    The Enforcement Rules of Intellectual Property Rights towards Transit Goods under CPTPP:Jurisprudential Interpretations and Policy Recommendations for China

    韩秀丽,厦门大学法学院教授、博士生导师,法学博士;翟雨萌,厦门大学法学院博士研究生。【中文摘要】过境国如何行使其边境执法权,对过境国以及进出口国相关利益将产生直接影响。CPTPP将过境货物纳入了知识产权的执法范围,这将维护进出口国的公共健康利益并在很大程度上避免实践中因过境国对过境的仿制药品执法而引发争议。但是,CPTPP并未明确启动过境货物的知识产权执法的条件,也未明确权利人向主管机关申请知识产权执法的对象是否包括过境货 物。因此,CPTPP的规定存在阻碍过境货物正当通行的可能性,未能有效协调过境国和进出口国利益。我国目前并非CPTPP的缔约国,但是在“一带一路”倡议下,过境运输是我国与沿线国家跨境贸易的重要运输方式,同时我国也是过境贸易的枢纽,有关过境货物的知识产权执法规则会对我国产生较大影响。为避免争议的发生,我国可以援引WTO规则和过境自由原则,在WTO框架内主张自身权利且要求CPTPP缔约方明确相关条款的内涵。此外,我国在订立区域贸易协定和完善国内法时,应当秉持协调过境国和进出口国利益的理念,填补有关过境货物知识产权执法规则的空白、细化具体条款,并且关注CFITP的溢出效应。 【Abstract】How transit countries exercise their border enforcement power has a direct impact on the interests of transit, importing and exporting countries. Transit goods are included in the scope of enforcing intellectual property rights in the CPTPP,which helps safeguard the public health of importing and exporting countries,and to a large extent,avoids the disputes that may arise out of the transit country's enforcement of generic drugs. However,the CPTPP does not stipulate the conditions for the enforcement of intellectual property rights towards transit goods,nor does it clarify whether rights holders can apply for enforcement of intellectual property rights from competent authorities towards transit goods.Therefore, the CPTPP provisions may hinder the proper passage of transit goods and fail to effectively coordinate the interests of transit, importing and exporting countries. Although China is not a party to the CPTPP,cross-border trade between China and countries along the routes of the Belt and Road Initiative depends on transit transport.Moreover,China is also an important transit trade hub,and the CPTPP's intellectual property enforcement rules for transit goods are expected to have a significant impact on China. To avoid disputes,China can invoke the WTO rules and the principle of transit freedom,claim its rights within the WTO framework and require CPTPP parties to clarify the meaning of relevant provisions. In addition,when concluding regional trade agreements and enhancing domestic laws,China should uphold the ideal of coordinating the interests of transit,and importing and exporting countries,fill in the void by formulating detailed provisions for the enforcement rules on the intellectual property rights of transit goods,and pay close attention to the spillover effect of the CPTPP.国家社会科学基金重点项目“国际法治理念下中国在非投资的法律保护机制研究”(15AFX024

    高中伟,四川大学马克思主义学院教授、博士生导师;段文健,四川大学马克思主义学院博士研究生。【中文摘要】社会动员历来是中国共产党广泛发动群众的优良传统,动员前提、动员主体、动员机制和动员结果是其基本构成要素。面对血吸虫病流行和蔓延的严峻形势,新中国初期,中国共产党运用自上而下的“层级运作模式”,领导人民展开了声势浩大的群众运动。通过系统化的宣传教育、灵活的防治策略、中西结合的技术推广和典型的榜样树立,新中国取得了血吸虫病防治的历史性胜利,既增强了群众身体素质、降低了患病风险率,又提高了生活幸福指数、促进了农业生产发展,同时也树立了共产党的威信、赢得了人民的信任。但后期受“大跃进” “浮夸风”等社会风气的影响,血吸虫病防治不同程度存在违背实事求是原则的工作作风。 【Abstract】Social mobilization,with such basic elements as premises,subjects,mechanisms and outcomes,has long been a legacy of the Communist Party of China in mobilizing the people.In the early years of the People's Republic of China,the schistosomiasis japonica epidemic erupted and threatened to spread all over China. In such circumstances,the Communist Party of China,utilizing a top-down “hierarchical operation model”,rallied the people for a massive mass movement against this disease. With systematic education and publicity campaigns,flexible protection strategies,integration of Chinese and Western techniques and promotion of typical examples against the disease,China secured historical success against schistosomiasis japonica. Thereafter,China saw better health of its people,lower risks of the disease,higher public contentment and strong agricultural development. The Communist Party of China thus won public trust and maintained its prestige.     