Vers une RSE émotionnelle ? Une étude exploratoire de discours institutionnels, de l’éthique au développement personnel
Get PDFLe concept de Responsabilité Sociétale des Entreprises (RSE), apparu dans les années 1950, s’est initialement construit autour d'une approche rationnelle. Cette approche, fondée sur des principes éthiques et utilitaristes, a souvent négligé la place des émotions, comme en témoigne la littérature des pionniers de la RSE (Freeman, Carroll). Certains chercheurs ont décrit la RSE comme un domaine dominé par la rationalité, laissant peu de place aux sentiments. Cependant, des courants plus récents en sciences de gestion ont montré l’importance des émotions dans la prise de décision, même dans des domaines a priori rationnels comme la finance. La recherche sur la RSE, ayant longtemps oublié les émotions, semble évoluer pour intégrer cette dimension. Ainsi, la RSE peut être abordée comme un espace où les émotions jouent un rôle crucial, bien qu’il reste encore à explorer la façon dont elles sont investies et exprimées.
L’objet de cette communication est de mieux comprendre comment les émotions sont intégrées dans les discours institutionnels en analysant deux corpus de données à l’aide de méthodes statistiques. Les premiers résultats montrent une utilisation massive des émotions liées au bien-être et une homogénéité des discours standardisés et peu différenciés
KlimaSeniorinnen case: Climate change legal scholarship needs empiricism, not hype
No full textIn April 2024, the European Court of Human Rights ruled in the KlimaSeniorinnen case that Switzerland had not implemented a legal framework capable of addressing climate change and that this constituted a violation of the right to private and family life. Despite being celebrated as “historic,” this ruling reflects established case law rather than a legal breakthrough. Hyperbolic reactions reveal a lack of empirical rigor in legal commentary, which undermines evidence-based climate policymaking. We caution against exaggerating the impact of individual rulings, given limited evidence of their influence on climate policies and emissions reductions, and encourage legal scholars to instead adopt methodological rigor akin to practices in other scientific disciplines. Specifically, we advocate for empirical approaches in law, through comprehensive data collection, robust statistical methods, and systematic analysis to better understand the role of courts in climate change mitigation

No full textDans cet arrêt, la chambre criminelle rappelle que l'extradition doit être refusée lorsque la personne concernée démontre qu'elle est exposée à un risque réel de voir prononcer contre elle une peine manifestement disproportionnée dans l'État requérant. À ce titre, seuls les juges du fond doivent apprécier ce risque. Pour se livrer à cette analyse, ils se fondent sur les critères dégagés par la jurisprudence de la Cour Européenne des Droits de l’Homme, tels que la nature et la gravité des faits reprochés ainsi que sur les circonstances de la procédure étrangère amenant au prononcé de la peine. Comme la loi l’exige, l’avis favorable de la chambre de l’instruction quant à l’extradition de la personne recherchée était motivé en l’espèce, en dépit de la possibilité de se voir infliger une peine de réclusion criminelle à perpétuité pour des infractions de nature économique et financière

Social Influence Distorts Ratings in Online Interfaces
No full textTheoretical work on sequential choice and large-scale experiments in online ranking and voting systems has demonstrated that social influence can have a drastic impact on social and technological systems. Yet, the effect of social influence on online rating systems remains understudied and the few existing contributions suggest that online ratings would self-correct given enough users. Here, we propose a new framework for studying the effect of social influence on online ratings. We start from the assumption that people are influenced linearly by the observed average rating, but postulate that their propensity to be influenced varies. When the weight people assign to the observed average depends only on their own latent rating, the resulting system is linear, but the long-term rating may substantially deviate from the true mean rating. When the weight people put on the observed average depends on both their own latent rating and the observed average rating, the resulting system is non-linear, and may support multiple equilibria, suggesting that ratings might be path-dependent and deviations dramatic. Our results highlight potential limitations in crowdsourced information aggregation and can inform the design of more robust online rating systems
