    Il linguaggio come strumento di pace: voci femminili tra filosofia e semiotica

    This work seeks to revisit and actualize the contribution of several major twentiethcentury women philosophers who devoted particular attention to the role of language within their reflections on peace. Based on the premise that war also arises from dehumanizing narratives, whereas peace requires authentic speech, silence, attentiveness, care, and beauty, language is here understood as possessing a performative and relational function: it does not merely describe reality, but transforms it, creating common spaces in which plurality can be expressed without annihilation. The aim is to explore new possible pathways and points of convergence for semiotic research on peace, identifying language as a privileged space of resistance and transformation. These philosophers for peace addressed not only armed conflict, but also its deep cultural roots - power as imposition, the separation between body and reason, the devaluation of care, the marginalization of otherness - and proposed an ethics of responsibility, shared vulnerability, and relationship. Returning to their texts does not mean engaging in a merely philological exercise; rather, it entails activating an interpretative framework capable of illuminating the contradictions of the present and deconstructing the logics of domination, violence, and oppression that still permeate international relations, social dynamics, and collective narratives

    L'attuazione dei diritti dei figli nel rito per le persone, i minorenni e le famiglie

    La monografia ha come oggetto la tutela giurisdizionale dei diritti del figlio minorenne, sia a contenuto personale che a contenuto patrimoniale. Nel contesto del nuovo procedimento in materia di persone, minorenni e famiglie, vengono esaminate le regole per l’«attuazione dei provvedimenti», che prevedono misure esecutive differenziate per l’effettiva realizzazione dell’interesse del minore. Si tratta di norme spesso chiamate a comporre la tensione tra i diritti dei figli e quelli dei genitori, tenuti ad adottare alcuni comportamenti che hanno un grande impatto sulla vita del bambino o dell’adolescente. Accanto a strumenti peculiari per la tutela dei diritti di credito, il catalogo delle misure “ristrutturato” dal legislatore prevede una sorta di c.d. esecuzione in via breve, per l'attuazione dei provvedimenti a contenuto personale e per la risoluzione dei conflitti in ordine alla responsabilità genitoriale, e incisive misure coercitive, che risultano potenziate a conferma che l'esecuzione indiretta è la tecnica attuativa per antonomasia in materia familiare

    Le disposizioni dell’art. 49 del codice della navigazione sono tuttora valide e conformi all’andamento interno ed europeo, specie con riferimenteo alla possibilità di concordare a monte un indennizzo, alla scadenza o rinnovo della concessione, relativo alle opere non amovibili realizzate sul demanio; in mancanza di accordo le opere stesse sono devolute allo Stato senza alcun indennizzo. Invero, la Corte di Giustizia U.E., (Sez. III, 11 luglio 2024,in causa C-598/22) ha stabilito che non viola il divieto stabilito dall’articolo 49 TFUE e non produce effetti restrittivi sulla libertà di stabilimento l’articolo 49, primo comma, del Codice della Navigazione che prevede espressamente la possibilità di derogare mendiate accordo al principio dell’acquisizione immediata senza alcun indennizzo o rimborso delle opere non amovibili costruite dal concessionario sul demanio pubblico marittimo. La disposizione del Codice della Navigazione evidenzia la dimensione contrattuale, e dunque consensuale, di una concessione di occupazione del demanio pubblico. Ne consegue che, in mancanza di diverso accordo, l’acquisizione immediata, gratuita e senza indennizzo delle opere non amovibili costruite dal concessionario su tale demanio non può essere considerata come una modalità di cessione forzosa delle opere suddette. La Corte fornisce tale condivisibile rivisitazione della normativa italiana e, implicitamente, ricorda all’interprete interno i criteri ermeneutici fissati dall’art. 12 delle preleggi. Infatti, secondo tale impostazione, una volta accertata la compatibilità con il diritto dell’Unione, la lettera dell’art. 49 del Codice della navigazione attribuisce sia il potere che la facoltà di negoziare il contenuto della concessione al momento dell’affidamento e del rilascio della concessione. Un corretto utilizzo di tale potere consentirebbe il bilanciamento degli interessi nella gestione del regime amministrativo applicabile ed eviterebbe ingiustificate aspettative e inutili contenziosi. Questa interpretazione, che supporta la previsione della legittima negoziabilità del potere, ricorrendone i presupposti e sempre nel perseguimento dell’interesse pubblico, consente di inserire nella convezione accessiva all’atto di concessione le regole dei reciproci rapporti giuridico patrimoniali, relativi ai profili che attengono alla natura inamovibile o meno ovvero facilmente amovibile delle opere realizzate dal concessionario (e autorizzate dal concedente) sul demanio marittimo, ove proficuamente utilizzabili sia dalla parte pubblica concedente che dai privati concessionari. La decisione delle CGUE rappresenta dunque una fonte giurisprudenziale atipica e ineludibile che dovrà essere osservata sia dal legislatore che dalle amministrazioni competenti in materia di pianificazione e rilascio di concessioni demaniali marittime sempre all’esito delle non più procrastinabili procedure di evidenza pubblica.The provisions of Article 49 of the Italian Navigation Code remain valid and consistent with both domestic and European legal frameworks, particularly about the possibility of agreeing in advance on compensation, upon expiration or renewal of the concession, for non-removable works constructed on public property. In the absence of such an agreement, these works are transferred to the State without any compensation. In this respect, the Court of Justice of the European Union (Third Chamber, 11 July 2024, Case C-598/22) ruled that Article 49, paragraph 1, of the Navigation Code—which expressly allows for derogation, by agreement, from the principle of immediate acquisition without compensation or reimbursement of non-removable works built by the concessionaire on maritime public property—does not breach the prohibition set forth in Article 49 TFEU and does not impose restrictive effects on the freedom of establishment. The provision of the Navigation Code highlights the contractual, and therefore consensual, nature of concessions for the occupation of public maritime property. Consequently, in the absence of a different agreement, the immediate, free, and uncompensated acquisition of non-removable works constructed by the concessionaire on such property cannot be regarded as a form of compulsory transfer. The Court thus offers a compelling reinterpretation of the Italian regulation and, implicitly, recalls for domestic interpreters the hermeneutic criteria established by Article 12 of the Preliminary Provisions to the Civil Code. According to this approach, once compatibility with Union law has been established, the wording of Article 49 of the Navigation Code grants both the power and the discretion to negotiate the content of the concession at the time of its award and issuance. Proper use of this power allows for the balancing of interests in the management of the applicable administrative regime, thereby avoiding unjustified expectations and unnecessary litigation. This interpretation, which supports the legitimate negotiability of such powers—provided the relevant conditions are met and always in pursuit of the public interest—makes it possible to incorporate into the ancillary agreement to the concession act the rules governing reciprocal legal and patrimonial relations. These include provisions regarding the nature of works (whether non-removable, removable, or easily dismantled) carried out by the concessionaire (and duly authorized by the grantor) on maritime public property, where they may be usefully employed by both the public authority and private concessionaires. The decision of the CJEU therefore constitutes an atypical yet unavoidable jurisprudential source, which must be observed by both the legislator and the competent administrations in the planning and granting of maritime state property concessions, always within the framework of the now unavoidable public procurement procedures

