La teoría general de la forma de Robert Summers (A propósito de Robert S. Summers, Form and Function in a Legal Sytem. A general Study)
The purpose of this paper is to introduce and analyse professor R. SUMMERS’ general theory of form. Based on the concept of form (defined by the author as a «purposive systematic arrangement»), SUMMERS advances an ambitious theory of epistemological import. He proposes a new way to look at the legal system, the form-oriented approach, while underlying the insufficiencies of the rule oriented-approch that characterises the thought of central legal philosophers such as H. KELSEN and H. HART. Thus, in SUMMERS’ analysis, rules are not the dominant element, as it is the case in traditional legal positivism, but just one kind of legal unit among others. The paper analyses both the structural (anatomy) and functional (physiology) dimensions of the new formal theory of law. Furthermore, it puts the theory within the framework of contemporary legal philosophy, in which it is destined to be in a relevant position.

Wealthier is healthier
With cross-country, time series data on health (infant and child mortality, and life expectancy) and per capita income, the authors estimate the effect of income on health. They use instrumental variables estimation to identify the effect of income on health that is structural and causal, isolated from reverse causation (healthier workers are more productive and hence wealthier) or incidental association (some other factor may cause both better health and greater wealth). The long-run income elasticity of infant and child mortality in developing countries lies between 0.2 and 0.4. Using those estimates, they calculate that in 1990 alone, more than half a million child deaths in the developing world could be attributed to poor economic performance in the 1980s.Health Economics&Finance,Inequality,Economic Theory&Research,Governance Indicators,Health Monitoring&Evaluation

Accuracy and Fairness – Siamese Twins? A Comment on Sarah Summers «Epistemic Ambitions of the Criminal Trial: Truth, Proof and Rights»
The author agrees with Sarah Summers’ view that a criminal judgment in a system of fair justice should be substantively accurate and at the same time should be the result of a fair process. The author argues, however, for keeping these two requirements apart because they are linked to different goals and may in individual cases conflict with each other. The author agrees with Sarah Summers’ view that a criminal judgment in a system of fair justice should be substantively accurate and at the same time should be the result of a fair process.
