Discutiendo sobre legalidad e interpretacion
In 2024, the publisher Palestra released my book Jueces, legalidad e interpretación, which brings together some of my works on the topic of legality. In this contribution, I examine the critical observations made by Edgar Aguilera, Hugo Osorio Morales, Ángeles Ródenas, and Natalia Scavuzzo on the concept and value of legality, the relationship between legality and legal interpretation, the role of politics in interpretation, and the connection between legality and the Rule of Law
Il doppiatore come autore: l’autorialità di Oreste Lionello nel cinema di Woody Allen
Nel processo di adattamento di un prodotto cinematografico è presente il contributo di diverse figure (Pavesi, 2005; Chiaro, 2008, 2009; Chaume, 2012), ognuna delle quali può lasciare un proprio segno autoriale nel prodotto finale (Ranzato, 2011; Zanotti, 2014). L’analisi proposta è finalizzata a indagare il ruolo del doppiatore all’interno del cosiddetto cinema d’autore, osservando la figura distintiva di Oreste Lionello nel cinema di Woody Allen. La voce di Lionello è associata in maniera indelebile al regista statunitense, il quale ha egli stesso riconosciuto come parte del suo successo in Italia possa essere attribuito alla traduzione e alle migliorie apportate in sede di doppiaggio (Ranzato, 2011; Allen, 2021). L’analisi proposta prevede uno studio di caso incentrato sul film Io e Annie (1977), osservando un tratto linguistico significativo nelle sceneggiature di Allen, nonché nel film oggetto di studio: le esitazioni. Queste sono centrali nella caratterizzazione del nevrotico e autocritico protagonista, Alvy Singer, il cui eloquio frammentario e titubante ne rivela la natura ansiosa e insicura, collaborando all’effetto comico del film. Attraverso un confronto tra i dialoghi originali inglesi e la versione doppiata, si vuole indagare il contributo di Lionello nella resa delle esitazioni, visto il ruolo che queste forme di insicurezza verbale ricoprono nella caratterizzazione della complessità emotiva del protagonista, e nella rappresentazione del suo rapporto con Annie, nonché con la vita in generale (Girgus, 2002)

Bisanzio e l’Italia “bisantina” tra letteratura, estetica e ideologia. Il caso D’Annunzio
Even as a child, D’Annunzio felt a ‘porphyrogenitus’: biologically, genetically Byzantine. Yet he never got to see Constantinople with his own eyes, nor could he give any description of it. The love for Byzantium, in D’Annunzio’s work, remained imprisoned in tiny tesserae of his immense literary mosaic and was expressed above all in the transference with Venice and Ravenna, which remained the two poles of D’Annunzio’s ‘public’ Byzantinism. He was born and raised on the “Greek sea”, and always constant in his passion for the “second Byzantium” and in his fascination for the capital of the Exarchate. Not least because, with the escalation of nationalism on the Italian domestic scene and the thickening of compromising implications of neo-Byzantine ideology on the international scene, the literary probyzantinism or ‘bisantinismo’ of which D’Annunzio had been a prophet in his youthful Roman years turned out to be ideologically risky. The “Byzantine” aesthetic construction that the poet had made of Rome in the “Cronaca bizantina” of Sommaruga folded in on itself and that youthful mythology was increasingly bent to patriotic ideology and definitively shifted to the antibyzantinism of the Adriatic world in conjunction with the political adventure of Fiume

Clifford representatives via the uniform algebraic rank
In this paper, we introduce the uniform algebraic rank of a divisor class on a finite graph. We show that it lies between Caporaso's algebraic rank and the combinatorial rank of Baker and Norine. We prove the Riemann–Roch theorem for the uniform algebraic rank, and show that both the algebraic and the uniform algebraic rank are realized on effective divisors. As an application, we use the uniform algebraic rank to show that Clifford representatives always exist. We conclude with an explicit description of such Clifford representatives for a large class of graphs
Administrative justice, regional courts and legal certainty in Italy
The Italian system of administrative justice, as resulting from tradition, statutory law and the Constitution, is based on a distinction between two judicial orders: the ordinary jurisdiction, and the administrative jurisdiction. To determine whether a case shall be decided by the administrative or by the ordinary judge, the general criterion is that of the nature of the subjective position of the person bringing the case, with legitimate interests belonging to the administrative jurisdiction, and subjective rights belonging to the ordinary one.
In Italy, the administrative jurisdiction is articulated into two tiers, with regional administrative courts deciding cases in the first instance and the Council of State adjudicating them in the second and last instance. The rulings of the Council of State can however be appealed to the Court of Cassation for grounds of jurisdiction, an aspect which has generated several uncertainties along the years.
In principle, in the Italian system of administrative justice there is no doctrine of stare decisis, nor are inferior courts bound by the precedents of the Council of State. Since the Council of State, through the Plenary assembly, is tasked with ensuring the uniform interpretation of the law within the administrative jurisdiction, it shall however by underlined that the judicial sections of the Council must refer a case to the Plenary assembly if they wish to disregard a previous ruling issued by the Plenary itself. Moreover, inferior courts tend to heavily rely on precedents, although they are under no legal obligation to do so.
EU law and the CJEU caselaw have deeply influenced the evolution of administrative justice in Italy. Besides frequently submitting requests for preliminary ruling to the CJEU, administrative judges – in Italy as in the other Member States – are subject to the general obligation to interpret and apply national law consistently with EU law and jurisprudence. Moreover, both the Constitutional Court and the Plenary assembly of the Council of State have recognized that CJEU rulings that apply or interpret EU provisions bear the same force of the EU provisions themselves. CJEU rulings therefore bind administrative judges and prevail over contrasting national law and precedents, which must be eventually disapplied
