Perkawinan beda agama di Tunisia dan di Indonesia perspektif Maqashid Syariah Abu Ishaq Asy-Syatibi
ABSTRAK
Dalam Hukum Keluarga Islam terdapat perkembangan pembaharuan di beberapa negara Islam. Pembaharuan tersebut salah satunya pada perkawinan. Salah satu negara Islam yang mengalami perkembangan pembaharuan dalam Hukum Keluarga ialah Negara Tunisia. Dalam pembaharuannya, Tunisia memperbolehkan atas perkawinan beda agama dengan ketentuan perempuan muslimah dengan laki-laki yang tidak beragama Islam. Adapun di Indonesia terkait perkawinan beda agama itu dilarang, yang mana diriliskannya SEMA No. 2 tahun 2023 bahwasannya petunjuk bagi hakim untuk tidak mengabulkan permohonan mengenai perkawinan antar umat yang berbeda kepercayaan dan agama.
Penelitian ini termasuk dalam jenis penelitian hukum normatif dengan pendekatan komparatif. Sumber data yang digunakan adalah sumber data primer berupa peraturan perundang-undangan, dan sumber data sekunder berupa buku-buku, jurnal-jurnal, dan media berita terkait perkawinan beda agama. Metode pengumpulan bahan hukum dilakukan dengan cara studi dokumen atau studi kepustakaan. Analisis sumber data dilaksanakan melalui tahapan reduksi, penyajian, dan kesimpulan.
Berdasarkan hasil penelitian ini dapat disimpulkan, bahwa kebolehan atas perkawinan beda agama di Tunisia disebabkan para wanita di Tunisia tidak mendapatkan hak kebebasan dalam memilih pasangan. Kemudian pemerintah Tunisia juga menginginkan akan kesetaraan gender, serta kesejahteraan bagi rakyat dan bangsanya. Sedangkan di Indonesia perkawinan beda agama dilarang setelah rilisnya SEMA No. 2 Tahun 2023. Sebab untuk dapat meluruskan dari persimpangan pendapat terhadap dikabulkannya permohonan atas perkara perkawinan beda agama yang di lakukan oleh salah satu hakim Pengadilan Negeri dan mematahkan aturan pada Putusan Mahkamah Agung no. 1400 K/Pdt/1986. Adapun jika dilihat dari perspektif maqashid syariah Abu Ishaq Asy-Syatibi terhadap kedua aturan di kedua negara tersebut, yang lebih relevan pada aturan yang hampir memenuhi akan lima unsur yang ada dalam konsep maqashid syariah yaitu pada aturan SEMA no. 2 Tahun 2023 mengenai perkawinan beda agama di Indonesia, dari segi dalam menjaga agama pada unsur dharuriyat, menjaga jiwa pada unsur tahsiniyat, menjaga akal pada unsur dharuriyat, menjaga keturunan pada unsur dharuriyat, dan menjaga kekayaan pada unsur dharuriyat.
ABSTRACT
In Islamic Family Law there are developments of reform in several Islamic countries. One of these reforms is on marriage. One of the Islamic countries that has experienced the development of reform in Family Law is Tunisia. In its renewal, Tunisia allows interfaith marriages with the provision of Muslim women with men who are not Muslim. As for Indonesia, interfaith marriage is prohibited, which was released by SEMA No. 2 of 2023 instructions for judges not to grant requests regarding marriages between people of different beliefs and religions.
This research is included in the type of normative legal research with a comparative approach. The data sources used are primary data sources in the form of laws and regulations, and secondary data sources in the form of books, journals, and news media related to interfaith marriages. The method of collecting legal materials is done by means of document studies or literature studies. Analysis of data sources was carried out through the stages of reduction, presentation, and conclusion.
Based on the results of this study, it can be concluded that the permissibility of interfaith marriage in Tunisia is because women in Tunisia do not get the right to freedom in choosing a partner. Then the Tunisian government also wants gender equality, as well as welfare for its people and nation. Meanwhile, in Indonesia, interfaith marriage is prohibited after the release of SEMA No. 2 of 2023. Because to be able to straighten out the intersection of opinions on the granting of an application for an interfaith marriage case by one of the District Court judges and break the rules in Supreme Court Decision no. 1400 K / Pdt / 1986. As for when viewed from the perspective of Abu Ishaq Ash-Syatibi's maqashid sharia on the two rules in the two countries, which is more relevant to the rules that almost fulfill the five things that exist in the elements in the concept of maqashid sharia, namely the rules of SEMA no. 2 of 2023 regarding interfaith marriages in Indonesia, in terms of protecting religion in the element of dharuriyat, protecting the soul in the element of tahsiniyat, protecting the mind in the element of dharuriyat, protecting offspring in the element of dharuriyat, and protecting wealth in the element of dharuriyat.

في قانون الأسرة الإسلامية هناك تطورات إصلاحية في العديد من الدول الإسلامية. أحد هذه الإصلاحات يتعلق بالزواج. من الدول الإسلامية التي شهدت تطورات إصلاحية في قانون الأسرة هي تونس. ففي إطار تجديدها، تسمح تونس بالزواج بين الأديان مع السماح بزواج المرأة المسلمة من رجل غير مسلم. في إندونيسيا، يُحظر الزواج بين أصحاب الديانات المختلفة، بصدور قانون رقم ٢ لعام ٢٠٢٣، الذي يوعز إلى القضاة بعدم الموافقة على طلبات الزواج بين أصحاب المعتقدات والأديان المختلفة.
يندرج هذا البحث ضمن نوع البحوث القانونية المعيارية ذات المنهج المقارن. وتتمثل مصادر البيانات المستخدمة في مصادر البيانات الأولية في شكل قوانين ولوائح، ومصادر البيانات الثانوية في شكل كتب ومجلات ووسائل إعلام إخبارية تتعلق بالزواج بين الأديان. وتتم طريقة جمع المواد القانونية عن طريق دراسات الوثائق أو الدراسات الأدبية. وتم تحليل مصادر البيانات من خلال مراحل الاختزال والعرض والاستنتاج.
وبناءً على نتائج هذه الدراسة، يمكن استنتاج أن إباحة الزواج المختلط في تونس يعود إلى أن المرأة في تونس لا تحصل على حق الحرية في اختيار الشريك. ثم إن الحكومة التونسية تريد أيضًا المساواة بين الجنسين، وكذلك الرفاهية لشعبها وأمتها. وفي الوقت نفسه، في إندونيسيا، يحظر الزواج بين الأديان في إندونيسيا بعد صدور قانون رقم ٢ لعام ٢٠٢٣. لأنه حتى يتسنى تصويب تقاطع الآراء حول منح طلب الزواج بين الأديان الذي أجراه أحد قضاة المحكمة الجزئية وخرق القواعد الواردة في قرار المحكمة العليا رقم ١٤٠٠ ك/ب دت/ ١٩٨٦. أما إذا نظرنا من منظور مقاصد الشريعة لأبي إسحاق الشاطبي إلى القاعدتين في البلدين، وهو الأليق بالقواعد التي تكاد تستوفي الأمور الخمسة الموجودة في العناصر الخمسة في مفهوم مقاصد الشريعة، وهي قواعد سيما رقم ٢ لسنة ٢٠٢٣ في الزواج بين الأديان في إندونيسيا، من حيث حفظ الدين في عنصر الذريات، وحفظ النفس في عنصر الإحسان، وحفظ العقل في عنصر الذريات، وحفظ النسل في عنصر الذريات، وحفظ المال في عنصر الذريات
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