    Survey on Knowledge and Application of Food Safety Requirements in the Large-Scale Retail Trade

    The aim of this study was to assess the perception and awareness of food safety requirements among food business operators involved in the large-scale retail trade. In the first phase of the survey, the determination of aerobic colony count, total coliforms, beta-glucuronidase positive Escherichia coli and coagulase-positive staphylococci, as well as two pathogenic microorganisms (Listeria monocytogenes and Salmonella spp.) was carried out on food contact surfaces in different points of sale of raw meat, gastronomy products, fish products, and fruits and vegetables. The aerobic colony count ranged from < 1 to a maximum of 2600 CFU/cm2, while L. monocytogenes and Salmonella spp. were found on only two food contact surfaces. The second phase of this study aimed to investigate the level of knowledge and understanding of hygiene and regulatory requirements among food business operators. Expert consultants conducted interviews with managers and operators working in the points of sale and performed an accurate inspection by compiling a checklist on regulatory requirements. Wide variability was observed among the investigated supermarkets, and the most common non-conformities were associated with the hygiene level of work premises, as well as good manufacturing practice and personal hygiene. This finding highlights the importance of regular training of personnel and the consistent repetition of food safety and hygiene topics in these training programs. The continuous implementation of staff training could benefit both safety and quality of food products, meeting the expectations of all customers and business partners involved in the large-scale retail trade

    Retinal Gatekeepers: Molecular Mechanism and Therapeutic Role of Cysteine and Selenocysteine

    Oxidative stress is a key contributor to retinal degeneration, as the retina is highly metabolically active and exposed to constant light stimulation. This review explores the crucial roles of cysteine and selenocysteine in redox homeostasis and retinal protection. Cysteine, primarily synthesized via the transsulfuration pathway, is the rate-limiting precursor for glutathione (GSH), the most abundant intracellular antioxidant. Selenocysteine enables the enzymatic activity of selenoproteins, particularly glutathione peroxidases (GPXs), which counteract reactive oxygen species (ROS). Experimental evidence from retinal models confirms that depletion of cysteine or selenocysteine results in impaired antioxidant defense and photoreceptor death. Furthermore, dysregulation of these amino acids contributes to the pathogenesis of age-related macular degeneration (AMD), retinitis pigmentosa (RP), and diabetic retinopathy (DR). Therapeutic approaches including N-acetylcysteine, selenium compounds, and gene therapy targeting thioredoxin systems have demonstrated protective effects in preclinical studies. Targeting cysteine and selenocysteine-dependent systems, as well as modulating the KEAP1–NRF2 pathway, may offer promising strategies for managing retinal neurodegeneration. Advancing our understanding of redox mechanisms and their role in retinal cell viability could unlock new precision treatment strategies for retinal diseases
