The Authority of Pretrial Judges in Assessing the Authority to Calculate State Financial Losses in Proving the Elements of The Corruption Offence
Pretrial is a court process used to assess the actions of law enforcement in search, seizure, arrest, detention, and suspect determination. The scope of pretrial was expanded after a Constitutional Court decision in 2015. However, there are different interpretations of this decision. Some pretrial decisions focus on the authority of the institution declaring state financial losses, while others only look at formal evidence without assessing quality. This study aims to determine whether pretrial judges have the authority to assess which institution has the authority to declare state financial losses. The research method used in this research is normative research method through statute approach and case approach. This research concludes that the authority to assess which institution has the authority to declare the existence of state financial losses is included in the subject matter of the case. Based on Supreme Court Regulation No. 04/2016 on Prohibition of Judicial Review of Pre-Trial Decision which states that pre-trial judges only assess the formal aspects, namely related to the fulfilment of 2 (two) evidence and do not enter the subject matter. To ensure consistency in pretrial decisions and legal certainty, a Supreme Court regulation or circular letter should specify the pretrial object and authority for declaring state losses. A special task force of pretrial judges appointed by the District Court Chief Justice should also be created to handle pretrial decisions and ensure consistency and legal certainty
Aspects Affecting Women's Involvement In Political Leadership: A Case Study Of The University Of Education, Winneba, Ghana
Women's involvement in political leadership is crucial to ensure gender equality and meet sustainable development and international integration requirements. Although many measures have been developed domestically and internationally to enable women to be involved in political leadership, women's involvement in this area still needs to be improved in Ghana and around the globe. However, women's participation in political leadership has increased relatively but not significantly. The study investigates the aspects that affect women's participation in political leadership. The study assesses the influence of demographic, economic, cultural and gender-based electoral perception on women's participation in political leadership.Economic aspects such as mobility, income, and resources were examined as cultural aspects such as women's priorities and if the cultural aspect supports women's entry into politics. The study was conducted through a descriptive survey with a quantitative approach. Data was collected using online questionnaires and responses from 70 University of Education, Winneba participants. Data were analysed using percentage and frequency distribution techniques using the JASP 6.0 version. Data collected was presented in tables in frequencies and percentages. Results showed a significant association between women's involvement in political leadership and demographic and cultural aspects. The research has theoretical and practical implications for future studies on women and politics in the country
Effectiveness of Waste Management Regulation in Denpasar City, Indonesia
The purpose of this study is to examine the effectiveness of waste management regulations in Denpasar City and understand the challenges faced in implementing the Gubernatorial Regulation on Waste Management. Based on this understanding, the study aims to explore the effectiveness of source-based waste management arrangements in Denpasar City and understand the obstacles encountered in implementing waste management arrangements. The research method used is empirical legal research, which involves analyzing the gap between what should be done and what is actually done. To assess the effectiveness of waste management regulations, both a legal approach and a factual approach are used. The legal approach examines source-based waste management arrangements in Bali, while the factual approach analyzes the actual situation in society. The data sources include interviews as primary data and legislation related to source-based waste management as secondary data. Qualitative analysis techniques are used to process the data. The research plan spans one year and aims to publish in international journals and register intellectual property. This study is part of TKT 4, which focuses on using statutory regulations to provide facilities and infrastructure for waste management, such as waste trucks and recycling machines provided by the Bali Provincial Government. It also integrates technical management to ensure collaboration and functionality among all stakeholders involved in waste management programs. However, the reliability of this system is still relatively low compared to the final system, which is why further research is conducted during its implementation
The Contribution and Role Played by Individual Persons in Criminal Victimisation
Committing a crime is the outcome of a process where many factors are at work. In most cases, crime is not an action but a reaction, or an overreaction, to external and environmental stimuli. This investigation aims to find out why individuals contribute to their criminal victimisation and sometimes even play some role in accelerating or provoking the offender to commit the wrong. Suppose individuals ensure that adequate steps are taken to deter, delay and provide warnings to assist in summoning assistance to prevent crime or reduce the impact of wrongdoing. In that case, criminal victimisation may drop considerably. Situational crime prevention theory proposes that if society takes some measures to reduce the chances of committing a crime, the potential offenders will not succeed in their endeavour to offend. This article argues that the commission of crimes is primarily a function of opportunities to break the laws, which, admissibly, is influenced by the behaviour of potential victims occasionally. Researchers now just do not see a victim as an innocent point of impact on crime but know the victim, at times, playing quite an active role as a contributor to his victimisation. This study adopted a cross-sectional survey design. This approach lets the scholar get data from various sets of populations simultaneously. In this study, the emphasis is on reducing victimisation through enhancing individual personal security. Towards this end, the researcher sought to examine the role played by particular persons in victimisation. The study examined these relationships using samples of common area residents (n = 210), key informants (n = 45) and 145 members of focused group discussions. The findings of this research are expected to provide data that helps inform policymakers and the individuals who are the primary victims of criminal victimisation of the need for enhanced personal security to assist in crime risk management. Effect of Workplace Satisfaction on Employee Performance: Case Study of Federal Capital Development Authority Abuja
Workers who are unhappy with their jobs may intentionally cut back on their dedication. Because workers are an organisation's engine room, their job discontent can also negatively impact the company's functioning. Federal Capital Development Authority Abuja is used as a case study to explore the relationship between worker performance and job happiness. Data was acquired from primary and secondary sources for the previously described rationale. The participants were given 400 questionnaires, and 320 were successfully returned. The research analysis was built around these findings. Ordinary least square regression was the statistical technique used to analyse the data. This study also used broad observations and in-person interviews as information sources. The study's findings demonstrated a linear relationship between job satisfaction (type of work, job reward, and job security) and employee morale, a performance proxy for workers. According to the letter, workers are dissatisfied with the conditions under which the company employs them. The study recommended that the organisation's management create adequate working conditions to boost employee morale
