    Navigating Regional Regulatory Changes in Indonesia: An In-Depth Analysis of Post-Amendment Implementation of Law Number 12 of 2011 on Legislation Formation

    In the context of Indonesia as a State of Law, the imperative role of the rule of law cannot be overstated in realizing the state\u27s objectives. The formulation of Legislative Regulations, essential for upholding the rule of law, necessitates meticulous consideration of three fundamental principles: benefit, justice, and legal clarity. To ensure the effectiveness of these regulations in aligning with the direction and goals of national legal development, the process adheres to key principles, encompassing the clarity of objectives, appropriate institutional involvement, congruence among types, hierarchy, and material content, practicability, clarity of formulation, and transparency. This procedural framework is consistently implemented in a sustainable, coordinated, and integrated manner. The legal landscape in Indonesia underwent significant transformations with the enactment of Law Number 11 of 2020 on Job Creation, introducing the omnibus law technique. However, the subsequent Constitutional Court Decision Number 91/PUU-XVIII/2020 provisionally deemed this law unconstitutional. Responding to this decision, Law Number 12 of 2011 underwent a substantial amendment through Law Number 13 of 2022, specifically addressing the omnibus approach and enhancing meaningful public participation in statutory rule creation. This legal revision significantly influences the development of legal instruments at the regional level. Consequently, an examination of the implementation of regional legal product formation becomes imperative post the amendment of Law Number 12 of 2011 on the Formation of Legislative Regulations

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    Legal Uncertainty of Golf Game as Sports and Entertainment Branch in Local Tax Imposition

    The imposition of a golf tax actually raises legal issues related to the status of golf in connection with the imposition of regional taxes.  The object of this research is the status of golf as entertainment or a sport and the implications of legal uncertainty related to the imposition of regional taxes.  This research is a normative legal study with a historical, legislative, and case approach.  The legal materials used include primary legal materials in the form of legislation and court decisions, secondary legal materials in the form of research results such as journal articles and relevant books, as well as non-legal materials such as language dictionaries. The technique for collecting legal materials is conducted through library research by gathering legal materials from libraries as well as collecting legal materials through national and international journal article websites. The analysis of legal materials is conducted prescriptively, emphasizing legal prescriptions or solutions as answers to legal issues in this research.  The findings of this research emphasize that the legal uncertainty regarding the status of golf as entertainment and a sport in relation to local tax imposition implies that golf, as a sport, can only be subject to VAT and therefore cannot be subject to local tax.  The recommendation from this research is that there needs to be a revision of the legislation in the field of taxation and a clarification that golf can be subject to regional taxes. This research is expected to contribute to the thinking and practice related to the development of tax imposition on golf facilities

    The effectiveness of Indonesia’s State Administrative Courts is increasingly under scrutiny, particularly regarding the dismissal procedures that often lack transparency and accountability. This research explores the urgent need for reform in these procedures to foster greater public trust in the judicial system. In a country where citizens’ rights and access to justice are vital to democratic governance, the lack of clarity and fairness in dismissal decisions can undermine confidence in the court’s integrity. The novelty of this study lies in its focus on dismissal procedures as a critical yet often overlooked area of judicial reform. By examining current practices, legal frameworks, and case law, the research identifies key weaknesses in the system, proposing innovative reforms aimed at enhancing procedural transparency, consistency, and accountability. A comparative analysis with international best practices highlights practical solutions that could be adopted to improve the fairness and efficiency of dismissal processes. This research makes a significant contribution by offering a targeted framework for reform that prioritizes the protection of citizens’ rights, ensuring that judicial decisions, particularly dismissals, are made with clarity, fairness, and public scrutiny. It calls for systemic change to align administrative justice with democratic principles of openness and accountability

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
