Il controllo giudiziale nella fase di apertura del concordato preventivo riformato con un cenno “al prima e al dopo”
Il contributo esamina il controllo giudiziale nel concordato preventivo riformato, con focus sulla fase di apertura ex art. 47 CCII e richiami alla trattazione prioritaria (art. 7 CCII) e all’omologazione (art. 112 CCII). L’analisi delimita il perimetro delle verifiche del tribunale, distinguendo tra concordato liquidatorio e in continuità, e discute l’orientamento verso un controllo prevalentemente “in negativo”, rimettendo ai creditori le valutazioni prognostiche sulla realizzabilità del piano. Si approfondiscono inoltre alcune scelte sistematiche (ammissibilità/ritualità), la verifica sulla corretta formazione delle classi e l’intensità del controllo dopo le riforme. In chiusura, sono trattati vari profili applicativi: integrazioni di piano e documenti, (non) modificabilità della sola attestazione, ripresentazione della domanda e questioni processuali, inclusa l’impugnabilità dei provvedimenti
Sensitive and accurate determination of 32 PFAS in human serum using online SPE-UHPLC-HRMS
Per- and polyfluoroalkyl substances’ (PFAS) extreme persistence has been linked to many adverse effects on human health including increased risk of certain cancers. This study presents the development and validation of a new, highly sensitive method for the quantification of 32 PFAS in human serum using online solid-phase extraction (SPE) coupled with ultra-high performance liquid chromatography–high resolution mass spectrometry (UHPLC–HRMS). Legacy and emerging PFAS were targeted. Main steps of sample pretreatment include protein precipitation (PP), pellet rinsing, centrifugation, preconcentration through solvent evaporation, and online SPE using a weak anion-exchange polymeric sorbent. The PP and pellet-rinsing procedures were optimized through a comprehensive exploration of solvent combinations. Following this, a pretreatment that offers the best compromise for the targeted PFAS was identified using principal component analysis. The method demonstrated excellent linearity (R2 = 0.977–0.997) with limits of quantification ranging from 8.9 to 27 ng/L, 5 to 15 times lower than previous methods. Precision (intraday 2.6–14.0 % and interday 1.3–11.0 % relative standard deviation) and accuracy (recoveries 72.7–106 %) were robust. The method was validated in accordance with ISO/IEC 17025 and successfully applied to five human serum samples, confirming its suitability for high-throughput profiling of PFAS in biomonitoring studies. This method is the first to use online SPE for the simultaneous determination of a broad range of PFAS, including ether congeners such as perfluoro(2-ethoxyethane) sulfonic acid and Nafion byproduct 2. Furthermore, control charts were employed to assess instrument performance during routine analysis and implement necessary actions
Hempseed Water-Soluble Protein Fraction and Its Hydrolysate Display Different Biological Features
Hempseeds, from the Cannabis sativa plant, and its derivates are a versatile food option for various dietary preferences. Due to their aminoacidic profile, researchers have studied the presence of bioactive peptides in hempseed proteins. In this study, the water-soluble fraction of hempseed protein was extracted, and the derived peptides were analyzed. The investigation focused on their biological function, particularly their antioxidant activity. Several biological functions have arisen, such as angiotensin-converting enzyme inhibition activity, dipeptidyl-peptidase IV, dipeptidyl-peptidase III inhibition, and ubiquitin-mediated proteolysis activation. The hydrolysates show greater 2,2-azinobis-[3-ethylbenzothiazoline-6-sulphonic acid (ABTS) radical scavenging activity compared to the proteins (97.95 ± 4.48 versus 81.04 ± 10.63). Furthermore, the impact of these proteins and peptides on the U937 cell line was evaluated to assess cell viability and their potential role in modulating inflammation associated with gastrointestinal autoimmune diseases. Protein treatment resulted in a significant reduction in cell viability, as opposed to hydrolysates, which did not affect it
Comparison of 30-day complications between a tine-based and a screw-in helix fixation single-chamber ventricular leadless pacemaker: Results of a propensity score–matched analysis from a multicenter, nationwide registry
Background: Medtronic Micra VR and Abbott Aveir VR are 2 single-chamber ventricular leadless pacemakers (L-PMs) currently available in clinical practice. They differ in their design, fixation mechanism (tine-based fixation for Micra VR, screw-in helix fixation for Aveir VR), and implantation technique. Few comparative safety data are available for these L-PMs. Objective: We aimed to compare the rate of acute procedure-related complications of patients undergoing Aveir VR vs Micra VR implantation. Methods: A prospective, multicenter, observational registry enrolled consecutive patients who underwent Aveir VR or Micra VR implantation. The rate and nature of device-related complications at 30-day follow-up were analyzed and compared between the groups. Individual 1:1 propensity score matching of baseline characteristics was performed. Results: A total of 1141 patients (75.9 ± 14.8 years; 60.2% male) were enrolled: 211 Aveir VR and 930 Micra VR. Propensity score matching yielded 189 matched pairs. In the matched cohort, the risk of device-related complications at 30 days of follow-up of the 2 L-PMs was similar (2.1% vs 2.1%; P = 1). Device migration (1.6% vs 0.5%; P = .315) and vascular complications (0.5% vs 1.1%; P = .562) were the most frequent complications, with no significant differences between the groups. Cardiac perforation was rare (1 case in the Micra VR group, no cases in the Aveir VR group). Conclusion: The risk of acute device-related complications associated with Aveir VR and Micra VR L-PM implantation was similar. These findings suggest that despite differences in design, fixation mechanism, and implantation technique, these 2 devices appear to have a similar short-term safety profile
Trustee, dovere di rendiconto e sanzioni pecuniarie per il ritardo. La nuova via milanese (Trib. Milano, 4 giugno 2024)
La scelta della legge processuale italiana per la soluzione delle
controversie in materia di trust interno può costar cara al trustee
inadempiente nella consegna del rendiconto perché lo espone al
rischio di una condanna pecuniaria in caso di ritardo nell’esecuzione
dell’ordine del giudice.
È presto per dire se questo fenomeno - per il momento tutto italiano
- potrà influenzare la giurisprudenza di common law, ma certamente
rappresenta un principio di irrigidimento della giurisprudenza
nazionale nei confronti del trustee.
Questa conseguenza, certamente negativa, deve basarsi su un
rigoroso accertamento delle circostanze di fatto da cui dipende la
sussistenza degli obblighi del trustee e di cui la sentenza deve dar
conto, anche con riguardo al profilo dell’istruttoria processuale. La
sentenza del Tribunale di Milano, invece, appare carente sotto
questo profilo e, per questa via, diviene un esempio da non seguire.
The author’s view
The choice of Italian procedural law can cost dearly to the trustee
breaching his duty to account because it exposes him to the risk of a pay
order in the event of delay in complying with the court statements.
It is early to say whether this phenomenon - only Italian at the moment
- will influence common law’s judgments, but it certainly represents a
kick-off of hardening our national ruling towards the trustee.
This effect, which is certainly negative, must be based on a serious
verification of facts on which the existence of the trustee's obligations
depends and which the judgment must take into account, also with
regard to the procedural rules of investigation. On the other hand, the
judgment of the Court of Milan is lacking in this respect and, in this way,
becomes an example to avoid