Cognitive Approach to Paremiological Units
In the last decade, the cognitive approach to the analysis of paremiological units has found both theoretical justification in the works of local and foreign scientists and its practical application in the scientific articles and dissertations of local linguists. When discussing the cognitive characteristics of paremiological units, the term concept should be mentioned first. Paremiological units reflect various concepts. Each concept collects a certain number of paremiological units around itself, which have also been examined in the article. The most common components of paremias as components of models - both significant and non-nominal, as well as metalinguistic formulas - are substitutes expressing action, result, and person. In this form, the model partially reflects what is repeated in the structure and semantics of proverbs on the one hand and its lexical content and generalised meaning on the other hand.Forming symbolic meaning in paremiological units can be considered an inferencing process. On its basis, knowledge based on cognitive structures is gathered. Paremiological units are often conceptualised as follows. The author considers the lexemes that interest him in one way or another as the main components of paremiological units. Then, paremiological units are grouped according to one or another conceptual feature. As a result, it is possible to talk about conceptualising paremiological units, the collection of such expressions around certain concepts.The article provides brief information about the cognitive characteristics of paremiological units to determine the most complete scheme of analysis of paremias in the cognitive aspect
Judicial Implications of the Appointment of a Judge for Children Who Determines a Diversion Conference That Does Not Meet the Requirements for Diversion Implementation
This paper discusses the juridical implications of the appointment of a Juvenile Judge whose diversion conference implementation does not meet the requirements for diversion. It is structured based on doctrinal research findings, employing a legislative approach and conceptual analysis utilizing teleological interpretation. The research findings indicate that the juridical implications of appointing a Juvenile Judge whose diversion conference implementation does not meet the requirements for diversion lie in the action of the Juvenile Judge in prescribing diversion despite not meeting the mandatory diversion provisions, which, when solely considered from a grammatical interpretation of the Juvenile Justice Law, constitutes an ultra petite action. However, when viewed from a teleological interpretation, the Juvenile Judge's action aligns with the purpose of the Juvenile Justice Law, namely to keep children away from judicial processes to avoid stigmatization. Moreover, even if the judge takes an ultra-petite action, it is based on the principle of the best interests of the child, as long as the contents of the diversion agreement do not contradict the Law, religion, local community norms, morality, or contain elements that the child cannot implement, or exhibit lousy faith, then the Chief Judge should still issue a Decree on the Diversion Agreement
Isolation of Cyloeucalenol from Ethyl Acetate Extracts of Musa Acuminata Colla Bract
The investigation seeks to separate secondary metabolites to identify the bioactive compound(s) found in banana blossoms. The researchers divided the ethyl acetate extract into compounds using column chromatography. The fractions retrieved from the column were subjected to thin-layer chromatography to ensure their purity for component separation, yielding BF57 fractions as a white needle-like crystal substance. The proportion was determined using 1D Nuclear Magnetic Resonance (1D NMR) and 2D Nuclear Magnetic Resonance (2D NMR) spectroscopy. The extracted chemical structures were identified as cycloeucalenol after thoroughly interpreting NMR spectral data and comparison to the literature
Sanctions for Dismissing the Position of a Notary: Comparative Study in Indonesia and South Korea
This research aims to analyze the considerations of the Notary Supervisory Council in imposing sanctions for dismissing a notary's position in Indonesia compared with South Korea, to analyze law enforcement and ethics in the process of rejecting a notary's position, and to analyze the similarities and differences in sanctions for dismissing a notary's position. The type of legal research used in this research is normative legal research. The considerations of the Central Supervisory Council in Indonesia and the Notary Disciplinary Committee in South Korea in imposing sanctions for dismissing Notaries in their respective countries have similarities, namely that the Central Supervisory Council and the Notary Disciplinary Committee both have the freedom to impose sanctions on Notaries based on the considerations obtained. Sanctions imposed on Notaries in Indonesia who violate the code of ethics are not in the form of dismissal from the position of notary but dismissal from membership in the Indonesian Notary Association.Meanwhile, the South Korean Notary Disciplinary Committee carried out the results of the disciplinary hearing decision. When the disciplinary hearing decides that the notary has been given a penalty in the form of dismissal, the notary is automatically dismissed from his position. The Indonesian and South Korean Notary Laws have several similarities; both apply sanctions for dismissal and temporary dismissal or suspension of duties. Then the difference is that in Indonesia's Law on Notary Positions, there are three types of notary dismissal. In contrast, the Notary Law of the Republic of Korea only recognizes two types of dismissal
Exploring the Contribution of Women in Da'wah: Case Study of Women's Community on Thousand Mosque Island
This article aims to explore more about women in da'wah, especially in identifying and describing the role and contribution of the women's community in da'wah activities, exploring the challenges and obstacles faced by the women's community in carrying out the role of da'wah, as well as the strategies used to overcome challenges in da'wah activities. . Apart from exploring the impact of the contribution of the women's community in da'wah on spiritual, social and cultural development in the community on the Island of a Thousand Mosques. The method used is qualitative research with a case study approach. Meanwhile, data analysis uses thematic analysis. Data was obtained through in-depth interviews, participant observation, and analysis of related documents. The research results show that women have a significant role in various aspects of da'wah, including religious education, socio-religious activities, and moral development. They act as teachers in taklim assemblies, organizers of religious events, and are active in religious-based women's empowerment programs. Their contributions not only have an impact on strengthening individual faith but also on social cohesion and improving the quality of life of society. This research highlights the importance of recognizing and supporting the role of women in da'wah to create a more inclusive and spiritually sustainable society
