The importance of Islamic application in the aspects of economic life has increased, and since banks appeared in our Islamic world, they are becoming more and more important day after day, because banks today have become the balance of economic progress for countries, the more their capabilities increase. Its financial activities have reflected on the economic system, and therefore the countries of the world are striving to monitor the financial institutions and their affiliated banks and set the systems and policies that guarantee their protection and ensure that they achieve their goals and the general objectives of the banking system.
The importance of the study was represented in the urgent desire to know speculation in jurisprudence and law, the reason for my love for this science and my conviction of the nation’s need for it as it accepts its religion and the sciences of its legitimacy in its orientation to God. Knowledge and the benefit of the nation, so that this would be an incentive for researchers and students of knowledge to continue the path and follow their example, to highlight the link between speculation, jurisprudence rules and the texts of the law, and to determine the extent to which the Sudanese legislator benefits from speculation and jurisprudential rules in its legal legislation. The study followed the descriptive legal approach and the comparative approach:because the subject of the thesis will deal with the comparative laws that dealt with the jurisprudence rules of the speculative contract as a model, such as the Egyptian and French law and other Arab and foreign laws. Through this study, the researcher reached several results, the most important of which are that their different sects seem unsuitable for practical application in Islamic banks, as they lack many of the controls of banking dealings. As for the nature of credit in Islamic banks, it is different from credit in traditional banks because of the different approach that governs Islamic banks However, despite this, the latter may contribute to monetary expansion through its contribution to the doubling of cash through some financing tools used in Islamic banks such as speculation. However, the role of Islamic banks in monetary expansion is relatively less than the role of traditional banks under a single banking market , Complete Employing the cash available with Islamic banks in investment tools based on the principle of obtaining a profit margin away from forms of financing based on profit or loss sharing. And if the banks operating in Islamic countries adopt the mudarabah formula as a means of bank financing, then this creates fundamental differences when adopting this method, and therefore the difficulty appears in performance evaluation studies in Islamic banks, which makes the evaluation shady, especially in comparative studies. Through the previous results, a number of recommendations were reached, the most important of which is working on the development of new tools within the framework of the speculation contract applied in Islamic banks, and it is summarized in correcting the mistakes that occurred in them and transcending the tools that I found ready in the jurisprudence literature and maintaining a balance in distributing their income among shareholders and deposit holders and finding solutions for methods of calculating the profits belonging to each party. Through the previous results, a number of recommendations were reached, the most important of which is working on the development of new tools within the framework of the speculation contract applied in Islamic banks, and it is summarized in correcting the mistakes that occurred in them and transcending the tools that I found ready in the jurisprudence literature and maintaining a balance in distributing their income among shareholders The owners of deposits and finding solutions for methods of calculating the profits belonging to each party, making the bank as a mediator between the two parties in the speculation contract, so that it can bear the guarantee and entitlement to the profit, intensifying research and theoretical studies in the field of addressing financing problems in Islamic banks, especially those tools that can be developed, foremost among them The speculation contract, emphasizing the importance of the legal personality as a jurisprudential way out for the development of the speculative contract

That Islam is the religion of humanity, it recognizes freedom with its aspects, provided that it does not harm those who practice it or cause harm to others. It is considered a cause for the disintegration of societies.
