    When Animal Welfare Meets Institutional Panic: India\u27s Supreme Court Creates Territorial Exclusion Zones for Community Dogs

    This short article examines the Indian Supreme Court’s November 2025 order establishing permanent territorial exclusion zones for sterilized and vaccinated community dogs in institutional spaces, while simultaneously affirming the Catch, Neuter, Vaccinate, and Release method as scientifically sound for general urban areas. Through comparative constitutional analysis of Germany\u27s proportionality framework, Ecuador\u27s rights of nature jurisprudence, and Argentina\u27s individual animal rights doctrine, the article demonstrates how this two-tiered territorial system subordinates Article 51A(g)\u27s constitutional mandate of animal dignity to institutional expedience, while paradoxically reducing protection for children and patients from rabies through territorial replacement by unvaccinated populations. The analysis reveals three interconnected failures: constitutional incoherence in applying dignity protections based solely on geography, epidemiological counterproductivity through territorial replacement by unvaccinated populations, and structural impossibility given India\u27s shelter capacity deficit.     Should we succumb to technopanic or embrace techno-optimism in this so-called post-truth era? In his latest book, Technopanic (currently available only in Italian), Alberto Acerbi, Assistant Professor in the Department of Sociology and Social Research at the University of Trento, suggests a cautious middle path. Drawing on his background at the interface of cultural evolution, psychology, anthropology, and sociology, Acerbi provides a timely and, one might argue, much-needed, empirically grounded reflection on the contemporary anxieties surrounding digital technologies. Although some examples refer to the Italian sociopolitical context, the book’s arguments are highly transferable to broader international debates

    Dreh- und Angelpunkt unseres heutigen Privatrechtsdenkens, unserer heutigen Sprache der Rechte, ist der Wille – und aus dieser Willensperspektive meinen manche noch heute, auch die römischen Quellen lesen zu können. Der vorliegende Beitrag möchte einem bereits von anderen angemahnten Perspektivwechsel, einer anderen Lesart der Quellen das Wort reden. Denn auch soweit das römische Recht dem Willen besondere Bedeutung eingeräumt haben mag, nach hier vertretender Auffassung war und blieb Kristallisationspunkt des römischen Rechtsdenkens und seiner Sprache der Aktionen immer der Tatbestand. Liest man aber aus dieser Perspektive konsequent auch die römischen Quellen, dann liest man zur sog. Höchstpersönlichkeit: nichts.     Public Policies for Human-Fauna Relations: Convergences and Contrasts Between South America and the European Union

    Relations between human beings and non-human fauna have assumed increasing centrality in contemporary legal and political agendas, driven by the intensification of global ecological crises, the accelerated loss of biodiversity and the expansion of ethical debates concerning the protection of sentient beings. In this context, this article undertakes a comparative analysis of the normative models and public policies aimed at the protection of fauna and nature developed in South America and in the European Union, seeking to identify convergences, divergences and structural limits within these experiences. The study adopts a functional comparative law approach, combining normative, jurisprudential and institutional analysis. On the one hand, it examines the consolidation, within the European Union, of a highly institutionalised regulatory model centred on animal welfare and the legal recognition of animal sentience, structured through supranational legislation and the case law of the Court of Justice of the European Union. On the other hand, it analyses the emergence, in South American countries, of constitutional and jurisprudential innovations incorporating ecocentric perspectives, particularly through the recognition of the rights of nature and the expansion of legal protection for fauna as an integral component of ecological systems. The findings indicate that, although the European model presents greater normative uniformity and institutional capacity for implementation, it remains constrained by a predominantly instrumental and anthropocentric logic. By contrast, South American experiences offer significant conceptual advances by extending legal protection beyond the human sphere yet face substantial challenges of practical effectiveness. It is concluded that these distinct normative trajectories may be understood as complementary in the construction of more coherent and effective public policies capable of addressing contemporary global socio-environmental challenges

