    L'ordine delle questioni di merito nel processo civile di primo grado. Profili processuali.

    La tesi si pone l’obiettivo di offrire una riflessione sul tanto complesso quanto interessante tema dell’ordine delle questioni di merito nel processo civile di primo grado. La tematica verrà analizzata prendendo le mosse dalla più recente dottrina e giurisprudenza. La tesi – che rappresenta l’esito di un percorso di ricerca e di studio delle fonti nonché, soprattutto, di analisi del dibattito esistente in seno alla dottrina e alla giurisprudenza – vuole indagare circa la struttura dell’attività decisoria e verificare, da un lato, se il giudice sia o meno vincolato ad un rigido ordine di esame e di decisione delle questioni e, dall’altro lato, se le parti siano o meno titolari di un potere in grado di influire su quest’ultimo. Ciò detto, il lavoro si compone di tre capitoli. Il primo è dedicato all’analisi dei concetti introduttivi indispensabili ai fini di una comprensione adeguata della tematica oggetto di indagine. Il secondo è dedicato allo studio dei principi cardine dell’ordinamento che informano la materia oggetto di indagine. Il terzo, infine, è dedicato alla ricerca dell’ordine di decisione delle questioni di merito con particolare attenzione ai poteri delle parti. Il presente lavoro, realizzato con sincero interesse ha l’umile aspirazione di porsi come contributo alle tematiche annunciate che toccano il fulcro del diritto processuale civile riguardando, appunto, l’attività decisoria del giudice. Si ritiene utile segnalare che l’analisi si è concretata sui profili processuali dell’ordine delle questioni di merito in relazione al primo grado di giudizio. Ne deriva che non saranno tratti i profili di diritto sostanziale del tema (che potrebbero dettare un ordine diverso) e non sarà trattato il tema dell’impugnazione della decisione con la quale il giudice abbia violato l’ordine imposto dalla normativa o impresso dalla parte. Le tematiche saranno oggetto di ulteriore attività di ricerca che, auspicabilmente, confluirà in ulteriori contributi.The thesis aims to offer a reflection on the complex but interesting topic of the order of questions of merit in civil proceedings at first instance. The topic will be analysed based on the latest doctrine and case law. The thesis - which represents the outcome of a research and study of sources as well as, above all, an analysis of the debate that exists within doctrine and jurisprudence - aims to investigate the structure of decision-making activity and verify, on the one hand, whether or not the court is bound by a strict order for examination and decision of the questions and, on the other hand, whether or not the parties are holders of power capable of influencing it. Having said this, the work is divided into three chapters. The first is devoted to the analysis of introductory concepts essential for an adequate understanding of the subject matter under investigation. The second is devoted to the study of the fundamental principles of the system that inform the subject matter under investigation. The third, finally, is devoted to the search for the order of decision of questions of substance with particular attention to the powers of the parties. This work, carried out with sincere interest has the humble aspiration to be a contribution to the announced issues that touch on the core of civil procedural law regarding, precisely, the decision-making activity of the judge. It is useful to point out that the analysis has focused on the procedural aspects of the order of questions of substance in relation to the first instance. It follows that the substantive law profiles of the subject (which could dictate a different order) will not be covered and the topic of the appeal of the decision by which the court has violated the order imposed by the law or imprinted by the party will not be covered. The topics will be the subject of further research, which will hopefully result in further contributions

    Treatment of a real brewery wastewater with coagulation and flocculation: impact on organic substance and nutrients concentrations

    Featured Application This work presents important data about the impact of the coagulation and flocculation process on the industrial-scale treatment of brewery wastewater, providing technical operators with essential information about the efficacy of various reagents under varied conditions.Abstract Brewery wastewater (BWW) often contains a high concentration of organic matter and nutrients, requiring pre-treatment before it can be effectively treated in conventional wastewater treatment plants. This study focuses on the use of coagulation-flocculation techniques to treat real industrial wastewater. Firstly, lab-scale tests have been carried out to determine the most effective coagulant and flocculant type and concentration. The levels of pollutants, including chemical oxygen demand (COD), biological oxygen demand in five days (BOD5), total nitrogen (Ntot), total phosphorus (Ptot), and orthophosphate (P-PO43-) have been measured to assess the efficiency of the procedure. Industrial scale tests were performed in optimal conditions in order to evaluate the effectiveness of the treatment on a larger scale and estimate the generation of chemical sludge. The most effective substances for coagulation and flocculation were polyaluminium chloride (PAC) and anion-active flocculant (AAF) ZETAG 4139 0.1%, respectively, at concentrations of 675 mgL-1 and 40 mgL-1. During industrial-scale tests, the process allowed the effective removal of TSS (86.8%), Ntot (51.8%), Ptot (95.5%), and P-PO43- (99.6%), while the limited removal of organic substances has been highlighted (BOD5: 34.3%; COD: 26.5%). The dry matter (DM) content of the separated sludge was found to be 4.5-5%, and a yield of 1.01 kgDM per kg of COD removed was obtained after flocculation treatment of the BWW. These findings can be beneficial for both the scientific community and technical operators, offering insights into the effectiveness of various coagulants and flocculants on industrial-scale wastewater treatment

