    The present article refers to the sections of the Italian National Report drafted by the author in the context of her participation in the Minor’s right to information in eu civil actions project; such a project focused on children’s right to information within the framework of civil proceedings in the eu. In the article, emphasis has been put on how the child’s right to be informed in this specific context is enshrined in the Italian legal system. Furthermore, the paper analyses the right at issue under the perspective of case law, referring mainly to the Italian Corte di cassazione, the European Court of Human Rights and the Court of justice of the European Union

    Il tema della "maternità surrogata", nonostante gli interventi del-le Corti nazionali e internazionali e del legislatore italiano (o forse anche a causa di questi), ha destato un grande interesse in ambito privatistico, sollecitando soluzioni della dottrina caratterizzate da differenti impostazioni metodologiche e assiologiche. Il lavoro intende offrire un contributo al dibattito, nella consapevolezza della complessità, non solo giuridica, della materia. L’Autrice, esaminando la giurisprudenza italiana e sovranazionale, analizza i concetti di "dignità", "ordine pubblico", "atti di disposizione del corpo", "diritto alla salute", affrontando così problemi come l’inquadramento della m.s. nell’esercizio dei diritti propri dello "status" di cittadino U.E.; il rapporto tra il figlio nato all’estero da m.s. e il partner del genitore biologico secondo il "best interest of the child"; l’applicabilità dell’“adozione in casi particolari”; e infine, la scelta legislativa d’intendere la m.s. quale "reato universale"

    The paper concerns the possibility that the testator finds himself (or herself) in a state of vulnerability. This case will be examined with reference to the following legal provisions: Articles 591 and 624 of the Italian Civil Code. The first one concerns the lack of testamentary capacity, whilst the second one is referred to the possible vices in the testator’s consent, including the hypothesis in which fraud was applied (bearing in mind that, when the use of fraud affects the process of drafting a testament, the proper Italian term appears to be “captazione” rather than the generic “dolo”). Furthermore, the analysis carried out will focus on two cases of vulnerability: the state of fragility that could derive from functional illiteracy and the one caused, in certain circumstances, by old age

    In questo contributo dapprima si affronta la questione dell’applicabilità delle garanzie previste dal GDPR anche ai richiedenti protezione internazionale nell’Unione europea, rispetto al trattamento dei loro dati personali nel sistema automatizzato Eurodac. In seguito, saranno brevemente analizzati due profili problematici: quello relativo al possibile uso della coercizione al fine di raccogliere, di questi soggetti, le impronte digitali e quello inerente alla soglia minima d’età necessaria per procedere al trattamento di tali dati, nel quadro della proposta di riforma avanzata in materia dalla Commissione europea nel maggio 2016

    In the commented case (Trib. Torre Annunziata, ord. 6 aprile 2020), the judge was asked to decide whether it was possible for one parent to temporarily prevent the other from seeing their minor daughter, due to the Covid-19 pandemic. The decision states the following: it is not possible to hinder, as a general rule, the exercise of joint parental responsibility by suspending all face-to-face contacts between the minor and the parent not living with him/her, on the basis of the pandemic situation. In contrast, the judge needs to balance all the interests at stake to determine if, in those specific circumstances, physical contacts within the family could expose the child to the risk of being infected. This line of reasoning appears compatible with the minor’s right to keep a healthy and harmonious relationship with both his/her parents and, at the same time, with the minor’s fundamental right to health. Therefore, such a decision appears ultimately to pursue the child’s «best interest»
