    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     Do Fundamental Rights Conflict with Private Law

    : The relationship of fundamental rights and private law is often filled with mistrust, which results in a framework where (1) the issue of horizontal effect acquires an oversized importance; (2) the relationship is described in terms of the conflict between fundamental rights and private rights; and (3) fundamental rights are seen as a constraint on consent. This article proposes a different, symbiotic, approach, where (1) horizontal effect is given less attention, because, in general, courts refuse to be tied by a single, unifying theory, when they approach the issue; (2) the purported ‘conflict between’ is reframed as an issue of overlapping conflicts between private interests on one level, and fundamental rights on the other, which are resolved through different methods; and (3) party autonomy is a cornerstone of both fundamental rights and private law, and a tool to address the two levels of conflict. With this approach we can identify some ‘false’ conflicts and restrict the ‘real conflicts’ to identifiable scenarios. The analysis is based on the extensive case law of Spanish courts, and the case law by the European Court of Human Rights (ECtHR), using parallels with other jurisdictions for purposes of comparison.: Les rapports entre les droits fondamentaux et le droit privé sont souvent empreints de méfiance, ce qui aboutit à un cadre où (i) la question de l’effet horizontal acquiert une trop grande importance; (ii) les rapports sont décrits en termes de conflit entre les droits fondamentaux et les droits privés; et (iii) les droits fondamentaux sont considérés comme un frein au consentement. Le présent article propose une approche différente, symbiotique, où (i) l’on attache moins d’attention à l’effet horizontal, parce que en général, les tribunaux refusent d’être tenus par une seule théorie unificatrice lorsqu’ils abordent la question; (ii) le prétendu ‘conflit entre’ est redéfini comme une question de conflits qui s’entrecroisent entre des intérêts privés d’une part et des droits fondamentaux d’autre part, qui sont résolus par différentes méthodes; et (iii) l’autonomie des parties est la pierre angulaire à la fois des droits fondamentaux et du droit privé, et un outil pour aborder les deux niveaux de conflit. Grâce à cette approche nous pouvons identifier plusieurs ‘faux’ conflits limitant les ‘conflits réels’ à des scénarios identifiables. L’analyse se base sur l’abondante jurisprudence des tribunaux espagnols et la jurisprudence de la Cour Européenne des Droits de l’Homme (CEDH), utilisant des parallèles avec d’autres juridictions dans un but de comparaison.Die Beziehung zwischen Grundrechten und dem Privatrecht ist oft geprägt von Misstrauen, was zu einem Regelwerk führt, in dem (i) die Problematik der horizontalen Wirkung eine überproportionale Wichtigkeit einnimmt; (ii) die Beziehung mit dem Begriff des Konflikts zwischen Grundrechten und dem Privatrecht beschrieben wird; und (iii) Grundrechte als Hindernis einer privatrechtlichen Einigung betrachtet werden. Der vorliegende Beitrag schlägt einen anderen, symbiotischen Ansatz vor, bei dem (i) der horizontalen Wirkung weniger Aufmerksamkeit zuteil wird, weil Gerichte bei der Herangehensweise an dieses Problem es im Allgemeinen ablehnen, von einer einzelnen, vereinheitlichenden Theorie gebunden zu sein; (ii) der beschriebene “Konflikt zwischen” neu eingeordnet wird als ein Problem von überlappenden Konflikten zwischen privaten Interessen auf einer Ebene und Grundrechten auf einer anderen, die durch unterschiedliche Methoden gelöst werden; und (iii) die Vertragsfreiheit ein Eckstein sowohl der Grundrechte als auch des Privatrechts ist und ein Werkzeug, den beiden Konfliktebenen zu begegnen. Mit diesem Ansatz können einige “falsche” Konflikte identifiziert und die “realen Konflikte” auf identifizierbare Szenarios beschränkt werden. Die Analyse basiert auf der extensiven Rechtsprechung der spanischen Gerichte und der Rechtsprechung des Europäischen Gerichtshof für Menschenrechte, wobei Parallelen mit anderen Rechtsordnungen zur Vergleichung genutzt werden

    This paper offers some lessons drawn from the first years of experience of both the joint Board of Appeal (BoA) of the European Supervisory Authorities and the Appeal Panel (AP) of the Single Resolution Board. The paper outlines their institutional design and the main substantive and procedural issues that have arisen in the cases so far decided by both bodies. It offers a view “from the inside”, which shows not only the certainties of appeal bodies, but also their many challenges. The paper also discusses design strengths and weaknesses of the current EU adjudicatory system of public law disputes in the Banking Union and the Capital Markets Union, bearing in mind the importance of independent review, and the Vaassen criteria for “courts”. The paper concludes by offering preliminary stocktaking and reflections on a possible way forward to enhance the complementary (and supporting) role of financial appeal bodies to the EU courts

    Variations on the Author

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.