    Il pendolarismo ferroviario è centrale per la mobilità e lo sviluppo economico delle aree metropolitane, in quanto permette agli individui di accedere a opportunità di lavoro e studio. È un elemento chiave per la connettività e la vitalità di queste regioni ed è alla base dello lo spostamento giornaliero di milioni di persone. Questo studio esamina la situazione dei ritardi e delle prestazioni della linea ferroviaria che collega Como Lago, Saronno e Milano Cadorna, in Lombardia. Il focus è basato sull’effettivo orario di arrivo del treno a destinazione, valutando gli aspetti critici della linea, passando per le problematiche emerse sulla rete ferroviaria della Regione Lombardia. La performance delle corse è influenzata per la presenza di tratti a binario unico e da numerosi passaggi a livello, che incidono sulle prestazioni in entrambe le direzioni. Nel lavoro si cerca di analizzare il fenomeno da un punto di vista descrittivo ed inferenziale, cercando di valutare l’andamento in un’ottica intertemporale, basandosi su due mesi comparabili nel corso dell’anno 2024, avendo cura di analizzare le corse in entrambe le direzioni e con un focus finale sulle fasce pendolari, dove il numero di passeggeri è maggiore. I risultati di questa analisi possono essere utilizzati per guidare interventi mirati, volti a ottimizzare l'operatività della linea e a migliorare l'esperienza quotidiana dei pendolari che utilizzano questa linea ferroviaria

    L'articolo discute l'applicabilità delle norme di diritto internazionale privato ai casi che coinvolgono collegamenti con territori o soggetti palestinesi. Sostiene che la nozione di statualità, rilevante per l'applicazione delle norme di diritto internazionale privato, dovrebbe essere strettamente funzionale, ovvero svincolata dal concetto accettato nel diritto internazionale pubblico e determinata in relazione alle finalità specifiche del diritto internazionale privato. Di conseguenza, le norme sul conflitto di leggi che portano all'applicazione del diritto palestinese sono operative, la cittadinanza palestinese può essere configurata come fattore di collegamento, è possibile scegliere i tribunali palestinesi come foro competente e l'exequatur può essere concesso alle sentenze emesse dai tribunali palestinesi

    Anatomical alterations: biparietal thinning in antiquity. review of published cases and a new case

    Cranial anatomical variations, such as biparietal thinning, offer critical insights into the health and living conditions of ancient populations. Despite the presence of extensive archaeological records, biparietal thinning remains a relatively rare and understudied condition. This review aims to synthesize existing bioarchaeological literature on biparietal thinning, addressing its historical prevalence, geographical distribution, and potential etiologies. This study integrates data from previous bioarchaeological research supplemented with a new case from skeletal remains excavated at the hypogeal cemetery of Santa Maria Maggiore in Vercelli, Northern Italy. The analysis included macroscopic examination, radiological imaging, and comparative analysis with clinical and paleopathological cases to identify and assess the characteristic features of biparietal thinning. Our analysis of the skeletal remains of an old adult female individual revealed clear indicators of biparietal thinning. Notably, the thinning was bilateral, with the absence of diploe in the affected areas while maintaining the inner and outer tables of the cranial vault. These findings align with documented cases in the literature and contribute new data to the limited corpus of biparietal thinning cases. This study underscores the importance of integrating paleopathological findings with modern medical knowledge to enhance the understanding of ancient diseases. The case from Vercelli provides an opportunity to explore the multifactorial origins of biparietal thinning and highlights the necessity of a multidisciplinary approach, combining archaeological, anthropological, and medical perspectives. By presenting this new case, we aim to stimulate further research into biparietal thinning and similar cranial pathologies, enriching the broader narrative of human health evolution

    Catheter-related deep vein thrombosis: Where are we at and where are we going? Updates and ongoing unmet clinical needs

    Background: Catheter-related thrombosis (CRT) is one of the major complications affecting patients with indwelling venous catheters, usually involving the upper extremity deep venous system. This condition can lead to potentially life-threatening complications such as pulmonary embolism and sepsis. The risk of developing CRT varies depending on type of catheters and patient characteristics. Despite advances in materials and technologies, the actual incidence of CRT is still considerable. Available evidence on CRT management remains controversial, and clinical guidelines base their recommendations on data from non-catheter related upper extremity or lower extremity deep venous thromboses. Aims: This narrative review aims to describe the epidemiology of CRT, to review the available evidence on its management and to highlight the current unmet needs. Methods: No formal search strategy was applied for the revision of the literature. The main sources of information used were Medline and guidelines from international societies. Content: The management of CRT requires a careful balance between the risk of thrombus progression, recurrent events, and systemic embolization and the increased bleeding risk in often fragile patients. Open issues include the optimal management of the catheter and the type and duration of anticoagulant therapy. Direct oral anticoagulants are increasingly prescribed, representing an important alternative to the standard of care low molecular weight heparins in selected cases. The development of new anticoagulant drugs such as factors XI and XII inhibitors may offer further advantages in this context. Conclusions: The management of CRT is still challenging with constant need for updated evidence to support tailored approaches