冯兵,四川大学马克思主义学院教授,历史学博士。【中文摘要】社会治理是国家治理的重要组成部分,鸦片烟毒是制约新中国初期社会发展的突出问题,主要表现为鸦片种植面积泛滥、制毒贩毒猖獗、吸毒人员成风。中国共产党发挥集中统一领导的优势,完善行政部署和组织安排,遵循破旧立新的治理原则、刚柔并济的治理手段和标本兼治的治理方法,充分发动群众力量,广泛开展宣传动员,齐心协力改造烟民,多方联合整治毒贩,彻底扫除了毒害,树立了良好的社会风貌,保护了人民的身心健康,促进了社会生产与发展,赢得了人民的认可,树立了执政的威信。 【Abstract】Social governance is an important part of national governance. Opium was a prominent problem restricting social development in the early years of the People s Republic of China. The problem was mainly manifested in massive opium plantation,rampant drug making and dealing and enormous numbers of opium addicts. To tackled the problem, the Communist Party of China,taking advantage of its centralized and unified leadership,set out to improve administrative deployments and organizational arrangements,adhere to the governance principle of innovation,and adopted the approaches of combining strict and flexible strategies and addressing both symptoms and root causes.     Towards visible-wavelength passively mode-locked lasers in all-fibre format

    锁模皮秒/飞秒光纤激光器具有小型化、光束质量好、稳定性佳、低成本且免维护等优点,然而,目前被动锁模光纤激光器工作波段仍主要局限在近红外1-2 μm光谱区域,在可见光波段(380-760 nm)却几乎未有进展。如何实现可见光被动锁模光纤激光器,直接产生小型化、低成本且高性能的可见光超快激光,是一直困扰超快激光研究领域的一个难题。罗正钱教授课题组通过数值求解金兹伯格-朗道方程,发现耗散孤子谐振机制利于可见光波段超大色散光纤腔被动锁模脉冲的稳定建立。基于数值模拟的结果,该研究成果是在可见光范围内向小型化超快光纤激光器迈出的重要一步。将为可见光超快光纤激光在精密光谱学、生物医学、显微成像、光通信、科学研究等领域的应用奠定基础,具有很好的研究潜力和应用价值。厦门大学为该论文的第一署名单位,电子科学与技术学院博士研究生邹金海为论文第一作者,罗正钱教授为论文通讯作者。Mode-locked fibre lasers (MLFLs) are fundamental building blocks of many photonic systems used in industrial, scientific and biomedical applications. To date, 1–2 μm MLFLs have been well developed; however, passively mode-locked fibre lasers in the visible region (380–760 nm) have never been reported. Here, we address this challenge by demonstrating an all-fibre visible-wavelength passively mode-locked picosecond laser at 635 nm. The 635 nm mode-locked laser with an all-fibre figure-eight cavity uses a Pr/Yb codoped ZBLAN fibre as the visible gain medium and a nonlinear amplifying loop mirror as the mode-locking element. First, we theoretically predict and analyse the formation and evolution of 635 nm mode-locked pulses in the dissipative soliton resonance (DSR) regime by solving the Ginzburg-Landau equation. Then, we experimentally demonstrate the stable generation of 635 nm DSR mode-locked pulses with a pulse duration as short as ~96 ps, a radio-frequency signal-to-noise ratio of 67 dB and a narrow spectral bandwidth of 1 nm) and modulated optical spectrum.     厦门大学图书馆“人文社科实验室” “学会活动”(189) 标题:Infinitist 主讲人:Rauf Oran 厦门大学人文学院哲学系2016级外国哲学专业博士生 内容: If someone needs subjunctive mood to classify epistemology of Karl Popper, would someone call it skeptic or infinitist? please reformulate this research question?]His theory of objective knowledge and his solution to the problem of induction seem as if he is skeptic, however if we analyze the working mechanism of his epistemology, we would be more inclined that he is infinitist rather than that he is skeptic. In his epistemology, the objective knowledge can be falsified and, therefore, it never reaches to an end. It always has a potential to be falsified, so verification always goes ad infinitum. Infinitism