    Spiritual care is important to ensure that the physical and mental health of a person is protected. Spiritual care in the context of Muslims is very much associated with iman and amal soleh of a person. A Muslim is required to perform Ibadah, reciting the Quran and doa as prescribed in the Quran and Sunnah as part of protecting his mind, soul and physical from any harmful or negative elements. The duty to take care of the soul and spiritual part of a Muslim is crucial especially if he is suffering from any terminal illness that could affect his mental health and possibly his physical health will be more affected. This paper is to discuss the ethical values of spiritual care in the context of Islamic religion and the legal and practical aspects of as what has been practiced in Malaysia

    Hisbah in Malaysia: preventing vices and immoralities

    This paper analyses the role of the hisbah institution, the Religious Enforcement Division at the State Religious Department in Malaysia, in curbing immoral activities as well as other contemptible acts according to sharÊ’ah. In the division, there are Religious Enforcement Officers who warn the potential offenders and also arrest anyone for the violation of rules incorporated in the Islamic enactments. The objectives of establishing the division as well as the department are to protect the sanctity of Islam as a way of life and to prevent Muslims from immoral activities. Each state in Malaysia has its own Department. These Departments carry different names but they perform similar functions of prohibiting vice and preventing ma'Îiah i.e. transgression. Based upon documentary evidence and court cases, this paper highlights the current developments in the Division and the challenges it faces in protecting Muslim's faith in Malaysia

Undang-undang Islam yang diciptakan oleh Allah SWT adalah untuk umat manusia di alam semesta ini. Kajian sejarah terhadap undang-undang Islam adalah tetap sama dari zaman turunnya wahyu hingga ke hari ini. Walau bagaimanapun, dari segi pentadbiran undang-undang Islam ada perkembangannya, ada juga pasang surutnya sekali gus adalah juga sejarahnya.     This paper attempts to discuss the position of ?ul? as a mediation tool to resolve cases brought up in the Shariah Court. The first part of the paper is to explain the importance of ?ul? in the institution of justice in Islamic law. Some relevant authorities from the sources of Islamic law will be highlighted including the practice of the companions. The second part of the paper will focus on the status of ?ul? in the Shariah Court in Malaysia in terms of history, ethics of the ?ul? officer and the procedure of how ?ul? takes place in the Shariah Court. The last part of the paper will focus on the ?ul? officers including female officers and compare their status with male ?ul? officers, nature of cases (e.g divorce, ta?l?q, ?a??nah) handled by the ?ul? officers and their success rate. The paper will conclude by a discussion of the possibility of the ?ul? officers occupying the position of a judge in the Shariah Court. The last point to be discussed is the balance in terms of number of cases resolved between them

    Hukuman dalam Islam terbahagi kepada dua iaitu hukuman retributif dan hukuman restoratif. Hukuman yang sering diperkatakan ialah bersifat retributif iaitu bersifat menghukum pesalah di atas kesalahan beliau yang lalu. Manakala hukuman restoratif pula membawa maksud hukuman yang bersifat memulih tetapi tidak begitu popular dalam undang-undang Islam di Malaysia. Makalah ini akan membincangkan tentang konsep, sifat dan objektif kedua-dua jenis hukuman ini. Selain itu, makalah ini bertujuan untuk melihat perbezaan dan kesinambungan yang ada pada kedua-dua jenis hukuman yang disebutkan di atas. Nas-nas syariah telah jelas menunjukkan bahawa hukuman restoratif dan retributif wujud dalam Islam. Malah pada satu tahap, boleh dilihat bahawa Islam itu sendiri banyak mengesyorkan untuk kita memilih hukuman restoratif berbanding hukuman retributif. Beberapa kes yang telah diputuskan oleh Mahkamah Syariah di Malaysia juga bertujuan untuk melihat sejauhmanakah pelakasanaan hukuman restoratif dikenakan ke atas tertuduh. Makalah ini juga membincangkan sejauhmana kedua-dua hukuman ini dilaksanakan di Mahkamah Syariah di Malaysia. Rujukan juga akan dibuat ke atas beberapa undang-undang Islam yang terpakai di Malaysia seperti Undang-undang Tatacara Jenayah, Undangundang Kesalahan Jenayah Syariah dan tidak ketinggalan juga Akta Mahkamah Syariah (Bidangkuasa Jenayah) 1965 [Akta 355]. Cadangan untuk meminda Akta 355 sangat dialu-alukan agar hukuman ke atas pesalah jenayah syariah bukan hanya bersifat retributif tetapi juga bersifat restoratif

    تهدف هذه الدراسة إلى عرض الحقوق التي يشترك فيها الزوجان أثناء زواجهما ودراستها في ضوء الفقه الإسلامي. وذلك من خلال الإجابة عما تلك الحقوق المشتركة بين الزوجين؟ وما أنواعها، وما الدليل عليها؟ وبما يعتبر الشارع فيها؟ ولماذا جعلها الشارع مشتركة بين الزوجين؟ والغرض من أجوبة هذه الأسئلة أن للزوجين حقوقا في الإسلام، وأن هذه الحقوق مشتركة بينهما، وأن الشرع يعتبر المساواة بينهما فيها. تتألف هذه الدراسة من ثلاثة مباحث حيث يتناول أولها مفهوم الحقوق المشتركة بين الزوجين، ويتعرض الثاني لأنواع الحقوق المشتركة بين الزوجين، ويتطرق الثالث إلى أحكام هذه الحقوق ومقاصدها. وتسلك هذه الدراسة المنهج الاستقرائي في جمع المعلومات وتتبعها من مصادرها الأصلية والثانوية، والمنهج التحليل في استخراج المعاني والنتائج من هذه المعلومات. The purpose of this research is to present the rights that spouses share during their marriage and to study them in the light of Islamic jurisprudence. This is through answering questions of what are the mutual rights between spouses? What are their types? What is the legal evidence for these types? What are legal considerations in legitimating these rights? Why does Islam make these rights equally to both husband and wife? The purpose of answering these questions is to present that Islam recognizes such equality between male and female in their rights and responsibilities. This study consists of three chapters, while the first describes the meaning of mutual rights between spouses, the second illustrates the types of mutual rights between spouses, and the third touches the legal rulings of these rights and their objectives. This study follows the inductive method in collecting and compiling related data, and analytical method in deducting results and findings from this data

    Forgiveness and restorative justice in Islam and the West: a comparative analysis

    Restorative justice, as a viable alternative to retributive justice, emerged in the West during the 1970s and 1980s. It emphasises respect, dialogue, and collaborative decision-making. This study explains the principles of the restorative justice system and describes various Islamic principles and values akin to restorative justice. Such a study is warranted by the fact that the compatibility of restorative justice with Islamic principles and values is underresearched in the social sciences and humanities. This study, based on primary sources and case studies, found that Islam encourages amicable settlement of disputes through mediation and arbitration while ensuring justice, fairness, and equity in all situations. Similar to restorative justice, Islamic principles emphasise respect, honour and dignity, and mutual obligations and responsibilities in righting wrong. Prophet Muhammad (SAW) and his successors applied these principles, and such a system continues to be practised in certain small villages in contemporary Muslim societies. However, unlike Western restorative justice, Islam places particular emphasis on forgiveness as a value, thus limiting the cycle of retribution and retaliation detrimental to society. Islam considers forgiveness as a great virtue that brings forth gratitude, heals broken relationships, and establishes peace at individual and social levels. Islam aims at constructing a just society which empowers victims, offenders, and the community. Unlike the Western concept of restorative justice, the shariah incorporates elements of restorative justice with a heavy emphasis on forgiveness, with or without an apolog
