Ostatività e benefici penitenziari: una riforma in itinere
The prohibition of access to penitentiary benefits for convicts of specific crimes, unless they usefully cooperate with judicial authorities, has been the subject of tormented events. The author analyzes the salient features of this system, focusing on the Italian Constitutional Court and the European Court of Human Rights case-law, as well as on a recent legislative proposal on the matter
Il riformato ordinamento penitenziario italiano: modifiche e innovazioni in materia di vita detentiva
Abstract. The article details the changes introduced into the Italian penitentiary law by legislative decrees of October 2, nos. 123 and 124, with an emphasis on the rights of detainees. The author highlights the positive and negative aspects of a reform, which, on the one hand, introduces some improvements regarding a life inside the prison but, on the other hand, fails to intervene in matter of measures alternative to detention and in overcoming the legislative automatism and restrictions about the access to penitentiary benefits, depending on the kind of committed crime
During the execution of a prison sentence, incarceration profoundly affects family and emotional relationships. The author examines the issue of convicted parents’ access to alternatives to imprisonment, with a focus on home detention. Particular attention is given to Constitutional Court ruling 52/2025, which expanded the possibility for incarcerated fathers to benefit from special home detention. The essay concludes with a brief reflection on the systemic implications of the decision and the prospects for balancing punitive needs with the protection of the parent-child bond
This work explores the principle of non-punishment for victims of human trafficking, drawing on the Court of Cassation ruling, that excluded the liability of a victim of human trafficking for crimes committed under coercion. Starting from the supranational legal context and the European Court of Human Rights case-law on this issue, the Author delves into the challenges of implementing the non-punishment principle within the Italian legal framework, due to the lack of a specific provision
De la perception de la forme : pour une phénoménologie de l'espace dans les oeuvres de Daniele del Giudice, Peter Handke et Jean-Philippe Toussaint
During the Renaissance, Alberti’s concept of total visibility and, more specifically, the rediscovery of perspective as artificial instrument of space construction led to a representation of spatiality created ‘in the Image of Man’ . Since then, our understanding of the subject’s perception changed, both in function and in nature as a consequence of a progressive antropogenetic deconstruction. By focusing on the works of Daniele del Giudice, Peter Handke and Jean-Philippe Toussaint from the 1980s onwards, my research aims to study the causality between the modification of perception in arts and its impact on the subject. My comparative exploration of these authors questions perspective perception as a non-dualistic subject-object matter from a conceptual, epistemological, ideological and ontological common ground. The respective visual strategy of each author thus shows this phenomenological mutation of perception to both in its relation to the perceiving subject and the perceived object, and therefore, through its space and time relation. By shifting the question of the subject from an ontological to a phenomenological point of view, the authors intend to reeducate the subject’s gaze through which space and time are perceived as a continuum. In order to create a sense of spatial belonging, it is thus necessary to break free from the concepts of historical time and perspective
Author Response: Teaching Video NeuroImage: Bilateral Hemifacial Spasm in Giant Cell Arteritis
We appreciate the comments on our case.(1) Although we agree that a bilateral hemifacial spasm is typically characterized by asynchronous muscle contractions on the left and right sides, contractions are also often asymmetric in severity, as observed in our case. The cheek movements on the right side of the face were likely the consequence of a stronger contraction of the palpebral part of the orbicularis oculi muscle, rather than the result of cheek muscle contractions as the orbicularis oris did not move during spasms. While a central origin cannot entirely be ruled out, the exclusive involvement of the upper facial muscles in our patient seems more consistent with a peripheral irritation of the superior branch of the facial nerves
The Relationship Between Fear of Missing Out and Phubbing Behaviors: The Mediating Role of Addictive Smartphone Behaviors Among University Students
This study aims to provide insight into potential risk factors for phubbing behaviour, which has become increasingly prevalent in recent years despite limited research on this issue. A cross-sectional study was conducted with 599 Italian and Turkish university students (53.1% female) to investigate the mediating effect of Addictive Smartphone Behavior (ASB) on the relationship between Fear of Missing Out (FOMO) and Phubbing Behavior (PB). Participants completed surveys that included the Smartphone Addiction Scale Short Version (SASSV), the Fear of Missing Out scale (FoMOs), and the General Scale of Phubbing (GSP). Statistical analysis revealed significant direct and indirect effects among FOMO, ASB, and PB, with FOMO having a positive influence on both ASB and PB. Furthermore, there was an indirect influence of FOMO on PB via ASB. These findings contribute to a better understanding of the psychological variables underlying phubbing behaviour. © 2024, The Author(s), under exclusive license to Springer Nature Switzerland AG
Studies on Italian reservoirs
The main morphometric and water quality characteristics of the 221 Italian reservoirs covering an area of at least 0.2 km2 is given. Most of the reservoirs are used for drinking water purposes, especially on the islands of Sicily and Sardinia, where the more important cases of eutrophication have been found. These situations are examined in greater detail, with regard to algal population dynamics, the phosphorus budget and the comparison between theoretical and experimental nutrients loads. -from Author
Seafloor Map of the Alghero Bay (Sardinia, Italy)
© 2020 The Author(s). Published by Informa UK Limited, trading as Taylor & Francis Group on behalf of Journal of Maps. The Alghero Bay is a coastal area of high economic value because of the presence of one of the most popular beaches of Sardinia (San Giovanni, Maria Pia, Le Bombarde, Lazzaretto). The organisms living in the meadow of Posidonia oceanica, which densely cover the offshore areas of the bay, represent the most important source of sediments to these beaches. For this reason, a detailed mapping of the local seabed features and distribution of P. oceanica constitutes an important tool for the coastal managing of the area. The integrated use of several methodologies, such as Side Scan Sonar, Remote Operating Vehicle, Drone and direct sediment sampling has allowed us to realize a very detailed seafloor map of the Alghero Bay