works with the same principle: It asserts that any knowledge always has a potential reason and reasoning always goes ad infinitum. To understand the logical similaritybetween Popper’s epistemology and infinitism, I firstly explain why his epistemology cannot be called as a skeptic. Then I show the similarity between his epistemology and infinitism. Of course we cannot ignore the difference of definition of knowledge in a traditional and Popperian sense. Although there is difference between the structure of traditional and objective knowledge, it is important to understand that the way of showing up of justified-true-belief and yet-to-unjustified-true-belief is logically same.     Reflections on the Participation of Returning Elites in Village Governance

    朱冬亮,厦门大学马克思主义学院、厦门大学中国农村林业改革发展研究基地教授,厦门大学社会与人类学院博士生导师;洪利华,厦门大学社会与人类学院博士研究生。【中文摘要】新农村建设和乡村振兴战略实施过程中,不少返乡精英携带着资金、人力、技术、文化或市场优势,重新进入村庄场域参与村庄的治理。返乡精英参与乡村治理在改变甚至重建乡村经济和社会治理结构的同时,也在一定程度上导致乡村治理出现“寡头化”和“精英俘获”现象。个体理性、市场理性、乡村弱社会、政府支农项目资源输入和各级政府的政策激励成为形塑返乡精英参与乡村治理的驱动力,也因此带来乡村治理的双重效应:一方面,因返乡精英突出的个人才能使其成为“乡贤”对提升乡村发展和治理水平有多方面的促进作用;另一方面,返乡精英“寡头化” 也可能导致乡村资源分配不合理,加剧“精英俘获”现象。对于返乡精英参与乡村治理中究竟发挥什么样的作用,还应结合当前城乡一体化、乡村振兴发展新形势和国家宏观政策制度,方能作出更加客观全面的评价。 【Abstract】Amid new rural development and the implementation of the strategy for rural revitalization,many returning elites have entered the village realm again with their advantages in capital,manpower,technology,culture or market information ,participating in the governance of the village community. The participation of returning elites in village governance not only changes or even reconstructs the economic and social governance structure of rural areas,but also leads to the phenomenon of “oligopoly” and “elite capture” of rural governance to a certain extent. The individual rationality,the market rationality,the weak rural society, the resources input of government for agricultural projects and the policy incentive of governments at all levels become the internal and external driving forces for returning elites to participate in village governance. This creates the dual effect of returning elites participating in village governance. On the one hand,because of the outstanding individual ability of the returning elites,they become “village sages”,which can promote the development and governance of rural areas in many aspects. On the other hand,the “oligopoly” of the returning elites may also lead to irrational distribution of rural resources and exacerbate “elite capture”.     固体氧化物电解池可高效地电解H2O/CO2制备燃料,越来越受到人们的重视. 本文对近年来在燃料电极(阴极)材料方面的研究进展进行了全面综述,指出各种阴极材料的优缺点及发展趋势,强调亟待解决的关键科学与技术问题.Solid oxide electrolysers are now attracting much more attentions because they can efficiently produce fuels by electrolyzing H2O/CO2. In this paper, a comprehensive introduction to the recent progress in the development of fuel electrode (cathode) materials is provided. The advantages, disadvantages and development trend towards various cathode materials are pointed out.     固体氧化物电解池是一种先进的能量转换装置,具有高效、简单、灵活、环境友好等特点,是目前国际能源领域的研究热点. 本文对高温固体氧化物电解制氢技术的基本原理、关键材料、系统组成、发展历程及国内外研究现状等进行了总结和分析,小结了该技术发展面临的主要挑战,简述了清华大学在高温固体氧化物电解领域近期的研究进展,并对其未来应用前景进行了展望.Solid oxide electrolysis cell is an advanced energy conversion device with high efficiency, simplicity, flexibility, and environmental friendliness. It is currently a research hotspot in the international energy field. This paper introduces and analyzes the basic principles, key materials, system components and developments of solid oxidation electrolysis cells.