    Wurzelresorptionen sind ein pathologischer Vorgang, welcher viele Ursachen haben kann und verschiedene Folgen mit sich zieht. Dieser Fall zeigt einen Patienten mit multiplen stark fortgeschrittenen Wurzelresorptionen. Die klinischen und radiologischen Befunde sprachen für Ersatzresorptionen und cervikale Resorptionen. Die histologische Untersuchung des einen entfernten Zahns zeigte unspezifische Befunde ohne Anhalt auf eine Ersatzresorption. Die Ursache für die Resorptionen in diesem Fall bleibt unklar, auch wenn eine mögliche Verbindung mit einem Testosteronmangel in Betracht gezogen wird.Root resorption is a pathological process that can have many causes and various implications. The following case shows a patient with multiple advanced root resorptions. The clinical and radiological findings indicated replacement resorptions and cervical resorptions. Histological examination of one of the extracted teeth showed nonspecific findings with no evidence of replacement resorption. The cause of the resorption in this case remains unclear, although a possible connection with testosterone deficiency is being considered.La résorption radiculaire est un phénomène pathologique qui peut avoir de nombreuses causes et entraîner diverses conséquences. Ce cas présente un patient avec plusieurs résorptions radiculaires très avancées. Les résultats cliniques et radiologiques indiquaient des résorptions de substitution et des résorptions cervicales. L\u27examen histologique d\u27une dent extraite a révélé des résultats non spécifiques sans indication d\u27une résorption de substitution. La cause des résorptions dans ce cas reste incertaine, même si un lien possible avec un déficit en testostérone est considéré

    Human exploitation of the Earth and its living creatures demands a deeper reflection that includes religious perspectives. Many now turn to religious traditions to reconsider the human-environment relationship, particularly regarding animals and plants. This work offers a concise overview of key Islamic doctrinal views on animal rights, followed by a summary of major fiqh (Islamic jurisprudence) rules aimed at animal protection. It also examines current laws in various Islamic countries. While fiqh establishes norms to limit human dominance over animals, it stops short of granting them independent legal status.     Die Pflicht zur Suche nach der Wahrheit im Strafprozess ist nach kontinental-europäischem Verständnis aufs Engste mit der Legitimation staatlichen Strafens verknüpft. Zur Erreichung eines auf Wahrheit beruhenden Urteils verlangt der Untersuchungsgrundsatz folglich die Erforschung der materiellen Wahrheit. Während diesem Postulat im ordentlichen Verfahren - freilich nicht vorbehaltlos - gefolgt wird, distanzieren sich die kurzen Prozesse deutlich von den üblichen Kautelen der Wahrheitsfindung. Erscheint der Schuldspruch im Kurzprozess im Hinblick auf die geltenden Wahrheitsansprüche defizitär, stellt sich die Frage, wie er legitimiert werden kann. Die schrittweise Optimierung des Ermittlungsaufwands und Aufweichung von Verfahrensgrundsätzen drängen dabei auf einen Perspektivenwechsel im modernen Strafprozess. Wird der Stellenwert der Wahrheit überschätzt - oder ist sie gar entbehrlich? Der vorliegende Beitrag geht diesen Fragen nach und untersucht einen Vorschlag der jüngeren Doktrin zur Legitimation von Kurzverfahrenssanktionen. -- L\u27obligation de rechercher la vérité dans le procès pénal est, selon la conception continentale-européenne, étroitement liée à la légitimation du pouvoir de punir de l\u27État. Afin de parvenir à un jugement fondé sur la vérité, la maxime de l\u27instruction impose ainsi la recherche de la vérité matérielle. Si ce postulat est suivi - certes non sans réserves - dans la procédure ordinaire, les procédures simplifiées s\u27écartent sensiblement des garanties usuelles de la recherche de la vérité. Lorsque la déclaration de culpabilité dans une procédure simplifiée apparaît déficiente au regard des exigences de vérité, la question de sa légitimation se pose. La rationalisation progressive de l\u27activité d\u27enquête et l\u27assouplissement des principes régissant la procédure imposent alors un changement de perspective dans la procédure pénale moderne. La vérité est-elle surestimée - ou même dispensable ? Le présent article examine ces questions et analyse une proposition récente de la doctrine visant à légitimer les sanctions issues des procédures simplifiées

The paper then considers the legal status of animals and whether animals can be rights-holders. The nature-based approach to animal rights is critically analyzed and several objections to this framework are discussed. The article advances further arguments in support of the sentience-based approach to animal rights, contending that animal rights ought to be grounded in animals’ interests as sentient beings.
