    This thesis explores the London Market Excess of Loss Spiral (“LMX Spiral”), a phenomenon based upon excess of loss reinsurance contracts that developed within the London reinsurance market of the 1980s. The unwinding of the LMX Spiral was a key factor in the crisis the Lloyd’s insurance market had to face in the early 1990s. However, whilst the crisis resulted in a wave of litigation in the English courts, there is no legal appraisal of the additional element of risk brought by the LMX Spiral itself. The case law instead focuses on the duties of the underwriters and various agents that fuelled its development.This situation is unsatisfactory for two reasons. Firstly, reinsurance spirals are a potential side-effect of XL reinsurance markets and therefore other spirals may develop in the future. Secondly, this thesis shows that once a reinsurance spiral reaches a certain point, it becomes unsustainable, generating instability within the relevant reinsurance market.This thesis provides a detailed legal appraisal of reinsurance spirals and a new analysis of excess of loss reinsurance contracts. The first part sets out the relevant legal principles and describes the LMX Spiral and its impact; listing, for the first time, the “Spiral Effects” identified through reports and actuarial models. The second part reviews the case law and assesses the legal nature of the excess of loss “Spiral Contracts” at the core of any reinsurance spiral, concluding that the Spiral Effects can distort the Spiral Contracts to the point where they become simple contracts of indemnity. The third part explores the nature of excess of loss reinsurance in light of the review of the Spiral Contracts, submitting that excess of loss reinsurance contracts cover both the liability of the reinsured and the relevant insured peril

Analyse eines technisch-betrieblichen Wandels und dessen Implikationen für die technische Berufsausbildung.ZusammenfassungAktuell wird viel darüber nachgedacht, welche Veränderungen Industrie 4.0 für unsere Ausbildungsberufe und unsere Berufsausbildung mit sich bringen wird. Aus einer Analyse der aktuellen Veröffentlichungen zu dieser Problematik lassen sich nur sehr vorsichtige Prognosen generieren, da diese zumeist über die berufliche Entwicklung nur schwache Trend-Hinweise und relativ unspezifische Aussagen bzgl. der für Industrie 4.0 erforderlichen Kompetenzen beinhalten. Innerhalb der vielfältigen aktuelle Veränderungen in den technischen Berufen zeigt sich die Entwicklung von Facharbeit hin zur Wissensarbeit als markanter Prozess, der zum einen mit den technischen Entwicklungen, die Industrie 4.0 kennzeichnen, korrespondiert, und zum anderen einen Ansatzpunkt für eine theoretisch fundierte Erforschung darstellt. Die Implementierung von Industrie 4.0 in die berufliche Bildung wird absehbar nicht in Form einer eingegrenzten Aktualisierung erfolgen, sondern als langzeitliche Transformation. In den kommenden Jahren wird sich dies wahrscheinlich kaum in den Ausbildungsberufen und der Berufsausbildung auswirken, sondern überwiegend durch Weiterbildung und lernförderliche Arbeitsgestaltung getragen werden. The relevant papers provide a weak trend about the professional development and relativelyunspecific formulation regarding the competences required for industry 4.0, so that only very cautious forecasts can be generated. Within the various changes in the technical professions, the development of “specialist work“ (Facharbeit) towards “knowledge work“ is a distinctive process that corresponds, on the one hand, with technical developments of industry 4.0, and on the other hand as a starting point for a theoretically exploration itself. The implementation of industry 4.0 in vocational education and training and its changes will not take place in the form of a restricted replacement, but rather as a long-term transformation. In the forthcoming years it is unlikely that the vocational training system will be affected directly, because at first the advanced training and learning related work structuring programmes. Die Analysen gründen auf einer Stichprobe von rund 1000 Auszubildenden. Die in früheren Modellierungen dokumentierten Strukturen des Fachwissens können weitgehend repliziert werden, die in früheren Modellierungen beobachtbaren Inkonsistenzen zur Ausdifferenzierung des Fachwissens an fachsystematischen Inhaltsbereichen einerseits und tätigkeitsbezogenem Wissen andererseits können aufgelöst werden. Die in anderen Untersuchungen identifizierten Schwierigkeitsmerkmale der berufsfachlichen Aufgaben können partiell repliziert werden, einen besonders hohen Erklärungsanteil erbringen Merkmale des Aufgabenformats. Professional knowledge is highly predictive for explaining professional competences in key areas in the work of car mechatronics technicians. The analyses are based on a sample of 1000 trainees. The structure of the professional knowledge found in previous studies could largely be replicated. Hereby we were able to resolve the inconsistencies between content specific dimensions and activity specific dimensions that existed in previous models. The difficulty features of the profession specific tasks that were identified in previous studies could partially be replicated. Features of the item format predict the item difficulty particularly well.
