential of a Mediterranean zooxanthellate coral to ocean acidification: insights from a naturally acidified habitat
Ocean acidification caused by shifts in carbonate chemistry resulting from increased atmospheric CO2 concentration is threatening marine calcifying organisms, including corals.
Here, we assessed the photo-physiological and molecular mechanisms underling acclimatization mechanisms to low pH/high pCO2 conditions in the Mediterranean zooxanthellate coral Balanophyllia europaea at a CO2 vent off Panarea Island (Italy).
In agreement with previous findings, we demonstrated a higher chlorophyll a content per unit of coral host surface, due to higher dinoflagellate endosymbiont densities at low pH sites. This translated in a higher content of photosynthates sustained by an increase in the total photosynthetic capacity of the symbionts. This likely enhanced carbohydrate translocation to coral host, providing nutritional benefits, and increasing energy reserves to sustain tissue growth. The presence of a higher-biomass coral phenotype was confirmed by an increased host protein content at low pH.
Our molecular findings, support the idea of a rearrangements of the transcriptional levels of biomineralization-related genes in the host as well as of photosynthetic components in the algal counterpart.
Overall, our findings show further details of the acclimatization mechanisms of this coral-dinoflagellate mutualism under ocean acidification, as predicted by end-of-century scenarios, complementing previous studies on the skeletal properties of B. europaea at low pH/high pCO2 conditions
How to implement a clinical ethics committee in an oncological research hospital: Qualitative results from a process evaluation study using normalization process theory (EVACEC)
Introduction The Clinical Ethics Committee (CEC) of the Local Health Authority (LHA) of Reggio Emilia, Italy, is a multi-professional service established in 2020 to support healthcare professionals (HPs) in dealing with ethical issues in clinical practice. We evaluated the integration of the CEC into routine practice, 24 months after its implementation. Methods We conducted semi-structured interviews with CEC members and LHA stakeholders involved in the service implementation. The interview scripts were outlined and transcript analysis was carried out following the four concepts of Normalization Process Theory (NPT): coherence, cognitive participation, collective action, reflexive monitoring. Results Between June 2022 and January 2023, 15 participants were interviewed (12 CEC members and 3 LHA directors). All participants consider the service an important opportunity for HPs to be supported in complex situations (coherence). The CEC’s President, a bioethicist working at the LHA, played a key role ensuring the CEC’s participation and activation (cognitive participation). The main barriers to the CEC implementation were: financial sustainability, CEC members’ lack of training, absence of in-person relationships (collective action). Overall, participants reported a positive experience with the CEC, however recommended several modifications (reflexive monitoring). Conclusions We identified key components to support the normalization of CECs and enable their activation within a clinical setting. An active and sustainable CEC must be visible, accessible, understood and trusted, clear in purpose, sufficiently integrated into the life of the organisation, adequately resourced, appropriately constituted and competent, accountable and independent. These findings can inform the development of practical strategies for CECs implementation and of appropriate outcomes for further evaluation
The Cost of Skeletal Call-By-Need, Smoothly
Skeletal call-by-need is an optimization of call-by-need evaluation also known as "fully lazy sharing": when the duplication of a value has to take place, it is first split into "skeleton", which is then duplicated, and "flesh" which is instead kept shared.
Here, we provide two cost analyses of skeletal call-by-need. Firstly, we provide a family of terms showing that skeletal call-by-need can be asymptotically exponentially faster than call-by-need in both time and space; it is the first such evidence, to our knowledge.
Secondly, we prove that skeletal call-by-need can be implemented efficiently, that is, with bi-linear overhead. This result is obtained by providing a new smooth presentation of ideas by Shivers and Wand for the reconstruction of skeletons, which is then smoothly plugged into the study of an abstract machine following the distillation technique by Accattoli et al
Per un costituzionalismo deliberativo
La deliberazione democratica è oggi una pratica diffusa e istituzionalizzata che attraversa in vario modo numerosi ambiti degli ordinamenti costituzionali: dalle assemblee legislative alla giustizia costituzionale, dalle autorità indipendenti ai fori di revisione costituzionale. Alla luce di questa trasformazione, il volume propone di ripensare il costituzionalismo come una dottrina deliberativa dei rapporti tra politica e diritto, fondata su ragionevolezza, inclusività e contemperamento tra istanze plurali. Al centro di questa dottrina vi è l’idea di «sistema deliberativo»: un insieme di attori e processi interdipendenti – istituzioni politiche, giuridiche e spazi pubblici – che, nella loro interazione, producono una deliberazione democratica, rappresentativa e legittima. Il volume porta alla luce e delinea il nucleo giuridico di questo sistema, rimasto finora sullo sfondo di riflessioni incentrate sulle sue componenti politiche. Legislazione, giustizia costituzionale e soft law svolgono un ruolo fondamentale nella costruzione di un sistema deliberativo, connettendo le sue articolazioni e contribuendo alla qualità e capacità rappresentativa della deliberazione democratica
Digital Humanities for the Heritage of Political Ideas in Medieval Bologna
This paper outlines a methodology for creating an educational and informative communication system for non-specialised audiences in order to preserve and pass on the heritage of ideas and practices adopted in the medieval political and administrative sphere. Through the combined use of digital technologies (such as GISs, 3D modelling and virtual tours), historical sources can potentially reveal how political and administrative aspects affected different areas within the medieval city, not just the main seats of power. Bologna, a prestigious medieval university metropolis, is chosen as a case study because of the remarkable wealth of documentation in its archives from the city’s political culture in the Middle Ages. Written historical sources, including documentary and narrative texts, are among the primary tools employed in the study of European medieval urbancommunities in general. Documentary sources help us understand and reconstruct the complexities of civic administration, urban policies and the economy, as well as how citizens experience them daily. The involvement of citizens in the political and administrative life of late medieval cities is explored through the management and digital processing of historical documentation. Digital humanities tools can facilitate this analysis, offering a perspective that sheds light on the formation of the pre-modern state. Although digital databases and repositories have significantly contributed to preserving and digitally archiving historical sources, these are often aimed exclusively at the academic level and remain underutilised as privileged didactic and educational tools for a broad audience
