    Le dynamisme du législateur de l’Union européenne en matière pénale ne fait plus aucun doute. En, à peine, trois mois, quatre directives de rapprochement des droits pénaux viennent d’être adoptées dans divers domaines : la protection de l’environnement , les violations des mesures restrictives de l’Union , les violences sexuelles ou encore la prévention de la traite des êtres humains . D’autres demeurent en discussion afin de réécrire des textes existants en matière de corruption et d’abus sexuels .     The neoclassical model and the welfare costs of selection

    This paper embeds firm dynamics into the Neoclassical model in a framework with partially reversible capital and investment distortions, allowing for a simple characterization of the transitional dynamics of economies moving towards greater selection. At equilibrium, aggregate technology is Neoclassical, with the quality of capital and the depreciation rate depending on selection. As investment distortions are corrected, selection increases, and both output per capita and welfare rise at the steady state. However, selection destroys existing production capacities, leading to transitional welfare losses. When calibrated to the US, the model shows that developing countries reducing investment distortions to US levels would experience substantial steady-state welfare gains, though transitional costs could absorb 70% to 76% of these gains. While the associated welfare gains from selection at steady-state are significant, between 10% and 23%, transitional costs largely offset these additional welfare gains

    The Science Fiction Science Method

    Predicting the social and behavioral impact of future technologies, before they are achieved, would allow us to guide their development and regulation before these im-pacts get entrenched. Traditionally, this prediction has relied on qualitative, narrative methods. Here we describe a method which uses experimental methods to simulate future technologies, and collect quantitative measures of the attitudes and behaviors of participants assigned to controlled variations of the future. We call this method ‘sci-ence fiction science’. We suggest that the reason why this method has not been fully embraced yet, despite its potential benefits, is that experimental scientists may be re-luctant to engage in work facing such serious validity threats as science fiction science. To address these threats, we consider possible constraints on the kind of technology that science fiction science may study, as well as the unconventional, immersive meth-ods that science fiction science may require. We seek to provide perspective on the reasons why this method has been marginalized for so long, what benefits it would bring if it could be built on strong yet unusual methods, and how we can normalize these methods to help the diverse community of science fiction scientists to engage in a virtuous cycle of validity improvement

    Investment timing and technological breakthroughs

    We study the optimal investment policy of a firm facing both technological and cash-flow uncertainty. At any point in time, the firm can decide to invest in a standalone technology or to wait for a technological breakthrough. Breakthroughs occur when market conditions become favorable enough, exceeding a certain threshold value that is ex-ante unknown to the firm. A microfoundation for this assumption is that a breakthrough occurs when the share of the surplus from the new technology accruing to its developer is high enough to cover her privately observed cost. We show that the relevant Markov state variables for the firm’s optimal investment policy are the current market conditions and their current historic maximum, and that the firm optimally invests in the stand-alone technology only when market conditions deteriorate enough after reaching a maximum. Empirically, investments in new technologies requiring the active cooperation of developers should thus take place in booms, whereas investments in state-of-the-art technologies should take place in busts. Moreover, the required return for investing in the stand-alone technology is always higher than if this were the only available technology and can take arbitrarily large values following certain histories. Finally, a decrease in development costs, or an increase in the value of the new technology, makes the firm more prone to bear downside risk and to delay investment in the stand-alone technology
